<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5314</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221220">December 20, 2022</action-date><action-desc><sponsor name-id="S391">Mr. Young</sponsor> (for himself and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the operation of the Organ Procurement and Transplantation Network.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lost Opportunities to Supply Transplantable Organs Act of 2022</short-title></quote> or the <quote><short-title>LOST Organs Act of 2022</short-title></quote>.</text></section><section id="id48B083E78F954E9EB2EA943407482073"><enum>2.</enum><header>Organ Procurement and Transplantation Network</header><text display-inline="no-display-inline">Section 372(b)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274(b)(2)</external-xref>) is amended—</text><paragraph id="idF9865408FC0C44B09066C082F4AFFC6B"><enum>(1)</enum><text>in subparagraph (E), by inserting <quote>and practice</quote> after <quote>quality</quote>;</text></paragraph><paragraph id="idD47944BBD8DD43319887C7799765B3DB"><enum>(2)</enum><text>by moving subparagraphs (M) through (O) 2 ems to the left;</text></paragraph><paragraph id="idDDFE806455CF4958B1D8FCB5D0C42F67"><enum>(3)</enum><text>by redesignating subparagraphs (H) through (O) as subparagraphs (J) through (Q), respectively; and</text></paragraph><paragraph id="id01A587AF2E7644B38B8C1201236D3896"><enum>(4)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEBFFD9D0E34F45779E6B4D1FD10B0423"><subparagraph id="idD6656A93C979443EA1A0641E79B6B58D" indent="up1"><enum>(H)</enum><text>track and publicly report, with redactions of personal identifiers of donors, waitlist candidates, and recipients, on the status of all organs in transport from organ procurement organizations to any location within the transplant supply chain, including transplant centers,</text></subparagraph><subparagraph indent="up1" id="id789ED1B1F76A45FD85C02E261F865083"><enum>(I)</enum><text>in the event that an organ is lost, damaged, or delayed in transport, establish an open and transparent process to determine cause, corrective action, and recommendations for updates to the standards of quality and practice under subparagraph (E) to prevent organs from being lost, damaged, or delayed,</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
