<official-title>To review the use of election security grants in the 2020 Presidential election and to prohibit future election security grants to States with unconstitutional election procedures.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Right to Organized, Transparent Elections through a Constitutionally Trustworthy Electoral College Act (PROTECT Electoral College Act)</short-title></quote>.</text></section> <section id="id3B7E61EB3B7340F386AC7F7429B1F7D9"><enum>2.</enum><header>Report on 2020 general election</header> <subsection id="id5C631BEC2AF94B23B4832B7388D77A98"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text>
<paragraph id="id4C4A7A3737674376BC3C0A6FD6232792"><enum>(1)</enum><header>2016 Presidential election</header><text>The term <term>2016 Presidential election</term> means the general election for Federal office occurring in 2016. </text></paragraph> <paragraph id="idDD373B27AD4847929A940CCAE55342AC"><enum>(2)</enum><header>2020 Presidential election</header><text>The term <term>2020 Presidential election</term> means the general election for Federal office occurring in 2020.</text></paragraph>
<paragraph id="idF4A9132693464005BCDB86E7A7D60228" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Applicable election security funds</header><text display-inline="yes-display-inline">The term <term>applicable election security funds</term> means the amount of grant funding provided to the State by the Election Assistance Commission—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8D57B44DFE9D403BBE2F8C6D3C775967"><enum>(A)</enum><text display-inline="yes-display-inline">from amounts appropriated under the heading <quote>Election Assistance Commission, Election Security Grants</quote> in the Financial Services and General Government Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/93">Public Law 116–93</external-xref>); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id2B933F22DAEE4947A9D97C8389D0AC41"><enum>(B)</enum><text display-inline="yes-display-inline">from amounts appropriated under the heading <quote>Election Assistance Commission, Election Security Grants</quote> in the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></subparagraph></paragraph> <paragraph id="idDD74B1BC57494862BD0E234EA7A1428A" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>State</header><text>The term <term>State</term> has the meaning given such term under section 901 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21141">52 U.S.C. 21141</external-xref>), except that such term shall include the Commonwealth of the Northern Mariana Islands.</text></paragraph>
<paragraph display-inline="no-display-inline" commented="no" id="idC05574C1A8CE4C8088472E7B7337E8D3"><enum>(5)</enum><header>Unsolicited mail-in ballot</header><text>The term <term>unsolicited mail-in ballot</term> means any ballot sent to a voter by mail if—</text> <subparagraph display-inline="no-display-inline" commented="no" id="idB5CB7F14AF454B83B6AAFB0D1B8AC0E2"><enum>(A)</enum><text>such ballot was not specifically requested by the voter; or</text></subparagraph>
<subparagraph display-inline="no-display-inline" commented="no" id="idD2015E9A02D94CB0B5A9ACC9CB1A40D6"><enum>(B)</enum><text>the ballot request by the voter was initiated by the mailing of a ballot application not specifically requested by the voter.</text></subparagraph></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="id3C56EE2EE39F44A9BA36875BA9F133CF"><enum>(6)</enum><header>Unsolicited mail-in ballot percentage</header><text>The term <term>unsolicited mail-in ballot percentage</term> means the number of unsolicited mail-in ballots distributed in the State as a percentage of the number of total ballots provided to voters in the State.</text></paragraph></subsection>
<subsection id="id9D84737B1EE149D19A3F9418684C65A4"><enum>(b)</enum><header>Report</header>
<paragraph id="idA2905164A73341D7995DE10B0405C00F"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General shall submit to Congress and make publicly available a report on the 2020 Presidential election. </text></paragraph> <paragraph id="id1BDB693085F4496BB61D2D0DDF6DF1E5"><enum>(2)</enum><header>Matters included</header><text>The report submitted under paragraph (1) shall include the following with respect to each State: that received applicable election security funds:</text>
<subparagraph id="id103E654A475F4F3CBE4C0156D1F31E58"><enum>(A)</enum><header>Unsolicited mail-in ballot percentage</header>
<clause id="id736F9EB6651B4A8BAB119CC3CF7A0375"><enum>(i)</enum><header>In general</header><text>An analysis of whether the unsolicited mail-in ballot percentage for State for the 2020 Presidential election was greater than the unsolicited mail-in ballot percentage for the State for the 2016 Presidential election. </text></clause> <clause id="id3ECEC5B161B246ABA8C3FB6135F6BE2A"><enum>(ii)</enum><header>Relevant authority for any increase</header><text>If the Comptroller General determines that the unsolicited mail-in ballot percentage for the State for the 2020 Presidential election was greater than the unsolicited mail-in ballot percentage for the State for the 2016 Presidential election, the Comptroller General shall provide a description of any change in authority (including any statutory change relating to the distribution of unsolicited mail-in ballots), action, or directive concerning unsolicited mail-in ballots occurring between the 2016 Presidential election and 2020 Presidential election that may have led to such result. </text></clause></subparagraph>
<subparagraph id="id4BCD2CBBE4AD4457A4C0F02FAC4B13A5"><enum>(B)</enum><header>Mail-in voter verification procedures</header>
<clause id="idA90C0A42B6D6495FB9C0438301FD96FB"><enum>(i)</enum><header>In general</header><text>An analysis of whether there were changes in the State’s methods and processes used to verify the identification of voters who vote using mail-in ballots, including signature verification requirements, that applied with respect to the 2020 Presidential election but did not apply to the 2016 Presidential election. </text></clause> <clause id="idEC77685522C5472F8BCBB7382E605E6A"><enum>(ii)</enum><header>Relevant authority for changes</header><text>If the Comptroller General determines that there were changes in the State’s mail-in voter verification procedures described in clause (i), the Comptroller General shall provide a description of any authority (including any statutory authority), action, or directive that led to such change. </text></clause></subparagraph>
<subparagraph id="id5E0FCF81B3A64F268B5C774F6E5D4CEE"><enum>(C)</enum><header>Other election procedures</header>
<clause id="idB8063D179CDF4D1E9D138A89457F3C0A"><enum>(i)</enum><header>In general</header><text>An analysis of whether the State materially altered or changed its election procedures for the 2020 Presidential election (other than procedures described in subparagraph (B)) from the procedures in effect for the 2016 Presidential election. </text></clause> <clause id="id47F56C167EC04E09ABD574660FA3867E"><enum>(ii)</enum><header>Relevant authority for changes</header><text>If the Comptroller General determines that there were changes in the election procedures described in clause (i), the Comptroller General shall provide a description of any authority (including any statutory authority), action, or directive that led to such change. </text></clause></subparagraph>
<subparagraph id="id90C897F27CE04D54A91ADB4A45C4861C"><enum>(D)</enum><header>Mail-in ballot collection</header>
<clause id="idFF4BE4CC7E9540D8BFB2DA4812616060"><enum>(i)</enum><header>In general</header><text>An analysis of whether there were specific, documented allegations of a person other than a voter or a voter’s family member or caregiver collecting or returning the voter's completed ballot in the 2020 Presidential election. </text></clause> <clause id="id14CA46D89A4B43D995319C1114D99F60"><enum>(ii)</enum><header>Relevant authority for collection</header><text>If the Comptroller General determines that there were specific, documented allegations described in clause (i), the Comptroller General shall provide a description of any authority (including any statutory authority), action, or directive permitting such collection or return. </text></clause></subparagraph>
<subparagraph id="idBA49ACF937374042844B50FFD632CB19"><enum>(E)</enum><header>Observation of ballot counting</header><text>An analysis of whether the State has a statute providing for third-party observation of ballot counting, and if so, whether there were specific, documented instances in connection with the 2020 Presidential election in which the State is alleged to have failed to comply with such statute.</text></subparagraph> <subparagraph id="idF5A9FAC97335478690A11E952CAFEB24"><enum>(F)</enum><header>Failure to enforce</header><text>An analysis of whether there were specific, documented instances in connection with the 2020 Presidential election in which the State allegedly failed to enforce one or more of its election statutes (other than a statute described in subparagraph (E)).</text></subparagraph>
<subparagraph id="id0f1e4b662d664149b714e1ad9b2cbe21"><enum>(G)</enum><header>Use of applicable election security funds</header><text>In the case of a State that received applicable election security funds, an analysis of—</text> <clause id="id0F43523EA6C04CF595EE56BB76CE33CE"><enum>(i)</enum><text>whether such funds were used to make expenditures with respect to the 2020 Presidential election;</text></clause>
<clause id="id89271F178FFE4CD4A05BDBC4E8BDA13E"><enum>(ii)</enum><text>whether such funds were used in connection with any activity carried out pursuant to an authority, action, or directive described in subparagraph (A)(ii), (B)(ii), (C)(ii), or (D)(ii); and</text></clause> <clause id="idA5320474CC5B4896B7DC87F8E8477AB9"><enum>(iii)</enum><text>whether the State complied with all statutory and other conditions imposed in connection with the receipt of such funds.</text></clause></subparagraph>
<subparagraph id="idE9CE2B3812FB4DBCB004C751368DA4DE"><enum>(H)</enum><header>Subsequent State actions</header><text>A description of any of the following actions taken by the State legislature:</text> <clause id="id3EF5141E75E94CCEA9FF1A9380306E6E"><enum>(i)</enum><text>The passage of a resolution expressing an opinion on, or the submission to Congress or the Comptroller General of a communication relating to, the items described in subparagraphs (A) through (G).</text></clause>
<clause id="id32F8D35656A5485388678543D3FE78E6"><enum>(ii)</enum><text>The enactment, after the completion of the 2020 Presidential election, of legislation regarding any authority, action, or directive described in subparagraph (A)(ii), (B)(ii), (C)(ii), or (D)(ii) or any failure described in subparagraph (E) or (F).</text></clause></subparagraph></paragraph></subsection></section> <section id="ide5c3809c5d5c461593b32a0af5f7cd0f"><enum>3.</enum><header>Temporary suspension of, and requirements for, future election assistance grants</header> <subsection id="ide933e34d47124d30948d6fa115bee09f"><enum>(a)</enum><header>In general</header><text>Subtitle D of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20901">52 U.S.C. 20901</external-xref> et seq.) is amended by adding at the end the following new part:</text>

<part id="idb021078bac8f4bf38ba461b770e9e031"><enum>7</enum><header>Requirements for election assistance</header>
<section id="id208d458244c54543bbec573c5cf7f4fa"><enum>297.</enum><header>Suspension of election assistance</header>
<subsection id="idC8263417E90743A38756AEB0C9688483"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no grant may be awarded under this Act before July 1, 2022.</text></subsection> <subsection id="idDE822275492A4EAEAB8B0D62F9E1E59F"><enum>(b)</enum><header>Suspension of previous grants</header><text>No State may expend Federal funds provided under this Act before the date of the enactment of this section before July 1, 2022.</text></subsection></section>
<section id="id74CAAFB94A314D5E91C3C9FA36F03168"><enum>298.</enum><header>Requirements for future election assistance</header>
<subsection id="id7BD9AB1BBFA2450E88BC2FD4879B7C61"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no State may receive any grant awarded under this Act after the date of the enactment of this section unless the State has certified by resolution adopted by the State legislature, as a condition of receiving the grant, that it is in compliance with the requirements of subsection (b). </text></subsection> <subsection id="id6901E2F790F949BA902BAFCF970BD195"><enum>(b)</enum><header>Requirements</header> <paragraph id="id240FCBFC06784C3DA7A5FAB3CCCD0810"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State satisfies the requirements of this section if, in connection with any election for Federal office—</text>
<subparagraph id="id051787203c2c4321a2cde8933fe20e4e"><enum>(A)</enum><text>the methods and processes used by the State to verify the identification of voters who vote using mail-in ballots are specifically set forth in statute;</text></subparagraph> <subparagraph id="idcae06fa479284bd29e21e5d34004ed07"><enum>(B)</enum><text>except as specifically provided by statute—</text>
<clause id="id6710991EA7FB4D8880CB048AD10C22E4"><enum>(i)</enum><text>the State does not use unsolicited mail-in balloting; and</text></clause> <clause id="id678b0a3d576741ddb80e82f069f4b308"><enum>(ii)</enum><text>the State does not permit persons other than the voter or the voter’s family members or caregivers to return a voter’s completed ballot;</text></clause></subparagraph>
<subparagraph id="id9bd1993d02bd4752b39f8999145a340e"><enum>(C)</enum><text>for any election after the last day that the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19, is in effect, the State uses all voting procedures in place as of January 1, 2020 (except as modified by State statutes applying to elections after such date);</text></subparagraph> <subparagraph id="id6036f1c3b6ae43e0a2d1b362d989ec57"><enum>(D)</enum><text>in the case of State that has a law providing for third-party observation of ballot counting, such ballot observation law is strictly followed in all instances;</text></subparagraph>
<subparagraph id="id3fea9ac2275d47998d2d4f19fbc55cfe"><enum>(E)</enum><text>the State complies with all requirements under title III; and</text></subparagraph> <subparagraph id="ide3a349cb7c194b9e821c1ad95833cf19"><enum>(F)</enum><text>the State has taken documented, affirmative measures to address—</text>
<clause id="id7989806B1838441C8E33B7709F0844E1"><enum>(i)</enum><text>any prior failure to satisfy the requirements of subparagraphs (A) through (E) that is identified by the State legislature in a resolution (or other similar communication submitted to Congress and the Comptroller General); or </text></clause> <clause id="id8071B7DF24DD4052B74406626CB55342"><enum>(ii)</enum><text>any prior specific, documented instance in which the State—</text>
<subclause id="id70C3389BAFF94659BA1EA2824867F28E"><enum>(I)</enum><text>failed to enforce one or more of its election statutes; or </text></subclause> <subclause id="idCB069E39E51F4CC497ED5FC6CBFF3039"><enum>(II)</enum><text>materially altered or changed its election procedures without a corresponding state statutory enactment.</text></subclause></clause></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" commented="no" id="id3A9EF343A8B04A1C950CE4ED4D19268A"><enum>(2)</enum><header>Unsolicited mail-in balloting</header><text>For purposes of paragraph (1)(B), the term <term>unsolicited mail-in balloting</term> means the process of sending ballots to a voter by mail if—</text> <subparagraph display-inline="no-display-inline" commented="no" id="idD640B477A20846A1B698A6BCF4578352"><enum>(A)</enum><text>such ballot was not specifically requested by the voter; or</text></subparagraph>
<subparagraph id="id5F3BBAB6CE1F42BCBB679B396ED61344" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the ballot request by the voter was initiated by the mailing of a ballot application not specifically requested by the voter.</text></subparagraph></paragraph></subsection></section></part> <part id="id94661D4851274ADF8EB5AA1E1303F461" style="OLC"><enum>8</enum><header>Prohibition on use of funds</header> <section commented="no" display-inline="no-display-inline" id="id8D04E48053874B7B8ECF15163010C4F2"><enum>299.</enum><header>Prohibition on use of funds</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, any amounts provided under this Act shall not be used in furtherance of any election procedure that is not expressly set forth in a statute enacted by the State legislature.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id2577b0f4c69f45e58e374a0cdb9fa48f"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the Help America Vote Act of 2002 is amended by inserting after the item relating to section 296 the following:</text> <quoted-block style="OLC" id="id585f97d0-f748-4f61-952c-d42129c42d6d"> <toc> <toc-entry level="part" idref="idb021078bac8f4bf38ba461b770e9e031">Part 7—Requirements for election assistance </toc-entry> <toc-entry level="section" idref="id208d458244c54543bbec573c5cf7f4fa">Sec. 297.
