<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5111</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221116">November 16, 2022</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require Transmission Organizations to accept bids from aggregators of certain retail customers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsive Energy Demand Unlocks Clean Energy Act</short-title></quote>.</text></section><section id="idF18C42A8FB1F4BFBA0327D4B33B4D763"><enum>2.</enum><header>Aggregator bidding into organized power markets</header><subsection id="idCE5C2D99CE114A93BEE3FC5A3330B37B"><enum>(a)</enum><header>Definitions of State regulatory authority and Transmission Organization</header><text>In this section, the terms <term>State regulatory authority</term> and <term>Transmission Organization</term> have the meanings given those terms in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>). </text></subsection><subsection id="id7A22CD368DEC4254B090730D09282E71"><enum>(b)</enum><header>Requirement</header><text>Notwithstanding any prohibition established by a State regulatory authority with respect to who may bid into an organized power market, each Transmission Organization shall accept any bid from an aggregator of retail customers that aggregated the demand response of the customers of any utility that distributed more than 4,000,000 megawatt-hours in the previous fiscal year.</text></subsection><subsection id="idf68c6618f98c4c0cb3c07498c7a5596a"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Federal Energy Regulatory Commission shall issue a rule to carry out the requirements of subsection (b).</text></subsection></section></legis-body></bill>
