<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5298</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221219">December 19, 2022</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself, <cosponsor name-id="S349">Mr. Portman</cosponsor>, and <cosponsor name-id="S372">Mrs. Capito</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide the Under Secretary for Science and Technology of the Department of Homeland Security with the authority to temporarily extend the duration of protections provided under the SAFETY Act, and for other purposes.</official-title></form><legis-body><section id="id34387b964a9941e8b502fb8a10241f3c" section-type="section-one"><enum>1.</enum><header>Risk management system</header><subsection id="idfa1d4bd2e5184f5d835b0c80465bf107"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>qualified anti-terrorism technology</term> has the meaning given the term in section 865 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665">6 U.S.C. 665</external-xref>).</text></subsection><subsection id="idB0802C5CA9A94422946564B1EBDC554A"><enum>(b)</enum><header>Extension</header><text>During fiscal year 2023, the Under Secretary for Science and Technology of the Department of Homeland Security may temporarily extend the duration of protections provided under the system of risk management set forth in subtitle G of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/441">6 U.S.C. 441 et seq.</external-xref>) to a qualified anti-terrorism technology if the Under Secretary determines that—</text><paragraph id="id9773b86bd47a4b988fba81f6e5e0e337"><enum>(1)</enum><text>an application for the renewal of such protections was submitted not later than 165 days before the date of the expiration of such protections; and</text></paragraph><paragraph id="idb09b52a792fb41fbb3d7bd179a26b26e"><enum>(2)</enum><text>such application for renewal was complete upon submission.</text></paragraph></subsection><subsection id="id97120f8518d14ea4bbc48ea0f4fd66e4"><enum>(c)</enum><header>Rule of construction</header><text>A determination by the Under Secretary to temporarily extend protections to a qualified anti-terrorism technology pursuant to the authority provided by subsection (b) may not be construed to preclude or otherwise limit the authority of the Under Secretary to ultimately approve or deny the application for renewal of such protections. </text></subsection></section></legis-body></bill>
