which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the right of adults to engage in private, non-commercial, consensual sexual conduct in the exercise of their liberty.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Private Conduct Act of 2022</short-title></quote>.</text></section><section id="idC3EFB9438DA5420AB42E5AF1DAADE7FD"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>adult</term> means an individual who has attained the lesser of—</text><paragraph id="idCB42B8963BA54605AA04352E81CAFCB6"><enum>(1)</enum><text>18 years or age; or</text></paragraph><paragraph id="id326A336C2F0D4907AD8F3307B074B173"><enum>(2)</enum><text>the minimum age at which an individual may consent to sexual conduct under applicable State law.</text></paragraph></section><section id="id84c08f99d08d4470b56fd41d4a1f7037"><enum>3.</enum><header>Protection of the right of adults to engage in private, non-commercial, consensual sexual conduct</header><subsection id="id288b1644bdb248b8b1c491546c0720c5"><enum>(a)</enum><header>In general</header><text>No person acting under color of law may—</text><paragraph id="id71C77DDB2B484047907E23EA87521D90"><enum>(1)</enum><text>prevent an adult from engaging in private, non-commercial, consensual sexual conduct with another adult;</text></paragraph><paragraph id="id71C77B11862B4EDDA9C4DA7C3831901D"><enum>(2)</enum><text>interfere with an adult engaging in private, non-commercial, consensual sexual conduct with another adult; or</text></paragraph><paragraph id="idE3F6A5325F054F868D9E0B6E447DF22B"><enum>(3)</enum><text>intimidate, threaten, or retaliate against an adult because that adult has engaged or may engage in such conduct with another adult.</text></paragraph></subsection><subsection id="id972350cfa40c4e7e8bc382948491585a"><enum>(b)</enum><header>Enforcement</header><text>For the purposes of violations under subsection (a), the enforcement mechanism provided for and available under the following shall apply:</text><paragraph id="idc0deb72db7da4db4a3ab80ee60dbb20b"><enum>(1)</enum><text>Section 1979 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>).</text></paragraph><paragraph id="id2f974976ab3c4592a46159defe62c5d2"><enum>(2)</enum><text>Section 241 of title 18, United States Code. </text></paragraph><paragraph id="id004c8c3f846745d5a2757383bb88e6a9"><enum>(3)</enum><text>Section 242 of title 18, United States Code.</text></paragraph><paragraph id="id97e376596d9a404abb233480b6067d09" commented="no"><enum>(4)</enum><text>Section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>).</text></paragraph></subsection><subsection id="id5862C203254244B7B0D7CCBE540B869E"><enum>(c)</enum><header>Clarification</header><text>Subsection (a) shall not apply to any law (including any regulation) prohibiting public sexual conduct, forced or non-consensual sexual conduct, or sexual conduct with a minor. </text></subsection></section><section id="idc2f324bac6f447bca93a229509cd6588"><enum>4.</enum><header>Rules of construction</header><subsection id="idd105be6a3f964e9f85a1679e6956b5ec"><enum>(a)</enum><header>In general</header><text>In interpreting the provisions of this Act, a court shall liberally construe such provisions to effectuate the purpose of ensuring the right of an adult to engage in private, non-commercial, consensual sexual conduct with another adult.</text></subsection><subsection id="id055304b23e0d48da9ecdb321712f9820"><enum>(b)</enum><header>Other laws</header><text>Nothing in this Act shall be construed to invalidate, limit, or displace the rights, remedies, procedures, or legal standards available to individuals under Federal law, or to supersede State laws, that provide protections against discrimination beyond those provided in this Act.</text></subsection><subsection id="id8e58d1c1b8d44a398e1546f5aec4aead"><enum>(c)</enum><header>Other individuals considered as acting under color of law</header><text>Any person who, by operation of a provision of Federal or State law, is permitted to implement or enforce a limitation, prohibition, or requirement that violates section 3 of this Act shall be considered as acting under color of law for purposes of this Act.</text></subsection></section><section id="idc313ba11ba784dd0b600f3c9c19405e2"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of such provision to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, or the application of such provision to all other persons, entities, governments, or circumstances, shall not be affected thereby.</text></section></legis-body></bill>
