Funding for additional FSIS inspectors.</toc-entry></toc></subsection></section><section id="ide52a2dcfa6ba43aca9e7f0ed7baeb12d"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <quote>Secretary</quote> means the Secretary of Agriculture.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3234d9cb33704238845936873899b118"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="ide5586135ea514a629ddae18077899c8f" commented="no"><enum>(1)</enum><text>factory farms owned or controlled by industrial operators—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7415529ce0144ca5a3f058a14929d4e6"><enum>(A)</enum><text display-inline="yes-display-inline">lack systemic resilience;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id411a3d2604c746eb8cca53a27b85a499"><enum>(B)</enum><text display-inline="yes-display-inline">present significant risks, particularly in the event of a disaster; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7de56768b9149629be658a1a708d8e1"><enum>(C)</enum><text display-inline="yes-display-inline">negatively impact—</text><clause id="ide61daba6d5124a3da840e248155bc5d5" commented="no"><enum>(i)</enum><text>farmed animals, who suffer tremendously from cruel depopulation methods and without meaningful disaster mitigation efforts;</text></clause><clause id="id3d509e522b6d4d4eba0e79e3013062ac" commented="no"><enum>(ii)</enum><text>meat and poultry processing workers, who are subjected to exploitative conditions and abusive behavior by employers in depopulation situations—</text><subclause id="id8f40976d7d754320bb237486a5ec9715" commented="no"><enum>(I)</enum><text>including—</text><item id="id7dd8c6b91579494db21b170ebfe8ebc7" commented="no"><enum>(aa)</enum><text>being required to spend long hours, over days or weeks, mass-killing farmed animals; and</text></item><item id="id825b3d5a4961477abefd0d608b829134" commented="no"><enum>(bb)</enum><text>being terminated following the completion of a depopulation event, without financial support; and</text></item></subclause><subclause id="idcff61a32ee10474888a5e355a1906c13" commented="no"><enum>(II)</enum><text>that lead to long-term psychological impacts, including increased feelings of anger and stress; and</text></subclause></clause><clause id="id24baa3a9f90d4a31aae2ed1aa02c0db5" commented="no"><enum>(iii)</enum><text>neighboring communities and the environment, including through—</text><subclause commented="no" display-inline="no-display-inline" id="ida7ffe51629d24fa489d8e3fe2a9bd82c"><enum>(I)</enum><text display-inline="yes-display-inline"> flood waters overrunning manure lagoons resulting in ecological degradation in the form of soil, surface, and groundwater contamination; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaa373125fea04c699c62138d516fbc13"><enum>(II)</enum><text display-inline="yes-display-inline">algae blooms; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id367143a4d07741e093c38ce826a00b94"><enum>(III)</enum><text display-inline="yes-display-inline">wildlife population crashes;</text></subclause></clause></subparagraph></paragraph><paragraph id="id1df1e65d154b436881c1d5e15b6857dd" commented="no"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id076c797a260842549ceaa82233683fc3"><enum>(A)</enum><text>since 2019, more than 60,000,000 poultry and 10,000,000 swine have been depopulated; and</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="ida409a0eb7fc04dd4a15b6ade3df7e6ed"><enum>(B)</enum><text>those massive cullings are often conducted using incredibly inhumane practices including ventilation shutdown, ventilation shutdown plus, sodium nitrite poisoning, and water-based foaming (as those terms are defined in section 114(a));</text></subparagraph></paragraph><paragraph id="id98c9ac59055b4681ba8a72e9463094cc" commented="no"><enum>(3)</enum><text>since 2019, industrial operators put slaughterhouse workers in jeopardy and cost taxpayers millions of dollars;</text></paragraph><paragraph id="idd072834b211a4ec7a7f58dd34689a2dd" commented="no"><enum>(4)</enum><text>industrial operators continue to experience record profits, including a 300-percent growth in profits during the COVID–19 pandemic;</text></paragraph><paragraph id="id729a98ace1294abc8600193fec2ba6c9" commented="no"><enum>(5)</enum><text>industrial operators have created a system that allows for the inhumane handling of nonambulatory livestock (as defined in section 3(a) of <external-xref legal-doc="public-law" parsable-cite="pl/85/765">Public Law 85–765</external-xref> (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>)) that causes needless suffering, unsafe working conditions, and the spread of foodborne and zoonotic diseases;</text></paragraph><paragraph id="ide6219a7d1be04576aaf8888bd2c04848" commented="no"><enum>(6)</enum><text>industrial operators have abused the use of certain drugs that increase the risk of livestock becoming nonambulatory livestock (as so defined);</text></paragraph><paragraph id="idce78944554f14859908693e759d91037" commented="no"><enum>(7)</enum><text>slaughterhouse deregulation and decreased Federal oversight of meat and poultry slaughter pose significant risks to workers, consumers, and animals;</text></paragraph><paragraph id="id30a60af3c1f842c3a55ff892fbc0528c" commented="no"><enum>(8)</enum><text>Federal humane slaughter laws currently exempt 98 percent of animals slaughtered for food;</text></paragraph><paragraph id="id65cdafb88c7d4b20875f1d2ed25a8113" commented="no"><enum>(9)</enum><text>current Federal animal transport laws are ineffective and inherently cruel; and</text></paragraph><paragraph id="id932faa4f1a524cc186879b691a489e2b" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text>Federal support is needed to create a level playing field for farmers engaged in higher-welfare practices who are struggling to compete in a highly monopolized market controlled by industrial operators. </text></paragraph></section><title id="id66eff6df752f47cfbf842398b22c1e3b"><enum>I</enum><header>High-risk AFO disaster mitigation and enforcement</header><section id="id973d8c4175b84e9787bb471f0f2a3ec5"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="idf2ebaa6bab6c4a3781b5b480ed3f89c2"><enum>(1)</enum><header>Animal feeding operation; AFO</header><subparagraph id="id061b135f33b14f3db79bbd135b0355ba"><enum>(A)</enum><header>In general</header><text>The term <term>animal feeding operation</term> or <term>AFO</term> means a single lot or facility at which—</text><clause id="idc7b0fe60213e4eb4a510d6ebaf770e0a"><enum>(i)</enum><text>for not less than a total of 45 days in any 12-month period, animals (other than aquatic animals) are—</text><subclause id="id0957bac5daec4a29b08cd704454949fe"><enum>(I)</enum><text>stabled or confined; and</text></subclause><subclause id="id480338c28e13485dbf8f0aa68bc91a28"><enum>(II)</enum><text>fed or maintained; and</text></subclause></clause><clause id="idc4b320bd49fc440e8bd0509b2435dfd2"><enum>(ii)</enum><text>crops, vegetation, forage growth, or postharvest residues are not sustained in the normal growing season over any portion of the lot or facility.</text></clause></subparagraph><subparagraph id="id8a38c82aaa8d42669f3f1eb033be8e31"><enum>(B)</enum><header>Multiple lots</header><text>For purposes of subparagraph (A), 2 or more lots or facilities described in that subparagraph shall be considered to be a single animal feeding operation if the lots or facilities—</text><clause id="idf4ee7818de2f48058cb0d8368dea7078"><enum>(i)</enum><text>are located within 3 miles of each other; and</text></clause><clause id="id0d271eb6198c477b81aa6789e0628d9b" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>are under common ownership or control. </text></clause></subparagraph><subparagraph id="id5578c328649f40fe8eae8e24ec4113bb"><enum>(C)</enum><header>Exclusion</header><text>The term <term>animal feeding operation</term> or <term>AFO</term> does not include a pasture-based livestock or poultry production system in which animals—</text><clause id="idf21528ffda954502b41e1f3e3ab93230"><enum>(i)</enum><text>are primarily raised on pasture, grassland, or other vegetative environments;</text></clause><clause id="id733ea48bc7c546789dbf965cc5d4a3cc"><enum>(ii)</enum><text>have the ability to exercise species-specific natural behaviors; and</text></clause><clause id="id5b65021543514c7784fade1137a55f28"><enum>(iii)</enum><text>have access to appropriate shelter, healthy vegetation, potable water, and adequate protection from predators.</text></clause></subparagraph></paragraph><paragraph id="idbd7abb73b6364b4f9010ce0bbed080ee"><enum>(2)</enum><header>Covered industrial operator</header><text>The term <term>covered industrial operator</term> means an individual or entity that owns or controls not less than the following number of livestock or poultry, as applicable, that are housed in an AFO at a single point in time:</text><subparagraph id="id2673ecec8ee04facba2042d1c91b1652"><enum>(A)</enum><text>2,500 swine.</text></subparagraph><subparagraph id="id5d515529f4294279a00967b1d9afe125"><enum>(B)</enum><text>30,000 turkeys or ducks.</text></subparagraph><subparagraph id="id8ec8e5f1b6dd4a33b61c136e1e9d3a79" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>82,000 laying hens or broilers.</text></subparagraph></paragraph><paragraph id="id811f46ffb782410caf77ff60029606c2"><enum>(3)</enum><header>Depopulation</header><text>The term <term>depopulation</term> means the rapid destruction of a population of animals in response to urgent circumstances.</text></paragraph><paragraph id="idc435becf53174770a0a017fd2363f745" commented="no"><enum>(4)</enum><header>Disaster event</header><text>The term <term>disaster event</term> means—</text><subparagraph commented="no" id="id6CE19AA91ED147C9BD93EE3045072E6A"><enum>(A)</enum><text>a public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>);</text></subparagraph><subparagraph id="idb20afedfeff546fb8026d472c3d8d13d" commented="no"><enum>(B)</enum><text>a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text></subparagraph><subparagraph commented="no" id="id865576C6C4F8404988D34CEB1CB37ADB"><enum>(C)</enum><text>a disaster designated by the Secretary pursuant to part 759 of title 7, Code of Federal Regulations (or successor regulations); and</text></subparagraph><subparagraph commented="no" id="id1F1433E3FEAA4D6983DFE5CB6BE56BF5"><enum>(D)</enum><text>a quarantine designated by the Secretary pursuant to the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>) or animal quarantine laws.</text></subparagraph></paragraph><paragraph id="id86a77db1d655460d93cd904cd0a70ab9"><enum>(5)</enum><header>High-risk AFO</header><text>The term <term>high-risk AFO</term> means an AFO that houses livestock or poultry owned or controlled by a covered industrial operator.</text></paragraph><paragraph id="id9FDD8C7CBB344E5D8A972730F18784F4" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Office</header><text>The term <quote>Office</quote> means the Office of High-Risk AFO Disaster Mitigation and Enforcement established under section 111.</text></paragraph></section><subtitle id="id962696e72fb341519905fff9ab5ba63d"><enum>A</enum><header>Department of Agriculture</header><section id="id25b7cb4cbc014a06bc0df8aec67ee866"><enum>111.</enum><header>Office of High-Risk AFO Disaster Mitigation and Enforcement</header><text display-inline="no-display-inline">The Secretary shall establish an office within the Department of Agriculture, to be known as the <quote>Office of High-Risk AFO Disaster Mitigation and Enforcement</quote>, which shall carry out or enforce, as applicable, sections 112 through 115.</text></section><section id="id15768c3be5f9433bb07053a4cf5d5b78"><enum>112.</enum><header>Registration of high-risk AFOs</header><subsection id="id20ed6e7a2c88489c93bc69edfa7eef4e"><enum>(a)</enum><header>Registration requirement</header><paragraph id="id7173d4892f924e4da1cc1e5018dd49bb"><enum>(1)</enum><header>In general</header><text>A covered industrial operator shall be required to register with the Office prior to selling, buying, or transferring livestock, poultry, or any product derived from livestock or poultry across State lines.</text></paragraph><paragraph id="idf0efb588becb4d5bbaa065fb8d75479b"><enum>(2)</enum><header>Information</header><text>In registering with the Office under paragraph (1), a covered industrial operator shall submit to the Office—</text><subparagraph id="idfeee12eb921b4430bc59b19487b217e3"><enum>(A)</enum><text>identifying information about the covered industrial operator, including the location, animal type, and peak inventory animal totals for all high-risk AFOs owned or controlled by the covered industrial operator; and </text></subparagraph><subparagraph id="id1fd81baecabf4898944b4a7bc093f97a"><enum>(B)</enum><text>a standard disaster mitigation plan that includes—</text><clause id="idd1aeeb830284474aaf9e1f874b6583e3"><enum>(i)</enum><text>a description of the type, location, and extent of all potential disaster events that can affect livestock or poultry housed in a high-risk AFO, including information on previous occurrences of disaster events and the probability of future disaster events;</text></clause><clause id="idb6cbeadaf6dc45079902289d660175a5"><enum>(ii)</enum><text>a plan to ensure that animals do not go without necessary resources such as shelter, food, and water during an extreme weather event;</text></clause><clause id="id9a4e121c28224097a6838b7b3a2de04d"><enum>(iii)</enum><text>a plan to increase flexibility and resiliency, including—</text><subclause commented="no" display-inline="no-display-inline" id="idc347f8aad32944d9a3751ac02c49e990"><enum>(I)</enum><text display-inline="yes-display-inline">identifying ways to house animals past their intended slaughter date; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9eeb6ad867ba41d4a69f0239d74207ac"><enum>(II)</enum><text display-inline="yes-display-inline">alternative slaughter and processing arrangements, including contracting with small-scale Department of Agriculture, State-certified, or mobile operations with existing capacity, in the event of supply chain disruptions;</text></subclause></clause><clause id="ide28c6c1b78fa4b85a190171414b082b2"><enum>(iv)</enum><text>a plan for accessing necessary resources, personal protective equipment, and labor to carry out depopulation in ways that most rapidly render animals unconscious in the event that depopulation is unavoidable;</text></clause><clause id="id5da58b55b17c4b40a6c438910a2e5408"><enum>(v)</enum><text>a plan for disposal of any deceased animals that—</text><subclause id="id6F5EC59A6B5740B78EE40795AD031120"><enum>(I)</enum><text>satisfies requirements under all relevant Federal, State, and local environmental and public health laws; and</text></subclause><subclause id="idD38F1F0678F847A0BD8A9688226DCA85"><enum>(II)</enum><text>does not rely on unlined burial or onsite incineration; and</text></subclause></clause><clause id="id81f2ce64bcaa41c9bb58d0afa909ce8d"><enum>(vi)</enum><text>other information, as determined appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c86a0cf891247bba9a80c2d53348c57"><enum>(3)</enum><header>Annual submission</header><text>A covered industrial operator that is registered with the Office pursuant to this subsection shall submit to the Office the information described in paragraph (2) on an annual basis.</text></paragraph><paragraph id="id0757ec59ee0e4c868ab88e6ff3133ad4" commented="no"><enum>(4)</enum><header>Restricted funds for plan</header><text>A covered industrial operator shall not, in developing a standard disaster mitigation plan described in paragraph (2)(B), use any Federal funds, including funds provided under the environmental quality incentive program under subchapter A of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa">16 U.S.C. 3839aa et seq.</external-xref>).</text></paragraph></subsection><subsection id="id5e86c98587dc401499bcc789a561f045"><enum>(b)</enum><header>Disaster mitigation maintenance fee</header><paragraph id="id36529e612c2945faab60701ca121bb11"><enum>(1)</enum><header>In general</header><text>A covered industrial operator registered under subsection (a) shall pay to the Office an annual fee by January 15 of each year for each high-risk AFO owned or controlled by the covered industrial operator.</text></paragraph><paragraph id="ide3f76d03abd245b29f1cddac4707bb79"><enum>(2)</enum><header>Total amount of fees</header><text>The amount of the fee required under paragraph (1)—</text><subparagraph id="idA599917BBB4C43BB938B5851FE7E27BA"><enum>(A)</enum><text>shall be determined by the Secretary in a manner that will ensure that the total amount of fees collected for each fiscal year shall sufficiently fund the activities of the Office for that fiscal year; but </text></subparagraph><subparagraph id="id3AA19509359446FC9669754B6EA06AFD"><enum>(B)</enum><text>shall not be less than $1 per animal unit (as defined by the Administrator of the Environmental Protection Agency) for each fiscal year.</text></subparagraph></paragraph><paragraph id="id8f3bf7c7844a402ebd5d7f2fe3480961" commented="no"><enum>(3)</enum><header>Restriction</header><text>A covered industrial operator may not reduce wages or grower payments in order to derive the amount of the fee required under paragraph (1).</text></paragraph></subsection><subsection id="id9af0c5c4b4d943578daa6758823fc171"><enum>(c)</enum><header>High-Risk AFO Disaster Mitigation and Enforcement Fund</header><paragraph id="id5cf30c70fedc45fcb55ecfc7d5439b52"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>High-Risk AFO Disaster Mitigation and Enforcement Fund</quote> (referred to in this subsection as the <quote>Fund</quote>).</text></paragraph><paragraph id="id460dec4e0f864057954372134f5af256"><enum>(2)</enum><header>Source; use</header><text>All moneys derived from fees collected by the Office under subsection (b) shall be deposited in the Fund and made available to the Secretary, without fiscal year limitation, to offset costs relating to—</text><subparagraph id="id6cfc3267a81144d7a56ace5c483be0f6"><enum>(A)</enum><text>the administrative costs associated with operating the Office and technical assistance offered by staff of the Office;</text></subparagraph><subparagraph id="id5151372500a14141962a41d229ffa6f0"><enum>(B)</enum><text>creating the national stockpile pursuant to section 114(c)(2);</text></subparagraph><subparagraph id="id7cfc080660f54198978067ac9f65b23f"><enum>(C)</enum><text>enforcement actions against covered industrial operators that do not comply with this subtitle; and</text></subparagraph><subparagraph id="id1959229a545a4b158cfa8747079a0a2a"><enum>(D)</enum><text>any other activities determined by the Secretary.</text></subparagraph></paragraph></subsection></section><section id="idb321c10d2fa14ee495a2a9971dcb6255"><enum>113.</enum><header>Covered industrial operator responsibilities and liabilities</header><text display-inline="no-display-inline">A covered industrial operator shall be responsible and liable for, with respect to each high-risk AFO owned or controlled by the covered industrial operator, all costs associated with activities related to disaster events or depopulation of livestock or poultry, including—</text><paragraph id="id3dc11d88d0114b4984dbd89d48fa2e2f"><enum>(1)</enum><text>procuring resources for depopulation of livestock or poultry, including from the national stockpile described in section 114(c)(2);</text></paragraph><paragraph id="idf4e6b628dd984cc48a1293c3a2d46b76"><enum>(2)</enum><text>disposal of deceased animals that—</text><subparagraph id="id81AC6B6A0C2A4AB98E6CF63E4EF90B59"><enum>(A)</enum><text>satisfies requirements under all relevant Federal, State, and local environmental and public health laws; and </text></subparagraph><subparagraph id="id6D0F92442B584E458179008C2296005E"><enum>(B)</enum><text>does not rely on unlined burial or onsite incineration;</text></subparagraph></paragraph><paragraph id="ideaa39cdcba7b4099b21a00d260c7361d"><enum>(3)</enum><text>compensation for contract growers and workers, as provided in subtitle B; </text></paragraph><paragraph id="id13d43acab7394a71907a80cebe8d5dc3"><enum>(4)</enum><text>compensation for any adverse health impacts, property value diminution, and loss of use and enjoyment of property suffered by neighboring residents of the high-risk AFO; and</text></paragraph><paragraph id="idf11c8520ab484a87a8dc4530be81072f"><enum>(5)</enum><text>other costs determined by the Secretary.</text></paragraph></section><section id="id99550ffd0b57490ebedb135ef9be72af"><enum>114.</enum><header>Restriction on certain methods of depopulation</header><subsection commented="no" display-inline="no-display-inline" id="id1bd98c07419e46d09f6df4f13b39fcae"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idf061ba3c0f5542a6924bb5c87092b90b"><enum>(1)</enum><header>Restricted practice</header><text>The term <quote>restricted practice</quote> means—</text><subparagraph id="id9719E1B25F40428D8BAAF959B3556FC7"><enum>(A)</enum><text>sodium nitrite poisoning;</text></subparagraph><subparagraph id="id76e4bf0d90124ee8b2cd78ffb93a03da"><enum>(B)</enum><text>ventilation shutdown;</text></subparagraph><subparagraph id="ide0bb9d6a346f4357b1ef9283ac38494a"><enum>(C)</enum><text>ventilation shutdown plus;</text></subparagraph><subparagraph id="id2e60d5da55014894a38131d589c43c50"><enum>(D)</enum><text>water-based foaming; and</text></subparagraph><subparagraph id="id9744d84c785f47078f690db0f005e27d" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>any other method identified by the Secretary. </text></subparagraph></paragraph><paragraph id="id01796681854349b8829afcb59b4bf3ff"><enum>(2)</enum><header>Sodium nitrite poisoning</header><text>The term <term>sodium nitrite poisoning</term> means a method of animal depopulation that involves feeding the toxic substance sodium nitrite to animals, causing changes to the blood that prevent delivery of oxygen to tissues and result in prolonged respiratory distress prior to loss of consciousness. </text></paragraph><paragraph id="id710AAA9AE87C44ECB8B0BED48EA5F56D"><enum>(3)</enum><header>Ventilation shutdown</header><text>The term <quote>ventilation shutdown</quote> means a method of animal depopulation that involves sealing a building in which animals are confined, shutting inlets, and turning off fans in order to raise the temperature in the building until the animals die from hyperthermia or hypoxia, including ventilation shutdown plus.</text></paragraph><paragraph id="id757e1abd78054901a9bbd9e7216abbcf"><enum>(4)</enum><header>Ventilation shutdown plus</header><text>The term <quote>ventilation shutdown plus</quote> means a ventilation shutdown method that involves the use of additional heat or humidity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb00e1cde9beb43e0938c3c5f65543556"><enum>(5)</enum><header>Water-based foaming</header><text>The term <quote>water-based foaming</quote> means a method of animal depopulation that involves pumping foam concentrate combined with water into a building in which animals are confined until the animals die from hypoxia.</text></paragraph></subsection><subsection id="idb28cd0d8a24443d8865b30ec1c07ddfb"><enum>(b)</enum><header>Restrictions; civil penalty</header><text>Notwithstanding any other provision of law, beginning 1 year after the date of enactment of this Act, a covered industrial operator that uses 1 or more restricted practices for any event of depopulation of livestock or poultry on a high-risk AFO owned or controlled by the covered industrial operator, as determined by the Office—</text><paragraph id="idB86819ACC5694453B2657B61B9762000"><enum>(1)</enum><text>shall not be eligible for any Federal contract for a period of 10 years beginning on that date; </text></paragraph><paragraph id="id914E9FCACB9B4546A4B3F1FCE4055A0B"><enum>(2)</enum><text>shall not be eligible for inspection of any facility owned or controlled by the covered industrial operator pursuant to the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>) or the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>), as applicable, for a period of 10 years beginning on that date; and</text></paragraph><paragraph id="idceecfb13f7bc4a5ab92156499bd56dee"><enum>(3)</enum><text>shall be assessed a civil penalty of up to $1,000 per animal per act of depopulation, with consideration given to the appropriateness of the penalty with respect to the gravity of the violation and the good faith of the covered industrial operator.</text></paragraph></subsection><subsection id="id955025f78957418d94553008d5becee1"><enum>(c)</enum><header>Standards and resources</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall issue a final rule—</text><paragraph id="id72b80f0275484681aa26da7c32d4f4b2"><enum>(1)</enum><text>to establish depopulation standards that rapidly induce unconsciousness and death with minimal pain and distress; and</text></paragraph><paragraph id="ide048438513a6412487d0eb918daea554"><enum>(2)</enum><text>to coordinate a national stockpile of resources—</text><subparagraph commented="no" display-inline="no-display-inline" id="id887cb378dba1488f97dc424729685821"><enum>(A)</enum><text display-inline="yes-display-inline">to carry out depopulation activities during a disaster event in a way that rapidly induces unconsciousness and death of the animals with minimal pain and distress; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc6700eef0174d5b84f020461fc66fed"><enum>(B)</enum><text display-inline="yes-display-inline">using funds from the High-Risk AFO Disaster Mitigation and Enforcement Fund established by section 112(c)(1).</text></subparagraph></paragraph></subsection></section><section id="id0a63b13ba47f4daf8e97ab09de2e3cb2"><enum>115.</enum><header>Reports</header><subsection id="id0F4933A3C67F49A0AA095112C6C3D9EB"><enum>(a)</enum><header>Reports to Secretary</header><text display-inline="yes-display-inline">Not later than 3 business days after completing any depopulation of any animals, a covered industrial operator performing or requiring such depopulation shall submit to the Secretary a report on that depopulation instance that specifies—</text><paragraph id="id8ED1535A7452422F85876F3DD5068DB4"><enum>(1)</enum><text display-inline="yes-display-inline">the 1 or more dates on which, and location at which, the depopulation and disposal of the animals occurred;</text></paragraph><paragraph id="id50624FED61B14CC78CFFD018A8D30494"><enum>(2)</enum><text display-inline="yes-display-inline">the total number, species, breed, and intended product of the depopulated animals;</text></paragraph><paragraph id="id1AB2DFCE83D94810AB653A6DD39ABD83"><enum>(3)</enum><text display-inline="yes-display-inline">the depopulation and disposal methods utilized;</text></paragraph><paragraph id="id89AE17D684EF4ABBBABA31A26AD57033"><enum>(4)</enum><text display-inline="yes-display-inline">any monitoring, testing, or sampling protocol put in place to monitor releases of environmental contaminants from the disposal location;</text></paragraph><paragraph id="id12120F1CD5FF4297B107B5A0A2DA1735"><enum>(5)</enum><text display-inline="yes-display-inline">a summary of any assets utilized or received from the national stockpile established pursuant to section 114(c)(2), as applicable;</text></paragraph><paragraph id="idF93E1705117C4D5C84C4F59252D44D19"><enum>(6)</enum><text display-inline="yes-display-inline">documentation of compliance or noncompliance with the standard disaster mitigation plan described in section 112(a)(2)(B) of the covered industrial operator; and</text></paragraph><paragraph id="idE7E44E295A4E49298FAB23A8B829A97F"><enum>(7)</enum><text display-inline="yes-display-inline">the cost associated with the depopulation and disposal, including labor.</text></paragraph></subsection><subsection id="id34362B98033C45ADB14D9BFCD66691ED"><enum>(b)</enum><header>Publicly searchable database</header><text display-inline="yes-display-inline">The Secretary, acting through the Office, shall develop and make publicly available an electronically searchable and sortable online database that contains information—</text><paragraph id="idBC5B6FE6322A48649130EA122E6F0ECE"><enum>(1)</enum><text display-inline="yes-display-inline">reported under subsection (a); and </text></paragraph><paragraph id="id7EB586D6D8F747F7B717FC72AAAAAD78"><enum>(2)</enum><text display-inline="yes-display-inline">submitted by covered industrial operators registering under section 112.</text></paragraph></subsection></section><section id="ided4de11a33c04f8985adbb4dd9fa0e73"><enum>116.</enum><header>Civil actions</header><subsection id="id7c2b290f99284665b7d44670dde7fa2b"><enum>(a)</enum><header>In general</header><text>Any person may—</text><paragraph id="idabedfa2658534c6e99e5b90f4b9f4b54"><enum>(1)</enum><text>bring a civil action against a covered industrial operator or the Secretary in an appropriate court to redress any violation of this subtitle or any other law relating to the activities described in this subtitle; and</text></paragraph><paragraph id="id73c2f1699b3b46bfa3918a7e11cb585e"><enum>(2)</enum><text>obtain appropriate relief in that civil action, including equitable relief and compensatory damages.</text></paragraph></subsection><subsection id="idca0e59de0fb4475795517d015b76ef05"><enum>(b)</enum><header>Attorney's fees for plaintiff</header><text>The court shall award a reasonable attorney’s fee as part of the costs to a prevailing plaintiff in a civil action described in subsection (a).</text></subsection></section></subtitle><subtitle id="id2896a35acbcb4199b7eb1f66a5323dc6"><enum>B</enum><header>Department of Labor</header><section id="ida911c3abb49841308941264707ed81c1"><enum>121.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id4e315e1fecb64c34b804322e7caa0680"><enum>(1)</enum><header>Affected contract grower</header><text>The term <term>affected contract grower</term> means an owner of an AFO—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddc0c8db78881483381e9d60d0835e36f"><enum>(A)</enum><text display-inline="yes-display-inline">that raises livestock or poultry pursuant to a written contract, marketing arrangement, or other arrangement, with a covered industrial operator; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id04048ff07a294536838eaa4e86470f20"><enum>(B)</enum><text display-inline="yes-display-inline">whose AFO is impacted by a disaster mitigation event. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbfcb8d77c094d1a8c1a5b3ee9cbe0c4"><enum>(2)</enum><header>Affected contractor</header><text>The term <term>affected contractor</term> means an individual or entity that supplies, either with or without a contract, a covered industrial operator with a worker to perform labor directly or indirectly related to a disaster mitigation event. </text></paragraph><paragraph id="id4dd33c28e00d4f3b855260e4d71bf057"><enum>(3)</enum><header>Covered worker</header><subparagraph commented="no" display-inline="no-display-inline" id="id013c6102380841de83d8211c52249771"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered worker</term>—</text><clause commented="no" display-inline="no-display-inline" id="idfa5e7567a9b843819b393188653dbdfd"><enum>(i)</enum><text display-inline="yes-display-inline">means an employee who performs labor in connection with a disaster mitigation event for a covered industrial operator; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida24525a87f794029b4fcc9d960d95641"><enum>(ii)</enum><text> includes any employee of an affected contract grower, or of another affected contractor, of a covered industrial operator.</text></clause></subparagraph><subparagraph id="ida56cf5d98c844d299da974e11f463ef9"><enum>(B)</enum><header>Additional terms</header><text>In this paragraph, the term <term>employee</term> means an individual performing any labor for a covered industrial operator, including through an affected contract grower or other affected contractor, unless—</text><clause id="id4d4cf58b76464381b6c907348f8f36be"><enum>(i)</enum><text>the individual is free from control and direction in connection with the performance of the labor, both under the contract for the performance of labor and in fact;</text></clause><clause id="id97481b2054da4907b7673bde8a2a7d25"><enum>(ii)</enum><text>the labor is performed outside the usual course of the business of the covered industrial operator; and</text></clause><clause id="id27ecd1ef1ccf40dfb74bd87def62d5f2"><enum>(iii)</enum><text>the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in the labor performed.</text></clause></subparagraph></paragraph><paragraph id="idef8ace7cd1e849e49fcddc01b59661af"><enum>(4)</enum><header>Disaster mitigation event</header><text>The term <term>disaster mitigation event</term> means a disaster event affecting a covered industrial operator that triggers activities described in the disaster mitigation plan submitted by the covered industrial operator under section 112(a)(2)(B).</text></paragraph></section><section id="idccfdc716783c44b781380609bc5494d2"><enum>122.</enum><header>Minimum labor standards for covered workers and affected contract growers</header><subsection id="idb24bea8be98b488c95c37334eaa8058e"><enum>(a)</enum><header>Applicability</header><text>A covered industrial operator that employs or contracts with covered workers, affected contract growers, or other affected contractors related to a disaster mitigation event shall comply with the labor standards described in subsection (b).</text></subsection><subsection id="idf7666371e69944c8a97cfdbc204971ea"><enum>(b)</enum><header>Labor standards</header><text>The labor standards described in this subsection are the following:</text><paragraph id="id0a03e39d444643268e18e3a11907f5e8"><enum>(1)</enum><header>Whistleblower protections</header><text>A covered industrial operator shall not discharge, cause to be discharged, or in any other manner discriminate against any covered worker or affected contract grower because such covered worker or affected contract grower—</text><subparagraph id="idf2bab3cdefe945d5adfbd6ecf1b58c12"><enum>(A)</enum><text>has filed any complaint or instituted or caused to be instituted any proceeding under or related to this section; or</text></subparagraph><subparagraph id="id3db731a1b4f94c45aad851512c48284d"><enum>(B)</enum><text>has testified or is about to testify in any such proceeding.</text></subparagraph></paragraph><paragraph id="ida5070cedfd2948fb87ea7d73e2a7e02f"><enum>(2)</enum><header>Health insurance requirement</header><text>During a disaster mitigation event and for a period of not less than 2 years following the disaster mitigation event, the covered industrial operator shall offer each covered worker and affected contract grower of the covered industrial operator a health plan that provides coverage that is at least equivalent to coverage provided by an essential health benefits package (as defined in subsection (a) of section 1302 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18022">42 U.S.C. 18022</external-xref>)) at the silver level of coverage (as defined in subsection (d)(1)(B) of such section), regardless of their employment status or contract with the covered industrial operator. Such covered industrial operator shall pay the full premium amount for such health plan for each such covered worker or affected contract grower who elects to enroll in such plan. </text></paragraph><paragraph id="id9af96d3bac824853a49e45d4094ce830"><enum>(3)</enum><header>Severance pay for covered workers</header><text>In the case of a disaster mitigation event, the covered industrial operator shall provide any covered worker terminated by the covered industrial operator, or by an affected contract grower or other affected contractor of the covered industrial operator impacted by the disaster mitigation event, during the 60-day period following the disaster mitigation event with 12 weeks of severance pay, at a weekly rate equal to the average weekly earnings of the covered worker during the disaster mitigation event.</text></paragraph><paragraph id="iddcb235739dd54e8d93beddfd5792d7b6"><enum>(4)</enum><header>Lost revenue for affected contract growers</header><text>In any case in which a covered industrial operator terminates the contract of an affected contract grower following a disaster mitigation event, the covered industrial operator shall provide an amount of lost revenue to the affected contract grower equal to the affected contract grower’s revenue from the covered operator during the preceding 180 days.</text></paragraph></subsection><subsection id="idef15ba00f37b4754ae8eade9d952b87b"><enum>(c)</enum><header>Enforcement by the Secretary of Labor</header><paragraph id="id444bd7f7564f4bc580a74c4223deeea0" commented="no"><enum>(1)</enum><header>General authority</header><text>The Secretary of Labor shall receive, investigate, and attempt to resolve complaints of violations of this section in the same manner that the Secretary of Labor receives, investigates, and attempts to resolve complaints of violations of sections 6, 7, and 15(a)(3) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref>, 207, and 215(a)(3)), including such Secretary’s authority to supervise payment of wages and compensation under section 16(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(c)</external-xref>).</text></paragraph><paragraph id="id031e98bf35294c699555728828794205" commented="no"><enum>(2)</enum><header>Civil penalties</header><text>The Secretary of Labor may assess a civil penalty against a covered industrial operator that violates any provision of this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id882ee7c3c94042a8b127195c7ae4932a"><enum>(3)</enum><header>Monitoring compliance</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Labor shall—</text><subparagraph id="ida766eb363c8440ca83551dc4c782fcea" commented="no"><enum>(A)</enum><text>develop a process to monitor compliance with the standards under this section that requires covered industrial operators to provide information to demonstrate such compliance; and</text></subparagraph><subparagraph id="idf9d4ecb48d9b4bcd9cc449cd245d868f" commented="no"><enum>(B)</enum><text>issue rules to determine penalties for noncompliance with this section.</text></subparagraph></paragraph><paragraph id="id6621a607d9e6496093fb084910135086"><enum>(4)</enum><header>Notification of Office</header><text>The Secretary of Labor shall notify the Office of any covered industrial operator that is determined to be noncompliant with the requirements of this section.</text></paragraph></subsection><subsection id="id6da18c5afa39458ab769f8897f9d4482"><enum>(d)</enum><header>Right of action for violations</header><paragraph id="idc8295c893e024cc7a3e3625348705bb2"><enum>(1)</enum><header>Private right of action for violations</header><text>An action to recover damages or obtain relief prescribed in paragraph (2) may be maintained against any covered industrial operator in any Federal or State court of competent jurisdiction by 1 or more covered workers or affected contract growers for and on behalf of themselves and other similarly situated covered workers or affected contract growers. </text></paragraph><paragraph id="ide71fcad4a9a84587af96327a06cf71db"><enum>(2)</enum><header>Liability</header><subparagraph id="id279f40d60a524114b18bff3315c13ba6"><enum>(A)</enum><header>In general</header><text>A covered industrial operator who violates this section shall be liable to each covered worker or affected contract grower that is aggrieved by the violation for—</text><clause commented="no" display-inline="no-display-inline" id="idfcea98fde7df4475b4464fb0d2a30ba7"><enum>(i)</enum><text display-inline="yes-display-inline">damages in the amount of unpaid wages, salary, overtime compensation, or other compensation denied or lost by reason of the violation; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id808781deca764f26b9a7a7ab910921f7"><enum>(ii)</enum><text display-inline="yes-display-inline">an additional equal amount as liquidated damages.</text></clause></subparagraph><subparagraph id="idf14917749d57486b9794000302412c5d"><enum>(B)</enum><header>Attorney’s fees and costs</header><text>In a civil action brought under paragraph (1) in which the plaintiff prevails, the court shall award the plaintiff reasonable attorney’s fees and costs of the action.</text></subparagraph></paragraph><paragraph id="idd1cc9ba4b40f43478e8eca1b40ecfdda"><enum>(3)</enum><header>Enforcement by the Secretary of Labor</header><text>The Secretary of Labor may bring an action in any court of competent jurisdiction to recover damages or obtain relief described in paragraph (2) on behalf of a covered worker or affected contract grower aggrieved by a violation of this section.</text></paragraph></subsection></section><section id="id7a4bfef94aff48b8862ea686efc70976"><enum>123.</enum><header>Prohibition on the use of incarcerated workers</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a covered industrial operator that the Secretary of Labor determines entered into a contract, on or after the date of enactment of this Act, with any entity to utilize incarcerated workers to perform labor related to a disaster mitigation event shall not be eligible for—</text><paragraph id="id0905aadce0b1438fbe2c7a31890ff6fc"><enum>(1)</enum><text>any Federal contracts for a period of 10 years beginning on the date of the determination; and</text></paragraph><paragraph id="idb7427a04b8424243999d0b0e780b4202" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text> inspection of any facility owned or controlled by the covered industrial operator pursuant to the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>) or the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>), as applicable, for a period of 10 years beginning on that date. </text></paragraph></section></subtitle></title><title id="id3bfa93b365364914ac18de5358e7e723"><enum>II</enum><header>Grant and pilot programs</header><section id="id8c960c4662854988898f3fa1c0be5667"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="idfe97e1d21a6a4ec2ae48e09dd3bdd919"><enum>(1)</enum><header>Controlled-atmosphere stunning</header><text>The term <term>controlled-atmosphere stunning</term> means rendering poultry unconscious through exposure to a mixture of gas (nitrogen and argon or concentrations of carbon dioxide) before slaughter.</text></paragraph><paragraph id="id66fb22a48be441b0afebc02b587c2cd1"><enum>(2)</enum><header>Eligible processing facility</header><text>The term <term>eligible processing facility</term> means an eligible facility described in section 764 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/21/473">21 U.S.C. 473</external-xref>), that has a labor peace agreement in place.</text></paragraph><paragraph id="id2ef9153eab0e44d587d9689e660f404a" commented="no"><enum>(3)</enum><header>Labor peace agreement</header><text>The term <term>labor peace agreement</term> means an agreement—</text><subparagraph id="id741235e664574db38717378f204b57d1" commented="no"><enum>(A)</enum><text>between an employer and a labor organization that represents, or is actively seeking to represent as of the date on which the labor peace agreement is entered, the employees of the employer; and</text></subparagraph><subparagraph id="id4c1905b038b24ad9b252533c0868266f" commented="no"><enum>(B)</enum><text>under which such employer and such labor organization agree that—</text><clause id="idaaf2bfd3f574469c9a2bc94cdd5ddc80" commented="no"><enum>(i)</enum><text>the employer will not—</text><subclause id="id9560001f550b41c3a712d6475e974346" commented="no"><enum>(I)</enum><text>hinder any effort of an employee to join a labor organization; or</text></subclause><subclause id="id09bd206124d048e3b36117ffa8a98563" commented="no"><enum>(II)</enum><text>take any action that directly or indirectly indicates or implies any opposition to an employee joining a labor organization;</text></subclause></clause><clause id="id88716b2486b54580b1e6c915fcd3cc12" commented="no"><enum>(ii)</enum><text>the labor organization will refrain from picketing, work stoppages, or boycotts against the employer;</text></clause><clause id="id71bf7f3d4b0e4d1e89bed540003b2561" commented="no"><enum>(iii)</enum><text>the employer will—</text><subclause commented="no" display-inline="no-display-inline" id="id042f9c60b123478095c310d59e72d489"><enum>(I)</enum><text display-inline="yes-display-inline">provide the labor organization with employee contact information; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id92b1f599add44552a768b7ec2308dd1e"><enum>(II)</enum><text display-inline="yes-display-inline">facilitate or permit labor organization access to employees at the workplace, including facilitating or permitting the labor organization to meet with employees to discuss joining the labor organization; and</text></subclause></clause><clause id="id8b91274c0be046d09bf23795cb8eb950" commented="no"><enum>(iv)</enum><text>the employer will, upon the request of the labor organization, recognize the labor organization as the bargaining representative of the employees if a majority of the employees choose the labor organization as their bargaining representative. </text></clause></subparagraph></paragraph><paragraph id="ida2751a97068c44698418f154cb817105"><enum>(4)</enum><header>Live-shackle slaughter</header><text>The term <term>live-shackle slaughter</term> means the method of stunning poultry before slaughter by shackling the poultry upside down by their legs and moving the poultry through electrified baths meant to render the poultry unconscious. </text></paragraph></section><section id="id01cfa487ce4f4423b55ad3813d67cb0d"><enum>202.</enum><header>Controlled-atmosphere stunning transition program</header><subsection id="idafac9978797b4ca1ba24cfb6719598c6"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a transition program to award grants to eligible processing facilities that process poultry to transition from live-shackle slaughter to controlled-atmosphere stunning.</text></subsection><subsection id="idb59336df5401402294f0bb9450abc208"><enum>(b)</enum><header>Eligibility</header><text>As a condition of receipt of a grant under subsection (a), an eligible processing facility shall not, for a period of 10 years following the date of receipt of the grant, sell a slaughter or processing facility to, or merge the slaughter or processing facility with, a packer that owns more than 10 percent of the market share of meat and poultry markets. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id301af04bd2024e9680e8ed359e66a179"><enum>(c)</enum><header>Funding</header><text>There is appropriated, out of any funds in the Treasury not otherwise appropriated, $750,000,000 to the Secretary to carry out this section.</text></subsection></section><section id="idc3b9cb94b6aa4c33bab043865d85e7f9"><enum>203.</enum><header>Pilot program for increased accessibility to inspection and technical assistance for eligible processing facilities</header><subsection id="id02ce658325a643eabfc9dcc34b326529"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out a 5-year pilot program within the Meat and Poultry Inspection Division of the Food Safety and Inspection Service—</text><paragraph id="id7ae04ed53ee347c9bc212a7780765c43"><enum>(1)</enum><text>to expand the availability of processing inspectors, technical assistance, and onsite inspection for eligible processing facilities, including no-cost overtime inspections; and</text></paragraph><paragraph id="id05e423c0ac48407582c3f86282912a78"><enum>(2)</enum><text>to identify and train part-time inspectors and technical assistance providers. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd47c921abac844fa974dd5a1e937b3d1"><enum>(b)</enum><header>Professional experience</header><text display-inline="yes-display-inline">The Secretary shall determine the appropriate professional experience of inspectors and providers described in subsection (a)(2), which shall include individuals with expertise in veterinary medicine, public health, food service management, and animal science, as applicable.</text></subsection><subsection id="idCEAD38CAC9FB485EB7223B48D9350F9E" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Funding</header><text>There is authorized to be appropriated to the Secretary not less than $50,000,000 to carry out this section.</text></subsection></section></title><title id="idf77575895fd44b00b63e5b7feccfc552"><enum>III</enum><header>Humane handling reforms</header><subtitle id="idbaee9977f56d4e7e830071805f2db6c1"><enum>A</enum><header>Transport</header><section id="idcc20ddef695241b097b84ae1f16e8737"><enum>311.</enum><header>Transportation of livestock and poultry</header><subsection commented="no" display-inline="no-display-inline" id="id97201226C3144A8DBFE3D074F6586FDE"><enum>(a)</enum><header>Transportation lasting more than 8 hours</header><paragraph commented="no" display-inline="no-display-inline" id="idBF92E9F206284D839DB8DFD380432DF4"><enum>(1)</enum><header>In general</header><text>Section 80502 of title 49, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id69BE917FCBAD43DB8B77AB27149A95A7"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>a rail carrier</quote> and all that follows through <quote>territory or possession,</quote> and inserting <quote>a covered provider of transportation</quote>;</text></subparagraph><subparagraph AFOs</header><text>The quantity of livestock or poultry referred to in subparagraph (A) is 1 or more of the following quantities of livestock or poultry housed in 1 or more Animal Feeding Operations at a single point in time:</text><clause commented="no" display-inline="no-display-inline" id="id4CB808BD786B4E068B2B6A9FB773F9F0"><enum>(i)</enum><text display-inline="yes-display-inline">2,500 swine.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2FDF4ABD434249E893ABA6736D7FF28F"><enum>(ii)</enum><text>30,000 turkeys or ducks.</text></clause><clause commented="no" display-inline="no-display-inline" id="id47A51CD659D140729160DE30EDF75088"><enum>(iii)</enum><text>82,000 laying hens or broilers.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC04CE591CB04E3CBA424C162B1D94FE"><enum>(2)</enum><header>Covered provider of transportation</header><subparagraph commented="no" display-inline="no-display-inline" id="idDF30D4D7BB454E3EAA9209AE3845CFF6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered provider of transportation</term> means an individual or entity described in subparagraph (B) that is transporting animals from a place in a State, the District of Columbia, or a territory or possession of the United States through or to a place in another State, the District of Columbia, or a territory or possession of the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC8D9AF7D187940AEAF2F9B82695AFDCC"><enum>(B)</enum><header>Individuals and entities described</header><text>An individual or entity referred to in subparagraph (A) is—</text><clause commented="no" display-inline="no-display-inline" id="id13974273C36143798D9C60E38299375C"><enum>(i)</enum><text display-inline="yes-display-inline">a rail carrier, express carrier, or common carrier (except by air or water);</text></clause><clause commented="no" display-inline="no-display-inline" id="id106AE6EDDA564733BA56E6B8CCCB2CA6"><enum>(ii)</enum><text>a receiver, trustee, or lessee of a carrier described in clause (i); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3DE5E4A59B6042D68A265DC22F727093"><enum>(iii)</enum><text>an owner or master of a vessel.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95FAE21ECCFB4AE8A02CCA94C4279975"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE0EFFD70F9D342B9AA7EC08A9848A656"><enum>(F)</enum><text>by inserting after subsection (c) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" display-inline="yes-display-inline">In any case in which animals are transported by a covered provider of transportation on behalf of a covered industrial operator for a period lasting, or expected to last, more than 8 consecutive hours, the covered provider of transportation transporting the animals shall ensure that—</text><subparagraph id="idB4211441C90B46A8A57242517C6F2C98"><enum>(A)</enum><text>the means of transport provides adequate protection of the animals from high winds, rain, and snow;</text></subparagraph><subparagraph id="id39DB0113A1C14D2E8348B52D3C429E38"><enum>(B)</enum><text>any livestock or poultry are provided with appropriate bedding or equivalent material that—</text><clause commented="no" display-inline="no-display-inline" id="id05A062D11DE54936AD5DED9D283E4B0B"><enum>(i)</enum><text display-inline="yes-display-inline">prevents slipping;</text></clause><clause commented="no" display-inline="no-display-inline" id="id32747A60E63F446693012AB66BA37BA2"><enum>(ii)</enum><text display-inline="yes-display-inline">ensures a level of comfort appropriate to—</text><subclause commented="no" display-inline="no-display-inline" id="id15191D3D6A514A64A44C242A2C79AE9A"><enum>(I)</enum><text display-inline="yes-display-inline">the species of the livestock or poultry;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idAA79DFB6318D4AA79C924F2DAFBE051A"><enum>(II)</enum><text display-inline="yes-display-inline">the number of animals being transported;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD3701674D3D34C259CF81F1431A54F83"><enum>(III)</enum><text display-inline="yes-display-inline">the duration of the period of transportation; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id49547505936C4C0A88632830936866A5"><enum>(IV)</enum><text display-inline="yes-display-inline">the weather; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id993D3DC7EF414896AB63F23F34A81B0A"><enum>(iii)</enum><text display-inline="yes-display-inline">provides adequate absorption of urine and feces;</text></clause></subparagraph><subparagraph id="id5542F9E5B5DB4C36B410050BE66CC076"><enum>(C)</enum><text>the animals are not overcrowded during transport, including by complying with the regulations promulgated under paragraph (2); </text></subparagraph><subparagraph id="id48F72628AD024E3895CFCAD864BC7C2C"><enum>(D)</enum><text>the means of transport is equipped with a water supply that ensures that each animal has access to water in a manner and quantity appropriate to the species and size of the animal;</text></subparagraph><subparagraph id="idD95121B856AF4B478578A856AF2495AA"><enum>(E)</enum><text>watering devices on the means of transport are—</text><clause commented="no" display-inline="no-display-inline" id="id473240159C554315B556DB009A18B908"><enum>(i)</enum><text display-inline="yes-display-inline">in good working order;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5E07B33640D149F58FCD58A7E2D05AF0"><enum>(ii)</enum><text display-inline="yes-display-inline">appropriately designed; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id157C3754F0464446A0B7A54F1F82AA5C"><enum>(iii)</enum><text display-inline="yes-display-inline">positioned appropriately for the species of animal to be watered during transport; and</text></clause></subparagraph><subparagraph id="idFD574663E13445D5B12CECE173BE9724"><enum>(F)</enum><text>the animals are not transported when the temperature within the means of transport cannot be maintained between 40 degrees Fahrenheit and 86 degrees Fahrenheit.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10466F8F7E28404CA37D1BA0B3C4E336"><enum>(2)</enum><header>Rulemaking</header><subparagraph commented="no" display-inline="no-display-inline" id="id137CFC89B0D8445EA0F4E675BD75429A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations setting species-specific space allowances during periods of transportation lasting more than 8 hours.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43AB55713CC241389AEBC06D932FF4BA"><enum>(B)</enum><header>Requirements</header><text>The regulations promulgated under subparagraph (A) shall ensure that each species of animal has enough space—</text><clause commented="no" display-inline="no-display-inline" id="idECEF69CE87244050A218BBB81B765C72"><enum>(i)</enum><text display-inline="yes-display-inline">to turn around;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7E98C8642A894B8C991AB790362B6C3B"><enum>(ii)</enum><text display-inline="yes-display-inline">to lie down; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id6CD1D094513B4202B0E6C1ED63059504"><enum>(iii)</enum><text display-inline="yes-display-inline">to fully extend the limbs of the animal.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id13CA4B03D6FD4387A0518B7E5595EF3E"><enum>(e)</enum><header>Recordkeeping</header><paragraph commented="no" display-inline="no-display-inline" id="id2FD4C82F3F6341C8BC9BEAC61CC53620"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each covered industrial operator shall maintain records of all livestock transported by the covered industrial operator.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" commented="no" display-inline="no-display-inline" id="id47b650db69024edfa5ca224bc7aa7a74"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="id0cfc3fd37ef6484f90742f9600d75e9f"><enum>(1)</enum><header>Eligible research institution</header><text>The term <term>eligible research institution</term> means—</text><subparagraph id="id38c3e1c7f4b84e76b712d787675064d3"><enum>(A)</enum><text>an 1862 Institution (as defined in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>));</text></subparagraph><subparagraph id="id82de04d059dc4879801b0daabc37215b"><enum>(B)</enum><text>an 1890 Institution (as defined in that section);</text></subparagraph><subparagraph id="id15ffa93bb9ae4260bc4c932c652ffa1c"><enum>(C)</enum><text>a 1994 Institution (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>));</text></subparagraph><subparagraph id="id58deab0445ee4d35979ef4c3c574d9e7"><enum>(D)</enum><text>a non-land-grant college of agriculture (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)) that has a demonstrable capacity to conduct livestock or poultry research, as determined by the Secretary;</text></subparagraph><subparagraph id="id1efffca2468a4154ad8f8dc52e9c8c1c"><enum>(E)</enum><text>Hispanic-serving agricultural colleges and universities (as defined in that section); and</text></subparagraph><subparagraph id="idaf009edde6fd422e897162262cd258f8"><enum>(F)</enum><text>a center of excellence recognized under section 1673 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5926">7 U.S.C. 5926</external-xref>).</text></subparagraph></paragraph><paragraph id="ida7ef8e767d6e4ca68b022712715d512d"><enum>(2)</enum><header>Higher-welfare transport</header><text>The term <term>higher-welfare transport</term> means the handling, loading, and transport mechanisms by which livestock and poultry are transported, at any time, which take into account animal welfare and species-specific requirements to ensure that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide1bf893303d44573a282e42f18aef159"><enum>(A)</enum><text display-inline="yes-display-inline">animal welfare is maintained throughout transport; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id451c222ae80b4e42993c86231a327fd2"><enum>(B)</enum><text display-inline="yes-display-inline">animals are spared unnecessary distress or injury.</text></subparagraph></paragraph></subsection><subsection id="id5e9470be6eb74ade9616e73430e2b5bc"><enum>(b)</enum><header>Grant program</header><text>The Secretary shall establish a program to provide grants to eligible research institutions to study higher-welfare transport.</text></subsection><subsection id="id06ac173edcfd4a6baa76f475e52fdf7d"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under this section, an eligible research institution shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="idfb6b3ff5aadc4e18be216a6e9b56117c"><enum>(d)</enum><header>Requirements</header><text>In carrying out the program established under subsection (b), the Secretary shall ensure that none of the grant funding may be used to perform any experiment that would not comply with current transport law.</text></subsection><subsection id="id7292945580634afb80cc270ea2bdd79a" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $50,000,000 for each of fiscal years 2023 through 2025. </text></subsection></section></subtitle><subtitle commented="no" level-type="subsequent" id="id2d0efe6ca57345c490dd53d073d33939"><enum>B</enum><header>Nonambulatory livestock</header><section id="id8fe11a9d3cee4f73a8288b9da4324725"><enum>321.</enum><header>Unlawful slaughter practices involving nonambulatory livestock</header><subsection id="idcb87c0ed759c45fcb8d74d8d12cb252a"><enum>(a)</enum><header>In general</header><text>Public Law 85–765 (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) is amended by inserting after section 2 (<external-xref legal-doc="usc" parsable-cite="usc/7/1902">7 U.S.C. 1902</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf08b86910ef64039b03b9727e8f82f01"><section id="id9A1B0A6FFE7E436EA38E2D55561B000C"><enum>3.</enum><header>Nonambulatory livestock</header><subsection id="id62b80b925a984f91b2e7160a29e030f1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0c097ca187a84c2a9931b9333fd780da"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph id="id8b364a790dc24c63890b168ad4df0eed"><enum>(A)</enum><text>a stockyard;</text></subparagraph><subparagraph id="id1031028644da4cc3ada97696bc3f1272"><enum>(B)</enum><text>a market agency;</text></subparagraph><subparagraph id="idcd309bdc082a4559a1df65d98bd6cdc8"><enum>(C)</enum><text>a packer (as defined in section 201 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/191">7 U.S.C. 191</external-xref>)); </text></subparagraph><subparagraph id="idcd4e547a5e8349fdbf314906490959c2"><enum>(D)</enum><text>a dealer (as defined in section 301 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/201">7 U.S.C. 201</external-xref>));</text></subparagraph><subparagraph id="idf2893c32c477460db39ed489807f4dd0"><enum>(E)</enum><text>a slaughter facility; and</text></subparagraph><subparagraph id="ida4418b6c1aef43ec91d7c256620d1dd0"><enum>(F)</enum><text>an establishment.</text></subparagraph></paragraph><paragraph id="id46f9914cc0bf41e6b8427328a94c8065"><enum>(2)</enum><header>Establishment</header><text>The term <term>establishment</term> means an establishment that is subject to inspection pursuant to the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>).</text></paragraph><paragraph id="id1d4b4e524aa2455997c54e67aad8f6e2"><enum>(3)</enum><header>Humanely euthanize</header><text>The term <term>humanely euthanize</term> means to immediately render an animal unconscious by mechanical, chemical, or other means, with the unconscious state remaining until the death of the animal.</text></paragraph><paragraph id="id8ede2df326e346b1876c91491bcebe47"><enum>(4)</enum><header>Nonambulatory livestock</header><text>The term <term>nonambulatory livestock</term> means any cattle, sheep, swine, goats, or horses, mules, or other equines who cannot stand or walk unassisted.</text></paragraph><paragraph id="id4964f7a431c948968ae2408d60c0c981"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="idfc7ea69080c2473ea21b276a28787fc4"><enum>(b)</enum><header>Humane treatment, handling, and disposition</header><text>The Secretary shall promulgate regulations to provide for the humane treatment, handling, and disposition of all nonambulatory livestock by covered entities, including requirements for covered entities—</text><paragraph id="id8F962CE2324C451281A1892133B38415"><enum>(1)</enum><text>to immediately humanely euthanize nonambulatory livestock when the livestock becomes nonambulatory livestock, subject to subsection (c); and</text></paragraph><paragraph id="id9C887DA2E29B48299AEEBEC2BD63209C"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3F8861CD770E40179DE48092BAA87FBE"><enum>(A)</enum><text>to have written policies and procedures in place, and proper equipment, relating to the humane handling, euthanization, and disposition of all nonambulatory livestock;</text></subparagraph><subparagraph id="id085C69FE7EB346B0AF02E66C846A1402" indent="up1"><enum>(B)</enum><text>to maintain records of all nonambulatory livestock; and</text></subparagraph><subparagraph id="id07E78995B7174E2D9D49D05708D65884" indent="up1"><enum>(C)</enum><text>to electronically submit those written policies and procedures and records to the Administrator of the Food Safety and Inspection Service.</text></subparagraph></paragraph></subsection><subsection id="idbbe2e5086966481ba1709dfaca0dc342"><enum>(c)</enum><header>Humane euthanasia</header><paragraph id="id15915f5f1e514c57b974e28fd4f0d9fa"><enum>(1)</enum><header>In general</header><text>The Secretary shall promulgate regulations specifying—</text><subparagraph id="id9D7C436DA3A74ECBA5A41A71E907623A"><enum>(A)</enum><text>the methods of euthanasia that shall be acceptable for the humane disposition of nonambulatory livestock required under the regulations promulgated under subsection (b); and </text></subparagraph><subparagraph id="idAE01B4B7229B40E6B94598F5FC20B690"><enum>(B)</enum><text>processes for ensuring effective enforcement of the use of those methods.</text></subparagraph></paragraph><paragraph id="id394a8404a51a4c7cae0e754b3341529d"><enum>(2)</enum><header>Disease testing</header><text>The regulations promulgated under subsection (b) shall not limit the ability of the Secretary to test nonambulatory livestock for a disease.</text></paragraph></subsection><subsection id="id2a789cc9cf8f4cd0a5449c26902cdef1"><enum>(d)</enum><header>Transacting or processing</header><text>A covered entity shall not—</text><paragraph id="id5E51E6514BC44E5FA38E043139C4B79A"><enum>(1)</enum><text>buy or sell a nonambulatory animal; or </text></paragraph><paragraph id="id2F9F08F53DB94A1BA84FBE4C664E67D4"><enum>(2)</enum><text>process, butcher, or sell meat or products of nonambulatory livestock.</text></paragraph></subsection><subsection id="id96203C951A274BDB940D8B25B2F61266"><enum>(e)</enum><header>Records</header><text>The Administrator of the Food Safety and Inspection Service shall maintain all documents submitted by covered entities pursuant to the regulations under subsection (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ideafe7b5ce32e4b6581e872aeda8cbb0a"><enum>(b)</enum><header>Inspection of nonambulatory livestock; labeling</header><text>Section 6 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/606">21 U.S.C. 606</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2B870729C51646F5A94F6F348B68B8BB"><subsection commented="no" display-inline="no-display-inline" id="idd72e1e66997244c8a955942063c94c20"><enum>(c)</enum><header>Inspection of nonambulatory livestock; labeling</header><paragraph id="id066D09A1AB8849228710A9C447F64AC6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of nonambulatory livestock</header><text display-inline="yes-display-inline">In this subsection, the term <quote>nonambulatory livestock</quote> means any cattle, sheep, swine, goats, or horses, mules, or other equines who cannot stand or walk unassisted. </text></paragraph><paragraph id="ida043078c6d494f5491c4a0e0a7937224"><enum>(2)</enum><header>Inspection</header><text>It shall be unlawful for an inspector at an establishment subject to inspection under this Act to pass through inspection any nonambulatory livestock or carcass (including parts of a carcass) of nonambulatory livestock.</text></paragraph><paragraph id="id5b7cb35c2bf24fd29b8d04a3e2a270cc"><enum>(3)</enum><header>Labeling</header><text>An inspector or other employee of an establishment described in paragraph (2) shall label, mark, stamp, or tag as <quote>inspected and condemned</quote> any carcass (including parts of a carcass) of nonambulatory livestock.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbf61fcb6cbf2445c88e11ff2af2a727b"><enum>(c)</enum><header>Effective date</header><paragraph id="id16a4198b7a9c483693e6b38284d804f5"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by subsections (a) and (b) shall take effect on the date that is 1 year after the date of enactment of this Act.</text></paragraph><paragraph id="id98dea61ed21c4c19ae2e6ebcd9cd4fb5"><enum>(2)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall promulgate final regulations to implement the amendments made by subsections (a) and (b).</text></paragraph></subsection></section><section id="id9680b7bfeafb48898fc227851e8c68be"><enum>322.</enum><header>Unlawful use of drugs contributing to nonambulatory conditions</header><text display-inline="no-display-inline">The Animal Health Protection Act is amended by inserting after section 10409A (<external-xref legal-doc="usc" parsable-cite="usc/7/8308a">7 U.S.C. 8308a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3437BB5839D94C8E83891178C2397C93"><section id="idFE362690CDF946F091BFF4737027D87D"><enum>10409B.</enum><header>Unlawful use of drugs on certain animals</header><text display-inline="no-display-inline">Any use of a beta-agonist drug, including ractopamine, zilpaterol, and lubabegron, in an animal in the absence of disease, including use for growth promotion or feed efficiency, is prohibited.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2ef683bf785d421f8d4883b5fcda6e94"><enum>323.</enum><header>Inclusion of poultry in Humane Methods of Slaughter Act</header><subsection id="id35cb0821fd154a4cb7c5f553a374b708"><enum>(a)</enum><header>In general</header><text>Public Law 85–765 (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/1901">7 U.S.C. 1901 et seq.</external-xref>) is amended by adding <quote>and poultry</quote> after the term <term>livestock</term> each place it appears, except as provided in subsection (b).</text></subsection><subsection id="idC76347F89B534FB3B9DA501AF14D505F"><enum>(b)</enum><header>Other conforming amendment</header><text>Section 2(a) of <external-xref legal-doc="public-law" parsable-cite="pl/85/765">Public Law 85–765</external-xref> (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/1902">7 U.S.C. 1902</external-xref>) is amended by striking <quote>and other livestock,</quote> and inserting <quote>other livestock, and poultry</quote>.</text></subsection><subsection id="id3808877daf874de9b0becf95056e7ec1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect on the date that is 10 years after the date of enactment of this Act.</text></subsection></section></subtitle><subtitle id="iddf06766995884864acff9da0313f4364"><enum>C</enum><header>Inspections</header><section id="id2bcfef8ce2ad4b9db0af8625267efa69"><enum>331.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="iddcab46afeab842d4bf3082029cbc6036"><enum>(1)</enum><header>Covered establishment</header><text>The term <term>covered establishment</term> means—</text><subparagraph id="id36081f1c943946149e9c4fb505e54565"><enum>(A)</enum><text>an official establishment (as defined in section 301.2 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id1f01fe3228494e349b23a689f579ce47"><enum>(B)</enum><text>an official establishment (as defined in section 381.1 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id63966a81655b4a3ca605063f7e2c0f28"><enum>(2)</enum><header>Employee</header><text>The term <term>employee</term> has the meaning given the term in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>). </text></paragraph></section><section id="id65235f51c17b4a2bae4f852436763460"><enum>332.</enum><header>Ending dangerous higher-speed slaughter and self-inspection systems</header><subsection commented="no" display-inline="no-display-inline" id="idc02530a239364242a51dfc36d6f10363"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of covered program</header><paragraph commented="no" display-inline="no-display-inline" id="id00d46109374842289b7055dd6b50704c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>covered program</quote> means any waiver, program, or regulation that—</text><subparagraph id="idf7e3520d884547348b8e1884eb3b0df7"><enum>(A)</enum><text>allows covered establishments to operate at slaughter speeds that exceed existing limits required by regulations of the Department of Agriculture as of the date of enactment of this Act;</text></subparagraph><subparagraph id="id898f28c7a9dd456b9af574f3997960f6"><enum>(B)</enum><text>reduces the number of Federal inspectors in covered establishments; or</text></subparagraph><subparagraph id="idb2e777876ca8467e9584c87b278e1474" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>replaces Federal inspectors at covered establishments with employees of the covered establishments for purposes of inspection.</text></subparagraph></paragraph><paragraph id="id2bf5907ba7bc4c4f8f373d8fe5c5cb25"><enum>(2)</enum><header>Inclusions</header><text>The term <quote>covered program</quote> includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="idea318efa1246418a9a101fd0d207cb91"><enum>(A)</enum><text display-inline="yes-display-inline">the New Swine Slaughter Inspection System described in the final rule entitled <quote>Modernization of Swine Slaughter Inspection</quote> (84 Fed. Reg. 49566 (August 21, 2014)); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b9d2f6bbd3549d09662bfa442069a60"><enum>(C)</enum><text display-inline="yes-display-inline">any waiver issued under an inspection system described in subparagraph (A) or (B).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id721c457d33754264b99ed67466b40cde"><enum>(b)</enum><header>Termination of covered programs</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Food Safety and Inspection Service, shall terminate or suspend implementation of or conversion to, as applicable, all covered programs.</text></subsection></section><section id="ide5f92b148aba478b8dc0d816ce33ccf6"><enum>333.</enum><header>Funding for additional OSHA inspectors</header><text display-inline="no-display-inline">There is authorized to be appropriated $60,000,000 for each of fiscal years 2023 through 2032 for the hiring of additional inspectors to carry out inspections under section 8 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657</external-xref>) in covered establishments. </text></section><section id="idde2a7ee824704c01bb64b8e241e9ac44"><enum>334.</enum><header>Funding for additional FSIS inspectors</header><subsection commented="no" display-inline="no-display-inline" id="id6d752cf6462640c5a02cadea3d2fd0bc"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $50,000,000 for each of fiscal years 2023 through 2032 to hire additional full-time equivalent positions within the Food Safety and Inspection Service relating to inspections conduced pursuant to, and the enforcement of, <external-xref legal-doc="public-law" parsable-cite="pl/85/765">Public Law 85–765</external-xref> (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/1901">7 U.S.C. 1901 et seq.</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id38e99453981f486f96a79269874db190"><enum>(b)</enum><header>Priority for hiring</header><text display-inline="yes-display-inline">In carrying out subsection (a), priority shall be given to hiring personnel—</text><paragraph commented="no" display-inline="no-display-inline" id="idbad0d4128aec4bf09b9e89d7aac8a4fa"><enum>(1)</enum><text display-inline="yes-display-inline">to inspect processing facilities (as described by the term <quote>eligible facility</quote> in section 764 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/21/473">21 U.S.C. 473</external-xref>)); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1bd31d645ca47f4b396989591cf5489"><enum>(2)</enum><text display-inline="yes-display-inline">in regions with the highest number of vacancies within the Food Safety and Inspection Service. </text></paragraph></subsection></section></subtitle></title></legis-body></bill>
