which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to direct the Secretary of Health and Human Services to develop best practices for the establishment and use of behavioral intervention teams at schools, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Behavioral Intervention Guidelines Act of 2022</short-title></quote>.</text></section><section id="H10890F40D726494DA406013B6FB824B5" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Best practices for behavioral and mental health intervention teams</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 520G of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-38">42 U.S.C. 290bb–38</external-xref>) the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1E2C716F150F4E0780C4362A6AF09D01"><section id="H4D89BA5D3F3546CC91297A010E7F85CD"><enum>520H.<?LEXA-Enum 520H–1.?></enum><header>Best practices for behavioral and mental health intervention teams</header><subsection id="H64510A69B2164820997CEFBC6D1B6FB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary for Mental Health and Substance Use, and in consultation with the Secretary of Education, shall submit to the Health, Education, Labor, and Pensions Committee of the Senate and the Energy and Commerce Committee of the House of Representatives a report that identifies best practices related to using behavioral and mental health intervention teams, which may be used to assist elementary schools, secondary schools, and institutions of higher education interested in voluntarily establishing and using such teams to support students exhibiting behaviors interfering with learning at school or who are at risk of harm to self or others. </text></subsection><subsection id="HBB6F1FE38DF743C2B24416E0BA3D55C4"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report under subsection (a) shall assess evidence supporting such best practices and, as appropriate, include consideration of the following:</text><paragraph id="H7AEF20E04069438896B04FD690728775"><enum>(1)</enum><text display-inline="yes-display-inline">How behavioral and mental health intervention teams might operate effectively from an evidence-based, objective perspective while protecting the constitutional and civil rights and privacy of individuals.</text></paragraph><paragraph id="HBAE1396E5F7640059E1F56AD5FA7BECA"><enum>(2)</enum><text display-inline="yes-display-inline">The use of behavioral and mental health intervention teams—</text><subparagraph id="H8F67FE4929AB421783B2D1BDE7B93099"><enum>(A)</enum><text>to identify and support students exhibiting behaviors interfering with learning or posing a risk of harm to self or others; and</text></subparagraph><subparagraph id="H4CCA0406B0AE41F39D568F2AF1A1D9B3"><enum>(B)</enum><text>to implement evidence-based interventions to meet the behavioral and mental health needs of such students.</text></subparagraph></paragraph><paragraph id="HD0B9D3D1A6E149BD9726913A36127814"><enum>(3)</enum><text display-inline="yes-display-inline">How behavioral and mental health intervention teams can—</text><subparagraph id="H85DB9FA2F37446B1B99531FDC8D1878D"><enum>(A)</enum><text display-inline="yes-display-inline">access evidence-based professional development to support students described in paragraph (2)(A); and</text></subparagraph><subparagraph id="HE27D237C1FC04361B3C998D91E188B24"><enum>(B)</enum><text>ensure that such teams—</text><clause id="H710F4B9E79924300B470B3E4ADF2BCD0"><enum>(i)</enum><text>are composed of trained, diverse stakeholders with expertise in child and youth development, behavioral and mental health, and disability; and</text></clause><clause id="H98D229B8E05140ECA504FA66EFD3EBC4"><enum>(ii)</enum><text>use cross validation by a wide-range of individual perspectives on the team.</text></clause></subparagraph></paragraph><paragraph id="HC28F31D2ADC5424EAB93C1F3EAD0284E"><enum>(4)</enum><text display-inline="yes-display-inline">How behavioral and mental health intervention teams can help mitigate inappropriate referral to mental health services or law enforcement by implementing evidence-based interventions that meet student needs.</text></paragraph></subsection><subsection id="H9E22B4AFFD8C45B192EAB96D5AA118C3"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary shall consult with—</text><paragraph id="HC3A65CADBF8446BAA3D5C3FF114D2233"><enum>(1)</enum><text>the Secretary of Education;</text></paragraph><paragraph id="H9A5317FD80E34840BDCE30B33F91D0ED"><enum>(2)</enum><text>the Director of the National Threat Assessment Center of the United States Secret Service;</text></paragraph><paragraph id="H2139CDAC3A1443CA9C13CEF07DDE46D1"><enum>(3)</enum><text>the Attorney General;</text></paragraph><paragraph id="H5F6088ED6027411C89D89A88FE14872C"><enum>(4)</enum><text display-inline="yes-display-inline">teachers (which shall include special education teachers), principals and other school leaders, school board members, behavioral and mental health professionals (including school-based mental health professionals), and parents of students;</text></paragraph><paragraph id="HAE0CAB7CFA584B2C91E0B7069F69D328"><enum>(5)</enum><text>local law enforcement agencies and campus law enforcement administrators;</text></paragraph><paragraph id="H06588817E8A2483CBBCF7305106AD852"><enum>(6)</enum><text>privacy, disability, and civil rights experts; and</text></paragraph><paragraph id="H4CF503D0008F46B2B567A83D7335F629"><enum>(7)</enum><text>other education and mental health professionals as the Secretary deems appropriate.</text></paragraph></subsection><subsection id="H0EA882B192F94FF6B58F25FA8C1164B7"><enum>(d)</enum><header>Publication</header><text>The Secretary shall publish the report under subsection (a) in an accessible format on the internet website of the Department of Health and Human Services.</text></subsection><subsection id="H1366454C09124761A8428F545E853784"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H229E17158C824080833EB288015B2BCA"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>behavioral and mental health intervention team</term> means a multidisciplinary team of trained individuals who—</text><subparagraph id="HEB2864FF00434C6E94385311DB81650A"><enum>(A)</enum><text display-inline="yes-display-inline">are trained to identify and assess the behavioral health needs of children and youth and who are responsible for identifying, supporting, and connecting students exhibiting behaviors interfering with learning at school, or who are at risk of harm to self or others, with appropriate behavioral health services; and</text></subparagraph><subparagraph id="H1F9B66C34FDC4B14B5D4000AB6DBD05C"><enum>(B)</enum><text>develop and facilitate implementation of evidence-based interventions to—</text><clause id="H9412171B309B4AB4916EFE7DCF2ED19A"><enum>(i)</enum><text>mitigate the threat of harm to self or others posed by a student described in subparagraph (A);</text></clause><clause id="H3741974BCD964818B05C03A56B54DB1C"><enum>(ii)</enum><text>meet the mental and behavioral health needs of such students; and</text></clause><clause id="HD4A11F535BEF49ADA37E70E2F5BC0E04"><enum>(iii)</enum><text display-inline="yes-display-inline">support positive, safe, and supportive learning environments.</text></clause></subparagraph></paragraph><paragraph id="H08F88FBFA6354857BE0F166D9A836E0A"><enum>(2)</enum><text display-inline="yes-display-inline">The terms <term>elementary school</term>, <term>parent</term>, and <term>secondary school</term> have the meanings given to such terms in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H9CA21C64F0704CF595E136E2A2E21408"><enum>(3)</enum><text>The term <term>institution of higher education</term> has the meaning given to such term in section 102 of the Higher Education Act of 1965.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
