rule</header><text>The terms <term>agency</term> and <term>rule</term> have the meanings given those terms in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H7772026FD6DB404AA926443B90C2F8CD"><enum>(2)</enum><header>Guidance</header><text>The term <term>guidance</term>—</text><subparagraph id="id30E05036201F4947946F058C22BB4DDF"><enum>(A)</enum><text>means an agency statement of general applicability, intended to have a future effect on the behavior of regulated parties, that sets forth a policy on a statutory, regulatory, or technical issue, or an interpretation of a statute or regulation; and</text></subparagraph><subparagraph id="idFF565F2046D046E5B9973245A0163072"><enum>(B)</enum><text>does not include—</text><clause id="HEDAB81A0893F43F5AB13D2C32009BB40"><enum>(i)</enum><text>a rule promulgated pursuant to notice and comment under section 553 of title 5, United States Code;</text></clause><clause id="HC8C25F536E1A4AD58766F2C91356F212"><enum>(ii)</enum><text>a rule exempt from rulemaking requirements under section 553(a) of title 5, United States Code;</text></clause><clause id="H4F0B456DD89E4194ACF0F40ECB565054"><enum>(iii)</enum><text>a rule of agency organization, procedure, or practice;</text></clause><clause id="HC1B40B7BB2B242A2A8B26C6CCCA552DB"><enum>(iv)</enum><text>a decision of an agency adjudication under section 554 of title 5, United States Code, or any similar statutory provision;</text></clause><clause id="HCEDE69CCEEBE442992A4B6EDB5495A23"><enum>(v)</enum><text>internal guidance directed to the issuing agency or other agency that is not intended to have a substantial future effect on the behavior of regulated parties; or</text></clause><clause id="H04B26D3D9A1E40ADACB0258080CCF5E7"><enum>(vi)</enum><text>internal executive branch legal advice or legal opinions addressed to executive branch officials.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HBB7B43B0EF5644DFB1530ADDBF071502"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each agency shall include a guidance clarity statement as described in subsection (c) on any guidance issued by that agency on and after the date of enactment of this Act.</text></subsection><subsection id="H18596376CB5047CFB927EF7FCA24E7AA"><enum>(c)</enum><header>Guidance clarity statement</header><text>A guidance clarity statement required under subsection (b) shall—</text><paragraph id="id9AEC06D741614D1A895A2759038C52D2"><enum>(1)</enum><text>be displayed prominently on the first page of the document; and</text></paragraph><paragraph id="id321934BD59AA44249B5C36FCAEA05238"><enum>(2)</enum><text>include the following: <quote>The contents of this document do not have the force and effect of law and are not meant to bind the public in any way. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.</quote>.</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id90aa2f26a0d949e1a9b085d4206fc0db" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidance Clarity Act of 2021</short-title></quote>.</text></section><section id="id3ab63a31b85e4fe8b955c4115dc7ec3f" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Guidance clarity statement required</header><subsection id="ida6e27bb6c16049ceac5d51ce959fb85e"><enum>(a)</enum><header>Requirement</header><text>Each agency, as defined in section 551 of title 5, United States Code, shall include a guidance clarity statement as described in subsection (b) on any guidance issued by that agency under section 553(b)(3)(A) of title 5, United States Code, on and after the date that is 30 days after the date on which the Director of the Office of Management and Budget issues the guidance required under subsection (c).</text></subsection><subsection id="id630b8466eefb4e6b8c94105f6c19c17f"><enum>(b)</enum><header>Guidance clarity statement</header><text>A guidance clarity statement required under subsection (a) shall—</text><paragraph id="id8f89a0ecbe1c4a568f54740815b10d1c"><enum>(1)</enum><text>be displayed prominently on the first page of the document; and</text></paragraph><paragraph id="idf29c804bfec94eb9b672dd27d3a5a161"><enum>(2)</enum><text>include the following: <quote>The contents of this document do not have the force and effect of law and do not, of themselves, bind the public or the agency. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.</quote>.</text></paragraph></subsection><subsection id="ided48d00b70b840eb8088df0556b6dbdc"><enum>(c)</enum><header>OMB guidance</header><text>Not later than 90 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to implement this Act.</text></subsection></section></legis-body><endorsement><action-date>April 27, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
