<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Unlawful Negative Machine Impacts through National Evaluation Act</short-title></quote>.</text></section> <section id="id7260c6aa928f470387bc6a367bd5d91c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id356937af21b14c63a7316847f3f29c04"><enum>(1)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given the term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note).</text></paragraph> <paragraph id="idfa103b4719d4486fa6265d4738fa9fc2"><enum>(2)</enum><header>Artificial intelligence system</header><text>The term <term>artificial intelligence system</term> means any data system, software, application, tool, or utility that operates in whole or in part using dynamic or static machine learning algorithms or other forms of artificial intelligence, including a data system, software, application, tool, or utility—</text>
<subparagraph id="id3205fefc8d0d4c2e8760fc608103fc3c"><enum>(A)</enum><text>that is established primarily for the purpose of researching, developing, or implementing artificial intelligence technology; and</text></subparagraph> <subparagraph id="id9630e4d028364bfeae438062273c9920"><enum>(B)</enum><text>for which the artificial intelligence capability is integrated into another system or business process, operational activity, or technology system.</text></subparagraph></paragraph>
<paragraph id="id909375B951E242E7AD378EB52826459C"><enum>(3)</enum><header>Covered civil rights law</header><text>The term <term>covered civil rights law</term> means—</text> <subparagraph id="id041298424C2A4A01AAC4D58B9767977F"><enum>(A)</enum><text>the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>), the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/621">29 U.S.C. 621 et seq.</external-xref>), the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), title V of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791 et seq.</external-xref>), section 6(d) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(d)</external-xref>), title II of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff et seq.</external-xref>), subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>), the Age Discrimination Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/42/6101">42 U.S.C. 6101 et seq.</external-xref>), and any provision of Federal, State, or local law, including the Constitution of the United States, that prohibits discrimination in public or private employment (including contracting), or in the provision of a program or activity or accommodation, on the basis of a protected class; and</text></subparagraph>
<subparagraph id="id6F7524CC829C414091D542038AEEDC2D"><enum>(B)</enum><text>the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>), the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10301">52 U.S.C. 10301 et seq.</external-xref>), and any provision of Federal, State, or local law, including the Constitution of the United States, that prohibits discrimination concerning legal status or a legal right on the basis of a protected class. </text></subparagraph></paragraph> <paragraph id="idd6efcebdbb8342d1bef5a90cf70b10d4"><enum>(4)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any person (including a partnership, corporation, Federal, State, or local agency, or entity) that is subject to a covered civil rights law. </text></paragraph>
<paragraph id="id21a6c4689d1a412d8e9c273410c74f3a"><enum>(5)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institute for Standards and Technology.</text></paragraph></section> <section id="idfb43e106458448f897fb0b83ad63f6e3" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Applicability of civil rights laws to decisions made by or augmented by algorithms</header> <subsection commented="no" display-inline="no-display-inline" id="id79E243FB50F140FABDE4C99B985AF5B1"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section to remove any doubt about the liability described in subsection (b) of a covered entity described in subsection (b).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="idA5E7B17CC83540B4A86B63D0789578B0"><enum>(b)</enum><header>Liability</header><text display-inline="yes-display-inline">A covered entity that uses artificial intelligence to make or inform a decision that has an impact on a person that is addressed by a covered civil rights law, including whether to provide a program or activity or accommodation to a person, shall be liable for a claim of discrimination under the corresponding covered civil rights law in the same manner and to the same extent (including being liable pursuant to that law’s standard of culpability) as if the covered entity had made such decision without the use of artificial intelligence.</text></subsection></section> <section id="id635118f396564ace8d5fa5e4bc17ab16"><enum>4.</enum><header>Requirement for National Institute of Standards and Technology program of technology evaluations of bias and discrimination in artificial intelligence systems</header> <subsection id="id05256ad98c0d453ca10ce5d321758c9d"><enum>(a)</enum><header>Establishment of technology evaluation program</header><text>Not later than 1 year after the date of the enactment of this Act, the Director shall establish a program for conducting technology evaluations to assess and assist in mitigating bias and discrimination in artificial intelligence systems of covered entities with respect to race, sex, age, disability, and other classes or characteristics protected by covered civil rights laws. In establishing such program, the Director shall ensure that such evaluations effectively approximate real-world applications of artificial intelligence systems. </text></subsection>
<subsection id="id147be79f46b64b4b9d2eab9c68b05db4"><enum>(b)</enum><header>Priority evaluation areas</header><text>In carrying out the program required under subsection (a), the Director shall prioritize the conduct of technology evaluations to mitigate bias in—</text> <paragraph id="id5AA59D8FA1A64A4F888EA9818CA259C1"><enum>(1)</enum><text>the applications identified as high risk by previous technology evaluations and strategy documents; </text></paragraph>
<paragraph id="id05ab3f38f88341ef9c798298be7250ac"><enum>(2)</enum><text>speech recognition and synthesis;</text></paragraph> <paragraph id="id0b4346b101ab46cdac20c1718daf7c81"><enum>(3)</enum><text>recommendation systems, including for financial and criminal justice applications;</text></paragraph>
<paragraph id="idcf8e8d9d7081464ca646e8418840c011"><enum>(4)</enum><text>sensitive image recognition technology, including facial and gait recognition systems; and</text></paragraph> <paragraph id="id6f7ab8d5f1f5448e81fe563e4557d2fa"><enum>(5)</enum><text>any other artificial intelligence use case that poses a high risk for discrimination based on classes or characteristics protected by covered civil rights laws, such as image and video synthesis, text generation, and conversation and information systems. </text></paragraph></subsection>
<subsection id="ide106fd03522e4760b2e176fe90d81c15"><enum>(c)</enum><header>Participation</header><text>In designing technology evaluations under subsection (a), the Director shall ensure the participation of any industry and nongovernmental experts and entities in the fields of artificial intelligence, machine learning, computer science, social sciences, civil rights, and civil liberties seeking to participate in such evaluations.</text></subsection> <subsection id="id98466cdb586e420a904635f6992f034a"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Director such sums as may be necessary to carry out this section for each of the fiscal years 2023 through 2028.</text></subsection>
<subsection id="id4150d842b0ce4c81b6f659ba989d24cc" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Sunset</header><text>The program required under subsection (a) shall terminate on December 31, 2028. </text></subsection></section> </legis-body> </bill>
