which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to create a national zero-emission vehicle standard, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id64578FABEC5A4F8AAAC2C27D29C3F1E3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zero-Emission Vehicles Act of 2022</short-title></quote> or the <quote><short-title>ZEVs Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="idCB17ABF0B26543078A26604226271D13"><enum>2.</enum><header>National zero-emission vehicle standard</header><text display-inline="no-display-inline">Part A of title II of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idB7E8EDB8D4F846DFA5A2AACCFDF148A5"><section id="idF59DD9C045304A3682745AEAC0F963D8"><enum>220.</enum><header>National zero-emission vehicle standard</header><subsection id="idC9E0EA7A58984336989D3C010AD24338"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idCDB68EC181354C55B1E95D6CFE48FE1A"><enum>(1)</enum><header>Base quantity of new passenger vehicles</header><text>The term <term>base quantity of new passenger vehicles</term> means the total quantity of new passenger vehicles delivered for sale by a vehicle manufacturer during the most recent model year.</text></paragraph><paragraph id="idB6D0097CFB9B4B38890E4187841890D4"><enum>(2)</enum><header>Passenger vehicle</header><text>The term <term>passenger vehicle</term> has the meaning given the term <quote>passenger motor vehicle</quote> in section 32101 of title 49, United States Code.</text></paragraph><paragraph id="idF0E8EEDF8B494D028B586995F7CEC5BC"><enum>(3)</enum><header>Qualified electric vehicle</header><text>The term <term>qualified electric vehicle</term> means a passenger vehicle that is—</text><subparagraph commented="no" id="idEA7DBCE529FA46C68DC351F81ECC269E"><enum>(A)</enum><text>a new clean vehicle (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/30D">section 30D(d)</external-xref> of the Internal Revenue Code of 1986); or</text></subparagraph><subparagraph commented="no" id="idAE0CB88F85514EDA8458D8FACCF74ADD"><enum>(B)</enum><text>a new qualified fuel cell motor vehicle (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/30B">section 30B(b)(3)</external-xref> of the Internal Revenue Code of 1986).</text></subparagraph></paragraph><paragraph id="id12055D7DDC334466ADD7F943C96EE4D9"><enum>(4)</enum><header>Retire</header><text>The term <term>retire</term>, with respect to a zero-emission vehicle credit, means to disqualify the zero-emission vehicle credit for any subsequent use under this section, including sale, transfer, exchange, or submission in satisfaction of a compliance obligation.</text></paragraph><paragraph id="id74E65B08CA494EAB8F036CB25787B9F7"><enum>(5)</enum><header>Vehicle manufacturer</header><subparagraph id="idE75FEE35A8F945C68080E03AC201929D"><enum>(A)</enum><header>In general</header><text>The term <term>vehicle manufacturer</term> means an entity that—</text><clause id="id2D68FB96A50D4C1DA3B8F9D84D83DD64"><enum>(i)</enum><text>engaged in the manufacturing of new passenger vehicles; and</text></clause><clause id="id1004BB45A5DC4942882F30FF10524A49"><enum>(ii)</enum><text>sold not fewer than 100 new passenger vehicles to ultimate purchasers in the United States within the current or previous calendar year, either directly or through an affiliate, such as a dealer.</text></clause></subparagraph><subparagraph id="id83FB08BE61AE4268969C1EEA1949765C"><enum>(B)</enum><header>Exclusions</header><text>The term <term>vehicle manufacturer</term> does not include—</text><clause id="id4A770A10C7614341ACED301942F7BF45"><enum>(i)</enum><text>a motor vehicle parts supplier; or</text></clause><clause id="id811D8E417651450B9B0F3F643D1E65E4"><enum>(ii)</enum><text>a dealer.</text></clause></subparagraph></paragraph><paragraph id="idD2614DD498E04D86A4F715B9C04E0550"><enum>(6)</enum><header>Zero-emission vehicle</header><text>The term <term>zero-emission vehicle</term> means a passenger vehicle that produces zero exhaust emissions of any criteria pollutant, precursor pollutant, or greenhouse gas, other than water vapor, in any mode of operation or condition, as determined by the Administrator.</text></paragraph></subsection><subsection id="id7AF977EE71C24C4EA0F90A2E2F3A81BE"><enum>(b)</enum><header>Compliance</header><text>For model year 2026 and each model year thereafter, each vehicle manufacturer shall meet the requirements of subsections (c) and (d) by submitting to the Administrator, not later than April 1 of the following calendar year, as applicable—</text><paragraph id="idDA41A8698EEF45EC973F360CD88CC71A"><enum>(1)</enum><text>for a vehicle manufacturer that fails to meet the minimum required percentage of zero-emission vehicle sales for the applicable model year, as determined under subsection (c), a quantity of zero-emission vehicle credits sufficient to offset that excess, as determined by the Administrator; or</text></subparagraph><subparagraph id="id903040E9F6F04D63A5F227E1713B033E"><enum>(B)</enum><text>obtained by purchase, transfer, or exchange under subsection (g).</text></subparagraph></paragraph><paragraph id="id821FF11AA0A84035B7FC2FA69141F714"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">A zero-emission vehicle credit may be counted toward compliance with subsection (b) only once.</text></paragraph></subsection><subsection id="idA5778794B1D443A2960DA52CA5E29AB5"><enum>(f)</enum><header>Issuance of zero-Emission vehicle credits</header><paragraph id="id41D10D29F3C44D0787EF11F975A4E4DD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Administrator shall establish by rule a program—</text><subparagraph id="id2A9FE21E3F1A4B83A86DE38207EF9577"><enum>(A)</enum><text display-inline="yes-display-inline">to verify and issue zero-emission vehicle credits to vehicle manufacturers;</text></subparagraph><subparagraph id="id4067136F353246559E504C36C10D11ED"><enum>(B)</enum><text display-inline="yes-display-inline">to track the sale, transfer, exchange, carry over, and retirement of zero-emission vehicle credits; and</text></subparagraph><subparagraph id="id2288D80B264F4B3BAF03E4EEF423BA50"><enum>(C)</enum><text display-inline="yes-display-inline">to enforce the requirements of this section.</text></subparagraph></paragraph><paragraph id="id44F38F40C3354430B663713ADC5CA2CF"><enum>(2)</enum><header>Application</header><subparagraph id="id4808E695BA074740B4D8A4616F4EAF7A"><enum>(A)</enum><header>In general</header><text>A vehicle manufacturer that delivered for sale, either directly or through an affiliate, such as a dealer, a new zero-emission vehicle or a qualified electric vehicle in the United States may apply to the Administrator for the issuance of a zero-emission vehicle credit.</text></subparagraph><subparagraph id="idB713A7344A9E4943BBBC84E9C10E33E5"><enum>(B)</enum><header>Eligibility</header><text>To be eligible for the issuance of a zero-emission vehicle credit, a vehicle manufacturer shall demonstrate to the Administrator that the vehicle manufacturer delivered for sale 1 or more zero-emission vehicles or qualified electric vehicles in the previous model year.</text></subparagraph><subparagraph id="id39F08C76D0C74796A043CBCB9EEF94AB"><enum>(C)</enum><header>Contents</header><text>The application shall indicate—</text><clause id="id9DF0B40666B14E24A268570909529AEE"><enum>(i)</enum><text>the type of zero-emission vehicle or qualified electric vehicle that was delivered for sale;</text></clause><clause id="id88BC05D849D1483CB10E6FD67A14121E"><enum>(ii)</enum><text>the State in which the zero-emission vehicle or qualified electric vehicle was delivered for sale; and</text></clause><clause id="idA3A31C78EB8441C6AA49D9B2A083DD96"><enum>(iii)</enum><text>any other information determined to be appropriate by the Administrator.</text></clause></subparagraph><subparagraph id="id4FEE0ABDE82E45D490AA9BFC91C04F29"><enum>(D)</enum><header>Aggregation</header><text>An application for a zero-emission vehicle credit under subparagraph (A) may aggregate information on all zero-emission vehicles and qualified electric vehicles delivered for sale by the vehicle manufacturer in the applicable model year.</text></subparagraph></paragraph><paragraph id="idEA9D6493351E4444935A0D4EECEEF48A"><enum>(3)</enum><header>Quantity of zero-emission vehicle credits</header><subparagraph id="idDA6AE693513D4288AE3F660DE396A015"><enum>(A)</enum><header>Zero-emission vehicles</header><text>The Administrator shall issue to a vehicle manufacturer the application under paragraph (2) of which is approved 1 zero-emission vehicle credit for each zero-emission vehicle delivered for sale in the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6E54390F834F4AFFAEA47446E15CFFE2"><enum>(B)</enum><header display-inline="yes-display-inline">Qualified electric vehicles</header><text display-inline="yes-display-inline">For a qualified electric vehicle delivered for sale by a vehicle manufacturer the application under paragraph (2) of which is approved, the Administrator shall issue a partial zero-emission vehicle credit based on the estimated proportion of the mileage driven—</text><clause commented="no" display-inline="no-display-inline" id="idc7a730d5d55246c4ae7b30c2dc5fa54c"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a qualified electric vehicle described in subsection (a)(3)(A), on the battery of the qualified electric vehicle, as determined by the Administrator; and</text></clause><clause id="id34486b0f62d848dabb01599428f7e6c4"><enum>(ii)</enum><text>with respect to a qualified electric vehicle described in subsection (a)(3)(B), on hydrogen that is produced through a process that results in a lifecycle greenhouse gas emissions (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45V">section 45V(c)</external-xref> of the Internal Revenue Code of 1986) rate of less than 0.45 kilograms of carbon dioxide-equivalent per kilogram of hydrogen, as determined by the Administrator.</text></clause></subparagraph><subparagraph id="id987ec3ff97b348af88d2c3efc3e65879"><enum>(C)</enum><header>Credit banking</header><text>A zero-emission vehicle credit issued for any model year that is not submitted to comply with the minimum annual percentage of zero-emission vehicles under subsection (c) during that model year may be carried forward for use pursuant to subsection (b)(1) within the next 5 years, but not later than model year 2035.</text></subparagraph></paragraph></subsection><subsection id="idD84B0F521035464F9E1299BD9F3F8C1B"><enum>(g)</enum><header>Zero-Emission vehicle credit trading</header><paragraph id="idA8B3EA22858C4296BCC0BB26E904A744"><enum>(1)</enum><header>In general</header><text>A zero-emission vehicle credit for any model year before 2035 that is not submitted to the Administrator to comply with the minimum annual percentage of zero-emission vehicles under subsection (c) for that model year may be sold, transferred, or exchanged by the vehicle manufacturer to which the credit is issued or by any other entity that acquires the zero-emission vehicle credit.</text></paragraph><paragraph id="id84FA41E2D8964C24A6FFFBC2F527CC95"><enum>(2)</enum><header>Delegation</header><subparagraph id="id1F404CEDC60E453789539A1F45D27E08"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may delegate to an appropriate market-making entity the administration of a national tradeable zero-emission vehicle credit market for purposes of creating a transparent national market for the sale or trade of zero-emission vehicle credits.</text></subparagraph><subparagraph id="id11769F5699AC4FBCAF97C811D4F677CE"><enum>(B)</enum><header>Public report</header><text>If the Administrator makes a delegation under subparagraph (A), the entity to which the Administrator made the delegation shall annually submit to Congress and make available to the public a report describing the status of the zero-emission vehicle credit market.</text></subparagraph></paragraph></subsection><subsection id="idF98D0449D1704F6F8B30FF03F29C8EDA"><enum>(h)</enum><header>Zero-Emission vehicle credit retirement</header><paragraph id="id591D6DDEA067480A9457B1A821ACEB52"><enum>(1)</enum><header>In general</header><text>Any entity that obtains legal rights to a zero-emission vehicle credit may retire the zero-emission vehicle credit in any model year.</text></paragraph><paragraph id="idCBE6FF244B154B88AE0DEBB9EB06F46B"><enum>(2)</enum><header>Use of retired zero-emission vehicle credit</header><text>A zero-emission vehicle credit retired under paragraph (1) may not be used for compliance with subsection (b) in—</text><subparagraph id="idF3CCCC80DD64406787940415155E561A"><enum>(A)</enum><text>the model year in which the zero-emission vehicle credit is retired; or</text></subparagraph><subparagraph id="id246B15B3719F4A13A2345F8D45E51F91"><enum>(B)</enum><text>any subsequent model year.</text></subparagraph></paragraph></subsection><subsection id="idB547485FBC4C4659B89FC6DE8BFCB221"><enum>(i)</enum><header>Information collection</header><text>The Administrator may collect the information necessary to verify and audit—</text><paragraph id="id4FDFC5752EBE4B7D9BC86DCBF415886D"><enum>(1)</enum><text display-inline="yes-display-inline">the model year sales of passenger vehicles of any vehicle manufacturer;</text></paragraph><paragraph id="id086AF2B4B40B4104B8BCBBBD98B3FC93"><enum>(2)</enum><text display-inline="yes-display-inline">a zero-emission vehicle credit submitted by a vehicle manufacturer pursuant to subsection (b)(1);</text></paragraph><paragraph id="id6FE075D3F77D46CF8079CB518EE05D55"><enum>(3)</enum><text>the validity of a zero-emission vehicle credit submitted for compliance by a vehicle manufacturer to the Administrator; and</text></paragraph><paragraph id="id947E6CB1D37944CAA011494B32637154"><enum>(4)</enum><text>the quantity of passenger vehicles delivered for sale in the United States of all vehicle manufacturers.</text></paragraph></subsection><subsection id="idC8FAED6345BC490C96724B165F623EE4"><enum>(j)</enum><header>State programs</header><paragraph id="id8E3FDEB15177486FB04DBC8DBFDC79CA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section shall preempt the authority of a State or political subdivision of a State to adopt or enforce any law (including regulations) relating to motor vehicles, including the authority to set standards for motor vehicle emissions and zero-emission vehicle requirements under section 177 and section 209.</text></paragraph><paragraph id="id733F6E8849D0499893E64F88C06C9C91"><enum>(2)</enum><header>Compliance with section</header><text>No law or regulation of a State or political subdivision of a State shall relieve any vehicle manufacturer from compliance with any requirement otherwise applicable under this section.</text></paragraph></subsection><subsection id="idF88750A27AEF4D4DB79C481C95DD7210"><enum>(k)</enum><header>Sense of Congress</header><text>It is the sense of Congress that vehicle manufacturers should diversify vehicle technologies and models to ensure consumer choice and access.</text></subsection><subsection id="id69FEB441530344BD8DD95F7D0CBD5BFA"><enum>(l)</enum><header>Regulations</header><text>Not later than 540 days after the date of enactment of this section, the Administrator shall promulgate regulations to implement this section.</text></subsection><subsection id="id04553215B3F348AEA9A4362DC190E4E5"><enum>(m)</enum><header>Enforcement</header><paragraph id="id0EC1BD3E92E74D1497021C8BE64CD2A4"><enum>(1)</enum><header>Civil penalty</header><subparagraph id="idBFB12A4D0DD64E00906543CBA4E4763D"><enum>(A)</enum><header>In general</header><text>A vehicle manufacturer that fails to comply with subsection (b) shall be liable for a civil penalty, assessed by the Administrator, in an amount that is equal to twice the average value of the aggregate quantity of zero-emission vehicle credits that the vehicle manufacturer failed to submit in violation of that subsection, as determined by the Administrator.</text></subparagraph><subparagraph id="idF5137A13CFF74113824741F9DE72F8DD"><enum>(B)</enum><header>Enforcement</header><text>The Administrator shall assess any civil penalty under subparagraph (A).</text></subparagraph><subparagraph id="id9F4BBC740478475389DB5944880B1325"><enum>(C)</enum><header>Deposit</header><text>With respect to any civil penalty paid to the Administrator pursuant to subparagraph (A), the Administrator shall deposit the amount into the Highway Trust Fund established by <external-xref legal-doc="usc" parsable-cite="usc/26/9503">section 9503(a)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="id01F8838314FA4AE9B040C9E10FDB02E9"><enum>(2)</enum><header>Injunction</header><text>After model year 2035, the Administrator shall issue an injunction on the manufacture of any passenger vehicles other than zero-emission vehicles by a vehicle manufacturer.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
