<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 526</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210302" legis-day="20210301">March 2 (legislative day, March 1), 2021</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to harmonize the definition of employee with the common law.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEC0D0051C5B34D61933D959F820BFB03"><section section-type="section-one" id="HCB23091043C743AFA86599237947F551"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modern Worker Empowerment Act</short-title></quote>.</text></section><section id="H5F0E1EA980F54019A55173145EFF61F1"><enum>2.</enum><header>Amendments to the Fair Labor Standards Act of 1938 to harmonize the definition of employee</header><subsection id="H3EA095D8E7CC459E9CC34D47922A0991"><enum>(a)</enum><header>Definition of employee</header><text display-inline="yes-display-inline">Section 3(e)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)(1)</external-xref>) is amended by inserting before the period the following: <quote>, as determined under the usual common law rules</quote>.</text></subsection><subsection id="HD6BEEF4AD62B408EA935998D35F0E6D7"><enum>(b)</enum><header>Definition of employ</header><text display-inline="yes-display-inline">Section 3(g) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(g)</external-xref>) is amended by inserting <quote>an employee</quote> after <quote>permit</quote>.</text></subsection></section></legis-body></bill>
