<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 5168</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to include aliens passing in transit through the United States to board a vessel on which the alien will perform ship-to-ship liquid cargo transfer operations within a class of nonimmigrant aliens, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="HD11A120975C542F4B4393D9BE6C0F11C" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Security and Lightering Independence Act of 2022</short-title></quote>.</text></section><section id="H23CD0589CFB64053BC7A7CB6BB0C50C1" section-type="subsequent-section" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Changes in nonimmigrant categories</header><subsection id="HB2E5D568F7854859AD69B29C7D6E230F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Transit through United States</header><text display-inline="yes-display-inline">Section 101(a)(15)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(C)</external-xref>) is amended to read as follows:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H378DCFF2B6D44D9181C685A4D4EAA468"><subparagraph id="H382D97B6777945C9A9977BCD30ECB057" indent="up1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H7CF787EBC3024FF3B14729208D6347FE"><enum>(i)</enum><text display-inline="yes-display-inline">an alien in immediate and continuous transit through the United States, for a period not to exceed 29 days;</text></clause><clause indent="up1" id="id93CF8CF81B4D43FE89AADD31D5864D83" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">an alien who qualifies as a person entitled to pass in transit to and from the United Nations Headquarters District (as defined in section 209A(e) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/4309a">22 U.S.C. 4309a(e)</external-xref>)) and foreign countries, under the provisions of paragraphs (3), (4), and (5) of section 11 of the Agreement regarding the Headquarters of the United Nations, done at Lake Success June 26, 1947 (61 Stat. 758); or</text></clause><clause indent="up1" id="id97D7579DAA464DC38CE94EB5B1A5E5E2" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">an alien passing in transit through the United States to board a vessel on which the alien will perform, or to disembark from a vessel on which the alien performed, ship-to-ship liquid cargo transfer operations to or from another vessel engaged in foreign trade, for a period not to exceed 180 days;</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="H49115E2F040A44DC88B2A17BE6704993" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Alien crewmen</header><text display-inline="yes-display-inline">Section 101(a)(15)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(D)</external-xref>) is amended—</text><paragraph id="H1CF711DF018C46089D29D3D7870157F9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by adding <quote>or</quote> at the end; and</text></paragraph><paragraph id="HC6777D14D2B6451C8D9E62AEF805BF4F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1520B856A22843749DDCAB108F388B05"><clause id="HD2F974310EF44884B8F055F6B561452C" indent="up2" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">an alien crewman performing ship-to-ship liquid cargo transfer operations to or from another vessel engaged in foreign trade, who intends to land temporarily solely in pursuit of the alien’s responsibilities as a crewman and to depart from the United States on the vessel on which the alien arrived or on another vessel or aircraft, for a period not to exceed 180 days;</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H4C4C2B3C6F994F18B2D71A7112B8FC46" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Conditional permits to land temporarily</header><text display-inline="no-display-inline">Section 252(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1282">8 U.S.C. 1282(a)</external-xref>) is amended—</text><paragraph id="H05709D2A7CA94915AB8A4B2326B998BB" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H3D2595765F734E44876B1D86905573D5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HC3E1475D68F248168ECAA7FD5B771141" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5A78C73341ED45999C6BA445B856A40F"><paragraph id="H4DC5C63B21104212A101D9A9CC2DEEBB" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">180 days, if the immigration officer determines that the crewman—</text><subparagraph id="id8EBB4F4E0AA14189BEAD7CA1F3101036" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">intends to depart, within the period for which the crewman is permitted to land, on the same vessel or on a vessel or aircraft other than the vessel on which the crewman arrived; and </text></subparagraph><subparagraph id="idA911D28392164DA4A125DEE13FE71148" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">will perform ship-to-ship liquid cargo transfer operations to or from any other vessel engaged in foreign trade during such period.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="HA51B91D5457649A98C29C678162F4560" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">For purposes of this Act, and the amendments made by this Act, the performance by a crewman of ship-to-ship liquid cargo transfer operations to or from any other vessel engaged in foreign trade shall not be considered, for immigration purposes, to be services, work, labor or employment by the crewman within the United States.</text></section></legis-body><attestation><attestation-group><attestation-date date="20221215" chamber="Senate">Passed the Senate December 15, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
