 partners and individuals subject to restraining orders</header><subsection id="id8521F4CAC0D64EBA993D7C1BA70125F0"><enum>(a)</enum><header>Definition</header><text>Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="id6587282F03654B02B2C672D5EB489EE0"><enum>(1)</enum><text>by striking paragraph (32) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0B83BBE040A242A8B5FBF2FF171F2798"><paragraph id="idD153F9343B884ABEB3C45F9DB156663A" indent="up1"><enum>(32)</enum><text>The term <term>intimate partner</term>—</text><subparagraph id="id3823C1D3D3EC455BB6EA696F8E1E79A0"><enum>(A)</enum><text>means with respect to a person, the spouse of the person, a former spouse of the person, an individual who is a parent of a child of the person, and an individual who cohabitates or has cohabited with the person; and</text></subparagraph><subparagraph id="id4B2CC73DEB844B7D998D10B91D19C1A8"><enum>(B)</enum><text>includes—</text><clause id="id5209DFB388D14A82BC810789DB09C487"><enum>(i)</enum><text>a dating partner or former dating partner (as defined in section 2266); and</text></clause><clause id="id6928AF69E66B413590B7504C8C8B8C39"><enum>(ii)</enum><text>any other person similarly situated to a spouse who is protected by the domestic or family violence laws of the State or tribal jurisdiction in which the injury occurred or where the victim resides.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8A16715642B94F7B8187FDEE4ACF7C07"><enum>(2)</enum><text>in paragraph (33)(A)—</text><subparagraph id="id99A4AB18AFA64CF6A5D5055B5F206AAF"><enum>(A)</enum><text>in clause (i), by inserting <quote>municipal,</quote> after <quote>State,</quote>; and</text></subparagraph><subparagraph id="id16A4BCDD1FFA47DB86BC72290AFB22A1"><enum>(B)</enum><text>in clause (ii), by inserting <quote>dating partner (as defined in section 2266),</quote> after <quote>spouse,</quote> each place it appears;</text></subparagraph></paragraph><paragraph id="id01B0400EDE534C2A9A521CF1D2BF0BCB"><enum>(3)</enum><text>by redesignating paragraphs (34) and (35) as paragraphs (35) and (36), respectively; and</text></paragraph><paragraph id="id786A9B80CD634FFE9F3F9CCA39340F3F"><enum>(4)</enum><text>by inserting after paragraph (33) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5881BBA9C846403D90CB3C2750C60195"><paragraph id="idF550989F70D7402D955081694F5947E1" indent="up1"><enum>(34)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB736F5A4833C4547BC27BC864B544D77"><enum>(A)</enum><text>The term <term>misdemeanor crime of stalking</term> means an offense that is—</text><clause indent="up1" id="idCB30960EDA7C45C0AD325C0BEAE4FF24"><enum>(i)</enum><text>a misdemeanor crime of stalking under Federal, State, municipal, or Tribal law; and </text></clause><clause indent="up1" id="idBE5FE61932EF4AB0B6EB8BAE9A588AEB"><enum>(ii)</enum><text>a course of harassment, intimidation or surveillance of another person that—</text><subclause id="id728D063C7C4A471AB230946543A71329"><enum>(I)</enum><text>places that person in reasonable fear of material harm to the health or safety of—</text><item id="id90B15EE4FFA64003AC08883AC90BDA04"><enum>(aa)</enum><text>that person;</text></item><item id="id85EF017B51B74660B6E7886210BB076A"><enum>(bb)</enum><text>an immediate family member (as defined in section 115) of that person;</text></item><item id="id0185DDF6D8DB44329EE94E24F01D36FA"><enum>(cc)</enum><text>a household member of that person; or</text></item><item id="idCC94B376775640D6B6370258E75ECFAC"><enum>(dd)</enum><text>a spouse or intimate partner of that person; or</text></item></subclause><subclause id="idA7418A09336848FB8022846EED2B06ED"><enum>(II)</enum><text>causes, attempts to cause, or would reasonably be expected to cause emotional distress to a person described in item (aa), (bb), (cc), or (dd) of subclause (I). </text></subclause></clause></subparagraph><subparagraph id="id470354d7075d4c278ecd8ef362a25d55" indent="up1"><enum>(B)</enum><text>A person shall not be considered to have been convicted of such an offense for purposes of this chapter, unless—</text><clause id="id54CE4C6B5DB44D43B556D5B18AAB1920"><enum>(i)</enum><text>the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and</text></clause><clause id="id8f1ef946fb484b81b0015604b9e4c3f4"><enum>(ii)</enum><text>in the case of a prosecution for an offense described in this paragraph for which a person was entitled to a jury trial in the jurisdiction in which the case was tried, either</text><subclause id="id3fa2e20cd6d6428186c101eccddbad3e"><enum>(I)</enum><text>the case was tried by a jury, or</text></subclause><subclause id="id19a4b2e2dadb43f694494df4f5215b11"><enum>(II)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise.</text></subclause></clause></subparagraph><subparagraph id="ida19529d81d5943e792e249b935c375fe" indent="up1"><enum>(C)</enum><text>A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id28BFD968728142A39DB0CD66D163EFF7"><enum>3.</enum><header>Prohibiting stalkers from possessing a firearm</header><text display-inline="no-display-inline">Section 922 of title 18, United States Code, is amended—</text><paragraph id="id0C65BEF30FBD46A6BD390F5986299ABD"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="idF2AD8B4230E24D9AB65720B081D696D5"><enum>(A)</enum><text>in paragraph (8)(ii), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id2918771239B44CB8B7DE40EBB12C374A"><enum>(B)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idDD54C1DB15914E468930822B4B69BDA8"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id44789CC96F7644E795A9E48BEDB7B69B"><paragraph id="id9008786c5a50422687f2c6354393ebae"><enum>(10)</enum><text>has been convicted in any court of a misdemeanor crime of stalking.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9B632F4F90E440E6AAB5FF4C6C9A836A"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph id="idE636F89D24E749E786C648362ABEDCC5"><enum>(A)</enum><text>in paragraph (8)(C)(ii), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="idF9D8A659DFBA4A2A87CC215438601FE4"><enum>(B)</enum><text>in paragraph (9), by striking the comma at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id060EB47E9AF34FFA80C2F178E6011269"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1C6A75C89DD44F55B4597A1390E2DAEB"><paragraph id="idC80583EB561D47E2BBCD78C9AAD00F53"><enum>(10)</enum><text>who has been convicted in any court of a misdemeanor crime of stalking,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
