the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to support upgrades at existing hydroelectric dams in order to increase clean energy production, improve the resiliency and reliability of the United States electric grid, enhance the health of the Nation's rivers and associated wildlife habitats, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maintaining and Enhancing Hydroelectricity and River Restoration Act of 2022</short-title></quote>.</text></section><section id="idC46E0B72005E4D1DA91BAA39B1BA6859"><enum>2.</enum><header>Credit for maintaining and enhancing hydroelectric facilities</header><subsection id="id9264DE24F36D41FDA8659E5A0DF92597"><enum>(a)</enum><header>In general</header><text>Subpart E of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986, as amended by section 13702 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended by inserting after section 48E the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB8638764ED3941728E3270DF61BCA290"><section id="id56028A1134B047EC94FFE0CD92F3120C"><enum>48F.</enum><header>Credit for maintaining and enhancing hydroelectric facilities</header><subsection id="id70375F4D7E43487D9E7305FC16EA26BB"><enum>(a)</enum><header>In general</header><text>For purposes of section 46, the credit for maintaining and enhancing hydroelectric facilities for any taxable year is an amount equal to 30 percent of the basis of any hydropower improvement property placed in service during such taxable year.</text></subsection><subsection id="id924A0AC45ABE436F9C2ECC39A7494800"><enum>(b)</enum><header>Certain progress expenditure rules made applicable</header><text>Rules similar to the rules of subsections (c)(4) and (d) of section 46 (as in effect on the day before the date of the enactment of the Revenue Reconciliation Act of 1990) shall apply for purposes of subsection (a).</text></subsection><subsection id="id7565FCE3CD4D40E4804BD0CD167B2F15"><enum>(c)</enum><header>Hydropower improvement property</header><text>In this section, the term <term>hydropower improvement property</term> means property—</text><paragraph id="id7582288CE75B45069E4EB3EE46F6BCF6"><enum>(1)</enum><text>which—</text><subparagraph id="idA25396C571654F85B2079099090F7F57"><enum>(A)</enum><text>adds or improves fish passage at a qualified dam,</text></subparagraph><subparagraph id="id1104511302884A1B92B97E6B0BCFADE2"><enum>(B)</enum><text>maintains or improves the quality of the water retained or released by a qualified dam,</text></subparagraph><subparagraph id="idCEC8678B99CC41F5A2856D70527EFF71"><enum>(C)</enum><text>promotes downstream sediment transport processes and habitat maintenance with respect to a qualified dam,</text></subparagraph><subparagraph id="idD0A57A1725AC4288A61501D58094B736"><enum>(D)</enum><text>upgrades, repairs, or reconstructs a qualified dam to meet Federal dam safety and security standards,</text></subparagraph><subparagraph id="id743CB06CCA244A2E88718B94FC5630CE"><enum>(E)</enum><text>improves the public uses of, and access to, public waterways impacted by a qualified dam in a manner consistent with a license issued by the Federal Energy Regulatory Commission or a settlement agreement reached with the Federal Energy Regulatory Commission pursuant to such a license,</text></subparagraph><subparagraph id="id4FD90700F4D64720BCBFAEC47AC4BDCD"><enum>(F)</enum><text>removes an obsolete river obstruction, or</text></subparagraph><subparagraph id="id4F99EA56231043F1BE40A103424F8564"><enum>(G)</enum><text>places into service an approved remote dam, and</text></subparagraph></paragraph><paragraph id="id3CABA3FE5E16443D95AF7A599D93CB37"><enum>(2)</enum><text>for which, prior to January 1, 2032, the taxpayer receives written approval with respect to any property described in paragraph (1) from the Federal Energy Regulatory Commission or State or local officials, as appropriate.</text></paragraph></subsection><subsection id="id5189BDF2F9D44E3C9D82BFA5A671FE13"><enum>(d)</enum><header>Other definitions</header><text>In this section—</text><paragraph id="id735B3604E2C941E0BFC1A12E9A596BD7"><enum>(1)</enum><header>Approved remote dam</header><text>The term <term>approved remote dam</term> means—</text><subparagraph id="id9E818E288D9B47DEA14A28A2E210C727"><enum>(A)</enum><text>a hydroelectric dam which—</text><clause id="id27796ADEFB154F408F61EBE39140828C"><enum>(i)</enum><text>exclusively services communities not interconnected to the Electric Reliability Council of Texas, the Eastern Interconnection, or the Western Interconnection,</text></clause><clause id="id01E8AC6FB43B4059BE9C5D34AC8BE9C6"><enum>(ii)</enum><text>was licensed by the Federal Energy Regulatory Commission before December 31, 2020, and</text></clause><clause id="id7CD0C1DA49314445A80A46A7E7DD4115"><enum>(iii)</enum><text>does not contribute to atmosphere pollution, and</text></clause></subparagraph><subparagraph id="id88186EEBBD084BFCAE8B40F215FBB5BA"><enum>(B)</enum><text>any qualified interconnection property (as defined in section 48(a)(8)(B)) associated with a dam described in subparagraph (A) which has a maximum net output of not greater than 20 megawatts. </text></subparagraph></paragraph><paragraph id="id3952D944A2AD48FE81F5A0190C137224"><enum>(2)</enum><header>Fish passage</header><text>The term <term>fish passage</term> means, with respect to any qualified dam, any new or upgraded turbine, fishway, or other fish passage technology which improves fish migration and survival rates.</text></paragraph><paragraph id="idD9E938E6196441DFAFF55D97ABA75283"><enum>(3)</enum><header>Obsolete river obstruction</header><text>The term <term>obsolete river obstruction</term> means a qualified nonpowered dam (as defined in section 34(e)(3) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/823e">16 U.S.C. 823e(e)(3)</external-xref>)) no longer serving its intended purpose.</text></paragraph><paragraph id="idC27FC74B70294790AC8FFBDB0DE5D68A"><enum>(4)</enum><header>Qualified dam</header><text>The term <term>qualified dam</term> means a hydroelectric dam that is licensed by the Federal Energy Regulatory Commission or legally operating without such a license before the date of enactment of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id83F3EC91DE79492AA044EAA66E232F70"><enum>(b)</enum><header>Elective payment and transfer of credit</header><paragraph id="id9E479ED78D874BB6BA4FE2A48474513D"><enum>(1)</enum><header>Elective payment</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6417">Section 6417</external-xref> of the Internal Revenue Code of 1986, as added by section 13801(a) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended—</text><subparagraph id="idB7CDFE2D3367481CBEE79E83457E0AAE"><enum>(A)</enum><text>in subsection (b), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id74277599BC474EF6975870DBE79B24C7"><paragraph id="id821DE4CC43A0408D83A783CAD13D4124"><enum>(13)</enum><text>The credit for maintaining and enhancing hydroelectric facilities under section 48F.</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id51CF3DFBADBD40F1AD36ED31D0676B51"><enum>(B)</enum><text>in subsection (d)(1)—</text><clause id="id0F103BA1C96A4ED898A4F7C6C3C3384B"><enum>(i)</enum><text>in subparagraph (E), by striking <quote>(C), or (D)</quote> each place it appears and inserting <quote>(C), (D), or (E)</quote>,</text></clause><clause id="id8FD548C41889440E82F13F2112137925"><enum>(ii)</enum><text>by redesignating subparagraph (E) (as amended by clause (i)) as subparagraph (F), and</text></clause><clause id="idE53EADB1320D42FFB8E11023D045571F"><enum>(iii)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD4A23B84537A47BF8C72548D5454505F"><subparagraph id="idEADA52E176014F30AFBC5A4A114D38A8"><enum>(E)</enum><header>Election with respect to credit for maintaining and enhancing hydroelectric facilities</header><text>If a taxpayer other than an entity described in subparagraph (A) makes an election under this subparagraph with respect to any taxable year in which such taxpayer has, after December 31, 2022, placed in service hydropower improvement property (as defined in section 48F(c)), such taxpayer shall be treated as an applicable entity for purposes of this section for such taxable year, but only with respect to the credit described in subsection (b)(13).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idFE261E069E4447A886ED93F097814079"><enum>(2)</enum><header>Transfer</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6418">Section 6418(f)(1)(A)</external-xref> of the Internal Revenue Code of 1986, as added by section 13801(b) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDFC4A6CC20DB473F8D8B03AEF8461F92"><clause id="id1B620413AF4E43AE9811D3C7D11DD9CC"><enum>(xii)</enum><text>The credit for maintaining and enhancing hydroelectric facilities under section 48F.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2B0BDB0FE8B44063B030F713853C5879"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="idD3A6CD339F0545FC81D7F1DC706AC6EB"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/46">Section 46</external-xref> of the Internal Revenue Code of 1986, as amended by section 13702(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended—</text><subparagraph id="id3AE9A86639B84CC5A13A9245EFB2DAC7"><enum>(A)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end,</text></subparagraph><subparagraph id="id00A46476D8394E34BA44EC76CD6D8173"><enum>(B)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>, and</quote>, and</text></subparagraph><subparagraph id="idA3A172EA680A431C80ED15200E142B4A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C6543807D9B4AF5804A42CDC316BD9F"><paragraph id="idAC1B9929FF5248428126A71ADD04CA05"><enum>(8)</enum><text>the credit for maintaining and enhancing hydroelectric facilities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idD1E14F651F5548B5B8BBFBE60882B110"><enum>(2)</enum><text>Section 49(a)(1)(C) of such Code, as amended by section 13702(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended—</text><subparagraph id="id217D190434EF44519682E7BE11F33E38"><enum>(A)</enum><text>in clause (vii), by striking <quote>and</quote> at the end,</text></subparagraph><subparagraph id="id0752AB344B044FDB8A013DFFB76D39BA"><enum>(B)</enum><text>in clause (viii), by striking the period at the end and inserting <quote>, and</quote>, and</text></subparagraph><subparagraph id="id146482764A66422FA1E17AA4FBCA78F3"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5FF8931F60654D74BC2664C4E676CD3B"><clause id="idDD63A712FCC145E79462F4EA13BBCF1E"><enum>(ix)</enum><text>the basis of any hydropower improvement property under section 48F.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4017989B8CDE4298ACA2D056E09388A8"><enum>(3)</enum><text>Section 50 of such Code is amended—</text><subparagraph id="id1F3B2D6242D84E8B89D7EF1AF073006C"><enum>(A)</enum><text>in subsection (a)(2)(E), as amended by section 13702(b) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, by striking <quote>or 48E(e)</quote> and inserting <quote>48E(e), or 48F(b)</quote>, and</text></subparagraph><subparagraph id="id7D49360EEA524F6C88B20FCA9440E388"><enum>(B)</enum><text>in subsection (d)(2), as amended by section 13102(f)(5) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>—</text><clause id="idA4A21078C30747E9BA09E035D77AD42C"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>or any hydropower improvement property (as defined in section 48F(c))</quote> after <quote>any energy storage technology (as defined in section 48(c)(6))</quote>, and</text></clause><clause id="id9D9D2908F2554DA7B5175E441FBB47B1"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>energy storage technology</quote> each place it appears and inserting <quote>energy storage technology or hydropower improvement property</quote>.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id1130905A7C434E37BB7C85936468EADC"><enum>(4)</enum><text>The table of sections for subpart E of part IV of subchapter A of chapter 1 of such Code, as amended by section 13702(b)(5) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>, is amended by inserting after the item relating to section 48E the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8B66B6388A540668AF45EAA65DC173E"><toc><toc-entry level="section" bold="off">Sec. 48F. Credit for maintaining and enhancing hydroelectric facilities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id753CB67023C046718C4431100690EB8D"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after December 31, 2022.</text></subsection></section></legis-body></bill>
