which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a student loan forgiveness plan for certain borrowers who are employed at a qualified farm or ranch.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Loan Forgiveness for Farmers and Ranchers Act</short-title></quote>.</text></section><section commented="no" id="idAE919441887C4AA2971C2762B82E19D9"><enum>2.</enum><header>Loan forgiveness for farmers and ranchers</header><subsection commented="no" id="id1846319B24034010BDBC373C9165A04C"><enum>(a)</enum><header>Amendment to the HEA</header><text>Part D of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C. 1087a et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDC2346474F6F476097C03D22C78A67AD"><section commented="no" id="idFDCA7C66BF304B729EDFA715EF482412"><enum>460A.</enum><header>Loan forgiveness for farmers and ranchers</header><subsection commented="no" id="id5FE56DA1942A4B7989FBE7FFE236BB31"><enum>(a)</enum><header>Qualified farm or ranch</header><text>In this section, the term <term>qualified farm or ranch</term> means a farm or ranch with a farm number (within the meaning given the term in section 718.2 of title 7, Code of Federal Regulations, as in effect on the date of enactment of the <short-title>Student Loan Forgiveness for Farmers and Ranchers Act</short-title>). </text></subsection><subsection commented="no" id="idA216E36FF34A43829F9B05C97CDB8134"><enum>(b)</enum><header>In general</header><text>The Secretary shall cancel the balance of interest and principal due, in accordance with subsection (c), on any eligible Federal Direct Loan not in default for a borrower who—</text><paragraph commented="no" id="idD225EBA269964325B25B47CC15B19980"><enum>(1)</enum><text>at the time of initial entrance into the agricultural student loan forgiveness program— </text><subparagraph commented="no" id="idA8F4F80108864E3496EAADED1E778F68"><enum>(A)</enum><text>is—</text><clause commented="no" id="idCD64C40C7AFB4B04B19F3649BD42623B"><enum>(i)</enum><text>employed full-time or part-time as farmer or rancher with an AD–20347 form on file with the Department of Agriculture that is current on the date of the initial entrance; or </text></clause><clause commented="no" id="idCCCA9850A7494F73A3CCE42E12545351"><enum>(ii)</enum><text>employed full-time or part-time as an employee or manager of a qualified farm or ranch; and</text></clause></subparagraph><subparagraph commented="no" id="idBE00F2E54B964DC2AE12000A88C3482F"><enum>(B)</enum><text>is—</text><clause commented="no" id="idB5F315CE60474BE3A0AC9204F4A83F36"><enum>(i)</enum><text>a beginning farmer or rancher (as defined under section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>));</text></clause><clause commented="no" id="idE257AD206255447FA4DA50D376F2E78B"><enum>(ii)</enum><text>an individual from a population that is underrepresented in the agricultural profession (as determined by the Secretary), such as minorities or women;</text></clause><clause commented="no" id="idA1A6CE90C9CF47059792D1A624F0110D"><enum>(iii)</enum><text>a socially disadvantaged farmer or rancher (as defined in section 355(e) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2003">7 U.S.C. 2003(e)</external-xref>)); or</text></clause><clause commented="no" id="idCFE0522261BB41D7920D5963E435B16F"><enum>(iv)</enum><text>a veteran farmer or rancher (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)); </text></clause></subparagraph></paragraph><paragraph commented="no" id="id39A2F972CCA64CE9B872EB015399EB46"><enum>(2)</enum><text>makes 120 monthly payments on the eligible Federal Direct Loan after the date of enactment of the <short-title>Student Loan Forgiveness for Farmers and Ranchers Act</short-title>, pursuant to any one or a combination of—</text><subparagraph commented="no" id="id40A0CAB84C884F67828560F7A31A5A14"><enum>(A)</enum><text>payments under an income-based repayment plan under section 493C;</text></subparagraph><subparagraph commented="no" id="idC147F466BF804CBABA69DC21666163E9"><enum>(B)</enum><text>payments under a standard repayment plan under section 455(d)(1)(A), based on a 10-year repayment period;</text></subparagraph><subparagraph commented="no" id="id4E59B16FBA98440F91BD05CF5A2CB99C"><enum>(C)</enum><text>monthly payments under a repayment plan under subsection (d)(1) or (g) of section 455 of not less than the monthly amount calculated under section 455(d)(1)(A), based on a 10-year repayment period; or</text></subparagraph><subparagraph commented="no" id="idB872B8D578E24221AC026B68A152A92C"><enum>(D)</enum><text>payments under an income contingent repayment plan under section 455(d)(1)(D);</text></subparagraph></paragraph><paragraph commented="no" id="id6E78722B3D8B422398CC06594A173C24"><enum>(3)</enum><text>is employed full-time as an employee or manager of a qualified farm or ranch at the time of such forgiveness; and</text></paragraph><paragraph commented="no" id="idAB031443FEC34CC5BF78D62F97ABDB78"><enum>(4)</enum><text>has been employed full-time as an employee or manager of a qualified farm or ranch during the period in which the borrower makes each of the qualifying payments described in paragraph (2).</text></paragraph></subsection><subsection commented="no" id="id12CC0C37410A459E93F275747CADDB3A"><enum>(c)</enum><header>Loan cancellation amount</header><text>After the conclusion of the employment period described in subsection (b), the Secretary shall cancel the obligation to repay the balance of principal and interest due as of the time of such cancellation, on the eligible Federal Direct Loans made to the borrower under this part.</text></subsection><subsection commented="no" id="idAE214D000F5F4579BB690423363E3CBB"><enum>(d)</enum><header>Removal from the program</header><paragraph commented="no" id="id024A6E9144E3492BACC73A03D445B849"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall remove a borrower from the agricultural student loan forgiveness program if the borrower—</text><subparagraph commented="no" id="id526ECDAEE13A430480A1D89970B0E8BD"><enum>(A)</enum><text>was less than 40 years old when the borrower entered the agricultural student loan forgiveness program, and that borrower fails to be employed full-time as an employee or manager of a qualified farm or ranch for a cumulative period of more than 7 years after entering the program; or</text></subparagraph><subparagraph commented="no" id="id6FCC79E1C2A246C4AE0A2ABB6D7F1FB5"><enum>(B)</enum><text>was 40 years old or older when the borrower entered the agricultural student loan forgiveness program, and that borrower fails to be employed full-time as an employee or manager of a qualified farm or ranch for a cumulative period of more than 3 years after entering the program.</text></subparagraph></paragraph><paragraph commented="no" id="id3A8D6BBF52CE48AF9E957A4B10DC6164"><enum>(2)</enum><header>Exception for military service</header><text>The Secretary shall not consider any of the following as a period of time counting toward removal from the agricultural student loan forgiveness program for purposes of paragraph (1):</text><subparagraph commented="no" id="id35A3C3CAD24E41C48806D5A14BB8B065"><enum>(A)</enum><text>Time serving on active duty during a war or other military operation or national emergency.</text></subparagraph><subparagraph commented="no" id="idEF824408EC67425FAB13CB282686F84C"><enum>(B)</enum><text>Time performing qualifying National Guard duty during a war or other military operation or national emergency.</text></subparagraph><subparagraph commented="no" id="idCC7DDA65BC5D4DE18DE27D6410861F4F"><enum>(C)</enum><text>The 180-day period following the demobilization date for the service described in subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph commented="no" id="id16A4611923CC46A5ABF8E47EE96A1907"><enum>(3)</enum><header>Readmission prohibited</header><text>The Secretary shall not allow a borrower who has been removed from the agricultural student loan forgiveness program under this section to be readmitted to the program, unless the Secretary finds that the borrower has experienced exceptional circumstances.</text></paragraph></subsection><subsection commented="no" id="id3679FB925173447D935F077316887FFF"><enum>(e)</enum><header>Eligible Federal Direct Loan</header><text>The term <term>eligible Federal Direct Loan</term> means a Federal Direct Stafford Loan, Federal Direct PLUS Loan, or Federal Direct Unsubsidized Stafford Loan, or a Federal Direct Consolidation Loan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE45CBBDF43CA4CF095481BCAB0334B5F"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not more than 180 days after the date of enactment of this Act, the Secretary of Education, in consultation with the Secretary of Agriculture, shall promulgate final regulations to carry out the amendment made by subsection (a), including regulations relating to the process of tracking and verifying work as an employee or manager of a qualified farm or ranch for purposes of section 460A of the Higher Education Act of 1965 (as added by this Act).</text></subsection></section></legis-body></bill>
