purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H7CFB1913B3204CD28DE81A2CC800A5E2" style="OLC"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Child Support Enforcement Act</short-title></quote>.</text></section><section id="H01AC1FA8296B4E289BD640C862AD73DC" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Improving the effectiveness of tribal child support enforcement agencies</header><subsection id="id66028C96A21F41AFBF2E8A15C56D856E" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Improving the collection of past-Due child support through State and tribal parity in the allowable use of tax information</header><paragraph id="id76273A46DA594469B7E3BC354449FA2F" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Amendment to the Social Security Act</header><text display-inline="yes-display-inline">Section 464 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/664">42 U.S.C. 664</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="id0E62C91EE2C2411CB86B24DE9DBB2850" display-inline="no-display-inline"><subsection id="id0B93863FE363466394348D9F7852B9A9" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Applicability to Indian tribes and tribal organizations receiving a grant under this part</header><text display-inline="yes-display-inline">This section, except for the requirement to distribute amounts in accordance with section 457, shall apply to an Indian tribe or tribal organization receiving a grant under section 455(f) in the same manner in which this section applies to a State with a plan approved under this part.</text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBD26D4F71614A779163939D08D43EEA"><enum>(2)</enum><header display-inline="yes-display-inline">Amendments to the Internal Revenue Code</header><subparagraph commented="no" display-inline="no-display-inline" id="idEDEC86072B53419AB1CF5EE1EF539F48"><enum>(A)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(a)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>any local child support enforcement agency</quote> and inserting <quote>any tribal or local child support enforcement agency</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96EAAEC5E3504273BF7160771F130C46"><enum>(B)</enum><text display-inline="yes-display-inline">Section 6103(a)(3) of such Code is amended by inserting <quote>, (8)</quote> after <quote>(6)</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE75EEBC622A4CB382BEACA96413A7E4"><enum>(C)</enum><text display-inline="yes-display-inline">Section 6103(l) of such Code is amended—</text><clause commented="no" display-inline="no-display-inline" id="idA746D50C3A804BB98BF5E8CF49CEB562"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (6)—</text><subclause commented="no" display-inline="no-display-inline" id="id566AFAEC5FA44837819D1A8DDDAFFC6A"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>or local</quote> in subparagraph (A) and inserting <quote>tribal, or local</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id70F0366B46A5456EB4AA88A33545EE4B"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="paragraph" style="OLC">and local</header-in-text></quote> in the heading thereof and inserting <quote><header-in-text level="paragraph" style="OLC">tribal, and local</header-in-text></quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7AA0A93F85C94C7CA71EC631DB81316C"><enum>(III)</enum><text display-inline="yes-display-inline">by striking <quote>The following</quote> in subparagraph (B) and inserting <quote>The</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id05CA9B2FCE4B43B8921B026F178F142C"><enum>(IV)</enum><text display-inline="yes-display-inline">by striking the colon and all that follows in subparagraph (B) and inserting a period; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id14397674F9064D1C9C43A5CBF444A827"><enum>(V)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7829B836D1BC4B6F8FEA8C3704FBBBE0"><subparagraph commented="no" display-inline="no-display-inline" id="id26A3FD5FCF1E49B4AEC6682FAFA8C7CC"><enum>(D)</enum><header display-inline="yes-display-inline">State, tribal, or local child support enforcement agency</header><text display-inline="yes-display-inline">For purposes of this paragraph, the following shall be treated as a State, tribal, or local child support enforcement agency:</text><clause commented="no" display-inline="no-display-inline" id="id2AAC1DAA7CF343BEAA649125DBE4AF49"><enum>(i)</enum><text display-inline="yes-display-inline">Any agency of a State or political subdivision thereof operating pursuant to a plan described in section 454 of the Social Security Act which has been approved by the Secretary of Health and Human Services under part D of title IV of such Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="id48EAF6979BD341109212AB7195930DCD"><enum>(ii)</enum><text display-inline="yes-display-inline">Any child support enforcement agency of an Indian tribe or tribal organization receiving a grant under section 455(f) of the Social Security Act.</text></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id03F8806682FA4F3FB678D9B2A0F19FE3"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (8)—</text><subclause commented="no" display-inline="no-display-inline" id="id424846CCDBC345CFADC8514DDF9DDC0A"><enum>(I)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or State or local</quote> and inserting <quote>State, tribal, or local</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCC9313B63FF44147A43B715351022709"><enum>(II)</enum><text display-inline="yes-display-inline">by adding the following at the end of subparagraph (B): <quote>The information disclosed to any child support enforcement agency under subparagraph (A) with respect to any individual with respect to whom child support obligations are sought to be established or enforced may be disclosed by such agency to any agent of such agency which is under contract with such agency for purposes of, and to the extent necessary in, establishing and collecting child support obligations from, and locating, individuals owing such obligations.</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id60DAE22C9FA24FDE94DB41828D784D66"><enum>(III)</enum><text display-inline="yes-display-inline">by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id005886F32CDE4DA29AA169FDE44365E3"><subparagraph commented="no" display-inline="no-display-inline" id="id62A56CA1F4C6423E92B2E71A8AB0F1A9"><enum>(C)</enum><header display-inline="yes-display-inline">State, tribal, or local child support enforcement agency</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>State, tribal, or local child support enforcement agency</term> has the same meaning as when used in paragraph (6)(D).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="idD7A58582FC7B456D98749390A152177C"><enum>(IV)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="paragraph" style="OLC">and local</header-in-text></quote> in the heading thereof and inserting <quote><header-in-text level="paragraph" style="OLC">tribal, and local</header-in-text></quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7C6475450B23464C9BDE87E0C56CD0B9"><enum>(iii)</enum><text display-inline="yes-display-inline">in paragraph (10)(B), by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B071590D6784C22B5BB331B43DA2307"><clause commented="no" display-inline="no-display-inline" id="idB92FDEB8FF15498AAFDD8E0D95E56655"><enum>(iii)</enum><text display-inline="yes-display-inline">The information disclosed to any child support enforcement agency under subparagraph (A) with respect to any individual with respect to whom child support obligations are sought to be established or enforced may be disclosed by such agency to any agent of such agency which is under contract with such agency for purposes of, and to the extent necessary in, establishing and collecting child support obligations from, and locating, individuals owing such obligations.</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81975D18A2104860A5FD89087962C776"><enum>(D)</enum><text display-inline="yes-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/6402">section 6402</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following: <quote>For purposes of this subsection, any reference to a State shall include a reference to any Indian tribe or tribal organization receiving a grant under section 455(f) of the Social Security Act.</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7435280C56CE473787AFA4DB3E319CBD"><enum>(b)</enum><header display-inline="yes-display-inline">Reimbursement for reports</header><text display-inline="yes-display-inline">Section 453(g) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(g)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id153A45C443A347839D0C1FDEC316797F"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">State</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB9137B5330FE48ABADC265D5D7CCB401"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>and State</quote> and inserting <quote>, State, and tribal</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4AD50A004AA64D97A9F7ACFD367DF7D2"><enum>(c)</enum><header display-inline="yes-display-inline">Technical amendments</header><text display-inline="yes-display-inline">Paragraphs (7) and (33) of section 454 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654</external-xref>) are each amended by striking <quote>450b</quote> and inserting <quote>5304</quote>.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210713" chamber="Senate">Passed the Senate July 13,
