Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To strengthen the collection of data regarding interactions between law enforcement officers and individuals with disabilities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Data on Interactions and Accountability for Law Enforcement with Individuals with Disabilities Act</short-title></quote>.</text></section><section id="idC411FBB513734A988D478447B934E683"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id5DB1A607F8BF49D5A90E6C7D827EE08C"><enum>(1)</enum><header>Disability</header><text display-inline="yes-display-inline">The term <term>disability</term> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph id="idC836F65FA31342D5BECA78D38F9DD829"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph></section><section id="id534da9de21a740f998b71092616d5a6a"><enum>3.</enum><header>Advisory Council on Disability Status and Law Enforcement Interaction Data Collection</header><subsection id="id3ea53ca6a5eb43769787ca5db21a1edd"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Secretary</term> means the Secretary of Health and Human Services.</text></subsection><subsection id="id96DEE176F6A74940B0BD99ECDA94C052"><enum>(b)</enum><header>Establishment</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall establish the Advisory Council on Disability Status and Law Enforcement Interaction Data Collection (in this section referred to as the <quote>Advisory Council</quote>).</text></subsection><subsection id="idb8aa50e8cebb46969927f9aaa5f5b7d1"><enum>(c)</enum><header>Membership</header><paragraph id="id20EC0A5A68DD4403B56F8600570D5DC8"><enum>(1)</enum><header>Considerations</header><text>The Secretary shall appoint the members of the Advisory Council in a manner that—</text><subparagraph id="ide05e2f09ef594ceca94560de3d4f4cae"><enum>(A)</enum><text>provides diverse representation of populations underrepresented on advisory committees, such as underrepresented racial and ethnic populations; and </text></subparagraph><subparagraph id="idB0FE822361474AE1AE778C09302DAB08"><enum>(B)</enum><text>ensures that more than 50 percent of the members are individuals with disabilities.</text></subparagraph></paragraph><paragraph id="id1D7EDBE2E5EA4C829DC5C3DEDBA8A6E1"><enum>(2)</enum><header>Composition</header><text>The members of the Advisory Council shall include representatives of—</text><subparagraph id="idC0E98A1BF1334709BCDBAC13AB0813C9"><enum>(A)</enum><text>individuals with disabilities;</text></subparagraph><subparagraph id="id8F7413E8FF324C91BA7D77CA2338BE35"><enum>(B)</enum><text>individuals aged 65 and older;</text></subparagraph><subparagraph id="id8960707E68A647A18CA0452662C04B05"><enum>(C)</enum><text>law enforcement organizations, including representatives of rank and file law enforcement officers;</text></subparagraph><subparagraph id="id07FA294A4C9D4EE5A43D797213D877F5"><enum>(D)</enum><text>faculty or researchers, at institutions of higher education or other research institutions, with expertise in disability research;</text></subparagraph><subparagraph id="idFE37165653424623B8ED969814C0FE89"><enum>(E)</enum><text>faculty or researchers, at institutions of higher education or other research institutions, with expertise in criminal justice research and statistics;</text></subparagraph><subparagraph id="id69779A77A2B8486FB9B8E1F2F226F977"><enum>(F)</enum><text>States, including State surveying agencies;</text></subparagraph><subparagraph id="id9D8218912B904BDA8767151710C77481"><enum>(G)</enum><text>State and local public safety agencies;</text></subparagraph><subparagraph id="id3A9DF0324018499A88BDF604026249A6"><enum>(H)</enum><text>nonprofit organizations led by and serving the disability population; </text></subparagraph><subparagraph id="id94462D9075DB44C9885581E622F2C6CC"><enum>(I)</enum><text>the National Quality Forum or other quality measurement entity; and</text></subparagraph><subparagraph id="id06657EB70C9944BFA3EDD54F5D7E6968"><enum>(J)</enum><text>the Bureau of Justice Statistics of the Department of Justice.</text></subparagraph></paragraph></subsection><subsection id="id582A672DD53B4183B3B104E0F741C062"><enum>(d)</enum><header>Chairperson; Vice-Chairperson</header><text>The Secretary shall select—</text><paragraph id="idD489A01776384C39A049240E0A0CF7C5"><enum>(1)</enum><text>a member of the Advisory Council who is an individual with a disability to be the chairperson of the Advisory Council; and </text></paragraph><paragraph id="id69EF9FC8EA004B878BB0A6E54DF33F40"><enum>(2)</enum><text>a member of the Advisory Council who is a representative of a law enforcement agency to be the vice-chairperson of the Advisory Council.</text></paragraph></subsection><subsection id="id610c8a058328422abb66252c35f764d0"><enum>(e)</enum><header>Duties</header><paragraph id="iddfee447b54744dc3a24072311357825c"><enum>(1)</enum><header>Data collection and reporting development</header><text>The Advisory Council shall—</text><subparagraph id="id7C8F760382A54F128BEFFB0747F8090C"><enum>(A)</enum><text>develop a valid and reliable data collection and reporting methodology on interactions between law enforcement officers and individuals with disabilities; and</text></subparagraph><subparagraph id="idE495DF85F1754F68B3A068B9665F6CE3"><enum>(B)</enum><text>provide recommendations to the Attorney General on best practices to collect disability status data in instances where a death, a shooting, or an injury has occurred as a result of an interaction with a law enforcement officer.</text></subparagraph></paragraph><paragraph id="idafd10eb283dc47aba7af8dd29d3ef5b0"><enum>(2)</enum><header>Recommendations</header><text>Not later than 2 years after the date of enactment of this Act, the Advisory Council shall submit to the Secretary, the Attorney General, the Committee on Finance and the Special Committee on Aging of the Senate, and the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives, the recommended data collection and reporting methodology and other recommendations developed under paragraph (1). </text></paragraph></subsection><subsection id="id1991D911C7A64F5292AB018775C5AB88"><enum>(f)</enum><header>Independent study</header><paragraph id="id3F86953E30354D54A3004B9D085BAB9C"><enum>(1)</enum><header>Grant authorized</header><text>After receiving the recommendations under subsection (e)(2), the Secretary shall award a grant, to an independent research organization or institution of higher education, to conduct an independent study to test the validity and reliability of the data collection and reporting methodology developed under such subsection. </text></paragraph><paragraph id="id8420E25E0F1C45338A8918A4E4CEF6BF"><enum>(2)</enum><header>Review by Advisory Council</header><text>The Secretary shall share the results of the study conducted under paragraph (1) with the Advisory Council as soon as practicable.</text></paragraph></subsection><subsection id="id24701ca0e42343f0ab31aa0cb16c0b3e"><enum>(g)</enum><header>Report</header><paragraph id="id57212CC5FFA8402FA904131BAF831A02"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after receiving the results of the study conducted under subsection (f), the Advisory Council shall reconvene and prepare and submit a report to the Secretary, the Attorney General, the Committee on Finance and the Special Committee on Aging of the Senate, and the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives, with final recommendations on best practices to collect data on the interactions between law enforcement officers and individuals with disabilities.</text></paragraph><paragraph id="id78297e5db1474f6298098fcd7d4e7214"><enum>(2)</enum><header>Public availability</header><text>Upon receiving the report described in paragraph (1), the Secretary shall make the report available to the public. </text></paragraph></subsection><subsection id="idfa70158533464ba3a88c2c115c4b8940"><enum>(h)</enum><header>Adoption of best practices by Attorney General</header><text>The Attorney General shall review the best practices recommended in the report under subsection (g)(1) and, to the extent that the Attorney General determines appropriate, implement the best practices within the Department of Justice.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0cb2bcdb58bc48868a787b2ba5daf5ed"><enum>(i)</enum><header display-inline="yes-display-inline">Termination</header><text>The Advisory Council shall terminate by not later than 30 days after the submission of the report to the Secretary under subsection (g)(1).</text></subsection></section><section id="idDD428C6A37A94B4D8C5D3A4EADBA9A29"><enum>4.</enum><header>Bureau of Justice Statistics survey</header><subsection id="idF784E15EEE8E437D8EE6158DE487A5B9"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Director</term> means the Director of the Bureau of Justice Statistics.</text></subsection><subsection id="idF93FD2A537A3464FBFAFA9D5CB6C9231"><enum>(b)</enum><header>Inclusion of disability status in Police-Public Contact Survey</header><text>The Director, in conducting the Police-Public Contact Survey, shall collect data on the disability status of individuals who have had contact with law enforcement officers.</text></subsection><subsection id="idBB95714396A24D5BA874312BBCA9F9AE"><enum>(c)</enum><header>Statistic analysis by third-Party organization</header><paragraph id="id17C6DAB448194E3AA0746FD0D2DEB4B3"><enum>(1)</enum><header>Grant</header><text>The Director shall award a grant to a single, independent third-party organization, which may be an institution of higher education or other research institution, to conduct a statistical analysis of data collected in the Police-Public Contact Survey to identify trends in reports of violence committed by law enforcement officers against individuals with disabilities.</text></paragraph><paragraph commented="no" id="id688BEF7D66CF4A6E9EFD5793D909BC0D"><enum>(2)</enum><header>Deadline</header><text>The Director shall require the third-party organization that receives the grant under paragraph (1) to complete the statistical analysis not later than 1 year after the date on which the Director begins collecting data on disability status under subsection (b).</text></paragraph></subsection></section><section id="idE7A2CC6DF19440008E0D1CAD02AAF0FE"><enum>5.</enum><header>Death in Custody Reporting Act</header><subsection id="id474EDB1CEC0841CEB2341635EB7D867F"><enum>(a)</enum><header>Disability status</header><text>Section 2 of the Death in Custody Reporting Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/34/60105">34 U.S.C. 60105</external-xref>) is amended—</text><paragraph id="id0E55FE3CD4BD47CAAFA7C738C98B8FEB"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>disability status,</quote> after <quote>ethnicity,</quote>;</text></paragraph><paragraph id="id7CD9A166DA214B6990D9490539B34C0F"><enum>(2)</enum><text>in subsection (f), in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Study and report</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Initial study and report</header-in-text></quote>; and</text></paragraph><paragraph id="idD80F200672BF4CAF8BC0B0FDB3D02FFA"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0C4C23668BF64F2497D02C38F37024FC"><subsection id="id581C449D2A42484FA52017F30AA33441"><enum>(g)</enum><header>Annual report</header><paragraph id="idD1D27DF8D4C14F9886D9EF707C77263D"><enum>(1)</enum><header>In general</header><text>Each year, the Attorney General shall publish a report on the information reported under subsection (b) and section 3(a).</text></paragraph><paragraph id="idF01557A23F474ACFBE30FBF0AD61634F"><enum>(2)</enum><header>Local disaggregation</header><text>The Attorney General shall disaggregate the information published under paragraph (1) by the locality in which the death occurred.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0C7167045276420A826A9A62F0934650"><enum>(b)</enum><header>FBI use-of-Force data collection program</header><text>The Death in Custody Reporting Act of 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/242">Public Law 113–242</external-xref>; 128 Stat. 2860) is amended—</text><paragraph id="id27EC468471B345C9AAF7FD04E54DDC3E"><enum>(1)</enum><text>in section 2(c) (<external-xref legal-doc="usc" parsable-cite="usc/34/60105">34 U.S.C. 60105(c)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id332D6BA2CE6A4F16B80D01636FDEEFF6"><paragraph id="idDA4518F65B7E45878EB67123B27F59B3"><enum>(3)</enum><header>Compliance through participation in National Use-of-Force Data Collection</header><text>A State may satisfy the requirement under subsection (a) by—</text><subparagraph id="id45881EA1ECCB44A3904C3E5065EED419"><enum>(A)</enum><text>participating in the National Use-of-Force Data Collection of the Federal Bureau of Investigation; and</text></subparagraph><subparagraph id="id1ABD6FC9CA9846BB91E94D692D2ECAE6"><enum>(B)</enum><text>including with the information reported for the National Use-of-Force Data Collection the disability status of of each subject of the use of force.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id391A560F6F864D3E8990AD0168761491"><enum>(2)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/18/4001">18 U.S.C. 4001</external-xref> note)—</text><subparagraph id="idDF29355AE67D427A942110BD67E71A11"><enum>(A)</enum><text>by redesignating subsection (c) as subsection (d); and</text></subparagraph><subparagraph id="idCFDDAF292B7B4279A9298885986B6E4B"><enum>(B)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00CE2E177FD146C3A43ECDA966F648F2"><subsection id="idAF6D64B7ADED4524A55E8BCBFAF14D90"><enum>(c)</enum><header>Compliance through participation in National Use-of-Force Data Collection</header><text>A Federal law enforcement agency may satisfy the requirement under subsection (a) by—</text><paragraph id="id76DB7BFD3D0C4533BD942B278B312BC7"><enum>(1)</enum><text>participating in the National Use-of-Force Data Collection of the Federal Bureau of Investigation; and</text></paragraph><paragraph id="id0A2907F8653340C59E7A60B1D6BFFB04"><enum>(2)</enum><text>including with the information reported for the National Use-of-Force Data Collection the disability status of each subject of the use of force.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
