<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 516</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210301">March 1, 2021</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> (for himself and <cosponsor name-id="S403">Ms. Sinema</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To plan for and coordinate efforts to integrate advanced air mobility aircraft into the national airspace system, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Air Mobility Coordination and Leadership Act</short-title></quote>.</text></section><section id="id7209c06bac0b476cb5c950a672ec7603"><enum>2.</enum><header>Advanced air mobility working group</header><subsection id="ide74695f2889b4378b963ca7e95ef28f4"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary of Transportation shall establish an advanced air mobility interagency working group (in this section referred to as the <quote>working group</quote>). </text></subsection><subsection id="idD267282924D84A4D863D4778DFEB1959"><enum>(b)</enum><header>Sense of congress</header><text>It is the sense of Congress that Advanced Air Mobility (AAM) represents a key area of sustainable transportation and economic growth for the United States and globally, and that it is imperative that the United States take a leadership role in the adoption and furtherance of this technology. Therefore, given the path to initial operations is taking place utilizing today’s regulatory framework, it is critical that government agencies collaborate and focus on taking this vital industry to the next level. </text></subsection><subsection id="id98f8ee1029234e75a2357d55b20147c0"><enum>(c)</enum><header>Purpose</header><text>The purpose of the working group established under this section is to plan for and coordinate efforts related to the physical and digital security, safety, infrastructure, and Federal investment necessary for maturation of the AAM ecosystem in the United States in order to—</text><paragraph id="id5D8EB85DB44546D380EC4FF9087F150F"><enum>(1)</enum><text>further United States leadership;</text></paragraph><paragraph id="idDBDC4EBD57154890BFB8BCD7573271BE"><enum>(2)</enum><text>grow new transportation options;</text></paragraph><paragraph id="idC442CA1E0E724B3192D59C51EA744121"><enum>(3)</enum><text>amplify economic activity and jobs;</text></paragraph><paragraph id="idF7672DA42C5C41FC9F2B56A9CA29C8D5"><enum>(4)</enum><text>advance environmental sustainability and new technologies; and</text></paragraph><paragraph id="id730DFF59F7624906830013E7638AAB4B"><enum>(5)</enum><text>support emergency preparedness and competitiveness. </text></paragraph></subsection><subsection id="id7a7fda1088d94e2c8d40fc42c7776962"><enum>(d)</enum><header>Membership</header><text>The working group shall be comprised of at least 1 representative of each of the following Federal departments and agencies:</text><paragraph id="id9c27754b6da94f3799f41ce702ecbae0"><enum>(1)</enum><text>Department of Transportation.</text></paragraph><paragraph id="idb4add35a82844b24b1b5b9b3119901d3"><enum>(2)</enum><text>Federal Aviation Administration.</text></paragraph><paragraph id="id2073d9f8aafb4357bfc56631eaf7c20a"><enum>(3)</enum><text>National Aeronautics and Space Administration.</text></paragraph><paragraph id="idb97eb0d188f14a4e98a2c7a04eb1cb95"><enum>(4)</enum><text>Department of Commerce</text></paragraph><paragraph id="ide3f88b8dd39445c9ac26563d2d2efafb"><enum>(5)</enum><text>Department of Defense.</text></paragraph><paragraph id="id3d994c9dfec34f2691d8a62c799b240d"><enum>(6)</enum><text>Department of Energy.</text></paragraph><paragraph id="id69ce5d6625524e40959953ad1f0fcca8"><enum>(7)</enum><text>Department of Homeland Security.</text></paragraph><paragraph id="idd217e6d9e2f44574af1144be69e64b89"><enum>(8)</enum><text>Department of Agriculture.</text></paragraph><paragraph id="id373593ECD8E1403B86F9A69E9762D33D"><enum>(9)</enum><text>Department of Labor.</text></paragraph><paragraph id="id81b6ecf1eec7417486a5b425828b465f"><enum>(10)</enum><text>Such other departments or agencies as the Secretary of Transportation determines appropriate.</text></paragraph></subsection><subsection id="id65df85f3e13c4ca1af3fd9cb7a629c9e"><enum>(e)</enum><header>Coordination</header><text>The working group shall engage with aviation industry and labor stakeholders, certifying organizations, and others determined appropriate by the Secretary of Transportation, including—</text><paragraph id="id1e50fddbe5cb40f0981a550eff7dd090"><enum>(1)</enum><text>manufacturers of avionics, AAM aircraft, propulsion systems, structures, and air traffic management systems;</text></paragraph><paragraph id="id8A6CEA96791740BF93524E0F07624997"><enum>(2)</enum><text>operators of AAM aircraft;</text></paragraph><paragraph id="idb6202925126a45d4a0414866f8ff6465"><enum>(3)</enum><text>air carriers and general aviation operators;</text></paragraph><paragraph id="id916e2da69b00434cb4a9c83373e39615"><enum>(4)</enum><text>airports;</text></paragraph><paragraph id="idd41ec70623024d5a991c73002e710487"><enum>(5)</enum><text>fixed-based operators;</text></paragraph><paragraph id="id6cdc9eec045a49678ebac8bf5205134b"><enum>(6)</enum><text>labor representatives of pilots, air traffic controllers, and aviation safety inspectors;</text></paragraph><paragraph id="id705af40c8e4a40539d883aa7b9362ee8"><enum>(7)</enum><text>State, local, and Tribal officials or public agencies, with representation of both urban and rural areas;</text></paragraph><paragraph id="id6da85cedc7dc4270804c652edc4d7459"><enum>(8)</enum><text>first responders;</text></paragraph><paragraph id="id354e65fb0c6a4292b573e1c4f7d3147a"><enum>(9)</enum><text>groups representing environmental interests;</text></paragraph><paragraph id="id3d4b017ef85d497fbf94d41644cffa26"><enum>(10)</enum><text>electric utilities, energy providers and market operators;</text></paragraph><paragraph id="idea89c6c2718f445baa771e58f5b86fd3"><enum>(11)</enum><text>academia with experience working with industry on new technology and commercialization; and</text></paragraph><paragraph id="idf6e3248e0d9442bcb43fa15e4a208797"><enum>(12)</enum><text>training and maintenance providers. </text></paragraph></subsection><subsection id="idb2f40d40f7f74dfea45cff046a19161b"><enum>(f)</enum><header>Review and examination</header><text>Not later than 1 year after the working group is established under subsection (a), the working group shall complete a review and examination of, at a minimum—</text><paragraph id="idee4dfb4395e848009927a6eebeccca38"><enum>(1)</enum><text>the steps which will mature AAM past initial operations;</text></paragraph><paragraph id="idf63f2934a37f488da21cdc581a7b8e41"><enum>(2)</enum><text>the evaluation of physical and digital security and safety requirements involved with future air traffic control concepts which might be considered as part of evolving AAM to higher levels of traffic density;</text></paragraph><paragraph id="id66f88d29ec9e4e66958e4aa6fa986578"><enum>(3)</enum><text>current Federal programs and policies that could be leveraged to advance the maturation of the AAM industry;</text></paragraph><paragraph id="id6be8867b1193430d835de59955e6ee96"><enum>(4)</enum><text>infrastructure, including aviation, surface and energy infrastructure, physical and digital security, and utilities necessary to accommodate and support expanded operations of AAM after initial implementation;</text></paragraph><paragraph id="id7646272b70194c25a03cfeb2860b6677"><enum>(5)</enum><text>anticipated benefits associated with AAM aircraft operations, including economic, environmental, emergency response, and transportation benefits; and</text></paragraph><paragraph id="id9da193a494f743b39ab7218a674ded67"><enum>(6)</enum><text>other factors that may limit the full potential of the AAM industry, including community acceptance of such operations. </text></paragraph></subsection><subsection id="idab0758e0b8c144a187394b5037ca6a96"><enum>(g)</enum><header>AAM national strategy</header><text>Based on the review and examination performed under subsection (f), the working group shall develop an AAM National Strategy that includes—</text><paragraph id="ide4d31ba7248e49349b75c906ef7c8907"><enum>(1)</enum><text>recommendations regarding the safety, security, infrastructure, air traffic concepts, and other Federal investment or actions necessary to support the evolution of early AAM to higher levels of activity and societal benefit; and</text></paragraph><paragraph id="iddcf6afa73d874d7a8382b272134bac97"><enum>(2)</enum><text>a comprehensive plan detailing the roles and responsibilities of each Federal department and agency necessary to facilitate implementing the recommendations developed under paragraph (1). </text></paragraph></subsection><subsection id="id865ad220a1b24cd7a240e1cd365bcaf1"><enum>(h)</enum><header>Report</header><text>Not later than 180 days after the completion of the review and examination performed under subsection (f), the working group shall submit to the appropriate committees of Congress a report—</text><paragraph id="id4e44650c37c3478584b9a81bc88199a5"><enum>(1)</enum><text>detailing the review and examination performed under subsection (f); and</text></paragraph><paragraph id="id7d36057f20cc48799082ab6543122ef2"><enum>(2)</enum><text>providing the AAM National Strategy, including the plan and associated recommendations, developed under subsection (g). </text></paragraph></subsection><subsection id="id71d062999207450b9c2599eb6217961e"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0F999BFC396A43B5B2A9EFD73D72D42A"><enum>(1)</enum><header>Advanced air mobility; AAM</header><text>The terms <term>advanced air mobility</term> and <term>AAM</term> mean an air transportation system that moves people and cargo between places using new aircraft designs including electric aircraft and electric vertical take-off and landing aircraft (eVTOL), which are integrated into existing airspace operations as well as operated in local, regional, intraregional, rural, and urban environments, and which may include unmanned or remotely piloted vehicles.</text></paragraph><paragraph id="id2436b585729e4928ada5238dc25bd22c"><enum>(2)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idA08ECC2A056F4FFEBDEA235B985133B2"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="idAF80697769EE4F45803D508475C4B9A3"><enum>(B)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="id0E458D2743F3410DBBFE92DC82F979A9"><enum>(C)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph id="idC7D9BAA1BDB34185984CEEAB997CAB0B"><enum>(D)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives;</text></subparagraph><subparagraph id="idFFF6BC91D1FC45629745B63144E22722"><enum>(E)</enum><text>the Committee on Armed Services of the House of Representatives; and</text></subparagraph><subparagraph id="idD756365589EE440CAC267BA16FB71DAB"><enum>(F)</enum><text>the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id9cab7a7e2a65417eb10945a48f3fbc96"><enum>(3)</enum><header>Electric aircraft</header><text>The term <term>electric aircraft</term> means any fixed-wing airplane, rotorcraft, or VTOL aircraft with a fully electric or hybrid (fuel and electric) driven propulsion system used for flight.</text></paragraph><paragraph id="idfb0134a4e49d406383a6dc86ce6f8c94"><enum>(4)</enum><header>Vertical take-off and landing; VTOL</header><text>The terms <term>vertical take-off and landing</term> and <term>VTOL</term> mean an aircraft with lift/thrust units used to generate powered lift and control and with more than two lift/thrust units used to provide lift during vertical take-off or landing.</text></paragraph></subsection></section></legis-body></bill>
