<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 106</calendar><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 517</legis-num><associated-doc>[Report No. 117–31]</associated-doc><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>March 1, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S346">Mr. Lee</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 26, 2021</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for joint reports by relevant Federal agencies to Congress regarding incidents of terrorism, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="idcd14b457-379f-4b5a-9962-275933ae59fa"><enum>1.</enum><header display-inline="yes-display-inline">Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reporting Efficiently to Proper Officials in Response to Terrorism Act of 2021</short-title></quote> or the <quote><short-title>REPORT Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idc3bcf52d-8698-4210-b0a6-553b42570c2e"><enum>2.</enum><header display-inline="yes-display-inline">Duty to report</header><subsection commented="no" display-inline="no-display-inline" id="id34e02a59-4a3b-4aa6-a04a-9166da757905"><enum>(a)</enum><header display-inline="yes-display-inline">Duty imposed</header><text display-inline="yes-display-inline">Except as provided in subsection (c), whenever an act of terrorism occurs in the United States, it shall be the duty of the primary Government agency investigating such act to submit, in collaboration with the Secretary of Homeland Security, the Attorney General, the Director of the Federal Bureau of Investigation, and, as appropriate, the Director of the National Counterterrorism Center, an unclassified report (which may be accompanied by a classified annex) to Congress concerning such act not later than 1 year after the completion of the investigation. Reports required under this subsection may be combined into a quarterly report to Congress.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ebcd8c4-c615-4bce-9c74-9f43b93b6a14"><enum>(b)</enum><header display-inline="yes-display-inline">Content of reports</header><text display-inline="yes-display-inline">Each report under this section shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id70845a12-ae98-4c61-b037-3685f2106018"><enum>(1)</enum><text display-inline="yes-display-inline">a statement of the facts of the act of terrorism referred to in subsection (a), as known at the time of the report;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddfd21741-f4bd-4dfb-a300-a4fb89ac179a"><enum>(2)</enum><text display-inline="yes-display-inline">an explanation of any gaps in national security that could be addressed to prevent future acts of terrorism;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0336244-ff55-4910-8fcd-018c58e441ff"><enum>(3)</enum><text display-inline="yes-display-inline">any recommendations for additional measures that could be taken to improve homeland security, including potential changes in law enforcement practices or changes in law, with particular attention to changes that could help prevent future acts of terrorism; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9A7D3CA17D942F9ABDB86B88E11C90F"><enum>(4)</enum><text display-inline="yes-display-inline">a summary of the report for public distribution.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id62ada25b-cbe5-446d-8d2c-a54619b0ec3b"><enum>(c)</enum><header display-inline="yes-display-inline">Exception</header><paragraph commented="no" display-inline="no-display-inline" id="id192009F3DBF040A88940D36B2C36F2B1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The duty established under subsection (a) shall not apply in instances in which the Secretary of Homeland Security, the Attorney General, the Director of the Federal Bureau of Investigation, or the head of the National Counterterrorism Center determines that the information required to be reported could jeopardize an ongoing investigation or prosecution.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4DB49A3B5007419B8A4C2CC4107BD260"><enum>(2)</enum><header display-inline="yes-display-inline">Notification requirement</header><text display-inline="yes-display-inline">In each instance described in paragraph (1), the principal making a determination under such paragraph shall notify Congress of such determination not later than 1 year after the completion of the related investigation described in subsection (a).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idddbdc33a-effa-4610-8566-c709b0718c18"><enum>(d)</enum><header display-inline="yes-display-inline">Defined term</header><text display-inline="yes-display-inline">In this section, the term <term>act of terrorism</term> means an act of domestic terrorism or international terrorism (as such terms are defined in section 2331 of title 18, United States Code).</text></subsection><subsection commented="no" display-inline="no-display-inline" changed="not-changed" id="id8560640B57574208B7AEDEFE9590CC9F"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">This section shall cease to be effective beginning on the date that is 5 years after the date of the enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date>July 26, 2021</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
