which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to provide that consumer room air cleaners are covered products to which certain energy conservation standards apply, and for other purposes.</official-title></form><legis-body><section id="id82288924c2ce411fbe6c0a7894a4a1f5" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 321 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5709a48839ca4aeeab22f8933bf191ae"><paragraph id="idd7c7e641f18944adaddd135f23bcb7e7"><enum>(67)</enum><header>Consumer room air cleaner</header><subparagraph id="id070115804444473E9DA1F9C32FE637F0"><enum>(A)</enum><header>In general</header><text>The term <term>consumer room air cleaner</term> means a consumer product for improving air quality that—</text><clause id="id4a212068e4f6482c970a39eb10ef8d9e"><enum>(i)</enum><text>is an electrically powered, self-contained, mechanically encased assembly; and</text></clause><clause id="id3bff3e03dd0b472da216e353210108cc"><enum>(ii)</enum><text>contains means to remove, destroy, or deactivate particulates, volatile organic compounds, or microorganisms from the air.</text></clause></subparagraph><subparagraph id="id55F184DED6544978881734BD48CEA438"><enum>(B)</enum><header>Inclusions</header><text>The term <term>consumer room air cleaner</term> includes—</text><clause id="idD1438670B49D46788B4CF02D63DF661D"><enum>(i)</enum><text>conventional room air cleaners; and </text></clause><clause id="id6CF7F03A09E04E7CADE44134DE4DA6D6"><enum>(ii)</enum><text>miscellaneous room air cleaners.</text></clause></subparagraph><subparagraph id="id25493fff949340e98cd81feb968ac0ee"><enum>(C)</enum><header>Exclusions</header><text>The term <term>consumer room air cleaner</term> does not include—</text><clause id="id1C152C10CD174A04AEB83AD887EB6C19"><enum>(i)</enum><text>a central air conditioner, room air conditioner, portable air conditioner, dehumidifier, or furnace (as those terms are defined in section 430.2 of title 10, Code of Federal Regulations (as in effect on the date of enactment of this paragraph)); or</text></clause><clause id="id087812ed0912470e83ee4ae7e8515cbb"><enum>(ii)</enum><text> a duct type device.</text></clause></subparagraph></paragraph><paragraph id="idd6b37bd5c7784818a68b68c6c4a5063a"><enum>(68)</enum><header>Conventional room air cleaner</header><text>The term <term>conventional room air cleaner</term> means a consumer room air cleaner that—</text><subparagraph id="id60a4bbfb9f0f4ba9b9bc0bec422936fe"><enum>(A)</enum><text>is a portable or wall-mounted (fixed) unit;</text></subparagraph><subparagraph id="idbd89e1bfd6a94962814d49df8da58e49"><enum>(B)</enum><text>plugs into an electrical outlet;</text></subparagraph><subparagraph id="id2f434f8fb5a942b08a4bc73e8f8dc2f8"><enum>(C)</enum><text>operates with a fan for air circulation; and</text></subparagraph><subparagraph id="idc31b6c4e4af64b129f2e75a428b28daf"><enum>(D)</enum><text>contains a means to remove, destroy, or deactivate particulates.</text></subparagraph></paragraph><paragraph id="ideb24021c8f674236887c7cdf9043c040"><enum>(69)</enum><header>Duct type device</header><text>The term <term>duct type device</term> means an air cleaner that—</text><subparagraph id="id6DC74754A1174091BC58616C228D2F3E"><enum>(A)</enum><text>is designed and marketed exclusively for use in and at adjoining ducts, including the plenum, of heating, air conditioning, and ventilating systems; and</text></subparagraph><subparagraph id="id192406E78EDD40A680C8976F5B812B5F"><enum>(B)</enum><text>is either cord-and-plug connected or permanently connected to the electrical supply source.</text></subparagraph></paragraph><paragraph id="idec05b31f00a343d69da8edbe79027c80" commented="no"><enum>(70)</enum><header>Miscellaneous room air cleaner</header><text display-inline="yes-display-inline">The term <term>miscellaneous room air cleaner</term> means any consumer room air cleaner that is not a conventional room air cleaner.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id81b95477b4dd416eb7186d9e31a9309b"><enum>2.</enum><header>Coverage of consumer room air cleaners</header><text display-inline="no-display-inline">Section 322(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6292">42 U.S.C. 6292(a)</external-xref>) is amended—</text><paragraph id="id7fb400ff042d4adfb45fef5008484ef2"><enum>(1)</enum><text>by redesignating paragraph (20) as paragraph (21); and</text></paragraph><paragraph id="id08f86afb5e264dbdb7c679b25e2f87c4"><enum>(2)</enum><text>by inserting after paragraph (19) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCBBD404FDC9348CFADD1302C775DFDA7"><paragraph id="idc000343f734941969385daa9af1284f6"><enum>(20)</enum><text>Consumer room air cleaners.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id90dd012f795e4acbaa95a40818df3d8f"><enum>3.</enum><header>Test procedures</header><text display-inline="no-display-inline">Section 323(b) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6293">42 U.S.C. 6293(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD63F7E1506214CF48E101CDEB5264C7F"><paragraph id="id8840e76877024b0aacee2b9722740b31" commented="no"><enum>(19)</enum><header>Conventional room air cleaners</header><subparagraph id="ideaba223230734b078255350926c07b63" commented="no"><enum>(A)</enum><text>For compliance with the standards under section 325(ii)(1), the test procedure shall be AHAM AC–7–2022, and section 6.2 of ANSI/AHAM AC–1–2020 for Dust CADR and section 5.2 of ANSI/AHAM AC–1–2020 for Smoke CADR may be applied for the calculation of PM<subscript>2.5</subscript>.</text></subparagraph><subparagraph id="id1f9de939163f4e1b8d6c5e61f63b9558" commented="no"><enum>(B)</enum><text>For compliance with the standards under section 325(ii)(2), the test procedure shall be AHAM AC–7–2022.</text></subparagraph><subparagraph id="ida627a7867a7b41a999132286ffa810d7" commented="no"><enum>(C)</enum><text>When considering amended standards for conventional room air cleaners that replace the standards under section 325(ii)(2), the Secretary shall consider amending the test procedure to include measurement of automatic mode, if such an inclusion would improve the accuracy of energy use measurements.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id94a09890ec584d498b0aced6fc343322"><enum>4.</enum><header>Labeling</header><text display-inline="no-display-inline">Section 324(a) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294">42 U.S.C. 6294(a)</external-xref>) is amended—</text><paragraph id="idb16b42d1d38d4a418f900acd5cc8f549"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (8) through (12)</quote> and inserting <quote>(8) through (12), and (20)</quote>; and</text></paragraph><paragraph id="id090f0a6acc5146b2b6e835abb7fb1168"><enum>(2)</enum><text>in paragraph (5), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf79fc6ede6ab4cd698c32a7641866991"><subparagraph id="id67fb327c146643e19768d00a9b43ed36"><enum>(D)</enum><text>The Commission shall not require compliance with labeling requirements under this section for conventional room air cleaners before December 31, 2025.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8830633d6e244069b259bb63c3748182"><enum>5.</enum><header>Energy conservation standards</header><text display-inline="no-display-inline">Section 325 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended—</text><paragraph id="idcaa1c895bfbe439187133df9fcb0e31c" commented="no"><enum>(1)</enum><text>in subsection (m)(4)(A)(i), by inserting <quote>consumer room air cleaners,</quote> after <quote>with respect to</quote>;</text></paragraph><paragraph id="idca130f9b3dfe4a559842acef7dd5e94c"><enum>(2)</enum><text>by redesignating subsection (ii) as subsection (jj); and</text></paragraph><paragraph id="id65ce4c4d7b784b50a2fb38837ed7f277"><enum>(3)</enum><text>by inserting after subsection (hh) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1EAEAA38EF5F42B89C6278481CEEEE7D"><subsection id="ide1c364f2cc5c4fc9a9d978d731c085d7" commented="no"><enum>(ii)<?LEXA-Enum (ii)?></enum><header>Conventional room air cleaners</header><paragraph id="id04FCCFC97C1546D2853F6893ECFD7C44" commented="no"><enum>(1)</enum><header>In general</header><text>The following standards shall apply to conventional room air cleaners manufactured during the period beginning on December 31, 2023 and ending on December 30, 2025:</text><subparagraph id="id821e7fe6452d4b8fa528837f8ab47e77" commented="no"><enum>(A)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of greater than 9 and less than 100 shall meet or exceed an IEF of 1.69 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph><subparagraph id="id4ba3c578d00c4ff6ad4c89ee1fb8111d" commented="no"><enum>(B)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of greater than 99 and less than 150 shall meet or exceed an IEF of 1.90 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph><subparagraph id="idb722983848c64f54b9ac60fbab972f0e" commented="no"><enum>(C)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of 150 or greater shall meet or exceed an IEF of 2.01 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph></paragraph><paragraph id="id4a7ad008c505456986a92c64daf38e88" commented="no"><enum>(2)</enum><header>Subsequent standards</header><text>The following standards shall apply to conventional room air cleaners manufactured on or after December 31, 2025:</text><subparagraph id="id5d66ca0be86743b2b770e54dc072e592" commented="no"><enum>(A)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of greater than 9 and less than 100 shall meet or exceed an IEF of 1.89 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph><subparagraph id="idd2e41320e59446c3bb74500422e4d1fe" commented="no"><enum>(B)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of greater than 99 and less than 150 shall meet or exceed an IEF of 2.39 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph><subparagraph id="id21cb9207859b4bbaa673f5d3d629f7c7" commented="no"><enum>(C)</enum><text>A conventional room air cleaner with a measured PM<subscript>2.5</subscript> CADR of 150 or greater shall meet or exceed an IEF of 2.91 PM<subscript>2.5</subscript> CADR/Watt.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id2d58ba0070fe4e28ac04d68225775b91"><enum>6.</enum><header>Preemption</header><text display-inline="no-display-inline">Subsection (jj) of section 325 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) (as redesignated by section 5(2)) is amended—</text><paragraph id="id3433c99602cf4635ac0c1321215397a0"><enum>(1)</enum><text>in paragraph (1), by striking <quote>; and</quote> at the end and inserting a semicolon;</text></paragraph><paragraph id="id0b30285df9aa41f9921b47aeae240cef"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id283af2d820524e04aff2f6b03e2f4d94"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5d4d10e59dbf49fa9b686c75038985c2"><paragraph id="idd5cc959c62b3408bbcdd6e4792fd0bda"><enum>(3)</enum><text>beginning on December 31, 2023, to consumer room air cleaners, except that section 327(a)(1)(B) shall apply to consumer room air cleaners beginning on the date of enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ide3243bf73dbe4c85a785e983d92dabd9"><enum>7.</enum><header>Conforming amendments</header><subsection id="id0EC6226E9E9C40B1BF9E1E62A3C1283D"><enum>(a)</enum><text>Section 321(6)(B) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291(6)(B)</external-xref>) is amended by striking <quote>(20)</quote> and inserting <quote>(21)</quote>. </text></subsection><subsection id="id5D7572D29061452C9BFE0DA0116173D7"><enum>(b)</enum><text>Section 324 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294">42 U.S.C. 6294</external-xref>) is amended by striking <quote>(20)</quote> each place it appears (other than in subsection (a)(1) (as amended by section 4(1))) and inserting <quote>(21)</quote>. </text></subsection><subsection id="idD61B71D411B74C509385548ECB758133"><enum>(c)</enum><text>Section 325 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended by striking <quote>(20)</quote> each place it appears and inserting <quote>(21)</quote>.</text></subsection></section><section id="id905e56ab87dd4f158ec6fa6807973b30"><enum>8.</enum><header>Other air cleaners</header><text display-inline="no-display-inline">Nothing in this Act affects the authority of the Secretary of Energy to regulate air cleaners (as defined in section 430.2 of title 10 of the Code of Federal Regulations (as in effect on the date of enactment of this Act)), other than consumer room air cleaners (as defined in section 321 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291</external-xref>)).</text></section></legis-body></bill>
