 purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id2fe74d79-7059-4fe8-b3a3-5666cf7ea8ff" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alaska Native Tribal Health Consortium Land Transfer Act of 2021</short-title></quote>.</text></section><section id="id702303b7efad491ebc7d4ac651e9a610"><enum>2.</enum><header>Conveyance of property to the Alaska Native Tribal Health Consortium</header><subsection id="id3841670607014c289dfeb05a641ca146"><enum>(a)</enum><header>Conveyance of property</header><paragraph id="idf3226006d58849029872dfab1a841108"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 2 years, after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this Act as the <quote>Secretary</quote>) shall convey to the Alaska Native Tribal Health Consortium located in Anchorage, Alaska (referred to in this section as the <quote>Consortium</quote>), all right, title, and interest of the United States in and to the property described in subsection (b) for use in connection with health programs. </text></paragraph><paragraph id="idf4884d6d898e4088a4b0dabc51640688"><enum>(2)</enum><header>Conditions</header><text>The conveyance of the property under paragraph (1)— </text><subparagraph id="ide5e8859d9d02417eb4e77ed6b57b7a28"><enum>(A)</enum><text>shall be made by warranty deed; and</text></subparagraph><subparagraph id="id959e55333d4c4545909a3b677ada1e9c"><enum>(B)</enum><text>shall not—</text><clause id="idf9bef3a10957436ab86d35077f5c5039"><enum>(i)</enum><text>require any consideration from the Consortium for the property; </text></clause><clause id="idac2cdccfbf884d84a3c23e30945231bb"><enum>(ii)</enum><text>impose any obligation, term, or condition on the Consortium; or </text></clause><clause id="id91e9fb6fca59493380d5fe74bdd7f185"><enum>(iii)</enum><text>allow for any reversionary interest of the United States in the property. </text></clause></subparagraph></paragraph><paragraph id="id4e7ab4614d06435b8a5f89ffbd54a791"><enum>(3)</enum><header>Effect on any quitclaim deed</header><text>The conveyance by the Secretary of title by warranty deed under paragraph (1) shall, on the effective date of the conveyance, supersede and render of no future effect any quitclaim deed to the property described in subsection (b) executed by the Secretary and the Consortium. </text></paragraph></subsection><subsection id="ided81cbf8a0844f7eb650fe6fd83f801a"><enum>(b)</enum><header>Property described</header><text>The property referred to in subsection (a), including all land, improvements, and appurtenances, is—</text><paragraph id="idd1a6a5075a5a4fa2bf2c55edfcc69645"><enum>(1)</enum><text>Lot 1A in Block 31A, East Addition, Anchorage Townsite, United States Survey No. 408, Plat No. 96–117, recorded on November 22, 1996, in the Anchorage Recording District; and </text></paragraph><paragraph id="ida6b90aba463b4d4db250995d67706fea"><enum>(2)</enum><text>Block 32C, East Addition, Anchorage Townsite, United States Survey No. 408, Plat No. 96–118, recorded on November 22, 1996, in the Anchorage Recording District. </text></paragraph></subsection><subsection id="id711a26c21e7b42708c7b4d358e044d16"><enum>(c)</enum><header>Environmental liability</header><paragraph id="id54f0009d28e449988501114d5fac7ac4"><enum>(1)</enum><header>Liability</header><subparagraph id="id9384813df38442b8956c78369f03ac8d"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law— </text><clause id="id8986789fafa74a8191f68cdcdb88d56c"><enum>(i)</enum><text>the Consortium shall not be liable for any soil, surface water, groundwater, or other contamination resulting from the disposal, release, or presence of any environmental contamination on any portion of the property described in subsection (b) that occurred on or before the date on which the property is conveyed to the Consortium under subsection (a)(1); and </text></clause><clause id="idd95c5d47c43e470691c7ca4e4f0c0869"><enum>(ii)</enum><text>the Secretary shall not be liable for any soil, surface water, groundwater, or other contamination resulting from the disposal, release, or presence of any environmental contamination on any portion of the property described in subsection (b) that occurred after the date on which the Consortium controlled, occupied, and used the property. </text></clause></subparagraph><subparagraph id="id38d7d014b4e34e6ca76b3a3a03132863"><enum>(B)</enum><header>Environmental contamination</header><text>An environmental contamination described in subparagraph (A) includes any oil or petroleum products, hazardous substances, hazardous materials, hazardous waste, pollutants, toxic substances, solid waste, or any other environmental contamination or hazard as defined in any Federal or State of Alaska law. </text></subparagraph></paragraph><paragraph id="id0d5a2bcc45b64bd187fc83b341fba822"><enum>(2)</enum><header>Easement</header><text>The Secretary shall be accorded any easement or access to the property conveyed under subsection (a)(1) as may be reasonably necessary to satisfy any retained obligation or liability of the Secretary. </text></paragraph><paragraph id="idab4ebffdcfab40eba9bc4c756328885a"><enum>(3)</enum><header>Notice of hazardous substance activity and warranty</header><text>In carrying out this section, the Secretary shall comply with subparagraphs (A) and (B) of section 120(h)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)(3)</external-xref>). </text></paragraph></subsection></section></legis-body><endorsement><action-date>April 14, 2021</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
