which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the treatment of Federal prisoners who are primary caretaker parents, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H385D8AD4F3904202B3E023AE45DB3FE7"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dignity Act</short-title></quote>.</text></section><section id="HE554457AF91B4639AB606D2E8EEC2818"><enum>2.</enum><header>Improving the treatment of primary caretaker parents and other individuals in Federal prisons</header><text display-inline="no-display-inline">Section 4051 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5D779F038862471BA1CEDBA42C27490A"><subsection id="id1F415ACC68034AF9944A07D177D6C2ED"><enum>(i)</enum><header>Visitation rules</header><text>The Director shall promulgate regulations for visitation between prisoners who are primary caretaker parents and their family members under which—</text><paragraph id="id1F5B3272B878465C8C6BC18691C66659"><enum>(1)</enum><text>a prisoner may receive visits not fewer than 6 days per week, which shall include Saturday and Sunday;</text></paragraph><paragraph id="id461036BAD97644BDBCFD25EC4E5A0BAF"><enum>(2)</enum><text>a covered institution shall be open for visitation for not fewer than 8 hours per day;</text></paragraph><paragraph id="id5CC673C5F1F84F279F613FEEEB971D3F"><enum>(3)</enum><text>a prisoner may have up to 5 adult visitors and an unlimited number of child visitors per visit; and</text></paragraph><paragraph id="idE62ADAE68EE94289AD6F28DA785712AA"><enum>(4)</enum><text>a prisoner may have physical contact with visitors unless the prisoner presents an immediate physical danger to the visitors.</text></paragraph></subsection><subsection id="id379B6D01DAD64DF08D0DEB79635210E1"><enum>(j)</enum><header>Ombudsman</header><text>The Attorney General shall designate an ombudsman to oversee and monitor, with respect to covered institutions—</text><paragraph id="id285269B1B344457C9EB617EC4F4FC93E"><enum>(1)</enum><text>prisoner transportation;</text></paragraph><paragraph id="id581AE9AFE1544B19A7EFBA0F375D4452"><enum>(2)</enum><text>use of segregated housing;</text></paragraph><paragraph id="id8DC87042B207465389F3A53E89D113F1"><enum>(3)</enum><text>strip searches of prisoners; and</text></paragraph><paragraph id="id834DB860CEA1459E90ED122B48CA4D44"><enum>(4)</enum><text>civil rights violations.</text></paragraph></subsection><subsection id="idB2440EBBB0B34D559AB982F6F864FCC0"><enum>(k)</enum><header>Telecommunications</header><paragraph id="idADA73AFB5CA34E158DB8F07CBF88ADD7"><enum>(1)</enum><header>In general</header><text>The Director—</text><subparagraph id="idC8FB1AE057ED40B38261CB8FF1E8B2E8"><enum>(A)</enum><text>may not charge a fee for a telephone call made by a prisoner; and</text></subparagraph><subparagraph id="id2DCBF0B61FEF4153A1F8B858858DD823"><enum>(B)</enum><text>shall make videoconferencing available to prisoners in each covered institution free of charge.</text></subparagraph></paragraph><paragraph id="id7B6455597DE5489086C98CAB4A8724DA"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in paragraph (1)(B) shall be construed to authorize the Director to use videoconferencing as a substitute for in-person visits.</text></paragraph></subsection><subsection id="H3D9597A7E13A4EB39B2AB15FA3320A35"><enum>(l)</enum><header>Use of sex-Appropriate correctional officers</header><paragraph id="HC0EF764A1D574002B1C1DC1A9F7D9956"><enum>(1)</enum><header>Regulations</header><text>The Director shall make rules under which—</text><subparagraph id="H681E10681240464B8613CF9479AC13F7"><enum>(A)</enum><text>a correctional officer may not conduct a strip search of a prisoner of the opposite sex unless—</text><clause id="H53A258DE730D43399CEC09E32524FC34"><enum>(i)</enum><text>the prisoner presents a risk of immediate harm to the prisoner or others, and no other correctional officer of the same sex as the prisoner, or medical staff, is available to assist; or</text></clause><clause id="HD494456A37E248F2B1F78BF2853C60B4"><enum>(ii)</enum><text>the prisoner has previously requested that an officer of a different sex conduct searches;</text></clause></subparagraph><subparagraph id="HE562F5A91CAF42AAAD0F63D5E3ADC807"><enum>(B)</enum><text>a correctional officer may not enter a restroom reserved for prisoners of the opposite sex unless—</text><clause id="H1CDAB5B974BB40CFBA5C72AD3ADF128F"><enum>(i)</enum><text>a prisoner in the restroom presents a risk of immediate harm to the prisoner or others; or</text></clause><clause id="H07B2B6D7DBC54992ADA1CC4938CCB9E4"><enum>(ii)</enum><text>there is a medical emergency in the restroom and no other correctional officer of the appropriate sex is available to assist;</text></clause></subparagraph><subparagraph id="HAC749A0F488142248567E9FB6B2430B3"><enum>(C)</enum><text>a transgender prisoner’s sex shall be determined according to the sex with which the prisoner identifies; and</text></subparagraph><subparagraph id="H1D7421F7959C4B2BA57F0FD9B352BAE6"><enum>(D)</enum><text>a correctional officer may not search or physically examine a prisoner for the sole purpose of determining the prisoner’s genital status or sex.</text></subparagraph></paragraph><paragraph id="H95D206E9D56149D49DAA4764306BBC34"><enum>(2)</enum><header>Relation to other laws</header><text>Nothing in paragraph (1) shall be construed to affect the requirements under the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/34/30301">34 U.S.C. 30301 et seq.</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8A28D1314791447098575B57713A8809"><enum>3.</enum><header>Overnight visit pilot program</header><subsection id="id96345434ED284F5D98E9A741737D5449"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id17FA9854DFAB409CAE777FB6DF6E1D80"><enum>(1)</enum><text>the term <term>Director</term> means the Director of the Bureau of Prisons;</text></paragraph><paragraph id="id25BD25BA46D744CCB634AD8B9D678EFD"><enum>(2)</enum><text>the term <term>primary caretaker parent</term> has the meaning given the term in section 31903 of the Family United Demonstration Project Act (<external-xref legal-doc="usc" parsable-cite="usc/34/12242">34 U.S.C. 12242</external-xref>); and</text></paragraph><paragraph id="id29CD4C2717414343867714D2A3B3D993"><enum>(3)</enum><text>the term <term>prisoner</term> means an individual who is incarcerated in a Federal penal or correctional institution.</text></paragraph></subsection><subsection id="idFBA1444B62294FAA936786F156FE7EC9"><enum>(b)</enum><header>Pilot program</header><text display-inline="yes-display-inline">The Director shall carry out a pilot program under which prisoners who are primary caretaker parents and meet eligibility criteria established by the Director may receive overnight visits from family members.</text></subsection><subsection id="idB6F1E3FEC85B460AAABD17580E48571C"><enum>(c)</enum><header>Eligibility criteria</header><text>In establishing eligibility criteria for the pilot program under subsection (b), the Director shall—</text><paragraph id="idD59BD3537B064598BD3E82BC55AD9E56"><enum>(1)</enum><text>require that a prisoner have displayed good behavior; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE57E4CA1C024CCD9C85B272921790CD"><enum>(2)</enum><text>prohibit participation by any prisoner who has been convicted of a crime of violence (as defined in section 16 of title 18, United States Code).</text></paragraph></subsection></section></legis-body></bill>
