<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 516</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To plan for and coordinate efforts to integrate advanced air mobility aircraft into the national airspace system, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="idc5724d9f-4754-4bbd-a0f7-56a728c43558" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Air Mobility Coordination and Leadership Act</short-title></quote>.</text></section><section id="id3CEEFE4692E14A128B043D30CF1F46A2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Advanced air mobility working group</header><subsection id="id16295f5c-6fb3-419b-acd5-aafc0bc97f89" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of Transportation shall establish an advanced air mobility interagency working group (in this section referred to as the <quote>working group</quote>). </text></subsection><subsection id="id346fc3ff-5530-406f-8adf-54a480f244da" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of congress</header><text display-inline="yes-display-inline">It is the sense of Congress that Advanced Air Mobility (AAM) represents a key area of sustainable transportation and economic growth for the United States and globally, and that it is imperative that the United States take a leadership role in the adoption and furtherance of this technology. Therefore, given the path to initial operations is taking place utilizing today’s regulatory framework, it is critical that government agencies collaborate and focus on taking this vital industry to the next level through policy and investment in energy, infrastructure, security and transportation. The focus of the working group is interagency coordination to enable the maturation and growth of AAM.</text></subsection><subsection id="ida2f96e1e-a14a-46bf-9e0d-1121690b7470" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the working group established under this section is to plan for and coordinate efforts related to safety, infrastructure, physical security and cybersecurity, and Federal investment necessary for maturation of the AAM ecosystem, particularly passenger-carrying aircraft, in the United States in order to— </text><paragraph id="id4792a144-f9c9-42b1-8abb-00ab88cd8ea2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">further United States leadership;</text></paragraph><paragraph id="id04b0fdda-fa94-44e9-a9fb-601f0c85b2bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">grow new transportation options;</text></paragraph><paragraph id="idff62b3a0-d63f-44f8-bc84-34d1ac6902bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">amplify economic activity and jobs;</text></paragraph><paragraph id="id1c3b0829-9e53-43cb-85e4-7b5531752de4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">advance environmental sustainability and new technologies; and</text></paragraph><paragraph id="idf48fe295-6996-47c3-9ee8-cba361651f7c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">support emergency preparedness and competitiveness. </text></paragraph></subsection><subsection id="idb8ae82e2-86ef-413b-9ddd-f27c0dfba657" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The working group shall be comprised of at least 1 representative of each of the following Federal departments and agencies:</text><paragraph id="id4dc1d8f5-f59e-420f-8b15-802fe4d0d8b2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Department of Transportation.</text></paragraph><paragraph id="idd5f0b70f-0d42-49c4-9f1e-91c3564ede53" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Federal Aviation Administration.</text></paragraph><paragraph id="id5487f27e-97a8-4353-aeb5-17fd4b80b00e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">National Aeronautics and Space Administration.</text></paragraph><paragraph id="idd4e980b5-ca22-4fa4-a991-683808eb14c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Department of Commerce</text></paragraph><paragraph id="id543cda0b-1f5a-4026-bee9-66b59b10eed0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Department of Defense.</text></paragraph><paragraph id="iddc921cf3-6508-4d96-b36b-cd6dae91d5dd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Department of Energy.</text></paragraph><paragraph id="id9ff83836-bf9f-4308-83ec-8395997bd027" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">Department of Homeland Security.</text></paragraph><paragraph id="idc62a3a0b-f993-43e2-bc3d-9ebd08b1c878" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">Department of Agriculture.</text></paragraph><paragraph id="idc5de918b-3367-4917-b885-b86dedc91fdb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">Department of Labor.</text></paragraph><paragraph id="idb6f7a43ef27c4daf9747f151a57a55ce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">Federal Communications Commission.</text></paragraph><paragraph id="idae68935c-7345-4587-917f-b61207e4ac98" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">Such other departments or agencies as the Secretary of Transportation determines appropriate.</text></paragraph></subsection><subsection id="id48b465c6-208c-4e62-acce-d4174d351a7e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">The working group shall engage with State, local, and Tribal governments, industry and labor stakeholders, stakeholder associations, and others determined appropriate by the Secretary of Transportation, including— </text><paragraph id="id30cba1fd-6cf4-4662-909d-0802321e2de5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">manufacturers of avionics, AAM use aircraft, propulsion systems, structures, and air traffic management systems;</text></paragraph><paragraph id="id5cb0d26f67f44a65b966715afff4a45a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">air carriers, commercial operators, general aviation operators and future AAM operators; </text></paragraph><paragraph id="idcc4f2ba2-6b1b-482f-be0f-d4372adaed54" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">airports;</text></paragraph><paragraph id="id3c421e69-d2d8-4c6e-8d70-ca1b64b21dff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">fixed-based operators, as defined in FAA Advisory Circular 150/5190–7;</text></paragraph><paragraph id="idefb5917d19d0486ab867e239da290a3d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">certified labor representatives for pilots associations, air traffic control specialists employed by the Federal Aviation Administration, and aviation safety inspectors; </text></paragraph><paragraph id="idc4a91ced3af34e16ac1ff2ec1d6ba351" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">State, local, and Tribal officials or public agencies, with representation from both urban and rural areas; </text></paragraph><paragraph id="id2269e569-f7fd-44e2-aea2-0a3a776b8bbb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">first responders;</text></paragraph><paragraph id="id131bad07-4560-4a39-919f-6eab5846c085" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">groups representing environmental interests;</text></paragraph><paragraph id="id612d180a-fbc4-4222-b106-2b10171af011" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">electric utilities, energy providers and market operators of electricity;</text></paragraph><paragraph id="id3adb0607-239e-4638-a525-de817acc5177" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">academia with experience working with industry on new technology and commercialization;</text></paragraph><paragraph id="idf041f563100e4990841aef009c0acd30" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">groups representing the telecommunications industry; and</text></paragraph><paragraph id="id9c93de21aac64f7f8fa8ec3221406051" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text display-inline="yes-display-inline">aviation training and maintenance providers. </text></paragraph></subsection><subsection id="idf84efb75-68ed-43bd-a8c1-4e40b1dd4075" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Review and examination</header><text display-inline="yes-display-inline">Not later than 1 year after the working group is established under subsection (a), the working group shall complete a review and examination of, at a minimum—</text><paragraph id="id29e2a5a9036d48448c5bf625ae05365f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the steps that will mature AAM past initial operations;</text></paragraph><paragraph id="id644623a0d8844447a17f49c60f92e871" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the evaluation of air traffic control and management concepts that might be considered as part of evolving AAM to higher levels of traffic density;</text></paragraph><paragraph id="id466394b303c14b899af9029aad2318ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">current Federal programs and policies that could be leveraged to advance the maturation of the AAM industry;</text></paragraph><paragraph id="id0ab8d7fb483e44a48827db9a7ef63cd5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">infrastructure, including aviation, surface, energy, and telecommunications infrastructure, physical security and cybersecurity, and utilities necessary to accommodate and support expanded operations of AAM after initial implementation; </text></paragraph><paragraph id="idd7e7652ddfe64aa0a770b577bf260622" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">steps needed to ensure a robust domestic supply chain;</text></paragraph><paragraph id="id6757ce8af9674860913e629edd81b6e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">anticipated benefits associated with AAM aircraft operations, including economic, environmental, emergency response, and transportation benefits;</text></paragraph><paragraph id="id64448d3c3174498f9aaf32d11f71259f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">the interests, roles, and responsibilities of Federal, State, local, and Tribal governments affected by AAM aircraft operations; and </text></paragraph><paragraph id="id40b40c689ee7449dbc3febddaf2a8c35" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">other factors that may limit the full potential of the AAM industry, including community acceptance or restrictions of such operations. </text></paragraph></subsection><subsection id="idb664a960-2a28-4f99-b13c-96e25fd16514" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">AAM national strategy</header><text display-inline="yes-display-inline">Based on the review and examination performed under subsection (f), the working group shall develop an AAM National Strategy that includes—</text><paragraph id="id541a4d23-cf42-4bdf-a3dc-734cfa21159c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">recommendations regarding the safety, security, infrastructure, air traffic concepts, and other Federal investment or actions necessary to support the evolution of early AAM to higher levels of activity and societal benefit; and</text></paragraph><paragraph id="idc7de74f6-5569-40e1-8cfc-4ff6c26a5b5e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a comprehensive plan detailing the roles and responsibilities of each Federal department and agency, and of State, local, and Tribal governments, necessary to facilitate implementing the recommendations developed under paragraph (1). </text></paragraph></subsection><subsection id="id658532b4-87d6-4ed2-8311-e31ea55137bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the completion of the review and examination performed under subsection (f), the working group shall submit to the appropriate committees of Congress a report—</text><paragraph id="id9b0a98e1-eb4a-431c-a248-dd2a76e54ff2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">detailing the review and examination performed under subsection (f); and</text></paragraph><paragraph id="id3c2ed506-ac96-407a-a42f-d389562dc5e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">providing the AAM National Strategy, including the plan and associated recommendations, developed under subsection (g). </text></paragraph></subsection><subsection id="id682d905640df427cbf948cbdd7fde0ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Evaluation of termination of working group</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the working group submits the report required under subsection (h), the Secretary of Transportation shall evaluate and decide whether to terminate the working group and shall notify the appropriate committees of Congress of such decision. </text></subsection><subsection id="id5d48fe29-fd6d-4341-b3c0-d062a8fb1da8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idd37b55b1-c6f0-4aea-9bee-4d25d5707d52" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Advanced air mobility; AAM</header><text display-inline="yes-display-inline">The terms <term>advanced air mobility</term> and <term>AAM</term> mean an air transportation system that moves people and cargo between places using innovative aircraft designs (such as vertical take-off and landing (VTOL)) and new technologies (such as electric or hybrid (fuel and electric) driven propulsion), which are integrated into existing airspace operations as well as operated in local, regional, intraregional, rural, and urban environments, and which may include remotely piloted or autonomous aircraft. </text></paragraph><paragraph id="id5285cb5b-95d2-49d6-9772-648b48d7c25b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate committees of congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id89bf784d-0fbc-4d73-854b-23794bebccb3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id0ff4dc99-0d83-4654-b38d-cc3d6160b6fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="idf3accd9f-55eb-4d7e-a45c-38c574a651e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph id="idcbb7e8a9-8d1d-48a4-828f-bae1e2546b8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Committee on Transportation and Infrastructure of the House of Representatives;</text></subparagraph><subparagraph id="idb00a046f-3246-44a9-878c-17d7cf9a4946" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the Committee on Armed Services of the House of Representatives; and</text></subparagraph><subparagraph id="ida399477b-dc5f-4c1a-93c9-b7e7df41dc3c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id649fc2b2-5ba6-4157-bcd3-34105ca90b02" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Vertical take-off and landing; VTOL</header><text display-inline="yes-display-inline">The terms <term>vertical take-off and landing</term> and <term>VTOL</term> mean an aircraft with lift/thrust units used to generate powered lift and control and with more than two lift/thrust units used to provide lift during vertical take-off or landing.</text></paragraph></subsection></section><section id="id0C81EDAF6CFD4498AE85E59162BE7AC2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">GAO study and report</header><subsection id="idA80E46153F324B90BE0FCC3030C3E06D" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="ide9ef35e36b98469cb00787b7bb1a0785" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study on the interests, roles, and responsibilities of Federal, State, local, and Tribal governments affected by AAM aircraft and operations; and</text></paragraph><paragraph id="idebb49a47bd4a4c76b4a9ccdc5a441376" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress a report on the study, including the Comptroller General's findings and conclusions.</text></paragraph></subsection><subsection id="idc667b5e3b087460c85b7b69e82040e5f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In conducting the study required under subsection (a), the Comptroller General shall review the following:</text><paragraph id="id3879104396c1463b849240ede2bcac59" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The state of the law as of the enactment of this Act with respect to Federal authority over operations of AAM aircraft systems in the national airspace system.</text></paragraph><paragraph id="id713d845571ec4f429be3a56f090b1f19" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The state of the law as of the enactment of this Act with respect to State, local, and Tribal authority over operations of AAM aircraft in the national airspace system.</text></paragraph><paragraph id="idaf7e61ef27a2407d983ff5c187efe00e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Potential gaps between authorities under paragraphs (1) and (2).</text></paragraph><paragraph id="idbe0e4e0086e24ccbb62c2b87184d972f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Proposals to facilitate the safe and financially viable growth and development of the AAM industry and integration of AAM aircraft into the national airspace system. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220323" chamber="Senate">Passed the Senate March 23, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
