which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to encourage participation in advanced payment models.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Patient Access to Value-Based Care Act</short-title></quote>.</text></section><section id="id38c6bb263ba6447bb928ad9d370e115d"><enum>2.</enum><header>Advanced payment model incentive, participation, and threshold modifications</header><subsection id="id6448a3db11334ec19a9e7ba4deb67b0f"><enum>(a)</enum><header>In general</header><text>Section 1833(z) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(z)</external-xref>) is amended—</text><paragraph id="idbb353b9cceac4d77a76749bd58fbb5ec"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>2024</quote> and inserting <quote>2026</quote>; and</text></paragraph><paragraph id="idcf0ca8acee8d4fbcb453ebd418a168c5"><enum>(2)</enum><text>in paragraph (2)(C)—</text><subparagraph id="id9925e740665b4fbfa029cf99a518e772"><enum>(A)</enum><text>in clause (i), by striking <quote>75 percent</quote> and inserting <quote>the applicable percent (as defined in clause (iv)) for such year</quote>;</text></subparagraph><subparagraph id="idf82fd47cdcf0453993c71a82e4d389be"><enum>(B)</enum><text>in clause (ii)(I)—</text><clause id="id4f20464ad0ba4c03b8cecfa7aac54ecc"><enum>(i)</enum><text>in the matter preceding item (aa), by striking <quote>75 percent</quote> and inserting <quote>the applicable percent (as defined in clause (iv)) for such year</quote>; and</text></clause><clause id="id8a2368b4b5be4184838933d0bb2bd3fe"><enum>(ii)</enum><text>in item (bb)—</text><subclause id="id97a2b78cdaf5485fb3a6c94940bb83ae"><enum>(I)</enum><text>by striking <quote>and other than payments made under title XIX</quote> and inserting <quote>other than payments made under title XIX</quote>; and</text></subclause><subclause id="idd8b65a7e806a4785b308bba0e51c5747"><enum>(II)</enum><text>by striking <quote>State program under that title),</quote> and inserting <quote>State program under that title, and other than payments made by payers in which no payment or program meeting the requirements described in clause (iii)(II) is available from the payer for participation by the eligible professional)</quote>; and</text></subclause></clause></subparagraph><subparagraph id="idbb3c5767747e410e986f0a6634f29a07"><enum>(C)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd1f6cb4e24e44fb7a675c44ce2a21401"><clause id="id6e9a374019bf4b208e9518f8d9f4be53"><enum>(iv)</enum><header>Applicable percent defined</header><text>For purposes of clauses (i) and (ii), the term <term>applicable percent</term> means—</text><subclause id="idb4b98f5d063c4b79bbd03989469fb48a"><enum>(I)</enum><text>for 2025, a percent specified by the Secretary, but in no case less than 50 percent or more than 55 percent; and</text></subclause><subclause id="id6bd13f544b81492b987e314be38ce36c"><enum>(II)</enum><text>for a subsequent year, a percent specified by the Secretary, but in no case less than the percent specified under this clause for the preceding year or more than 5 percentage points higher than the percent specified under this clause for such preceding year.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id7cf0cdf3a5914a8b8abb94bb25c1f4ee"><enum>(b)</enum><header>Partial qualifying apm participant modifications</header><text>Section 1848(q)(1)(C)(iii)(III) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(q)(1)(C)(iii)(III)</external-xref>) is amended—</text><paragraph id="id807b0e5179fc4589a9d31d007a8bcad6"><enum>(1)</enum><text>in item (aa), by striking <quote>75 percent was instead a reference to 50 percent</quote> and inserting <quote>the applicable percent was instead a reference to 10 percentage points less than the applicable percent</quote>; and</text></paragraph><paragraph id="id46b453408b304ce692e83b3f36fb8869"><enum>(2)</enum><text>in item (bb)—</text><subparagraph id="idb3041bb48b7a44388bd8bd51aac665d8"><enum>(A)</enum><text>by striking <quote>75 percent</quote> and inserting <quote>the applicable percent</quote>;</text></subparagraph><subparagraph id="ide38cc61379e84624a2630898610417fd"><enum>(B)</enum><text>by striking <quote>50 percent</quote> and inserting <quote>10 percentage points less than the applicable percent</quote>. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
