<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5114</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221116">November 16, 2022</action-date><action-desc><sponsor name-id="S307">Mr. Brown</sponsor> (for himself, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, <cosponsor name-id="S314">Mr. Tester</cosponsor>, and <cosponsor name-id="S369">Mr. Markey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Homeland Security Act of 2002 to provide training for Department of Homeland Security personnel regarding the use of containment devices to prevent exposure to potential synthetic opioids, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6710CE46467E4E648B32D6B96F2CFE5C"><section section-type="section-one" id="HF4D2DF36C3864E509B8265FF2F9D7197"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Exposure to Narcotics and Toxins Act of 2022</short-title></quote> or the <quote><short-title>PREVENT Act of 2022</short-title></quote>. </text></section><section id="H986C079A3C324FF28243EF9C00CC76A8"><enum>2.</enum><header>Training regarding the use of containment devices to prevent potential synthetic opioid exposure</header><subsection id="H789883A164FE47C48CFFF95F34896559"><enum>(a)</enum><header>Training</header><text display-inline="yes-display-inline">Section 416(b)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/216">6 U.S.C. 216(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFE684754850F4CF3B369518A5D1E71A2"><subparagraph id="HED5C5EA79E954B0D9B1856E7D7ABF0DC"><enum>(C)</enum><text display-inline="yes-display-inline">How to use containment devices to prevent potential synthetic opioid exposure.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4333633E472946C091171081B7FF659B"><enum>(b)</enum><header>Availability of containment devices</header><text display-inline="yes-display-inline">Section 416(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/216">6 U.S.C. 216(c)</external-xref>) is amended—</text><paragraph id="id92C5FDFD22D8475AAEDB80426F4EC7E0"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by inserting <quote><header-in-text style="OLC" level="subsection">, containment devices,</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">equipment</header-in-text></quote>; and</text></paragraph><paragraph id="idEF71139AAC314768824C342387C463C6"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>and opioid receptor antagonists, including naloxone</quote> and inserting <quote>, opioid receptor antagonists, including naloxone, and containment devices</quote>.</text></paragraph></subsection><subsection id="id0e8ae2e6965c4d3ba0f1c92492981031"><enum>(c)</enum><header>Applicability to other components</header><text>If the Secretary of Homeland Secretary determines that officers, agents, other personnel, or canines of a component of the Department of Homeland Security other than U.S. Customs and Border Protection are at risk of potential synthetic opioid exposure in the course of their duties, the head of such component shall carry out the responsibilities under section 416 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/216">6 U.S.C. 216</external-xref>) in the same manner and to the same degree as the Commissioner of U.S. Customs and Border Protection carries out such responsibilities.</text></subsection></section></legis-body></bill>
