which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the National Telecommunications and Information Administration to estimate the value of electromagnetic spectrum assigned or otherwise allocated to Federal entities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id9FAB802D6B704235B85B5F0072EBDE83"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Spectrum Valuation Act</short-title></quote>.</text></section><section id="id609417590CFC477DB30E88A959A0A6DA"><enum>2.</enum><header>Estimate of value of electromagnetic spectrum</header><subsection id="id0BD0E5265CD64BA2B6A37A63C2AB0F4B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901</external-xref> et seq.) is amended—</text><paragraph id="idB1B517BC8090436794BE5742F9EA5EB4"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 105 (<external-xref legal-doc="usc" parsable-cite="usc/47/904">47 U.S.C. 904</external-xref>) as section 106; and</text></paragraph><paragraph id="id9CFEECCCA7D046728311F3E5A3A6EC78"><enum>(2)</enum><text>by inserting after section 104 (<external-xref legal-doc="usc" parsable-cite="usc/47/903">47 U.S.C. 903</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A6EFF048DFD43839B155051DBA10C71"><section id="ida8771852b6194d89821de1bd6a780da7"><enum>105.</enum><header>Estimate of value of electromagnetic spectrum</header><subsection id="id8a179afe76e7459f90b6a26a2b412aaf"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="ida224eeb9d5764844a6cbb052896295c0"><enum>(1)</enum><text>the term <term>covered band</term> means the band of frequencies between 3 kilohertz and 95 gigahertz;</text></paragraph><paragraph id="id59AF4EE5EE9A4A4BA3B3D4FCA5BA6501"><enum>(2)</enum><text>the term <term>Federal entity</term> has the meaning given the term in section 113(l); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83fdac8e66e54c818ee8d2f2bd71f03a"><enum>(3)</enum><text>the term <term>OMB</term> means the Office of Management and Budget.</text></paragraph></subsection><subsection id="id406dcfa844db47c18072866ab43679e4"><enum>(b)</enum><header>Estimates required</header><text>The NTIA, in consultation with the Commission and OMB, shall estimate the value of electromagnetic spectrum in the covered band that is assigned or otherwise allocated to each Federal entity as of the date of the estimate, in accordance with the schedule under subsection (c).</text></subsection><subsection id="idf4e8904b7897443aa1561d789a9b0b21"><enum>(c)</enum><header>Schedule</header><text>The NTIA shall conduct the estimates under subsection (b) for the frequencies between—</text><paragraph id="id24334C303BFB4064A4FF11B40A852344"><enum>(1)</enum><text>3 kilohertz and 33 gigahertz not later than 1 year after the date of enactment of this section, and every 3 years thereafter;</text></paragraph><paragraph id="idE2B42FAA4CC94127A9F3A1E6488BF007"><enum>(2)</enum><text>33 gigahertz and 66 gigahertz not later than 2 years after the date of enactment of this section, and every 3 years thereafter; and</text></paragraph><paragraph id="id85854C7A37C14759BB6F739DCF2AC684"><enum>(3)</enum><text>66 gigahertz and 95 gigahertz not later than 3 years after the date of enactment of this section, and every 3 years thereafter.</text></paragraph></subsection><subsection id="id485fc6dcfacb4fa395f60e26834b646c"><enum>(d)</enum><header>Basis for estimate</header><paragraph id="id8C34AFCAF1E64447BDEC3A6C47F6B6B1"><enum>(1)</enum><header>In general</header><text>The NTIA shall base each value estimate under subsection (b) on the value that the electromagnetic spectrum would have if the spectrum were reallocated for the use with the highest potential value of licensed or unlicensed commercial wireless services that do not have access to that spectrum as of the date of the estimate.</text></paragraph><paragraph id="id75D3413BBF034B4FBDE1C393D4D7A50C"><enum>(2)</enum><header>Consideration of Government capabilities</header><text>In estimating the value of spectrum under subsection (b), the NTIA may consider the spectrum needs of commercial interests while preserving the spectrum access necessary to satisfy mission requirements and operations of Federal entities.</text></paragraph><paragraph id="id99BD4A58A2514D77958C995013E52710"><enum>(3)</enum><header>Dynamic scoring</header><text>To the greatest extent practicable, the NTIA shall incorporate dynamic scoring methodology into the value estimate under subsection (b).</text></paragraph><paragraph id="id8CAF9668DFA546E6BCE89B00D461625A"><enum>(4)</enum><header>Disclosure</header><subparagraph id="idFB93597326E74699BB0F031F38FD9D00"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the NTIA shall publicly disclose how the NTIA arrived at each value estimate under subsection (b), including any findings made under paragraph (2) of this subsection.</text></subparagraph><subparagraph id="idB1BACDA4734D4F1C94B31951E5058046"><enum>(B)</enum><header>Classified, law enforcement-sensitive, and proprietary information</header><text>If any information involved in a value estimate under subsection (b), including any finding made under paragraph (2) of this subsection, is classified, law enforcement-sensitive, or proprietary, the NTIA—</text><clause id="idA49CB065585A4F31860F1A26E7A99ACD"><enum>(i)</enum><text>may not publicly disclose the classified, law enforcement-sensitive, or proprietary information; and</text></clause><clause id="id6FDB2B2B4E964F539B1D517236A85653"><enum>(ii)</enum><text>shall make the classified, law enforcement-sensitive, or proprietary information available to any Member of Congress, upon request, in a classified annex.</text></clause></subparagraph></paragraph></subsection><subsection id="id8a118541d8fb496d8b93f2441a6bbf4a"><enum>(e)</enum><header>Agency report on value of electromagnetic spectrum</header><text>A Federal entity that has been assigned or otherwise allocated use of electromagnetic spectrum within the covered band shall report the value of the spectrum as most recently estimated under subsection (b)—</text><paragraph id="id3cbe686917f342f6a3411aeaee825ed6"><enum>(1)</enum><text>in the budget of the Federal entity to be included in the budget of the United States Government submitted by the President under section 1105 of title 31, United States Code; and</text></paragraph><paragraph id="id6e60671ff11a4f3e9287acac5f6a1e6d"><enum>(2)</enum><text>in the annual financial statement of the Federal entity required to be filed under section 3515 of title 31, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4FE9686DAAC84EBEA7897FC2ADC812F7"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 103(b) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)</external-xref>) is amended—</text><paragraph id="id94BFC84A441942DEBB7688E5016E7209"><enum>(1)</enum><text>in paragraph (1), by striking <quote>section 105(d)</quote> and inserting <quote>section 106(d)</quote>; and</text></paragraph><paragraph id="id0C18782E78A54C3AA0CB871BC1743D09"><enum>(2)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>section 105(d)</quote> and inserting <quote>section 106(d)</quote>.</text></paragraph></subsection></section></legis-body></bill>
