<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5345</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221221">December 21, 2022</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Deposit Insurance Act to provide that the consumer transaction account deposits of an insured depository institution are not considered to be funds obtained by or through a deposit broker, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H039AA74392D242FC9A965AE1A15CE1E7"><section section-type="section-one" id="HD9FAAE77A92D4766BDF8F84CCE05B554"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Transaction Account Protection Act of 2022</short-title></quote>.</text></section><section id="HAE27434B0DEE469CA77064DB46A0D54B"><enum>2.</enum><header>Limited exception for consumer transaction account deposits</header><text display-inline="no-display-inline">Section 29 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1831f">12 U.S.C. 1831f</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF69BE3D8202E4FCB96B4BA469682EAF2"><subsection id="H76C11CB6A93D4357891BB3460CA85138"><enum>(j)</enum><header>Limited exception for consumer transaction account deposits</header><paragraph id="H0DEC0C00A83642B09A42D60BCD02D621"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consumer transaction account deposits of an insured depository institution shall not be considered to be funds obtained, directly or indirectly, by or through a deposit broker.</text></paragraph><paragraph id="H59DB92FC7E594252AEC5554E73FA08FE"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="idEECD536DA4E84EBD89BAC08746EC90FA"><enum>(A)</enum><header>Consumer transaction account deposit</header><text>The term <term>consumer transaction account deposit</term> means a deposit in a transaction account with an insured depository institution—</text><clause id="H1065333B84474364BA9C303BAAAA142A"><enum>(i)</enum><text>that is entirely covered by deposit insurance;</text></clause><clause id="H37E4083E65A848F693ACF9E43E998FFA"><enum>(ii)</enum><text>that is opened by an individual;</text></clause><clause id="HBCB17872DFDA439E99A68F71BA5C374A"><enum>(iii)</enum><text>that is held in the name of the individual;</text></clause><clause id="H813A29B2494D4860975C3BE477B9A9E8"><enum>(iv)</enum><text>that is used monthly by the individual to make payments to, and to receive deposits from, third parties; and</text></clause><clause id="H2FE01B68AF654B66874A528FDE1C6BEB"><enum>(v)</enum><text>with respect to which only the individual is recognized by the insured depository institution as being authorized to designate that withdrawals or payments be made from the account.</text></clause></subparagraph><subparagraph id="id10E66A45CFF94FAABDF3DF91B284CFBF"><enum>(B)</enum><header>Transaction account</header><text>The term <term>transaction account</term> has the meaning given the term in section 19(b)(1) of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/461">12 U.S.C. 461(b)(1)</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
