ensure that certain loan programs of the Small Business Administration are made available to cannabis-related legitimate businesses and service providers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFC6EA7DDA4D74C1F8A1A12B509A9745F"><section commented="no" section-type="section-one" id="HB11D8E200D0443C999C80A06CE09314C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access for Cannabis Small Businesses Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HED6E2CC946F747B2964ED3A4F5BB91D2"><enum>2.</enum><header>7<enum-in-header>(a)</enum-in-header> loans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4D188848F853474E9390A3D8D2039827"><paragraph id="H25BCC81DD93343C1A6ADEA207D13F94C"><enum>(38)</enum><header>Loans to cannabis-related legitimate businesses and service providers</header><subparagraph id="H0C500A85CE734F1EAA012C01B0B625C2"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HC5F4D931041C4C1A85762BE01B46BC4F"><enum>(i)</enum><header>Cannabis</header><text display-inline="yes-display-inline">The term <term>cannabis</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></clause><clause id="H67E3E6542D41479889E32A97A94D5230"><enum>(ii)</enum><header>Cannabis product</header><text>The term <term>cannabis product</term> means any article that contains cannabis, including an article that is a concentrate, an edible, a tincture, a cannabis-infused product, or a topical.</text></clause><clause id="HC100848780F749DF81A1040DBAA747A0"><enum>(iii)</enum><header>Cannabis-related legitimate business</header><text display-inline="yes-display-inline">The term <term>cannabis-related legitimate business</term> means a manufacturer, producer, or any person or company that is a small business concern and that—</text><subclause id="HAD66327180BF43C3BB490A30380BD08A"><enum>(I)</enum><text>engages in any activity described in subclause (II) pursuant to a law established by a State or a political subdivision of a State, as determined by the State or political subdivision; and</text></subclause><subclause id="HAA28C0C1858B4983B5B82CE275E2D08B"><enum>(II)</enum><text>participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subclause></clause><clause id="H2FFA2241DDAB4A3EB899CD6F63533FCE"><enum>(iv)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means a person who manufactures, compounds, converts, processes, prepares, or packages cannabis or cannabis products.</text></clause><clause id="H7111DA9A26F04CAFA88D3280B280F922"><enum>(v)</enum><header>Producer</header><text>The term <term>producer</term> means a person who plants, cultivates, harvests, or in any way facilitates the natural growth of cannabis.</text></clause><clause id="HA54EF2C9A8A04BA28B2C7E5942691845"><enum>(vi)</enum><header>Service provider</header><text display-inline="yes-display-inline">The term <term>service provider</term>—</text><subclause id="H313A1CF1630A41BA87B16E81AD113172"><enum>(I)</enum><text>means a business, organization, or other person that—</text><item id="H8370807C9E9C4A038249132E8AE389E1"><enum>(aa)</enum><text>sells goods or services to a cannabis-related legitimate business; or</text></item><item id="H3C763D06BE2641329E1E8A1AE831B931"><enum>(bb)</enum><text>provides any business services, including the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to cannabis; and</text></item></subclause><subclause id="H3F0D21019C5F4862BBDBB24F455A9352"><enum>(II)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subclause></clause><clause id="H607B6A495A964BA4AB00D5DBDE617979"><enum>(vii)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, Puerto Rico, and any territory or possession of the United States.</text></clause></subparagraph><subparagraph id="H2659AA185B65474E85BE0BED77F154DE"><enum>(B)</enum><header>Loans</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not decline to provide a guarantee for a loan under this subsection, and a lender may not decline to make a loan made under this subsection, to an otherwise eligible small business concern solely because the concern is a cannabis-related legitimate business or service provider.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H141E3809240B44B2811BDF16D5225BFF"><enum>3.</enum><header>Disaster loans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H79A40D2B5EEE4D65913CD34ECF5EB99B"><paragraph id="HF7FC2963084A42B2805938756F8E738D"><enum>(16)</enum><header>Assistance to cannabis-related legitimate businesses and service providers</header><text>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not decline to provide assistance under this subsection to an otherwise eligible borrower solely because the borrower is a cannabis-related legitimate business or service provider (as defined in subsection (a)(38)). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H29DADEC8CE84411D9AABE03CDE101D40"><enum>4.</enum><header>Microloans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(13)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H53A49D23FD3E41C5B58D9B414E6E5D65"><paragraph id="HE21CFF7E3A1640249EA9AA87DD58A1FD"><enum>(14)</enum><header>Assistance to cannabis-related legitimate businesses and service providers</header><text>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not prohibit an eligible intermediary from providing assistance under this subsection to an otherwise eligible borrower solely because the borrower is a cannabis-related legitimate business or service provider (as defined in subsection (a)(38)). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3142C9B0D84B477DB48597C63156A3E4"><enum>5.</enum><header>Small business investment company debentures to finance cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Part A of title III of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB9C2910FE8344E538BEA80E3DF8F7A95"><section id="HEF21D76D06DD437FACF11CE5ED3599AA"><enum>321.</enum><header>Debentures to finance cannabis-related legitimate businesses and service providers</header><subsection id="H6AAE333964E041D981447B8416295D35"><enum>(a)</enum><header>Guarantees</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not decline to purchase or guarantee a debenture issued under this title to an otherwise eligible small business investment company solely because the small business investment company provides financing to an entity that is a cannabis-related legitimate business or service provider (as defined in paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subsection><subsection id="H1015FF74173C4C698005BB2921298036"><enum>(b)</enum><header>Other assistance</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not prohibit a small business investment company from providing assistance under this title to an otherwise eligible small business concern solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H20C856920540438EB36B49C9E3404CDA"><enum>6.</enum><header>State or local development company loans to finance cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD8EDEFBEF05743E387F998C551514273"><section id="H2D5863FA946B4BE69B592F2979DA0704"><enum>511.</enum><header>Loans to finance cannabis-related legitimate businesses and service providers</header><subsection id="HD29E38E5790B40DDBEAD142E04F254B7"><enum>(a)</enum><header>Guarantees</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Administrator may not decline to guarantee a debenture issued under this title for the purpose of making 1 or more loans to small business concerns solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>). </text></subsection><subsection id="HF8A7B7B96992425895D0342C6DA98AC0"><enum>(b)</enum><header>Other assistance</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), a qualified State or local development company may not decline an application for a loan under this title submitted by an otherwise eligible small business concern solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idA3371313BC6F48B38E9880500785FFF8"><enum>7.</enum><header>Assistance from resource partners for cannabis-related legitimate businesses and service providers</header><subsection id="id5ca4ee055a82450fb41802ffb1a12ed4"><enum>(a)</enum><header>Small business development centers</header><text>Section 21(c) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45aa1ec960634e7582f983e531bb86a9"><paragraph id="idd5e12aa229c94096acd7705f357a7116"><enum>(9)</enum><header>Services for cannabis-related legitimate businesses and service providers</header><text>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), a small business development center may not decline to provide services to an otherwise eligible small business concern under this section solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb5ca4d5fe6454b3e8cfcb4053dec8b0d"><enum>(b)</enum><header>Women’s business centers</header><text>Section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idba75631b8fc845298b80963950a8550d"><subsection id="id36a1c10024e34aa9a6d33d7a873933ad"><enum>(p)</enum><header>Services for cannabis-Related legitimate businesses and service providers</header><text>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), a women’s business center may not decline to provide services to an otherwise eligible small business concern under this section solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id83faa540bf23461eb4bb2c3d692967a4"><enum>(c)</enum><header>SCORE</header><text display-inline="yes-display-inline">Section 8(b)(1)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(b)(1)(B)</external-xref>) is amended by adding at the end the following: <quote>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the head of the SCORE program established under this subparagraph may not decline to provide services to an otherwise eligible small business concern solely because the concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38)).</quote>.</text></subsection><subsection id="idb66cb143ef1f4a0da6b700110328c2f5"><enum>(d)</enum><header>Veteran business outreach centers</header><text>Section 32 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C. 657b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id50c2cc9c77b34806b0057ce33e4d8eab"><subsection id="idc9f1e75faf824c38b64f5647d4e06b5e"><enum>(h)</enum><header>Services for cannabis-Related legitimate businesses and service providers</header><text>Notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), a Veteran Business Outreach Center may not decline to provide services to an otherwise eligible small business concern under this section solely because the small business concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="H21A8936EAFFD4536971AC16D93511DA0"><enum>8.</enum><header>Technical assistance providers</header><text display-inline="no-display-inline">In addition to the programs covered by the amendments made by this Act, and notwithstanding any provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), a provider of financial or technical assistance under a program administered or funded by the Small Business Administration may not decline to provide such financial or technical assistance to an otherwise eligible small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) solely because the concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(38)</external-xref>).</text></section><section commented="no" id="id68EF518407D948A4BB35B52AA8009918"><enum>9.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 120 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue or amend any rules, standard operating procedures, and other legal or policy guidance as necessary to carry out the requirements of this Act and the amendments made by this Act.</text></section></legis-body></bill>
