which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to expand access to psychological and behavioral services.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Mental Health Options Act of 2022</short-title></quote>.</text></section><section id="id016a703edf7e49bfa575263e53180007"><enum>2.</enum><header>Expanding eligibility for incentives to practice in rural and underserved areas</header><text display-inline="no-display-inline">Section 1833(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(m)</external-xref>) is amended—</text><paragraph id="id8dac7e54e6dd450ab7b4df19b578cab3"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id89E6BF3229BD426AAD9A4FE46A8E553F"><enum>(A)</enum><text>by inserting <quote>(A)</quote> before <quote>In the case</quote>; and</text></subparagraph><subparagraph id="idA6C7F3F5CAF4436F9695F39BE440C39D"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9E395B5A7A74CB991833A65462A833F"><subparagraph id="id7A7EB2FB71B4445795639B74CBAE031B" indent="up2"><enum>(B)</enum><text>In the case of services furnished by a clinical psychologist (as defined by the Secretary for purposes of section 1861(ii)) in a year to an individual, who is covered under the insurance program established by this part and who incurs expenses for such services, in an area that is designated (under section 332(a)(1)(A) of the Public Health Service Act) as a health professional shortage area as identified by the Secretary prior to the beginning of such year, in addition to the amount otherwise paid under this part, there also shall be paid to the clinical psychologist (or to an employer or facility in the cases described in clause (A) of section 1842(b)(6)) (on a monthly or quarterly basis) from the Federal Supplementary Medical Insurance Trust Fund an amount equal to 10 percent of the payment amount for the service under this part</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id700e8908811e4486b598714ea1d99902"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>or clinical psychologist</quote> after <quote>physician</quote>.</text></paragraph></section><section id="idf0747588cb084b57b44f3c5857b06fce"><enum>3.</enum><header>Eliminating unnecessary oversight and approval requirements for behavioral health services provided by clinical psychologists</header><subsection id="id99b4d70a32584b2b876b9dbe532832ec"><enum>(a)</enum><header>Comprehensive Outpatient Rehabilitation Facilities</header><text>Section 1835(a)(2)(E)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395n">42 U.S.C. 1395n(a)(2)(E)(iii)</external-xref>) is amended by inserting <quote>, except that an individual receiving qualified psychologist services as described in section 1861(ii) may be under the care of a clinical psychologist with respect to such services to the extent authorized under State law</quote> before the semicolon.</text></subsection><subsection id="idaeb4c88d5c2947a384efb8f6cbfc7659"><enum>(b)</enum><header>Skilled Nursing Facilities</header><text>Section 1819(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)</external-xref>) is amended—</text><paragraph id="idA3E47E87A6854359BA34E30C7C297F73"><enum>(1)</enum><text>in paragraph (5)(G), by inserting <quote>clinical psychologist,</quote> after <quote>nurse practitioner,</quote>; and</text></paragraph><paragraph id="id23f96f454ca744b697d331258dd94729"><enum>(2)</enum><text>in paragraph (6)(A), by inserting <quote>, except that a resident receiving qualified psychologist services as described in section 1861(ii) may be under the supervision of a clinical psychologist with respect to such services to the extent authorized under State law</quote> before the semicolon.</text></paragraph></subsection><subsection id="idF25079775E3D4A09A736F64CBCE73425"><enum>(c)</enum><header>Partial hospitalization services</header><paragraph commented="no" id="idF81AA476CB0B468AA3CD6F151DB418FF"><enum>(1)</enum><text>Section 1835(a)(2)(F)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395n">42 U.S.C. 1395n(a)(2)(F)(iii)</external-xref>) is amended by inserting <quote>, except that an individual receiving qualified psychologist services as described in section 1861(ii) may be under the care of a clinical psychologist with respect to such services to the extent authorized under State law</quote> before the period.</text></paragraph><paragraph id="id6A476A3FBD3B45EF9F64410C6FB02F92"><enum>(2)</enum><text>Section 1861(ff)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ff)(1)</external-xref>) is amended by inserting <quote>(or, in the case of qualified psychologist services, under the supervision of a clinical psychologist to the extent authorized under State law)</quote> after <quote>under the supervision of a physician</quote>.</text></paragraph></subsection><subsection id="id881bbc693b9c4b52840ec06f7ad0db3e"><enum>(d)</enum><header>Home health services</header><paragraph id="id0EE78F0612BF489DA07150653EACDE01"><enum>(1)</enum><text>Section 1861(m) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(m)</external-xref>) is amended—</text><subparagraph id="id8DE9729B1E694BDF87EEAAE62315A6CD"><enum>(A)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id392B450902BE41A38F65A94CE2D12AE5"><enum>(B)</enum><text>in paragraph (7), by inserting <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="id0D74F0C7CFCB47F29F77E0216696A567"><enum>(C)</enum><text>by inserting after paragraph (7) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ce5df50ddc1468798b508a892ceb5d7"><paragraph id="idb88d4e4dea2e46d898ba54a1dedb257f"><enum>(8)</enum><text>an individual receiving qualified psychologist services may be under the care of a clinical psychologist with respect to such services to the extent authorized under State law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idbf2c8a5f4d15476b87281aa1ecabd380"><enum>(2)</enum><text>Section 1891(a)(3)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395bbb">42 U.S.C. 1395bbb(a)(3)(F)</external-xref>) is amended by inserting <quote>clinical psychologist,</quote> after <quote>physician,</quote>.</text></paragraph></subsection><subsection id="id0a9b4686a3e943d292f532b9e0313023"><enum>(e)</enum><header>Inpatient psychiatric hospital services</header><text>Section 1814(a)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(2)(A)</external-xref>) is amended by inserting <quote>(or, in the case of qualified psychologist services, under the supervision of a clinical psychologist to the extent authorized under State law)</quote> after <quote>under the supervision of a physician</quote>.</text></subsection><subsection id="id48D148269E4B4B49A0CBEFA56ECEA900"><enum>(f)</enum><header>Rule of construction</header><text>In accordance with section 410.71(e) of title 42, Code of Federal Regulations (or any successor regulation), nothing in the provisions of, and amendments made by, this section shall be construed as changing or eliminating existing requirements regarding clinical consultation by clinical psychologists with a beneficiary’s physician, in accordance with accepted professional ethical norms and taking into consideration patient confidentiality.</text></subsection></section></legis-body></bill>
