which was read the first time</action-desc></action><action><action-date date="20221214">December 14, 2022</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>Making continuing appropriations for fiscal year 2023, extending various health programs, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continuing Appropriations and Health Extenders Act of 2022</short-title></quote>.</text></section><title id="idEE1D8B19AACD436298D7D07A47E25ACD" style="OLC"><enum>I</enum><header>Continuing appropriations</header><section id="id6FB8612E7B3E4B2A940CBBC8DAFE4F6B" section-type="subsequent-section"><enum>101.</enum><header>Extension of appropriations</header><text display-inline="no-display-inline">Section 106(3) of division A of the Continuing Appropriations and Ukraine Supplemental Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/180">Public Law 117–180</external-xref>; 136 Stat. 2116) is amended by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></section><section section-type="subsequent-section" id="idE739A9503C24482191B741367AAADB78"><enum>102.</enum><header>PAYGO report</header><text display-inline="no-display-inline">Notwithstanding subsection (a) of section 5 of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/934">2 U.S.C. 934</external-xref>), the Office of Management and Budget shall make publicly available the annual PAYGO report required under such subsection for 2022 and prepare any order required under subsection (b) of such section not later than February 4, 2023. </text></section></title><title id="H003511506B214631A58098738328D420" section-style="olc-section-style"><enum>II</enum><header>Extensions, Technical Corrections, and Other Matters</header><section id="H372FB1EBBA2B4E1AB5482C0D00DD4141" section-type="subsequent-section"><enum>201.</enum><header>Extension of FCC Auction Authority</header><text display-inline="no-display-inline">Section 309(j)(11) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(11)</external-xref>) is amended by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></section><section id="H523F0C866D1B4F70AD3F7008DAE381B6"><enum>202.</enum><header>Extension of Authorization for Special Assessment for Domestic Trafficking Victims’ Fund</header><text display-inline="no-display-inline">Section 3014(a) of title 18, United States Code, is amended, in the matter preceding paragraph (1), by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></section><section id="HFAF9788D4A8F45F28B03CEC4B175E53E" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header>Extension of Commodity Futures Trading Commission Customer Protection Fund Expenses Account</header><text display-inline="no-display-inline">Section 1(b) of <external-xref legal-doc="public-law" parsable-cite="pl/117/25">Public Law 117–25</external-xref> (135 Stat. 297) is amended by striking <quote>December 16, 2022</quote> each place it appears and inserting <quote>February 3, 2023</quote>. </text></section></title><title id="H8B9EDE4C5D184929A25AA3E4E3799051" style="OLC" section-style="olc-section-style"><enum>III</enum><header>Health and Human Services Extensions</header><subtitle id="HC2340AF626D64238B64196B7AD41C726" commented="no" level-type="subsequent"><enum>A</enum><header>Medicare and Medicaid</header><section id="HF08FA61E5C964D2CBD2C4B7BFA3105B1" section-type="subsequent-section"><enum>301.</enum><header>Extension of increased inpatient hospital payment adjustment for certain low-volume hospitals</header><subsection id="H58D966DA2FFD4CD9A161F2D262F2E83B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1886(d)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(12)</external-xref>) is amended—</text><paragraph id="H5170A4EB149A482A80DE0F521C61FA5B"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), in the matter preceding clause (i), by striking <quote>December 17, 2022</quote> and inserting <quote>February 4, 2023</quote>; and </text></subparagraph><subparagraph id="HDEA7E700571D44BBB36567FF1178ECB4"><enum>(B)</enum><text>in clause (iv), by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></subparagraph></paragraph><paragraph id="HC991957870104999A27EA2215FD45DDA"><enum>(2)</enum><header>Permitting hospitals to decline reclassification</header><text>Section 13501(e)(2) of the Omnibus Budget Reconciliation Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww</external-xref> note) is amended by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></paragraph></subsection></section><section id="H57BC1BC8978F44E99AC209F8E1EF8FE6" section-type="subsequent-section"><enum>303.</enum><header>Extension of increased FMAPs for the territories</header><text display-inline="no-display-inline">Section 1905(ff) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(ff)</external-xref>) is amended by striking <quote>December 16, 2022</quote> each place it appears and inserting <quote>February 3, 2023</quote> in each such place.</text></section></subtitle><subtitle id="HFB47A9C703BF47E193208148A97FB98D"><enum>B</enum><header>Human Services</header><section id="H2D9F15D611644B83A5D6778E73D37C67" section-type="subsequent-section"><enum>311.</enum><header>Extension of maternal, infant, and early childhood home visiting programs</header><text display-inline="no-display-inline">Activities authorized by section 511 of the Social Security Act shall continue through February 3, 2023, in the manner authorized for fiscal year 2022, and out of any money in the Treasury of the United States not otherwise appropriated, there is hereby appropriated for such purpose an amount equal to the pro rata portion of the amount appropriated for such activities for fiscal year 2022.</text></section><section id="HA7362E658CEA44088B0CBBCD6E8CBB24" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>312.</enum><header>Extension of child and family services programs</header><text display-inline="no-display-inline">Activities authorized by part B of title IV of the Social Security Act shall continue through February 3, 2023, in the manner authorized for fiscal year 2022, and out of any money in the Treasury of the United States not otherwise appropriated, there are hereby appropriated such sums as may be necessary for such purpose.</text></section></subtitle><subtitle id="H82941E01519E48F089AEA0D0BC13A72E"><enum>C</enum><header>Indian Health</header><section id="idD2558363EE8944AF83305C8303A06DE1"><enum>321.</enum><header>Extension of moratorium relating to funds for health care services for certain Alaska Native villages</header><text display-inline="no-display-inline">Section 424(a) of the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>; 128 Stat. 343; 132 Stat. 693;136 Stat. 2136) is amended by striking <quote>December 16, 2022</quote> and inserting <quote>February 3, 2023</quote>.</text></section></subtitle></title><title id="H77D2586A22EF4E4E9EB740271375D5E0"><enum>IV</enum><header>Reauthorization of other provisions</header><section id="H93BAD869993B42098959FABB12C3151F" commented="no"><enum>401.</enum><header>Reauthorization of the best pharmaceuticals for children program</header><text display-inline="no-display-inline">Section 409I(d)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284m">42 U.S.C. 284m(d)(1)</external-xref>) is amended by striking <quote>$5,273,973 for the period beginning on October 1, 2022 and ending on December 16, 2022</quote> and inserting <quote>$8,630,138 for the period beginning on October 1, 2022, and ending on February 3, 2023</quote>.</text></section><section id="H9D37E458629B40EBBC4F45E881E47BE4"><enum>402.</enum><header>Reauthorization of the humanitarian device exemption incentive</header><text display-inline="no-display-inline">Section 520(m)(6)(A)(iv) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360j">21 U.S.C. 360j(m)(6)(A)(iv)</external-xref>) is amended by striking <quote>December 17, 2022</quote> and inserting <quote>February 4, 2023</quote>.</text></section><section id="HCA0370FD12E14952BFBDA27B2F63B7FD"><enum>403.</enum><header>Reauthorization of the pediatric device consortia program</header><text display-inline="no-display-inline">Section 305(e) of the Food and Drug Administration Amendments Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/85">Public Law 110–85</external-xref>;
