which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To create a moratorium on the government use of facial recognition technology until a Commission recommends the appropriate guidelines and limitation for use of facial recognition technology.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ethical Use of Facial Recognition Act</short-title></quote>. </text></section><section id="idF11453CDB5444B998FD90B68ED625102"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="ide245f79faf8e4026b8452a60a54b5ec6"><enum>(1)</enum><text>Facial recognition is a technology that is increasingly being used and marketed to law enforcement agencies across the United States without appropriate debate or consideration of its impacts.</text></paragraph><paragraph id="id90df967b757241918fa75e7a6afbca5a"><enum>(2)</enum><text>Facial recognition has been shown to disproportionately impact communities of color, activists, immigrants, and other groups that are often already unjustly targeted.</text></paragraph><paragraph id="id29b9dd568f934889b2f6e64a3d3eb0b8"><enum>(3)</enum><text>Facial recognition has a history of being inaccurate, particularly for women, young people, African Americans, and other ethnic groups.</text></paragraph><paragraph id="idba51f8e1d7c541b8aa82469ab31d92bb"><enum>(4)</enum><text>There is evidence that facial recognition has been used at protests and rallies, which could chill speech.</text></paragraph><paragraph id="id499766ceb3b14604a85daf68d9eb9812"><enum>(5)</enum><text>It is critical that facial recognition not be used to suppress First Amendment related activities, violate privacy, or otherwise adversely impact individuals’ civil rights and civil liberties.</text></paragraph></section><section id="id8E651E10E46945599F49D73A5FB66D93"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idBAC49376957947478106E403DB5772E1"><enum>(1)</enum><header display-inline="yes-display-inline">Commission</header><text>The term <term>Commission</term> means the congressional commission established under section 6. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id762C78E1B63E47329D0E07DE2D984402"><enum>(2)</enum><header display-inline="yes-display-inline">Covered government official</header><text display-inline="yes-display-inline">The term <term>covered government official</term> means any officer, employee, or contractor of a Federal agency. </text></paragraph><paragraph id="idABB85653FAD04F07BBF12D5A32B595AC"><enum>(3)</enum><header>Facial recognition technology</header><text>The term <term>facial recognition technology</term> means the automated or semi-automated process that assists in identifying or verifying an individual based on the characteristics of an individual’s face.</text></paragraph><paragraph id="idA6C7C9D2BB264289B67439BEC5A2122E"><enum>(4)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code. </text></paragraph><paragraph id="id7F945684B3524E6CB2069D091E3F34C9"><enum>(5)</enum><header>Implementation bill</header><text>The term <term>implementation bill</term> means a bill—</text><subparagraph id="idFD841955B4814F86843C0223B87B7367"><enum>(A)</enum><text>consisting of the legislative language prepared under section 6(e)(1)(A); and</text></subparagraph><subparagraph id="idF3C9EDB27482425EBA086840955127B2"><enum>(B)</enum><text>introduced under section 6(e)(1)(B). </text></subparagraph></paragraph></section><section id="idE914294702FC4C5FBCAC6C8C447DACEE"><enum>4.</enum><header>Limits on use of facial recognition technology</header><text display-inline="no-display-inline">A covered government official may not set up any camera to be used in connection with facial recognition technology, access or use information obtained from facial recognition technology, or import facial recognition technology to identify an individual in the United States without a warrant until the date on which Congress enacts legislation implementing the guidelines for use of facial recognition technology established by the Commission under section 6.</text></section><section id="idB1BDB300BA7C49A3BD240134D8C4F54C"><enum>5.</enum><header>Enforcement</header><subsection commented="no" id="id734d9dc16adf41479c79d8a6746f9b88"><enum>(a)</enum><header>Civil action</header><text>Any person aggrieved by a violation of section 4 by a covered government official may bring a civil action for injunctive or declaratory relief in the appropriate district court of the United States.</text></subsection><subsection id="id169F2275F248407089D050C89D18D60F"><enum>(b)</enum><header>Limitation on Federal grants</header><text>Notwithstanding any other provision of law, no Federal funds may be used by a State or unit of local government to invest in facial recognition software, purchase facial recognition technology services, or acquire images for use in facial recognition technology systems.</text></subsection></section><section id="idB8C7DDEAE7DE440E9DDAB7075D649394"><enum>6.</enum><header>Commission</header><subsection id="id996360A9145C4851AE8D7A46913BE9A4"><enum>(a)</enum><header>In general</header><text>There is established a congressional commission to consider and create guidelines for the use of facial recognition technology in the United States. </text></subsection><subsection id="idDF7564DDDECC4EC08E973189065011AA"><enum>(b)</enum><header>Membership</header><paragraph id="idF4587DF5D02A4468A97DF6E2B5B531F1"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of 13 members, of whom—</text><subparagraph id="id1EDDC83576824B1BB6EF1BB18145AB17"><enum>(A)</enum><text>1 member shall be appointed by the President, and such member shall serve as the Chairperson of the Commission; </text></subparagraph><subparagraph id="idA6DB5337F42A411AB0E88B954C7EEC77"><enum>(B)</enum><text>3 members shall be appointed by the majority leader of the Senate;</text></subparagraph><subparagraph id="idAA35EF63D8A04B0A8C1EEFCF05D07B9D"><enum>(C)</enum><text>3 members shall be appointed by the minority leader of the Senate; </text></subparagraph><subparagraph id="id59F2B22783204041A68B8E0973E12397"><enum>(D)</enum><text>3 members shall be appointed by the Speaker of the House of Representatives; and</text></subparagraph><subparagraph id="id4FC8AA64EDDA48A98908EA17E9E9E563"><enum>(E)</enum><text>3 members shall be appointed by the minority leader of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idBFB850BE98ED45D687124A4FD108139D"><enum>(2)</enum><header>Expertise of members</header><subparagraph id="id41C7746078294EB5BF33E067137825AE"><enum>(A)</enum><header>In general</header><text>Members appointed under paragraph (1) shall represent each of the following groups:</text><clause id="id9eba66bbd1224ef1ad48c48b6cad6f25"><enum>(i)</enum><text>Law enforcement and immigration enforcement officials.</text></clause><clause id="id596725DEC6034863971037C0FA76066C"><enum>(ii)</enum><text>Privacy and technology experts.</text></clause><clause id="id03A5544D7A43487EA15CEA36208C7328"><enum>(iii)</enum><text>Communities most impacted negatively by the use of facial recognition technology. </text></clause></subparagraph><subparagraph id="id4ECD664E0FFF4BD98EE59AD7792A59B4"><enum>(B)</enum><header>Requirement</header><text>Not fewer than 7 members of the Commission shall be representatives of the group described in subparagraph (A)(iii). </text></subparagraph></paragraph></subsection><subsection id="idDEBDB98C3A9C4AE89C21E408BE387CC2"><enum>(c)</enum><header>Duties</header><text>The Commission shall—</text><paragraph id="idBCE02EAAA8BB47198B64B2461F985B6B"><enum>(1)</enum><text>consider and create guidelines and limitations for the use of facial recognition technology in the United States to ensure that the use of such technology does not—</text><subparagraph id="id665C1077C2E849CF9E12D3D573A0FC02"><enum>(A)</enum><text>create a constant state of surveillance of individuals in the United States that does not allow for a level of reasonable anonymity; </text></subparagraph><subparagraph id="id19E7D2C71A54455DA9278EE0EC60DA01"><enum>(B)</enum><text>produce biased or inaccurate results; </text></subparagraph><subparagraph id="id36E06B2D6F844C38BF0D23BD66BE7EF0"><enum>(C)</enum><text>disproportionately impact a racial, ethnic, national origin group, or other protected class of individuals; </text></subparagraph><subparagraph id="id2B9EE1B7F8BF40F3B17C113D0B898126"><enum>(D)</enum><text>impinge on the privacy, free speech, or due process rights of individuals in the United States; or</text></subparagraph><subparagraph id="id8881332994A440B9864B9366CAFAAE93"><enum>(E)</enum><text>limit the ability of law enforcement officers to track down missing and exploited children and trafficked individuals; and</text></subparagraph></paragraph><paragraph id="id53D62E8352D64604B9315EE6013C58A7"><enum>(2)</enum><text>consider and recommend the appropriate rules for governing the use and limitations on both government and commercial use of facial recognition technology, including—</text><subparagraph id="idEE384D07ED93469CB3BAB631A1A33F28"><enum>(A)</enum><text>whether there are appropriate uses for facial recognition technology without a warrant by government officials in a private or public space; </text></subparagraph><subparagraph id="idAA2E3E7A91DF43FF91A7A6B4E0016B60"><enum>(B)</enum><text>what are the appropriate uses and limitations for commercial use, including what rights individuals should have relating to the data produced and the use of their likeness in facial recognition technology; </text></subparagraph><subparagraph id="idee83453c24c448848f2257429155d0ee"><enum>(C)</enum><text>in what circumstances, if any, government officials should be permitted to use facial recognition without a warrant;</text></subparagraph><subparagraph id="id61175e3d4f6848f1b4d26fda3797a62f"><enum>(D)</enum><text>what rules should govern how and where images may be acquired through facial recognition technology, taking into account individuals’ reasonable expectations of privacy or anonymity;</text></subparagraph><subparagraph id="id8c963029b56f47218ac8cfb850c05a8a"><enum>(E)</enum><text>in what situations individuals should be able to opt out or required to opt in to the use of facial recognition technology;</text></subparagraph><subparagraph id="id585d9e5aff774cdc881efdc12f355b54"><enum>(F)</enum><text>what safeguards need to be put in place to prevent abuse of facial recognition technology;</text></subparagraph><subparagraph id="id81f8b2d684da47f8866272a7eefdc545"><enum>(G)</enum><text>what are appropriate remedies when facial recognition technology is misused; and</text></subparagraph><subparagraph id="id31d0ea4e7c8b464a99fafc844898bd3e"><enum>(H)</enum><text>what rights individuals have relating to the data produced and the use of their likeness in facial recognition technology. </text></subparagraph></paragraph></subsection><subsection id="id5EBD828B09C542DFA85C657193332AB3"><enum>(d)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall submit a report to Congress that contains—</text><paragraph id="idAE941FEAF3A94F9BA234D492C73C1D6E"><enum>(1)</enum><text>the guidelines required to be created under subsection (c); </text></paragraph><paragraph id="idFB918F3841EF499BAE00D7AAB1674CB9"><enum>(2)</enum><text>recommendations for implementation of such guidelines; and</text></paragraph><paragraph id="id59D246F367904E7296724BACF73E7A51"><enum>(3)</enum><text>any minority views or recommendations of the Commission. </text></paragraph></subsection><subsection id="id6D462D04620246779B5742186FFD1596"><enum>(e)</enum><header>Implementation</header><paragraph id="id523fcf3477a04de993e1ca0508108002"><enum>(1)</enum><header>Introduction</header><text>Not later than 90 days after the date on which the report required under subsection (d) is submitted to Congress—</text><subparagraph id="id38BDE58F66624BB8A2240C7FC0B4A81B"><enum>(A)</enum><text>Congress shall prepare legislative language to implement the recommendations included in such report; and</text></subparagraph><subparagraph id="idB5E151E10DE54C02A5C6090A511A9AD2"><enum>(B)</enum><text>the legislative language prepared under subparagraph (A)—</text><clause id="idd44a9d09142e44159aed129d12aa0736"><enum>(i)</enum><text>shall be introduced in the Senate (by request) not later than the third day on which the Senate is in session after the date on which the Commission approves the legislative language by the majority leader of the Senate or by a Member of the Senate designated by the majority leader of the Senate; and</text></clause><clause id="id981b8656b9324eab8fc7e4028b56b66b"><enum>(ii)</enum><text>shall be introduced in the House of Representatives (by request) not later than the third day on which the House of Representatives is in session after the date on which the Commission approves the legislative language by the majority leader of the House of Representatives or by a Member of the House of Representatives designated by the majority leader of the House of Representatives.</text></clause></subparagraph></paragraph><paragraph id="id60702c38a2d34252b888824ce9c4818e"><enum>(2)</enum><header>Consideration in the House of Representatives</header><subparagraph id="id12abffcf98274bdfb44d7e378e612fec"><enum>(A)</enum><header>Referral and reporting</header><text>Any committee of the House of Representatives to which an implementation bill is referred shall report it to the House not later than 3 days after the date on which the implementation bill is introduced in the House of Representatives. If a committee fails to report an implementation bill within that period, it shall be in order to move that the House of Representatives discharge the committee from further consideration of the bill. Such a motion shall not be in order after the last committee authorized to consider the bill reports it to the House of Representatives or after the House of Representatives has disposed of a motion to discharge the bill. The previous question shall be considered as ordered on the motion to its adoption without intervening motion except 20 minutes of debate equally divided and controlled by the proponent and an opponent. If such a motion is adopted, the House of Representatives shall proceed immediately to consider the implementation bill in accordance with subparagraphs (B) and (C). A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></subparagraph><subparagraph id="id9a76a074bac841c3a48e09c02223e959"><enum>(B)</enum><header>Proceeding to consideration</header><text>After the last committee authorized to consider an implementation bill reports it to the House of Representatives or has been discharged from its consideration, it shall be in order to move to proceed to consider the implementation bill in the House of Representatives. Such a motion shall not be in order after the House of Representatives has disposed of a motion to proceed with respect to the implementation bill. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></subparagraph><subparagraph id="idfd6bc02a602a419f86701e04aa16d64b"><enum>(C)</enum><header>Consideration</header><text>An implementation bill shall be considered as read. All points of order against an implementation bill and against its consideration are waived. The previous question shall be considered as ordered on an implementation bill to its passage without intervening motion except 2 hours of debate equally divided and controlled by the proponent and an opponent and one motion to limit debate on an implementation bill. A motion to reconsider the vote on passage of an implementation bill shall not be in order.</text></subparagraph></paragraph><paragraph id="id29d19efdead440799962a0e2bdc1ea49"><enum>(3)</enum><header>Expedited procedure in the senate</header><subparagraph id="id42545fd511db430d9ec51dcaea3793ee"><enum>(A)</enum><header>Committee consideration</header><text>An implementation bill introduced in the Senate under paragraph (1) shall be jointly referred to the committee or committees of jurisdiction, which committees shall report the bill and with a favorable recommendation, an unfavorable recommendation, or without recommendation not later than 3 days after the date on which the implementation bill is introduced. If any committee fails to report an implementation bill within that period, that committee shall be automatically discharged from consideration of the bill, and the implementation bill shall be placed on the appropriate calendar.</text></subparagraph><subparagraph id="id3b2061a49dde470b9022342593a7d81f"><enum>(B)</enum><header>Motion to proceed</header><text>Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than 3 days of session after the date on which an implementation bill is reported or discharged from all committees to which it was referred, for the majority leader of the Senate or the majority leader’s designee to move to proceed to the consideration of the implementation bill. It shall also be in order for any Member of the Senate to move to proceed to the consideration of the implementation bill at any time after the conclusion of such 3-day period. A motion to proceed is in order even though a previous motion to the same effect has been disagreed to. All points of order against the motion to proceed to an implementation bill are waived. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order. If a motion to proceed to the consideration of an implementation bill is agreed to, the implementation bill shall remain the unfinished business until disposed of.</text></subparagraph><subparagraph id="id2405466bb53c45f28a3ae2d300ab06d1"><enum>(C)</enum><header>Consideration</header><text>All points of order against an implementation bill and against consideration of the implementation bill are waived. Consideration of an implementation bill, including amendments thereto, and debatable motions and appeals in connection therewith shall not exceed a total of 30 hours which shall be divided equally between the majority and minority leaders or their designees. A motion further to limit debate on an implementation bill is in order, shall require an affirmative vote of a majority of the Members duly chosen and sworn, and is not debatable. Any debatable motion or appeal is debatable for not to exceed 1 hour, to be divided equally between those favoring and those opposing the motion or appeal. All time used for consideration of an implementation bill, including time used for quorum calls and voting, shall be counted against the total 30 hours of consideration.</text></subparagraph><subparagraph commented="no" id="id3b7145d6903e470baedaf88532720e72"><enum>(D)</enum><header>Limitations on consideration</header><text>A motion to postpone, or a motion to recommit the implementation bill or a motion to proceed to the consideration of other business is not in order.</text></subparagraph><subparagraph id="ida71d7701612743edaee465e6e2b42722"><enum>(E)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate, as the case may be, to the procedure relating to an implementation bill shall be decided without debate.</text></subparagraph></paragraph><paragraph id="id8de53fbd29794699bd8d43c403769f95"><enum>(4)</enum><header>Consideration by the other house</header><subparagraph id="id75ed25103fa84b10b98b922d7c3b8b29"><enum>(A)</enum><header>In general</header><text>If, before passing an implementation bill, one House receives from the other the implementation bill—</text><clause id="idd2aa12fd7dd84835b229333880719775"><enum>(i)</enum><text>the implementation bill of the other House shall be referred to a committee; and</text></clause><clause id="ida934da4b9e374dc3a34a04da5c884de1"><enum>(ii)</enum><text>the procedure in the receiving House shall be the same as if no implementation bill had been received from the other House.</text></clause></subparagraph></paragraph><paragraph id="id7c076e08ac6d49d8b90b14bd8c29fdbe"><enum>(5)</enum><header>Rules to coordinate action with other house</header><subparagraph id="idb408fa0e4c8a4290a17500c9a13f9bab"><enum>(A)</enum><header>Treatment of implementation bill of other house</header><text>If the Senate fails to introduce or consider an implementation bill under this section, the implementation bill of the House of Representatives shall be entitled to expedited floor procedures under this section.</text></subparagraph><subparagraph commented="no" id="id8b6eabbb17324c44927642e3982d726a"><enum>(B)</enum><header>Treatment of companion measures in the Senate</header><text>If following passage of an implementation bill in the Senate, the Senate then receives the implementation bill from the House of Representatives, the House-passed implementation bill shall not be debatable. The vote on passage of the implementation bill in the Senate shall be considered to be the vote on passage of the implementation bill received from the House of Representatives.</text></subparagraph></paragraph><paragraph id="id58cfeec7918f4478b5001098f91c4a0f"><enum>(6)</enum><header>Vetoes</header><text>If the President vetoes an implementation bill, debate on a veto message in the Senate under this section shall be 1 hour equally divided between the majority and minority leaders or their designees.</text></paragraph></subsection></section></legis-body></bill>
