which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Camp Lejeune Justice Act of 2022 to appropriately limit attorney's fees.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Camp Lejeune Victims Ensnared by Trial-lawyer’s Scams Act</short-title></quote> or the <quote><short-title>Protect Camp Lejeune VETS Act</short-title></quote>. </text></section><section id="id9d3f0084d3104555bea2242087fb1a1d"><enum>2.</enum><header>Attorneys fees in Federal cause of action relating to water at Camp Lejeune, North Carolina</header><subsection commented="no" display-inline="no-display-inline" id="id9b1e540ffaca4fe5a0122604ea68d234"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Camp Lejeune Justice Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/28/2671">28 U.S.C. 2671</external-xref> note prec.) is amended— </text><paragraph commented="no" display-inline="no-display-inline" id="id442187de0ee34e3d9b26a83b234488a8"><enum>(1)</enum><text>by redesignating subsections (h), (i), and (j) as subsections (i), (j), and (k), respectively; and</text></paragraph><paragraph id="id8329ece76f9744a2ad3914ca356446cb" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting after subsection (g) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idE015275F48DC4FE98E4BE4E79A023F01"><subsection id="id015b90383eb74c5a8ede2f51f7fc0bce"><enum>(h)</enum><header>Attorney fees</header><paragraph id="id5d416732b4f04a93956d8802b4b1fbe2"><enum>(1)</enum><header>General rule</header><text>Notwithstanding any contract, the attorney of an individual, or of the legal representative of an individual, may not receive, for services rendered in connection with an action filed under subsection (b) or any administrative action relating to such an action (as described in section 2675 of title 28, United States Code) (in this subsection referred to as an <quote>administrative claim</quote>), more than the percentage specified in paragraph (2) of a payment made in the action.</text></paragraph><paragraph id="id5d5416606f724533ab8b246c249c55a7"><enum>(2)</enum><header>Applicable percentage limitations</header><text>The percentage specified in this paragraph is—</text><subparagraph id="id32134ec895e34159bbaaaa9a5108caff"><enum>(A)</enum><text>2 percent for an administrative claim with respect to which a party entered a contract for services on or after August 10, 2022; or</text></subparagraph><subparagraph id="idea30653b4e8540de8a78701afc83039f"><enum>(B)</enum><text>10 percent for—</text><clause id="id1d2b2bbb2c1a4c6fab91f92fedee52c2"><enum>(i)</enum><text>an administrative claim with respect to which a party entered a contract for services before August 10, 2022; </text></clause><clause id="ide4f956f552284589a7bce0040ba98f49"><enum>(ii)</enum><text>a resubmission of an administrative claim after the denial of an initial administrative claim, without regard to the date on which the party entered the applicable contract for services; or </text></clause><clause id="id91f10945f7904d48aac40a2cc5d96a53"><enum>(iii)</enum><text>a judgment rendered or settlement entered in an action filed under subsection (b).</text></clause></subparagraph></paragraph><paragraph id="ideec81b790bb84640ba42491112ace77e"><enum>(3)</enum><header>Penalty</header><text>Any attorney who violates paragraph (1) shall be fined not more than $5,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6349da412eea48e0aaad6937ac8c6da7"><enum>(4)</enum><header>Terms for payment of fees</header><text>Any judgment rendered, settlement entered, or other award made with respect to an action filed under subsection (b) or an administrative claim shall provide that— </text><subparagraph commented="no" display-inline="no-display-inline" id="id55d7360e2d7b4ec191b84716840d108f"><enum>(A)</enum><text display-inline="yes-display-inline">the Government may not pay attorneys fees to an attorney directly; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id054299572bdf4135a149b39def929da0"><enum>(B)</enum><text display-inline="yes-display-inline">attorneys fees shall be payable to the attorney by an individual, or legal representative of an individual, after the individual or legal representative receives the amounts payable under the judgment, settlement, or award. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f287d27267b4da3aecb498ebcc79874"><enum>(5)</enum><header>Disclosure</header><subparagraph id="idc9769622641b4149901b5b733fa2aed0"><enum>(A)</enum><header>In general</header><text>Any judgment rendered, settlement entered, or other award made with respect to an action filed under subsection (b) or an administrative claim shall require disclosure to the Attorney General or to the court of the attorneys fees charged to an individual, or the legal representative of an individual. </text></subparagraph><subparagraph id="idc4e04d7082d94c9e8ff111213acea1c3"><enum>(B)</enum><header>Reporting</header><text>The Attorney General shall collect the disclosures under subparagraph (A) of attorneys fees charged and submit to Congress an annual report detailing— </text><clause commented="no" display-inline="no-display-inline" id="idfc82317f07054114b895756741beaf73"><enum>(i)</enum><text display-inline="yes-display-inline">the total amount paid under such judgments, settlements, and awards; </text></clause><clause commented="no" display-inline="no-display-inline" id="id7fb922b15f2c402192c132f137ed6c9f"><enum>(ii)</enum><text display-inline="yes-display-inline">the total amount of attorney fees paid in connection with such judgments, settlements, and awards; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1f52dcbc227f4581a99c412f1a330d19"><enum>(iii)</enum><text display-inline="yes-display-inline">for each such judgment, settlement, or award— </text><subclause commented="no" display-inline="no-display-inline" id="id6991080e0dac4afe8f7356b5aafe1589"><enum>(I)</enum><text display-inline="yes-display-inline">the name of the attorney for the individual or legal representative of the individual; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id35bc8fc96b0a49d59057edcc094f6828"><enum>(II)</enum><text display-inline="yes-display-inline">if applicable, the law firm of the attorney; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide6d0a28a5a5444c6856349c8406df740"><enum>(III)</enum><text display-inline="yes-display-inline">the amount of fees paid to the attorney.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddde8704f70204da09af8f23921f2cb97"><enum>(b)</enum><header>Update of regulations</header><text>The Secretary of Veterans Affairs shall amend section 14.636 of title 38, Code of Federal Regulations, and any other relevant regulations, to comply with the amendments made by subsection (a). </text></subsection></section></legis-body></bill>
