Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to modify the energy tax credit to apply to qualified distributed wind energy property. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDCE41CA0276A43529C8F2BB8193405E4"><section section-type="section-one" id="HF91C511A3F1440649B22E9ED2F328A8F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Wind Energy Modernization and Extension Act of 2021</short-title></quote>. </text></section><section id="HA5DC61602A0C424FB9081B749F3114B8"><enum>2.</enum><header>Qualified distributed wind energy properties added to energy credit</header><subsection id="HE294C0D1248847929033A820AF41597C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/48">Section 48</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H0875B3DB51A74D13AA852047893D3FFE"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H571C04DB38834346B04221704AEEBB1C"><enum>(A)</enum><text>in paragraph (7)—</text><clause id="H12BEF16FC279456CA9987B0BE770595E"><enum>(i)</enum><text>in the header, by striking, <quote><header-in-text level="paragraph" style="OLC">Phaseout for fiber-optic solar, qualified fuel cell, and qualified small wind energy property</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Phaseout for fiber-optic solar or qualified fuel cell property</header-in-text></quote>, and</text></clause><clause id="HC946C3ACC4524FDC86A861D757B4386A"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>qualified fuel cell property, qualified small wind property, or energy property</quote> and inserting <quote>qualified fuel cell property or energy property</quote>, and</text></clause></subparagraph><subparagraph id="HA5224DC8DC2040F9A26FC14F7321C6A5"><enum>(B)</enum><text>by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H61360E411A6B480483B51301962172C2"><paragraph commented="no" id="HE086A0A6072446E19DC46EF773124C7B"><enum>(8)</enum><header>Phaseout for qualified distributed wind energy property</header><subparagraph id="H0C757057AAAB4DBDB1D04523D3C7AA73"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), in the case of any qualified distributed wind energy property described in paragraph (3)(A)(vi), the energy percentage determined under paragraph (2) shall be equal to—</text><clause commented="no" id="H381316D22E524396B59C390BE5353459"><enum>(i)</enum><text>in the case of any property the construction of which begins before January 1, 2028, 30 percent, and</text></clause><clause id="H8471ABD51D6F411FA88E1453423BF995"><enum>(ii)</enum><text>in the case of any property the construction of which begins after December 31, 2027, 10 percent. </text></clause></subparagraph><subparagraph commented="no" id="H8A00832D732C4D6E8015595C1D7FF602"><enum>(B)</enum><header>Placed in service deadline</header><text display-inline="yes-display-inline">In the case of any qualified distributed wind energy property described in subparagraph (A)(i) which is not placed in service before January 1, 2029, the energy percentage determined under paragraph (2) shall be equal to 10 percent.</text></subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H085B72B2A66D4DFEA8CFC137DEBC7FEF"><enum>(2)</enum><text>by striking <quote>qualified small wind energy property</quote> each place it appears and inserting <quote>qualified distributed wind energy property</quote>, and</text></paragraph><paragraph id="HFF9B92AF123D4F319DEE2900E09F375B"><enum>(3)</enum><text>by amending subsection (c)(4) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H483964A6E0F542D8BF89B939AC7BECCC"><paragraph id="HF0E39123242E418CA952DD9C44EDCFDB"><enum>(4)</enum><header>Qualified distributed wind energy property</header><subparagraph id="HB9738DDAE4C2499E8665A35263765308"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>qualified distributed wind energy property</quote> means property that uses one or more wind turbines in a single project with a total nameplate capacity not exceeding 10 MW which—</text><clause id="HF1ACFC7A31BD45AB9220CF98B8E7DC71"><enum>(i)</enum><text display-inline="yes-display-inline">are installed on properties with sufficient electrical load such that the annual energy consumption of the property is at least 50 percent of the annual energy produced by the wind energy property, or</text></clause><clause id="H52EF7D85B6744B17B84FD86A49F902A1"><enum>(ii)</enum><text display-inline="yes-display-inline">are used as part of a subscription-based or shared-ownership program that benefits at least five customers and allocates energy production proportionately to subscription or ownership where no more than 50 percent of the energy produced is claimed by any one owner or subscriber.</text></clause></subparagraph><subparagraph id="H76808E3721534E508A8997CDDB1D6F83"><enum>(B)</enum><header>Wind turbine</header><text display-inline="yes-display-inline">The term <quote>wind turbine</quote> means equipment which—</text><clause id="H0B0619178902495D9DA809BA38791F06"><enum>(i)</enum><text>uses wind to produce electricity, and</text></clause><clause id="H08811A8057EB4C5C87DF7AC746DEC752"><enum>(ii)</enum><text>is certified by an accredited certification agency that applies the performance and design standards of the American Wind Energy Association or International Electrotechnical Commission.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H75A56F6759214FB890F2DAB9F8B3CDCD"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
