<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5218</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221208">December 8, 2022</action-date><action-desc><sponsor name-id="S229">Mrs. Murray</sponsor> (for herself, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S307">Mr. Brown</cosponsor>, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S386">Ms. Duckworth</cosponsor>, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, and <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the civil rights remedies equalization provision of the Rehabilitation Act Amendments of 1986 to clarify civil rights remedies.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clarifying Civil Rights Remedies Act of 2022</short-title></quote>.</text></section><section id="id6a27873fbe9f4cf2bfd4be512b710367"><enum>2.</enum><header>Purposes</header><subsection id="id6edd754a14f0431fb88dd3ce554c3f6b"><enum>(a)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="idadfdc3d42a8544ccb7c1930422cf81a1"><enum>(1)</enum><text>to remedy and deter violations of rights guaranteed under section 504 of the Rehabilitation Act of 1973, section 1557 of the Patient Protection and Affordable Care Act, title IX of the Education Amendments of 1972, the Age Discrimination Act of 1975, and title VI of the Civil Rights Act of 1964, by safeguarding the availability of damages for emotional harm in actions alleging violations of these laws; and</text></paragraph><paragraph id="id241797da614a4a10a55a1f91fc1fe5d7"><enum>(2)</enum><text>to invoke the sweep of congressional authority, including the power to enforce the Equal Protection Clause of the 14th Amendment to the Constitution of the United States and to set the terms on which Congress disburses Federal money under the Spending Clause of section 8 of article I of the Constitution, in order to remedy and deter discrimination on the basis of disability, race, color, national origin, age, and sex that people face every day.</text></paragraph></subsection></section><section id="idacf11bbb191b4f9b8e6e714498d1fb7b" commented="no"><enum>3.</enum><header>Civil rights remedies</header><text display-inline="no-display-inline">Section 1003 of the Rehabilitation Act Amendments of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-7">42 U.S.C. 2000d–7</external-xref>) is amended—</text><paragraph id="idA85744DD7CC4449EA0974DFE3F3CB13D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c);</text></paragraph><paragraph id="id4DF4EF67CE4F443690DE5CE3E513559E" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id51443499d4e247ff91a228ea2182c289"><subsection id="ide5776320156c44ffbb97309a4ddac3f6" commented="no"><enum>(b)</enum><header>Compensatory damages</header><text>Remedies at law available for a violation of a section or other provision referred to in subsection (a)(1), in a suit against any entity, private or public, including a State, shall include all types of compensatory damages, including damages for emotional harm.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idC03D9C273E2D42F2980EF3E5D3BA3867" commented="no"><enum>(3)</enum><text>by amending subsection (c), as amended by paragraph (1), to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0b96aa8d7a434d34a6b2fc09cdc0b475"><subsection id="id69a8af1dc1194cec9b2718a9d3158e6b" commented="no"><enum>(c)</enum><header>Effective date</header><text>The provisions of subsection (a) shall take effect with respect to violations that occur in whole or in part after October 21, 1986. Subsection (b) shall take effect with respect to violations for which a court has not rendered a final decision on the date of enactment of the Clarifying Civil Rights Remedies Act of 2022.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
