which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to establish within the Environmental Protection Agency the Office of Mountains, Deserts, and Plains, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legacy Mine Cleanup Act of 2022</short-title></quote>.</text></section><section id="id436B39032FB24EFD95ABAA9062C6FE5B"><enum>2.</enum><header>Office of Mountains, Deserts, and Plains</header><text display-inline="no-display-inline">Title I of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E81B2E1731C4E729A21B3BFF7DCE3B5"><section id="id5F9A0967DEE546EABE06D9EAA00EEB68"><enum>129.</enum><header>Office of Mountains, Deserts, and Plains</header><subsection id="id933DF0DF2A8D4B4A8F67B574E2955162"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idC065FEBD7D534F3D8893B2B247655550"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idDF894CC090B245E896EA85DEC8D917B2"><enum>(A)</enum><text><committee-name committee-id="SSAP00">the Committee on Appropriations of the Senate;</committee-name></text></subparagraph><subparagraph id="id96F65D33D29E4C81A1A05535AE19085B"><enum>(B)</enum><text><committee-name committee-id="SSEG00">the Committee on Energy and Natural Resources of the Senate;</committee-name></text></subparagraph><subparagraph id="idDBF88A165202457DBFD22731F2330691"><enum>(C)</enum><text><committee-name committee-id="SSEV00">the Committee on Environment and Public Works of the Senate;</committee-name></text></subparagraph><subparagraph id="idA1EB97B378A94F1AB480AD4246D63562"><enum>(D)</enum><text><committee-name committee-id="SSHR00">the Committee on Health, Education, Labor, and Pensions of the Senate;</committee-name></text></subparagraph><subparagraph id="idAD650F8DAA064E40881B1DB8FDD99A67"><enum>(E)</enum><text><committee-name committee-id="SLIA00">the Committee on Indian Affairs of the Senate;</committee-name></text></subparagraph><subparagraph id="idB13A8D01CEC846E1A5CC9FACA8F91B11"><enum>(F)</enum><text><committee-name committee-id="">the Committee on Appropriations of the House of Representatives;</committee-name></text></subparagraph><subparagraph id="idE8E29A9026F043D0B036C8055A26A7D6"><enum>(G)</enum><text><committee-name committee-id="">the Committee on Energy and Commerce of the House of Representatives;</committee-name></text></subparagraph><subparagraph id="id260FAFCA6DB54B398F531ECFCED48A59"><enum>(H)</enum><text><committee-name committee-id="">the Committee on Transportation and Infrastructure of the House of Representatives;</committee-name></text></subparagraph><subparagraph id="id2B46C161E9AE4054B5ACFF5D7EBA84BE"><enum>(I)</enum><text><committee-name committee-id="">the Committee on Natural Resources of the House of Representatives; and</committee-name></text></subparagraph><subparagraph id="idDBA55456AF2840EBBA635B56271E6DDD"><enum>(J)</enum><text><committee-name committee-id="">the Committee on Oversight and Reform of the House of Representatives.</committee-name></text></subparagraph></paragraph><paragraph id="id082AD0FAF2224B20987A119D7A3292E1"><enum>(2)</enum><header>Covered mine</header><text>The term <term>covered mine</term> means an abandoned hardrock mine site.</text></paragraph><paragraph id="iddc1c12fabebe406b8206fd29bf49e793" commented="no"><enum>(3)</enum><header>Eligible non-<enum-in-header>NPL</enum-in-header> site</header><text>The term <term>eligible non-NPL site</term> means a site—</text><subparagraph id="idcabf11e59fdd4ef786d4c16c743bdd1d" commented="no"><enum>(A)</enum><text>that is not on the National Priorities List; but</text></subparagraph><subparagraph id="id7c8176755b5448768b777940d86b3308" commented="no"><enum>(B)</enum><text>with respect to which the Administrator determines that—</text><clause id="idabee1347f9154521b952d22a732c69ae" commented="no"><enum>(i)</enum><text>the site would be eligible for listing on the National Priorities List based on the presence of hazards from contamination at the site, applying the hazard ranking system described in section 105(c); and</text></clause><clause id="idb80110638438443b954cb83cf1971f59" commented="no"><enum>(ii)</enum><text>for removal site evaluations, engineering evaluations/cost analyses, remedial planning activities, remedial investigations and feasibility studies, and other actions taken pursuant to section 104(b), the site—</text><subclause commented="no" id="idF32A0837D4EF41E78C717C1B94CB3254"><enum>(I)</enum><text>has undergone a pre-CERCLA screening; and </text></subclause><subclause commented="no" id="id636B7DDE6615444287F4821489F62F98"><enum>(II)</enum><text>is included in the Superfund Enterprise Management System.</text></subclause></clause></subparagraph></paragraph><paragraph id="idDD73555331FE45E2B1F41AE8A4977D1E"><enum>(4)</enum><header>Navajo Nation abandoned uranium mine site</header><text>The term <term>Navajo Nation abandoned uranium mine site</term> means an abandoned uranium mine site on land of the Navajo Nation. </text></paragraph><paragraph id="id697E091769B04F0DB88813E7CB86C548"><enum>(5)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Mountains, Deserts, and Plains established by subsection (b)(1).</text></paragraph><paragraph id="id0B6629AFD2A24CCF92E1520C4A946CAF"><enum>(6)</enum><header>Regional Office</header><text>The term <term>Regional Office</term> means a Regional Office of the Environmental Protection Agency.</text></paragraph></subsection><subsection id="id69fc140128474951963066a249260676"><enum>(b)</enum><header>Establishment</header><paragraph id="idf18ce04f5b3f437184035bc2136bc064"><enum>(1)</enum><header>In general</header><text>There is established within the Environmental Protection Agency the Office of Mountains, Deserts, and Plains.</text></paragraph><paragraph id="id1d489952dafa4bcb8eff4ec3a93fbdd2"><enum>(2)</enum><header>Director</header><text>The Office shall be headed by a Director, to be appointed by the Administrator (or a designee). </text></paragraph></subsection><subsection id="id0873413b3814403aa1f44ac44b4a9941"><enum>(c)</enum><header>Purposes</header><text>The purposes of the Office shall be—</text><paragraph id="id0908c7d4f8954370aee61c84c86d0b05"><enum>(1)</enum><text>to coordinate and provide oversight over response actions of the Environmental Protection Agency carried out at a covered mine in accordance with this Act;</text></paragraph><paragraph id="id1f15fe6051224153915b627899f91637"><enum>(2)</enum><text>to establish and disseminate best practices for covered mine response actions, including identifying innovative technologies and reuse approaches that support those response actions;</text></paragraph><paragraph id="id1ccea735dd764ed19bd7d4006de36cde"><enum>(3)</enum><text>to collaborate with Regional Offices, Federal land management agencies, States, and voluntary nongovernmental organizations, watershed groups, nonliable mining companies, and other entities to facilitate voluntary response actions at covered mines;</text></paragraph><paragraph id="idc0617ad076eb4aad9e55da3bf06be2f3"><enum>(4)</enum><text>to lead Environmental Protection Agency efforts to coordinate and expedite the completion of response actions at covered mines on Tribal land, including Navajo Nation abandoned uranium mine sites; </text></paragraph><paragraph id="id31fe7d18020f425ebddbee332a8d5a4f"><enum>(5)</enum><text>to coordinate with the Secretary of the Interior, the Secretary of Energy, the Secretary of Health and Human Services, the Nuclear Regulatory Commission, and other Federal agencies, as the Administrator determines to be appropriate, to ensure interagency coordination of covered mine response actions, with priority given to coordinating, and where possible, combining, Federal efforts to fund response actions at covered mines for which there is no potentially responsible party; and</text></paragraph><paragraph id="id1f8a4274de844e7a9ca8e47f1e0db07d"><enum>(6)</enum><text>to carry out other actions, as determined to be necessary by the Administrator—</text><subparagraph id="idBD89058F5DBF4FC292385424CEEF90C3"><enum>(A)</enum><text>to support efforts to investigate, characterize, or cleanup a discharge, release, or threat of release of a hazardous substance, pollutant, or contaminant into the environment at or from a covered mine; or </text></subparagraph><subparagraph id="id7E7D70B0B0174B9E8DB3F37A5BF8930D"><enum>(B)</enum><text>to otherwise protect and improve human health and the environment.</text></subparagraph></paragraph></subsection><subsection id="idce759022c1ce445fa648aec4686b97ed"><enum>(d)</enum><header>Duties</header><text>The Administrator shall carry out through the Office, at a minimum, the following duties:</text><paragraph id="id76d343abad944dc4b17b0168bd67a154"><enum>(1)</enum><header>Emphasis list</header><subparagraph id="ida7490e11e07149398a0c6101d374b162"><enum>(A)</enum><header>In general</header><text>The Administrator shall establish a list of covered mines that are prioritized for response actions under this Act.</text></subparagraph><subparagraph id="id35d8cc2eb7cb4a00b68ed4ab9a7f0693"><enum>(B)</enum><header>Updates; reports</header><text>The Administrator shall annually—</text><clause id="idd3c08745dae64488b3607c3e7a03013d"><enum>(i)</enum><text>update the list under subparagraph (A); and</text></clause><clause id="id76ded198bab8462bad6d2662eca03c24"><enum>(ii)</enum><text>submit to the appropriate committees of Congress a report describing the covered mines on the list.</text></clause></subparagraph><subparagraph id="id7e6c64d8d8c446a1953c9bd63654de08"><enum>(C)</enum><header>Coordination</header><text>The Administrator shall—</text><clause id="idb34262420f89470b85b69082ab2aa540"><enum>(i)</enum><text>regularly coordinate with Regional Offices, Federal agencies, States, Indian tribes, and stakeholders to make progress with respect to the covered mines on the list under subparagraph (A); and</text></clause><clause id="id0072a2ea50f943ab835b52606e23aa0d"><enum>(ii)</enum><text>ensure that Regional Offices make progress with respect to each covered mine on the list.</text></clause></subparagraph></paragraph><paragraph id="id6de02b93e0a24028be5147ad3dfcbe4d"><enum>(2)</enum><header>Community engagement</header><text>The Administrator shall—</text><subparagraph id="id47c06047078e4609a59b2eff9a193c76"><enum>(A)</enum><text>maintain and update, as needed, best practices for engaging with local communities with respect to response actions on covered mines; and</text></subparagraph><subparagraph id="idde9a89b85f4443489510fae73a257072"><enum>(B)</enum><text>coordinate with Regional Offices to support engagement with local communities described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id297b417ce7e94ce7886871b26d1af7a4"><enum>(3)</enum><header>Process improvement</header><subparagraph id="id34d0a5ad397a41c89d4332bddc7a8d12"><enum>(A)</enum><header>In general</header><text>The Administrator shall—</text><clause id="id9b5fda11519f4b93bbc1e3f71bbd4bab"><enum>(i)</enum><text>establish a standard process for developing, reviewing, and approving site assessments, remedial investigations, and feasibility studies for covered mines;</text></clause><clause id="id265a76edcdbb40e48749941043445a5e"><enum>(ii)</enum><text>conduct research of, and identify, technologies and remedial and removal approaches that are the most successful in limiting the acute and chronic risks posted to human health and the environment by covered mines;</text></clause><clause id="id4734ac4664224ee68a78aee0ddf2f2dd"><enum>(iii)</enum><text>to the extent technically feasible, establish remedial and removal standards for various types of covered mines, including type of mineral and design; and</text></clause><clause id="idecebc6a4a1214f5a9897f238e2a9f209"><enum>(iv)</enum><text>support—</text><subclause id="idF95992E4B2FD4815BFE1EB3963D06DF9"><enum>(I)</enum><text>consultations with Indian tribes with respect to covered mines; and</text></subclause><subclause id="idB319F5A6FA8743F6A78F2FF3338CD5BD"><enum>(II)</enum><text>efforts to provide regular updates to all levels a Tribal government with respect to response actions for covered mines.</text></subclause></clause></subparagraph><subparagraph id="id7f88a070124e4dfd875e9bbb611d2d41"><enum>(B)</enum><header>Tribal consultation</header><text>In supporting consultations with Indian tribes under subparagraph (A)(iv)(I), the Administrator shall—</text><clause id="id77de9c2d142d4dcbbdea8199ac677e71"><enum>(i)</enum><text>share all available covered mine data with Tribal partners; and</text></clause><clause id="idf5d51fcb6f8c496f9d086c237f83768c"><enum>(ii)</enum><text>ensure that Tribal allottee right-of-way regulations of the Eastern Regional Office of the Bureau of Indian Affairs are followed.</text></clause></subparagraph></paragraph><paragraph id="idc198eac0d260489d8fd958e96ddab8a7"><enum>(4)</enum><header>Interagency plan to address uranium contamination on the Navajo Nation</header><text>Not later than 1 year after the date of enactment of this section, and not less frequently than once every 5 years thereafter, the Administrator, in consultation with all levels of affected Tribal governments, shall prepare and submit to the appropriate committees of Congress a report describing a multi-year interagency plan for the coordination of the Federal Government with States and Tribal governments to carry out response actions at Navajo Nation abandoned uranium mine sites, including—</text><subparagraph id="id33a2fcfecbb94fde9047222f67f61824"><enum>(A)</enum><text>goals for the assessment of, and response actions at, Navajo Nation abandoned uranium mine sites;</text></subparagraph><subparagraph id="id74db7ef18e5448c28b1cc087b05b9142"><enum>(B)</enum><text>target dates by which goals described in subparagraph (A) are anticipated to be achieved; and</text></subparagraph><subparagraph id="id109010e082dc493eb7bd354fa7d471af"><enum>(C)</enum><text>the activities to be carried out by each Federal agency under the plan.</text></subparagraph></paragraph><paragraph id="id1cbb59e6934a4af1a3cd8637068c4f18"><enum>(5)</enum><header>Administrative and technical assistance</header><text>The Administrator shall, as appropriate, provide to States, units of local government, Indian tribes, and other entities technical assistance with respect to response actions on covered mines.</text></paragraph></subsection><subsection id="id447248663745433d876076bbc5ab2f93"><enum>(e)</enum><header>Authorization of appropriations for superfund actions at abandoned hardrock mining sites on Tribal land</header><paragraph id="ide08f19016c8943bead0732142d198a76"><enum>(1)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise available, there are authorized to be appropriated for each of fiscal years 2023 through 2032, to remain available until expended—</text><subparagraph id="id6351691bc45347509d065869276484b4"><enum>(A)</enum><text>$97,000,000 to the Administrator to carry out this subsection (except for paragraph (3)); and</text></subparagraph><subparagraph id="id0407940216054e2298ad460e953ced5f"><enum>(B)</enum><text>$3,000,000 to the Administrator of the Agency for Toxic Substances and Disease Registry to carry out paragraph (3).</text></subparagraph></paragraph><paragraph id="id0f1d0a6a45f44a4dbad1c108458ed13b"><enum>(2)</enum><header>Uses of amounts</header><text>Amounts appropriated under paragraph (1)(A) shall be used by the Administrator—</text><subparagraph id="id84f792007e5b43b080c6fa313cc424a1"><enum>(A)</enum><text>to carry out removal actions on abandoned hardrock mine land located on Tribal land;</text></subparagraph><subparagraph id="idb8ea860320a14e018ac7785f70f9a584"><enum>(B)</enum><text>to carry out response actions, including removal and remedial planning activities, removal and remedial studies, remedial actions, and other actions taken pursuant to section 104(b) on abandoned hardrock mine land located on Tribal land at—</text><clause id="id2afc955294af41efa70c1dc491f4abb8"><enum>(i)</enum><text>eligible non-NPL sites; and</text></clause><clause id="id77f127a8fc1f4f2088b62f19949e9f36"><enum>(ii)</enum><text>sites listed on the National Priorities List; and</text></clause></subparagraph><subparagraph id="id909fe396f4f84f00b46dc85ae54c22b6"><enum>(C)</enum><text>to make grants under paragraph (4).</text></subparagraph></paragraph><paragraph id="id68577b898670445eb5baf64fd8bae120"><enum>(3)</enum><header>Health assessments</header><text>Subject to the availability of appropriations, the Agency for Toxic Substances and Disease Registry, in coordination with Tribal health authorities, shall perform 1 or more health assessments at each eligible non-NPL site that is located on Tribal land.</text></paragraph><paragraph id="id8f5308490260419cb11fd559419a6079"><enum>(4)</enum><header>Tribal grants</header><subparagraph id="id3ae496acc6ca4c73987a334368d4f536"><enum>(A)</enum><header>In general</header><text>The Administrator may use amounts appropriated under paragraph (1)(A) to make grants to eligible entities for the purposes described in subparagraph (C).</text></subparagraph><subparagraph id="id0667ae413afe4a6a8267d4f89c86209f"><enum>(B)</enum><header>Eligible entities</header><text>An entity that is eligible to receive a grant under this paragraph is—</text><clause id="idd7b3c2c2e8264f74b86c5d1819f5f13d"><enum>(i)</enum><text>the governing body of an Indian tribe; and</text></clause><clause id="id6f52f29f432a4c3a96dc369acb0e0784"><enum>(ii)</enum><text>a legally established organization of Indians that—</text><subclause id="id1cfb0fa727be47fa91c5fc90420d17f3"><enum>(I)</enum><text>is controlled, sanctioned, or chartered by the governing bodies of 1 or more Indian tribes to be served, or that is democratically elected by the adult members of the Indian community to be served, by that organization; and</text></subclause><subclause id="id8b66544d93ba40c189eb14acb438699b"><enum>(II)</enum><text>includes the maximum participation of Indians in all phases of the activities of that organization.</text></subclause></clause></subparagraph><subparagraph id="idd772a00349a242e5835631c0116635de"><enum>(C)</enum><header>Use of grant funds</header><text>A grant under this paragraph shall be used—</text><clause id="id5551a0d3d7b04cf887da596fb089eb47"><enum>(i)</enum><text>for carrying out activities in accordance with the second sentence of section 117(e)(1);</text></clause><clause id="id4bc043a089ca4104ab53c283b16fc00b"><enum>(ii)</enum><text>for obtaining technical assistance in carrying out response actions under clause (iii); or</text></clause><clause id="idd5deeb4b95274e6da14591539a6b954f"><enum>(iii)</enum><text>for carrying out response actions, if the Administrator determines that the Indian tribe has the capability to carry out any or all of those response actions in accordance with the criteria and priorities established pursuant to section 105(a)(8).</text></clause></subparagraph><subparagraph id="id3da900fb27444fbb960f3b7e7b1279de"><enum>(D)</enum><header>Applications</header><text>To be eligible to receive a grant under this paragraph, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph id="id10241a033a56493981e14fcd98cfa077"><enum>(E)</enum><header>Cost share</header><text>The Federal share of the cost of activities carried out using a grant under this paragraph shall be 100 percent.</text></subparagraph></paragraph><paragraph id="id89897fd77ce84089ac9141a9786648ae"><enum>(5)</enum><header>Statute of limitations</header><text>If a response action described in paragraph (2)(B) is scheduled at an eligible non-NPL site, no action may be commenced for damages with respect to that eligible non-NPL site unless the action is commenced within the timeframe provided for such actions with respect to facilities on the National Priorities List in the first sentence of the matter following subparagraph (B) of section 113(g)(1).</text></paragraph><paragraph id="id5037166a34514c72b1ba3663dda113b3"><enum>(6)</enum><header>Coordination</header><text>The Administrator shall coordinate with the Indian tribe on whose land the applicable site is located in—</text><subparagraph id="id0f075d99e20a4a44a5442b6afb2e256d"><enum>(A)</enum><text>selecting and prioritizing sites for response actions under subparagraphs (A) and (B) of paragraph (2); and</text></subparagraph><subparagraph id="id46dedd4db2c7420f8cb301916a380ab0"><enum>(B)</enum><text>carrying out those response actions.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id05F232EB3B0043D3872C8D1616FE7E80"><enum>3.</enum><header>Abandoned and inactive noncoal mine restoration</header><text display-inline="no-display-inline">Section 560 of the Water Resources Development Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/33/2336">33 U.S.C. 2336</external-xref>) is amended—</text><paragraph id="id78B0C9C8301840BC835DE2722371B8A8"><enum>(1)</enum><text>in subsection (c), by inserting <quote>or on land taken into trust by the Secretary of the Interior on behalf of, and for the benefit of, an Indian Tribe</quote> after <quote>land owned by the United States</quote>; and</text></paragraph><paragraph id="id3E488CD32E194435BB286A32AB083715"><enum>(2)</enum><text>in subsection (f), by striking <quote>$30,000,000</quote> and inserting <quote>$50,000,000</quote>.</text></paragraph></section></legis-body></bill>
