which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Packers and Stockyards Act, 1921, to establish a cattle contract library, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cattle Market Transparency Act of 2021 </short-title></quote>.</text></section><section id="idCB67ACBCBDEE4033B83DA12DD6560B4A"><enum>2.</enum><header>Cattle contract library</header><subsection id="id25A4459FF9B64F698DD867E6F837C656"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Packers and Stockyards Act, 1921, is amended by inserting after section 223 (<external-xref legal-doc="usc" parsable-cite="usc/7/198b">7 U.S.C. 198b</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF3E70404C7204C6AB6D9ABAF9DF922A0"><subtitle id="idC4AF3A6A6DCB49BEBB2C5F9294CCE8EE" style="OLC"><enum>C</enum><header>Cattle contracts</header><section section-type="subsequent-section" id="id777C0105FABA46DF8BFE90E088078FFA"><enum>231.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id71CDB9B436834AADA815B91C55B82EAE"><enum>(1)</enum><header>Base price</header><text>The term <quote>base price</quote> means the price paid for cattle delivered to a packer, before application of any premiums or discounts, expressed in dollars per hundred pounds of carcass weight.</text></paragraph><paragraph id="idf33c43508e044ad08939cb200af67ad7"><enum>(2)</enum><header>Contract</header><subparagraph id="idFD99C3C89C694E2895A1DB16EFD0963B"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <quote>contract</quote> means any agreement, written or oral, between a packer and a producer for the purchase of fed cattle for slaughter.</text></subparagraph><subparagraph id="idD3F34DBDF07740A78CA9A74454339E4C"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>contract</quote> does not include a contract for a negotiated purchase.</text></subparagraph></paragraph><paragraph id="id69ad9c1761b54cdeb140dc9e5656d84d"><enum>(3)</enum><header>Fed cattle</header><text>The term <quote>fed cattle</quote> means a steer or heifer that has been finished on a ration of roughage and feed concentrates, such as grains, protein meal, grass (forage), and other nutrient-rich feeds, prior to slaughter.</text></paragraph><paragraph id="idb3c6597f809a4007be45ba43c6b38ea6"><enum>(4)</enum><header>Formula marketing arrangement</header><text>The term <quote>formula marketing arrangement</quote> means the advance commitment of cattle for slaughter—</text><subparagraph id="idFBD0DECC32C949A386F4C11DE7AB7085"><enum>(A)</enum><text>by any means other than through a negotiated purchase, negotiated grid purchase, or forward contract; and</text></subparagraph><subparagraph id="idDAEE611C3AA94E95891413307034793B"><enum>(B)</enum><text>using a method for calculating price—</text><clause id="id4B4E0E8A4EEB46208DAA1834FA4C3179"><enum>(i)</enum><text>under which the price is determined at a future date; </text></clause><clause id="idC15B10B5D1934806B77B70C8105C50A7"><enum>(ii)</enum><text>the basis of which is a price established for a specified market, which may be based on any publicly reported price, including plant average price, regional price, downstream price, or some other mutually agreeable price source; and</text></clause><clause id="id52B9D64C8C3A416CB7BECC424CFFE4E2"><enum>(iii)</enum><text>that may include a grid or nongrid price. </text></clause></subparagraph></paragraph><paragraph id="id3cdcaeda68624a379dd340f40114ec8e"><enum>(5)</enum><header>Forward contract</header><text>The term <quote>forward contract</quote> means—</text><subparagraph id="ID76974E8ADFF046BFBB328D7DD718784C"><enum>(A)</enum><text>an agreement for the purchase of fed cattle, executed in advance of slaughter, under which the base price is established by reference to—</text><clause id="IDEC715435B58D40DB87F4A8F2F744A68E"><enum>(i)</enum><text>prices quoted on the Chicago Mercantile Exchange; or</text></clause><clause id="IDB28A31C76D124DD8A27A7D4A915011D1"><enum>(ii)</enum><text>other comparable publicly available prices; or</text></clause></subparagraph><subparagraph id="ID978AE81397A047B9906EC1EDEEA4CE20"><enum>(B)</enum><text>any other contract for the purchase of fed cattle, executed in advance of slaughter, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id15956c402fcd4316a8e82e61972ce0c9"><enum>(6)</enum><header>Heifer</header><text>The term <quote>heifer</quote> means a bovine female that has not given birth to a calf. </text></paragraph><paragraph commented="no" id="id2c2949be3b35483eb8df1537fe5bfa7a"><enum>(7)</enum><header>Negotiated grid purchase</header><text>The term <quote>negotiated grid purchase</quote> means a purchase of fed cattle by a packer from a producer under which—</text><subparagraph commented="no" id="id6DE81921FC754B3286098CCC4D2B3838"><enum>(A)</enum><text>the buyer-seller interaction results in a negotiated base price, which may be adjusted by premiums and discounts; and</text></subparagraph><subparagraph commented="no" id="id38B09F16FC11448A93131F89AA226EFC"><enum>(B)</enum><text>the cattle are scheduled for delivery to the packer not more than 14 days after the date on which the agreement for purchase is made.</text></subparagraph></paragraph><paragraph id="id1dfa03dda5ca4de7b8eaf1e93b551fc1"><enum>(8)</enum><header>Negotiated purchase</header><text>The term <quote>negotiated purchase</quote> means a purchase of fed cattle (commonly known as a <quote>cash</quote> or <quote>spot market</quote> purchase) by a packer from a producer under which—</text><subparagraph id="ida9fa858837d841dc8393b1d2279cc9e8"><enum>(A)</enum><text>the buyer-seller interaction that results in the purchase and the agreement on the actual base price for the purchase occur on the same day; and</text></subparagraph><subparagraph id="idc2a3a4b79e0a4a7c9e4e4f336ac72bb1"><enum>(B)</enum><text>the cattle are scheduled for delivery to the packer not more than 14 days after the date on which the agreement for purchase is made. </text></subparagraph></paragraph><paragraph id="idceb74f469af0488ba39f32afff3fe3bf"><enum>(9)</enum><header>Packer</header><text>The term <quote>packer</quote> has the meaning given the term in section 221 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635d">7 U.S.C. 1635d</external-xref>).</text></paragraph><paragraph id="id75d0b332970b496b893e12c0f8f2c2fd"><enum>(10)</enum><header>Producer</header><text>The term <quote>producer</quote> means a person engaged in the business of selling cattle to a packer for slaughter.</text></paragraph><paragraph id="idd897645b5e994ea88bf749fb7d57fa2d"><enum>(11)</enum><header>Steer</header><text>The term <quote>steer</quote> means a bovine male castrated before reaching sexual maturity.</text></paragraph><paragraph commented="no" id="id64f501f83fad493282fae14c0f61fd60"><enum>(12)</enum><header>Type of contract</header><subparagraph commented="no" id="idF928F97DD0604328A824940ED42A471D"><enum>(A)</enum><header>In general</header><text>The term <quote>type of contract</quote> means the classification of a contract for the purchase of cattle—</text><clause commented="no" id="idBFB1CE29952A4510846B5C60B75DA41E"><enum>(i)</enum><text>into 1 of the categories described in subparagraph (B); and</text></clause><clause commented="no" id="idBB3CE8D2D3144E16B4B789CBE3AC6A49"><enum>(ii)</enum><text>by determining the base price of the cattle.</text></clause></subparagraph><subparagraph commented="no" id="id9232653CE05A40EA926CE023CBB9A6D9"><enum>(B)</enum><header>Categories</header><text>The categories for classification of a type of contract are the following:</text><clause commented="no" id="ida943b00638ad44ed9aba2ec94546133b"><enum>(i)</enum><text>Formula marketing arrangement. </text></clause><clause commented="no" id="id87b07dc92fea4e62a349de584395222b"><enum>(ii)</enum><text>Forward contract.</text></clause><clause commented="no" id="id3e3b00fd96964ac1a0780a99c08db898"><enum>(iii)</enum><text>Negotiated grid purchase contract.</text></clause></subparagraph></paragraph></section><section commented="no" id="id5EDAEAA7701E45AD96C4786501B1C656"><enum>232.</enum><header>Cattle contract library</header><subsection id="id1bbfbcf35ccc4021bdccd87e343b699c"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations to carry out this section, the Secretary shall establish and maintain a library or catalog of each type of contract offered by packers to producers for the purchase of all or part of the production of the producers of fed cattle (including cattle that are purchased or committed for delivery), including any schedules of premiums or discounts associated with the contract.</text></subsection><subsection id="idbdebface63784c379881b230149020a9"><enum>(b)</enum><header>Information collection</header><paragraph id="id9d9e227dbb174b0f9d72a744c19c5d9e"><enum>(1)</enum><header>In general</header><text>To maintain the library or catalog established under subsection (a), the Secretary shall obtain information from each packer on each type of existing contract of the packer by requiring a filing or other form of information submission from each packer.</text></paragraph><paragraph id="id53db0f92d0824f46a4c7c1b15c03aa78"><enum>(2)</enum><header>Contracted cattle numbers</header><text>Information that shall be submitted to the Secretary by a packer under paragraph (1) shall include, with respect to each existing contract of a packer—</text><subparagraph id="id4906b37c26a34bc6a12f3bb8322dbd29"><enum>(A)</enum><text>the type of contract; and</text></subparagraph><subparagraph id="id59c993c6a3e646b787b069a38e325577"><enum>(B)</enum><text>a description of the provisions in the contract that provide for expansion in the numbers of fed cattle to be delivered under the contract for the 6-month and 12-month periods following the date of the contract.</text></subparagraph></paragraph></subsection><subsection id="idACE34C94FD324838AB7F7778CCC99E83"><enum>(c)</enum><header>Availability of information</header><paragraph id="id1d0e67814be44305be66324106adbe20"><enum>(1)</enum><header>In general</header><text>The Secretary shall make available to producers and other interested persons information on the types of contracts in the library or catalog established under subsection (a), including notice (on a real-time basis, if practicable) of the types of contracts that are being offered by packers to, and are open to acceptance by, producers for the purchase of fed cattle.</text></paragraph><paragraph id="idCD127E87CA434B2292CD8377FE53EE4E"><enum>(2)</enum><header>Monthly report</header><subparagraph id="idFFBB604248B347B6A74E46CD93754188"><enum>(A)</enum><header>In general</header><text>Beginning 30 days after the library or catalog is established under subsection (a), the Secretary shall make the information obtained each month in the library or catalog available in a monthly report to producers and other interested persons.</text></subparagraph><subparagraph id="idB58ABCD17E784A4FB0B703675EEA9014"><enum>(B)</enum><header>Contents</header><text>The monthly report described in subparagraph (A) shall include—</text><clause id="id9f9808fd4d244b1186ca83b87ec10f64"><enum>(i)</enum><text>an estimate by the Secretary of the total number of fed cattle committed under contracts for delivery to packers within the 6-month and 12-month periods following the date of the report, organized by reporting region and type of contract; and</text></clause><clause id="id93b82a449faa42559ab724dfd050c4ef"><enum>(ii)</enum><text>an estimate by the Secretary of the total maximum number of fed cattle that may be delivered within the 6-month and 12-month periods following the date of the report, based on the provisions described in subsection (c)(2)(B) in existing contracts, organized by reporting region and type of contract. </text></clause></subparagraph></paragraph></subsection><subsection id="id067C180386C44A7A8590AEB85A321BD4"><enum>(d)</enum><header>Maintenance of library or catalog</header><text>Information in the library or catalog established under subsection (a) about types of contracts that are no longer offered or in use shall be removed from the library or catalog.</text></subsection><subsection id="id5b80ff70b6384c599be09b5ac34d7c42"><enum>(e)</enum><header>Confidentiality</header><text>The reporting requirements for packers under this section shall be subject to the confidentiality protections provided under section 251 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636">7 U.S.C. 1636</external-xref>).</text></subsection><subsection id="id65e7cba6bf46436aa7a1254bb795dc62"><enum>(f)</enum><header>Violations</header><text>It shall be unlawful and a violation of this Act for any packer to willfully fail or refuse—</text><paragraph id="id099536DCB537434B9A46780162F8D33F"><enum>(1)</enum><text>to provide to the Secretary accurate information required under this section; or</text></paragraph><paragraph id="idCA9AF6A49F0745989DB27FC01BDB0C6C"><enum>(2)</enum><text>to comply with any other requirement of this section.</text></paragraph></subsection><subsection id="id3f72161eeb3b4994aa01e78b9d487de5"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCA606A82E19B4278B5A26594B5855645"><enum>(b)</enum><header>Conforming amendment</header><text>Section 201 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/191">7 U.S.C. 191</external-xref>), is amended by striking <quote>When used in this Act</quote> and inserting <quote>Unless specified otherwise, in this Act,</quote>.</text></subsection></section><section id="idB8629FFEF9484F8A8DCD800F35D7E6C9"><enum>3.</enum><header>Cash market acquisition of cattle</header><subsection id="idACC8F497A84D4ABB885D4F9B46AD3664"><enum>(a)</enum><header>Sense of the Senate</header><text>It is the sense of the Senate that all participants in the fed cattle market have a responsibility to contribute to regionally sufficient levels of negotiated trade of fed cattle in all cattle feeding regions in order to achieve robust price discovery.</text></subsection><subsection id="idB41D622B85324EECBAD5583D94A6F606"><enum>(b)</enum><header>Cash market acquisition of cattle</header><text display-inline="yes-display-inline">Title II of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/191">7 U.S.C. 191</external-xref> et seq.) (as amended by section 2), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3309FEE874DD440F9C1824B376675E36"><subtitle id="idD3D231EBCEBB482D8410820E0C54801D" style="OLC"><enum>D</enum><header>Cash market acquisition of cattle</header><section section-type="subsequent-section" id="id6D1A7DE63691484A819AE8CE5078E43A"><enum>241.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph commented="no" id="id5127DA3E3280412783164C3F1C3E91CF"><enum>(1)</enum><header>Negotiated grid purchase</header><text>The term <quote>negotiated grid purchase</quote> means a purchase of fed cattle by a packer from a producer under which—</text><subparagraph commented="no" id="idCA6B9B93BA8F40A4B9437454158E1817"><enum>(A)</enum><text>the buyer-seller interaction results in a negotiated base price, which may be adjusted by premiums and discounts; and</text></subparagraph><subparagraph commented="no" id="id802562D261DD4F96B57B8ABE22DF050E"><enum>(B)</enum><text>the fed cattle are scheduled for delivery to the packer not more than 14 days after the date on which the agreement for purchase is made. </text></subparagraph></paragraph><paragraph id="idC3B3A1A3799748A9B98E1EB590D6313F"><enum>(2)</enum><header>Negotiated purchase</header><text>The term <quote>negotiated purchase</quote> means a purchase of fed cattle (commonly known as a <quote>cash</quote> or <quote>spot market</quote> purchase) by a packer from a producer under which—</text><subparagraph id="idDFADDAE4E95C47079C8422A451284655"><enum>(A)</enum><text>the buyer-seller interaction that results in the purchase and the agreement on the actual base price for the purchase occur on the same day; and</text></subparagraph><subparagraph id="id779FAC507FF94CF8AA0402124992C71C"><enum>(B)</enum><text>the fed cattle are scheduled for delivery to the packer not more than 14 days after the date on which the agreement for purchase is made.</text></subparagraph></paragraph><paragraph id="idC247E582B6054DE1A8C3F89FB81EC2CB"><enum>(3)</enum><header>Packer</header><subparagraph id="idCD7133911406433C8C2D995C4C3A790A"><enum>(A)</enum><header>In general</header><text>The term <quote>packer</quote> has the meaning given the term in section 221 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635d">7 U.S.C. 1635d</external-xref>).</text></subparagraph><subparagraph id="id3D0A7DBD7A5D4AF5A79DD7DD27CDD27A"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>packer</quote> does not include a packer that slaughters cattle at only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph id="id84B6AE7DB9C3434898CE6303B8152E2B"><enum>(4)</enum><header>Producer</header><text>The term <quote>producer</quote> means a person engaged in the business of selling cattle to a packer for slaughter.</text></paragraph><paragraph id="id426F2A6E50D944A4B63D5611BEE31030"><enum>(5)</enum><header>Regional mandatory minimum</header><text>The term <quote>regional mandatory minimum</quote> means, for each reporting region (as designated by the Agricultural Marketing Service), of the number of transactions and quantity of cattle purchased for slaughter by a packer in that region each slaughter week, the minimum number of such transactions and the minimum percentage of such cattle, respectively, that are required to be purchased through negotiated purchases or negotiated grid purchases from producers.</text></paragraph><paragraph id="idDBF34B2F6D394F769FB9B6652D31F0C7"><enum>(6)</enum><header>Slaughter week</header><text>The term <quote>slaughter week</quote> has the meaning given the term <quote>current slaughter week</quote> in section 212 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635a">7 U.S.C. 1635a</external-xref>).</text></paragraph></section><section section-type="subsequent-section" id="id80D8709E43FE4175A44A446320498494"><enum>242.</enum><header>Regional mandatory minimums</header><subsection id="id7A640A2043A64CA082E2119F314DEB13"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this subtitle, the Secretary, in consultation with the Chief Economist, shall establish—</text><paragraph id="id69A89B89217A49909506D272D5C34D2A"><enum>(1)</enum><text>regional mandatory minimums for the purpose of enhancing price discovery and transparency for cattle market participants; and</text></paragraph><paragraph id="id7D24B33A48B54E25925A24583693A0A3"><enum>(2)</enum><text>methods for establishing those regional mandatory minimums, which shall be publicly available.</text></paragraph></subsection><subsection id="idA707AA07778A4AE0A45391875FBF379F"><enum>(b)</enum><header>Public input</header><text>In carrying out subsection (a), the Secretary shall make all proposed regional mandatory minimums and proposed methods for establishing those minimums subject to a notice and comment period.</text></subsection><subsection id="idDF7071E067274FFA94E99AA44B0D46EE"><enum>(c)</enum><header>Duration</header><text>Regional mandatory minimums established for each reporting region under subsection (a)(1)—</text><paragraph id="id24CB9C91CF6D4B169965989B0FAE3215"><enum>(1)</enum><text>may be weekly or on another periodic basis, as determined by the Secretary; and</text></paragraph><paragraph id="idF717A55D71A84DDC9D732F1ED3AD2DD2"><enum>(2)</enum><text>shall be applicable for not more than a 24-month period. </text></paragraph></subsection><subsection id="idD322F4372EAA453981FFD631145E6FDC"><enum>(d)</enum><header>Considerations</header><text>In carrying out subsection (a) for each reporting region, the Secretary, in consultation with the Chief Economist, shall consider the following factors:</text><paragraph id="ide1615f652a624aa88ec7d4b42c381b1d"><enum>(1)</enum><text>The number of packers in the reporting region.</text></paragraph><paragraph id="id7a917ad13d834f78866c777105b2fd48"><enum>(2)</enum><text>The availability of cattle in the reporting region.</text></paragraph><paragraph id="id28276977309b4dd68174a1d1586d72e4"><enum>(3)</enum><text>Pre-existing contractual arrangements of packers in the reporting region.</text></paragraph><paragraph id="id3AD8000B35524FC4BAF539B3ECDCBA2B"><enum>(4)</enum><text>The number of pricing transactions (pens of cattle sold) in the reporting region.</text></paragraph></subsection><subsection id="id50b4b51bfe4c45288ac018f9de1bd623"><enum>(e)</enum><header>Initial requirement</header><text>The initial regional mandatory minimums established for each reporting region under subsection (a)(1) shall be not less than the average percentage of negotiated purchases and negotiated grid purchases in that region from the 3 previous calendar years. </text></subsection><subsection id="id54AE503DF37544048E0DA4579713CA3C"><enum>(f)</enum><header>Biannual review</header><text>On establishing regional mandatory minimums under subsection (a)(1), the Secretary—</text><paragraph id="idFBD2D2736A064686A1DC4CA9B1363DB4"><enum>(1)</enum><text>shall review the regional mandatory minimums not less frequently than once every 2 years; and</text></paragraph><paragraph id="idDCFACD53C7EB42E1930A13CF94650D4C"><enum>(2)</enum><text>may, in consultation with the Chief Economist, modify the regional mandatory minimums after—</text><subparagraph id="id504472F7BE464277BD6BE54B913CE0AB"><enum>(A)</enum><text>making the proposed modification subject to a notice and comment period; and</text></subparagraph><subparagraph id="ide413e31b4d084d87b9d3923b312fd8ad"><enum>(B)</enum><text>consulting with representatives of the United States cattle and beef industry.</text></subparagraph></paragraph></subsection><subsection id="id7A129B5634C3477B90E879183F934B9E"><enum>(g)</enum><header>Enforcement</header><text display-inline="yes-display-inline">On establishing regional mandatory minimums under subsection (a)(1), the Secretary shall—</text><paragraph id="idCD1FFF6FAEDD4738B434A19C987CB4F5"><enum>(1)</enum><text display-inline="yes-display-inline">regularly monitor compliance by packers with those regional mandatory minimums; and</text></paragraph><paragraph id="id328F6D91625D48E5B641D2EB6D18D9E1"><enum>(2)</enum><text>enforce this section in accordance with section 203.</text></paragraph></subsection><subsection id="id4CD8F159C5B342EA85C97DAE8C828899"><enum>(h)</enum><header>Cost-Benefit analysis</header><text>Not later than 3 years after establishing regional mandatory minimums under subsection (a)(1), the Secretary, in consultation with the Chief Economist, shall conduct a quantifiable, data-driven cost-benefit analysis regarding the operation and effect of those regional mandatory minimums.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id201AC05997F643168E4CB6261AB9B388"><enum>4.</enum><header>14-day cattle slaughter</header><subsection id="id0A2E531B3DD74F69BFCB8ACD9C213B09"><enum>(a)</enum><header>Definition of cattle committed</header><text>Section 221(1) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635d">7 U.S.C. 1635d(1)</external-xref>) is amended by striking <quote>7-day</quote> and inserting <quote>14-day</quote>.</text></subsection><subsection id="id77012B8873404DF99B69A4EFC7280F46"><enum>(b)</enum><header>Mandatory reporting for live cattle</header><text>Section 222(c) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635e">7 U.S.C. 1635e(c)</external-xref>) is amended—</text><paragraph id="idE3EE155CEDB14F0592504CC58AB4A6EE"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id3082895B266848F885E272E696179114"><enum>(A)</enum><text>by striking subparagraphs (B) and (C); and</text></subparagraph><subparagraph id="idE8C3E6C06E7647AF91497D67271C7784"><enum>(B)</enum><text>by redesignating subparagraph (D) as subparagraph (B);</text></subparagraph></paragraph><paragraph id="id00EEFB0E961640D09C3B137CB1CFD7F0"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="idEE5EE7E306DA42808B8AF514B0FD4D48"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0C364B6EE9E141E8BC154DA5700F783B"><paragraph id="id0B74D88A1D2E4DCBB5F15914718D9B08"><enum>(2)</enum><header>Prior day reporting</header><subparagraph id="id8042FC1282634F69AF7D8E14632E6A2A"><enum>(A)</enum><header>In general</header><text>The corporate officers or officially designated representatives of each packer processing plant shall report to the Secretary, for each business day of the packer processing plant, not later than 10:00 a.m. Central Time on each reporting day, the information from the prior business day described in subparagraph (B).</text></subparagraph><subparagraph id="idEAC9700618FD4196B263A89CD7807CDF"><enum>(B)</enum><header>Information required</header><text>The information required under subparagraph (A) shall be, with respect to the prior business day, the number of cattle, organized by cattle type, scheduled for delivery to a packer processing plant for slaughter for each of the next 14 calendar days.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id795CF7D3551B4F9C9600D7ACBBFE7D6F"><enum>5.</enum><header>Public availability of information</header><text display-inline="no-display-inline">Section 251(a) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1636">7 U.S.C. 1636(a)</external-xref>) is amended—</text><paragraph id="id9075D67998DA479398FB1BDF339A414C"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text></paragraph><paragraph id="idB6BDC62345E24818ABC0556BBF48353C"><enum>(2)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>The Secretary shall make available to the public information</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC1C9DBB57E664BDCA19F0E17F62F867E"><paragraph id="idF3C03AC896A94C8FB56833F82A4DD49D"><enum>(1)</enum><header>In general</header><text>The Secretary shall make available to the public all information</text></paragraph><after-quoted-block>;
