Applicability of FOIA.</toc-entry></toc></subsection></section><section id="idffdb44c4cc12464497e9d9ef82ec8c56"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="id2b8607c66f814696b8959ef25eec7c53"><enum>(1)</enum><text>the term <term>Advisory Committee</term> means the Federal Advisory Committee on Facial Recognition Technology established under section 201(a);</text></paragraph><paragraph id="id43bd97b1630a49739c2eaf3dffc7d5bc"><enum>(2)</enum><text>the term <term>applicable congressional committee</term> means—</text><subparagraph id="idF85B6C45005B4F409CC35B49CFFCEA89"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs, the Committee on Commerce, Science, and Transportation, and the Committee on the Judiciary of the Senate; and </text></subparagraph><subparagraph id="id3542B991A1B847DC9F0186FD152ACCC2"><enum>(B)</enum><text>the Committee on Homeland Security, the Committee on Energy and Commerce, the Committee on Oversight and Reform, the Committee on Science, Space, and Technology, and the Committee on the Judiciary of the House of Representatives;</text></subparagraph></paragraph><paragraph id="ida9ab01835d3d4eb999a92928db4df6c8"><enum>(3)</enum><text>the term <term>Director</term> means the Director of the Office of Management and Budget;</text></paragraph><paragraph id="id9b103e9e228849bcacdad875a62c8fdd"><enum>(4)</enum><text>the term <term>facial recognition technology</term> means an automated or semi-automated process of—</text><subparagraph id="id5a27c1ac4b5d4517a0271252991ee306"><enum>(A)</enum><text>generating a mathematical representation of an individual’s face, known as a probe face template; and</text></subparagraph><subparagraph id="id76ce9d19ac5e4362bfcbbc05af5a54ad"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idf9f30b1dc8574020b4ed7c85834f9368"><enum>(i)</enum><text>querying a gallery populated with many face templates that may be linked to personally identifiable information and subsequently returning an identity if the similarity of the probe face template to any face template in the gallery is above a specified threshold; or</text></clause><clause indent="up1" id="idE6786459997C4E01B58B11BCA405CBB2"><enum>(ii)</enum><text>comparing the probe face template to a specific face template of an existing image of the individual to verify their identity;</text></clause></subparagraph></paragraph><paragraph id="id5497240cfcc946aba548b73e156fafd9"><enum>(5)</enum><text>the term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 3502 of title 44, United States Code;</text></paragraph><paragraph id="id287bcb2ad90f4f0a99f3e084e1473d44"><enum>(6)</enum><text>the term <term>high risk</term>, with respect to a use case, means one in which face recognition query outputs influence the decision to—</text><subparagraph id="idA0379E2BD67B4AD8A0D5649E76DF2590"><enum>(A)</enum><text>arrest or convict an individual, deny an individual access to government services to which the individual is legally entitled; or </text></subparagraph><subparagraph id="id402A9FAEC09D43728503F217B2A06578"><enum>(B)</enum><text>take other action that directly impacts the fundamental rights or equal protection of that individual under the law;</text></subparagraph></paragraph><paragraph id="id0604e2bac1e04460968e01a0a33c1922"><enum>(7)</enum><text>the term <term>intelligence community</term> has the meaning given the term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>);</text></paragraph><paragraph id="id8de655863d3f4cad803324206090613e"><enum>(8)</enum><text>the term <term>Secretary</term> means the Secretary of Homeland Security;</text></paragraph><paragraph id="id07c4e40f03324a259f1250adc6e91d82"><enum>(9)</enum><text>the term <term>use case</term>—</text><subparagraph id="idB05EB613607640D983A9E20AFB009BD8"><enum>(A)</enum><text>means a description of the ways and circumstances in which a technology is operated to perform a specific function; and</text></subparagraph><subparagraph id="id18C51082803446F295B95A286C96D403"><enum>(B)</enum><text>does not include research programs that use Institutional Review Board informed consent; and</text></subparagraph></paragraph><paragraph id="idb1737b31aad64b8ab0d32b31c0fab3ec"><enum>(10)</enum><text>the term <term>security use case</term> means the ways and circumstances in which a technology is operated to perform a specific function related to—</text><subparagraph id="id80F7F8A4AFA648AEB745162D9E543B47"><enum>(A)</enum><text>conducting a criminal investigation;</text></subparagraph><subparagraph id="id7D86F237B1E2467A8FB5C9AC28E4C952"><enum>(B)</enum><text>protecting national security;</text></subparagraph><subparagraph id="idFD1E332B4088487EA1C84DE50B023F82"><enum>(C)</enum><text>monitoring and preventing unauthorized access to Federal buildings; or</text></subparagraph><subparagraph id="idF4D93FBC91BB4875BCBBECF48CD76BF6"><enum>(D)</enum><text>detecting or combating fraud or other illegal activity.</text></subparagraph></paragraph></section><title id="idbbd106804d2b48d2929f7329f44a5e84"><enum>I</enum><header>Establishing best practices for current Federal use of facial recognition technology</header><section id="id1956fa0995e24492804c7ac0ed05927e"><enum>101.</enum><header>Disclosure of Federal uses of facial recognition technology</header><subsection id="id0c6fdb721e4345b4870d353e08afc77e"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, and biannually thereafter, the Director shall submit to the applicable congressional committees a report on all Federal Government programs that use face recognition technology.</text></subsection><subsection id="id6c538e8dde1b47739792caf8b5fa7710"><enum>(b)</enum><header>Execution of report</header><text>In order to facilitate the submission of the report under subsection (a), the head of each Federal agency shall provide necessary information to the Director at the request of the Director.</text></subsection><subsection id="idb54b7b3172c04a69a3ff82531b09a787"><enum>(c)</enum><header>Contents</header><text>Each report submitted under subsection (a) shall include—</text><paragraph id="id123de8f062bb4d9092562394605c1b94"><enum>(1)</enum><text>a description of each facial recognition technology use case deployed by a Federal agency;</text></paragraph><paragraph id="idcd448eb090d743dab990da13f157f39f"><enum>(2)</enum><text>an evaluation of how facial recognition technologies deployed by a Federal agency comply with the accuracy requirements under section 102;</text></paragraph><paragraph id="id891b655b32344d96a6c3c37133507151"><enum>(3)</enum><text>a list of the private sector entities which provide facial recognition technologies to each Federal agency for each use case;</text></paragraph><paragraph id="id6c7a0e12c3b34852b96e68d90632270d"><enum>(4)</enum><text>a list of the State, local, and Tribal government agencies and entities that provide access to facial recognition technologies to each Federal agency for each use case;</text></paragraph><paragraph id="ida4ccc7c3f2c44eed8c963effe3f4dc91"><enum>(5)</enum><text>the databases that facial recognition technology queries for each Federal agency for each use case and, if applicable, the authorization allowing access to privately owned and maintained databases;</text></paragraph><paragraph id="id559ca2e70e96469ab742a24673662533"><enum>(6)</enum><text>an explanation of the reasons, with quantitative rationales where possible, for using facial recognition technology for each use case;</text></paragraph><paragraph id="idaf23c3ba9dd6450e9bc8907f1bd102ed"><enum>(7)</enum><text>for each use case described in paragraph (1), an enumeration of whether the use case is high risk; and</text></paragraph><paragraph id="id1954fd4f4c1b485a8530be448d18c9d9"><enum>(8)</enum><text>any additional information the Director determines appropriate.</text></paragraph></subsection><subsection id="id98197ff6e28344838aaaa738df7a2b46"><enum>(d)</enum><header>Form of report</header><text>Each report required under subsection (a) shall be submitted in an unclassified form, but may contain a classified annex.</text></subsection></section><section id="id8443ad31edbe49328ad7c09e871e2de5"><enum>102.</enum><header>Accuracy requirements for the procurement of facial recognition technology</header><subsection id="id6b5ba355c2a247b48cd9646f51cb00d6"><enum>(a)</enum><header>Development of accuracy requirements</header><text>Not later than 1 year after the first report is submitted under section 101(a), the Director of the National Institute for Standards and Technology and the Secretary, in consultation with the Director of the Office of Science and Technology Policy and other agencies and entities as appropriate, shall develop minimum accuracy requirements, specific to each Federal agency, for use cases of facial recognition technology in the Federal Government as determined in the report.</text></subsection><subsection id="id67beb56fc55b43e8bf821015160dd289"><enum>(b)</enum><header>Development of accuracy requirements for high risk use cases</header><text>In developing the requirements under subsection (a), the Director of the National Institute for Standards and Technology shall ensure that the requirements for the use cases identified as high risk shall be more strict than the requirements for the uses cases that are not high risk.</text></subsection><subsection id="idf3d93015f16c4eec98eee909ea56ed1c"><enum>(c)</enum><header>Certification for the accuracy standards</header><text>The head of each Federal agency shall develop a process to ensure that, with the exception of research and testing, the facial recognition technology used by the Federal agency meets the relevant requirements established under subsection (a).</text></subsection><subsection id="id2f06a3b553c349f8ae7d5ff1f397fee7"><enum>(d)</enum><header>Accuracy across demographic groups</header><text>The requirements under subsection (a) shall include minimum accuracy requirements for individuals regardless of different skin tone or race, disability status, age, or sex, alone and in combination, to ensure that facial recognition technology can accurately identify diverse individuals.</text></subsection><subsection id="id4998e8434605438b9fd10cc8ab0dd1cc"><enum>(e)</enum><header>Transparency requirements</header><text>Not later than 30 days after the date on which the requirements are developed under subsection (a), the Director of the National Institute for Standards and Technology shall make such requirements available on a public website.</text></subsection></section><section id="id95b49d7e84a64be7b24b583cb7ac34f1"><enum>103.</enum><header>Requirement for procurement of facial recognition technology</header><subsection id="idf7776307823e406a8ac6da90f20dcad4"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c), before a Federal agency procures or acquires a facial recognition technology, the Federal agency shall—</text><paragraph id="id2535832a3b3c47e4b7aa20247368e283"><enum>(1)</enum><text>publicly report testing and performance results from the Face Recognition Vendor Testing Program of the National Institute of Standards and Technology or other reputable testing authority in a manner that is compatible with Global Reporting Initiative 102 requirements for the facial recognition systems that the Federal agency aims to procure or acquire;</text></paragraph><paragraph id="id3ebed5be092e458c86410521d77be6ad"><enum>(2)</enum><text>certify to the Director that the technology shall meet the accuracy requirements developed under section 102; and</text></paragraph><paragraph id="idcf9fe3b0eb964f228053de0dae71a8aa"><enum>(3)</enum><text>include the certification described in paragraph (1) in the next report required under section 101.</text></paragraph></subsection><subsection id="id69710f34033b48b3b6198677b6edd756"><enum>(b)</enum><header>Limitation on procurement of facial recognition</header><paragraph id="id6aa9a3ed1b394abc85d1cfbc9bdd3647"><enum>(1)</enum><header>In general</header><text>On and after the date on which the accuracy requirements are developed under section 102(a), the head of a Federal agency shall not procure or acquire facial recognition technology that does not meet the requirements under subsection (a).</text></paragraph><paragraph id="id00059fd65c6e490aad39a63684be438f"><enum>(2)</enum><header>Acquisitions before development of accuracy requirements</header><text>The head of a Federal agency—</text><subparagraph id="id711bde3cba4c48a2b423b6f58f326f3d"><enum>(A)</enum><text>may procure or acquire facial recognition technology before the date described in paragraph (1); and</text></subparagraph><subparagraph id="id186692b895164335bae7d1bcdc41ebdd"><enum>(B)</enum><text>if the head of the Federal agency procures or acquires technology described in subparagraph (A), shall ensure that the technology meets the requirements under subsection (a) not later than 1 year after the date on which the accuracy requirements are developed under section 102(a).</text></subparagraph></paragraph></subsection><subsection id="id7ce9ba0771bf4711a4c5b82438cbdbc2"><enum>(c)</enum><header>Exceptions</header><text>The requirements under subsection (a) shall not apply to a facial recognition algorithm software update, enhancement, derivative, correction, defect, or fix, or research program exempted under section 102.</text></subsection></section><section id="id571fd53005a14088862df80ff3350891"><enum>104.</enum><header>Disclosure of high risk use case</header><subsection id="id3a5d19e91a7f484eb383c4df0f1d9faa"><enum>(a)</enum><header>Testing and transparency for high risk use cases</header><text>Not later than 30 days after a report required under section 101 is submitted, each Federal agency shall report on a publicly available and easily accessible Federal website the testing and performance results of the relevant facial recognition algorithm from the Face Recognition Vendor Testing Program of the National Institute of Standards and Technology or other reputable testing authority for high risk use cases.</text></subsection><subsection id="id302c5d06d0954b74a4c839535f7c4b19"><enum>(b)</enum><header>Updates</header><text>Each Federal agency shall update the results published under subsection (a) following the identification of new high risk use cases in subsequent reports submitted under section 101.</text></subsection></section><section id="id9e3e14ba21b84058b2c5a075f8b05751"><enum>105.</enum><header>Requirement of human involvement in facial recognition technology decisionmaking</header><subsection id="id06b1e043cd46409eb94bec86ba2a2d80"><enum>(a)</enum><header>In general</header><text>A Federal agency shall not take any adverse final action to an identified or verified individual that was based on a query output from facial recognition technology deployed by that Federal agency unless a human person has reviewed the facial recognition technology query output and documented the human involvement in the process.</text></subsection><subsection id="id3f6633004d2b4cacb4948e101b828be8"><enum>(b)</enum><header>Qualifications for high risk use cases</header><text>With respect to a high risk use case, the individual described in subsection (a) shall be qualified in accordance with the relevant training standards developed by the Face Identification Scientific Working Group for particular use cases.</text></subsection></section><section id="id715e855a12564aeda2bdb8e03b2295e5"><enum>106.</enum><header>United States person notice and opt-out for non-investigative uses of facial recognition technology</header><subsection id="ida311f08cb5754be396ef0c13bd0bc2a5"><enum>(a)</enum><header>In general</header><text>A Federal agency that uses facial recognition technology for a purpose other than a criminal investigation or other security use case, such as identity verification, shall—</text><paragraph id="id0526e308e33347f4a8c4803511e7d37f"><enum>(1)</enum><text>notify the United States person that they are or were subject to identity verification by facial recognition technology; and</text></paragraph><paragraph id="id03ce18e2f2c740f5a8d778c2ed4e4db7"><enum>(2)</enum><text>provide the United States person an alternative method of identity verification that does not involve the use of facial recognition technology.</text></paragraph></subsection><subsection id="id5cfc7b00c2944f44a787d9afd13dd2e4"><enum>(b)</enum><header>Publication of opt-Out availability</header><text>Federal agencies using facial recognition technology in a manner described in subsection (a) shall communicate to a United States person subject to the use of facial recognition technology that the United States person can elect to verify their identity using an alternative method that does not involve the use of facial recognition technology.</text></subsection><subsection id="idfc493ae001b64310b7d45e5f76781750"><enum>(c)</enum><header>Simplicity of the opt-Out</header><text>For United States persons that exercise the rights under subsection (b), Federal agencies shall not impose a burden for opting out that is substantially greater than the person would experience by using facial recognition technology.</text></subsection></section><section id="ida1ff670655f1428c8fde43aee1d64482"><enum>107.</enum><header>Guarantee of Constitutional rights</header><text display-inline="no-display-inline">A Federal agency shall not use facial recognition technology to violate any rights guaranteed by the Constitution of the United States.</text></section><section id="id80ae2e630995438b8d7b0c684b09c739"><enum>108.</enum><header>Database access restrictions for Federal use of facial recognition technology</header><text display-inline="no-display-inline">No component, official, or personnel of a Federal agency shall use facial recognition technology to access a privately owned and maintained database without prior authorization from the head of the Federal agency, with the exception of a database used for a research and testing program.</text></section><section id="idde12253925664e9ab09c003cb3eae1a6"><enum>109.</enum><header>Notification for criminal defendants</header><text display-inline="no-display-inline">Any criminal defendant, or a counsel thereof, identified through an investigative process that used facial recognition technology in the course of the investigation that led to identifying the defendant by the Federal agency conducting the investigative process shall receive notice that facial recognition technology was used in the investigative process.</text></section><section id="ida30045eb62c0491d921fd76da2463d63"><enum>110.</enum><header>Rule of construction for facial recognition technology that is not high risk</header><text display-inline="no-display-inline">Nothing in this title shall be construed to diminish any Federal requirements with respect to face recognition technology that is not classified as high risk.</text></section><section id="id0db2c67b0c2041b8911fa7a491bcb012"><enum>111.</enum><header>Limitation to civilian agencies</header><text display-inline="no-display-inline">Nothing in this title shall apply to the Department of Defense or any element of the intelligence community.</text></section></title><title id="idb55499c5c0ee4316a73d298706547c22"><enum>II</enum><header>Developing best practices for future Federal use of facial recognition technology</header><section id="idc947258c020b4a6e80de5b2ed21ca55f"><enum>201.</enum><header>Establishment of a Federal Advisory Committee on Facial Recognition Technology</header><subsection id="id5b1f8dcf1b0549ef971e5b626f88666d"><enum>(a)</enum><header>Establishment</header><text>The Director, in consultation with the Secretary, the Director of the National Institute for Standards and Technology, and the head of any other Federal agency that the Director determines appropriate, shall establish a Federal advisory committee on the use of facial recognition technology to be known as the <quote>Federal Advisory Committee on Facial Recognition Technology</quote> to advise Federal agencies on matters related to the use of facial recognition technology.</text></subsection><subsection id="ida23967b7429241c38afa765effd5861c"><enum>(b)</enum><header>Purposes of the Advisory Committee</header><text>The Advisory Committee shall advise the Federal agencies on—</text><paragraph id="ida8821c2b5c7040d78cebc5d05e58e4de"><enum>(1)</enum><text>opportunities to deploy facial recognition technology to improve the effectiveness of the Federal Government;</text></paragraph><paragraph id="ida24b2688d1e5477f8e52a1e2be5e0a86"><enum>(2)</enum><text>the risks associated with the use of facial recognition technology in different use cases;</text></paragraph><paragraph id="id29a0ee2fd09a404e99878d867cadbf22"><enum>(3)</enum><text>the ways that Federal agencies can improve the safety and reliability of facial recognition technology, including through research and development funding to support face recognition technology innovation;</text></paragraph><paragraph id="id5cc26eb46a8d4db68ca5bb4f8d3ed996"><enum>(4)</enum><text>the ethics of facial recognition technology and its use, including mitigating potential bias associated with the use of facial recognition;</text></paragraph><paragraph id="idc2d25584113d4449a728e72fc26b2bad"><enum>(5)</enum><text>protections for privacy, civil liberties, civil rights, and information security when using facial recognition;</text></paragraph><paragraph id="id06493ab10060423f830bcd9e02d0e646"><enum>(6)</enum><text>the ways that Federal agencies can manage, track, and resolve facial recognition failure rates relating to skin complexion or color;</text></paragraph><paragraph id="idebe5c48589f641c0b6c102eb9639b427"><enum>(7)</enum><text>trends in the use of facial recognition technology;</text></paragraph><paragraph id="id939e613f5fed4afc8aadc53835c8bbd9"><enum>(8)</enum><text>any necessary updates to the list of high risk use cases that should be enumerated in the biannual reports required under section 101(a);</text></paragraph><paragraph id="id3ae8781866d9472ba3a62457b57e999f"><enum>(9)</enum><text>requirements for monitoring and documenting any Federal agency use of facial recognition technology that the Federal Government does not own for a high risk use case; and</text></paragraph><paragraph id="idf6a1c96488ba4eef9b0a9d810e44ed64"><enum>(10)</enum><text>any other safeguards necessary, including audit and compliance procedures, standards, and training programs, to ensure the safe and reliable deployment of new facial recognition systems not currently used by the Federal Government.</text></paragraph></subsection><subsection id="ide2b52484c0eb460eac4f759588125579"><enum>(c)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act and every year thereafter, the Director shall submit a report on the activities of the of the Advisory Committee and any guidance provided to Federal agencies on matters related to the use of facial recognition technology to—</text><paragraph id="id27cbfa9c189c49cca4dd95df0096fa35"><enum>(1)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></paragraph><paragraph id="id9a9c45e509674432a8870d483ad605f0"><enum>(2)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></paragraph><paragraph id="id96fbcb5eb7704bfe93758027dc8245c4"><enum>(3)</enum><text>the Committee on Homeland Security of the House of Representatives;</text></paragraph><paragraph id="id292802e3af2146c1a3273645304bc203"><enum>(4)</enum><text>the Committee on Oversight and Reform of the House of Representatives; and</text></paragraph><paragraph id="idec2c1ff92f704a94b71840cc4e4254ec"><enum>(5)</enum><text>the Committee on Science, Space, and Technology of the House of Representatives.</text></paragraph></subsection></section><section id="id4c5f1f1683d14b5684a810717ebf318f"><enum>202.</enum><header>Membership of the Federal Advisory Committee on Facial Recognition Technology</header><subsection id="id90409087630846f9953686e62e2dca74"><enum>(a)</enum><header>In general</header><text>The Advisory Committee shall be composed of 17 members who shall be appointed by the Secretary in addition to the representatives listed in subsection (c).</text></subsection><subsection id="idd893fb234f0342e48a5e4c08723eae15"><enum>(b)</enum><header>Representation</header><text>In carrying out subsection (a), the Secretary shall ensure that members are appointed as follows:</text><paragraph id="id733b5a79e6e748f781ba3b6f6c0c1e01"><enum>(1)</enum><text>4 members from private industry, including small businesses.</text></paragraph><paragraph id="id076cfb1ec5184aa19441c1629b309eea"><enum>(2)</enum><text>4 members from the academic or research community who are computer scientists or otherwise primarily technical experts in the science and engineering behind facial recognition technology.</text></paragraph><paragraph id="id3655c4e2a8174275a90e7d9a47ea3c7e"><enum>(3)</enum><text>4 members from civil society, including individuals that advocates for privacy, civil liberties, or civil rights.</text></paragraph><paragraph id="id8a164a0c557d43b6a4c3559423b3ac66"><enum>(4)</enum><text>1 member from the Biometric and Identity Technology Center of the Department of Homeland Security.</text></paragraph><paragraph id="id6a5d3596271a4b9786a71c674a029d45"><enum>(5)</enum><text>1 member from the Face Identification Scientific Working Group.</text></paragraph><paragraph id="id1eb5e86f9b9447adb1f668b9db14ebd4"><enum>(6)</enum><text>1 member from the Face Identification Subcommittee of the Organization of Scientific Area Committees for Forensic Science of the National Institute of Standards and Technology.</text></paragraph></subsection><subsection id="id633f3e09f0344b55ab11b32b80343852"><enum>(c)</enum><header>Ex-Officio representation</header><text>The Advisory Committee shall be composed of 1 ex-officio representative knowledgeable in biometric risks, benefits, programs, policies, operations, and applications from—</text><paragraph id="idf0f5c6a993bf4111bae67dd6fed3443e"><enum>(1)</enum><text>the National Institute of Standards and Technology;</text></paragraph><paragraph id="id5b291cf14ec6493f963218afe90908f6"><enum>(2)</enum><text>the Department of Commerce;</text></paragraph><paragraph id="idd11e9eca03464691afd926e28a227446"><enum>(3)</enum><text>the General Services Administration;</text></paragraph><paragraph id="id9cecd0ae2f4c4992858bae0ea94f6d46"><enum>(4)</enum><text>the Department of Justice;</text></paragraph><paragraph id="id3f69b3f02ece4da98aa163db6ed97b9b"><enum>(5)</enum><text>the Department of Homeland Security;</text></paragraph><paragraph id="id89727f47f9184cdfb07ad74fc15a18ab"><enum>(6)</enum><text>the Department of State;</text></paragraph><paragraph id="idafae9006052a4eb0a9d453f8de36d1ba"><enum>(7)</enum><text>the Department of Education;</text></paragraph><paragraph id="id31c0699ae02b4e54b6e65defefcabfdd"><enum>(8)</enum><text>the Department of Energy;</text></paragraph><paragraph id="id2ed51a272f4b4152b325b0a62d8e6801"><enum>(9)</enum><text>the Transportation Security Administration;</text></paragraph><paragraph id="id0b1fc6c719014768bfd8eddc5b98a179"><enum>(10)</enum><text>the Department of Veterans Affairs;</text></paragraph><paragraph id="id328c1228f42b40449bcebe6c6010734c"><enum>(11)</enum><text>U.S. Customs and Border Protection;</text></paragraph><paragraph id="id9773796bc50349a79f5096c5dc961405"><enum>(12)</enum><text>U.S. Immigration and Customs Enforcement;</text></paragraph><paragraph id="id4f005b48cc074dfdb79ddbb646fac26d"><enum>(13)</enum><text>the Federal Emergency Management Agency;</text></paragraph><paragraph id="idb4199d4a330f4d31b842b4fd77db6c8a"><enum>(14)</enum><text>the Office of Biometric Identity Management;</text></paragraph><paragraph id="id1c0efd3e3f8d4b869c5225c0c56fe2e7"><enum>(15)</enum><text>the National Science Foundation;</text></paragraph><paragraph id="id4b991341a4ce44cb9190b94f0d075d23"><enum>(16)</enum><text>the National Science and Technology Council;</text></paragraph><paragraph id="ida9cb6891c40541e6abcfabeb2a451266"><enum>(17)</enum><text>the Office of Science and Technology Policy; and</text></paragraph><paragraph id="id232ead9accde4bd3a115eb480a38dafc"><enum>(18)</enum><text>such other Federal agencies as the Secretary considers appropriate.</text></paragraph></subsection><subsection id="id71c7ab6d86ce445c831b5b3a2910ac40"><enum>(d)</enum><header>Chairperson</header><text>The Secretary shall appoint a chairperson for the Advisory Committee from among the members appointed under subsection (a).</text></subsection></section><section id="id439457a97adb44889e3d6283ecf295b3"><enum>203.</enum><header>Meetings of the Federal Advisory Committee on Face Recognition Technology</header><subsection id="idb3c99dc42d1e4dea89649d5547fdb877"><enum>(a)</enum><header>Meetings</header><text>The Advisory Committee shall meet in person, or by telepresence, not less frequently than twice per year.</text></subsection><subsection id="ide31a714a7aa745c081ce6ff58fb6e615"><enum>(b)</enum><header>Powers</header><text>In order to carry out its duties under section 201, the Advisory Committee shall—</text><paragraph id="ida6d1ba3c9a954fbcbdb7eb0c42ec27ac"><enum>(1)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Advisory Committee considers appropriate;</text></paragraph><paragraph id="id9c0a7268a7cd4edaa46675cee75d031a"><enum>(2)</enum><text>submit to Federal agencies such recommendations as the Advisory Committee considers appropriate;</text></paragraph><paragraph id="idf9b9b5538a62413aa68f05b2b35576dc"><enum>(3)</enum><text>issue reports, guidelines, and memoranda;</text></paragraph><paragraph id="ida8ef33fd149c41619f04e1a4ec9dd8d4"><enum>(4)</enum><text>hold or host conferences and symposia;</text></paragraph><paragraph id="idce3df5f0af5e4721ba37adbc43e262cf"><enum>(5)</enum><text>establish subcommittees; and</text></paragraph><paragraph id="id3e469a49ae354961aa499454ce617201"><enum>(6)</enum><text>establish rules of procedure.</text></paragraph></subsection><subsection id="id0a676fdec2a44b6f9854670758195523"><enum>(c)</enum><header>Travel expenses</header><text>The members of the Advisory Committee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of Federal agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Advisory Committee.</text></subsection></section><section id="idd7b14f9faa2744048c82ea6b94576562"><enum>204.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated such sums as may be necessary to carry out the requirements of this title.</text></section></title><title id="id77506011a0af46d5a10e488e37a48a0b"><enum>III</enum><header>FOIA</header><section id="idd334987de7324eb7a2d3c0a9be5fca68"><enum>301.</enum><header>Applicability of FOIA</header><text display-inline="no-display-inline">Nothing in this Act, or in a report produced under section 101, shall be construed to allow the disclosure of information or a record that is exempt from public disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></section></title></legis-body></bill>
