which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide greater scrutiny of visas for Chinese Communist Party members.</official-title></form><legis-body><section id="idf1d62f09adf146909372ebe2186b7e89" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CCP Visa Ban Act of 2022</short-title></quote>.</text></section><section id="id9E863BF145F548C085DE063A3FDA4FC4"><enum>2.</enum><header>Scrutiny of visas for Chinese Communist Party members</header><subsection id="idc575875eef8d46bb8ef6e5ba8cf1a0f6" commented="no"><enum>(a)</enum><header>Inadmissibility</header><text>Section 212(a)(3)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(D)</external-xref>) is amended—</text><paragraph commented="no" id="id9093A199702E44E78BCDCB0EA2ED8799"><enum>(1)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Immigrant membership</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Membership</header-in-text></quote>; and</text></paragraph><paragraph id="id39CD41A1A82C4AEEB095F917C534E71B" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1c4cc8271ff24699bb25e1d575950e30"><clause id="idba6e4779bc194fca955cacbe1011bf67" commented="no"><enum>(v)</enum><header>Prohibition on issuance of certain visas to members of the Chinese Communist Party</header><text>An alien who is or has been a member of or affiliated with the Chinese Communist Party—</text><subclause commented="no" id="id1AEB26198768464EB5617A25AF1C0394"><enum>(I)</enum><text>is inadmissible; and</text></subclause><subclause commented="no" id="idB687751821FE44E3B12FDCDCE60F0068"><enum>(II)</enum><text>shall not be issued a visa as a nonimmigrant described in section 101(a)(15)(B).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEC2C3CE6669B48EAB2A60A3047EF8AC6"><enum>(b)</enum><header>Applications for visa extensions</header><text>With respect to applications to extend visas issued to nonimmigrants described in section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>) through enrollment in the Electronic Visa Update System or any successor system—</text><paragraph id="id24BD59551D5B49E684BCC27C33B555E2"><enum>(1)</enum><text>the Commissioner of U.S. Customs and Border Protection shall ensure that such system has a functionality for determining whether an applicant is a covered alien; and</text></paragraph><paragraph id="idADF9D33C670F46CCB51C42B66D7A2D96"><enum>(2)</enum><text>in the case of an applicant determined to be a covered alien, the applicant's request for enrollment shall be denied.</text></paragraph></subsection><subsection id="id8D815BD551BB4C4F8A9600475630CD94"><enum>(c)</enum><header>Cancellation of visas authorized</header><paragraph id="idE7E25E7791834C8F9A5F6684EFF10EFA"><enum>(1)</enum><header>In general</header><text>On encountering a covered alien who is in possession of a valid, unexpired visa issued under section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>), the Commissioner of U.S. Customs and Border Protection shall cancel such visa.</text></paragraph><paragraph id="id13CA5ACF0652436BACB67E6D06DE0E23"><enum>(2)</enum><header>Role of Bureau of Consular Affairs</header><text>Not later than 90 days after the date of the enactment of this Act, the Assistant Secretary for Consular Affairs shall—</text><subparagraph id="idC51D62461ADA4DED8FDCC6ED4FE66BBB"><enum>(A)</enum><text>cancel all nonimmigrant visas issued to covered aliens under section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>); and </text></subparagraph><subparagraph id="id20F006E70E3A413B88D63A9A8668E91D"><enum>(B)</enum><text>update the Consular Consolidated Database and the Consular Lookout and Support System to reflect such cancellations.</text></subparagraph></paragraph><paragraph id="id424AAFCC544B46838E4206FFBE571B7F"><enum>(3)</enum><header>Remedy</header><text>The sole legal remedy available to an alien whose visa has been cancelled under this subsection shall be to submit a new application for a visa in accordance with the procedures established by the Bureau of Consular Affairs. </text></paragraph></subsection><subsection id="id0CBC9016D5664550A30808E255ED01E4"><enum>(d)</enum><header>Definition of covered alien</header><text>In this section, the term <term>covered alien</term> means an alien who is or has been a member of or affiliated with the Chinese Communist Party. </text></subsection></section></legis-body></bill>
