which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to authorize law enforcement agencies to use COPS grants for recruitment activities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recruit and Retain Act</short-title></quote>.</text></section><section id="id5D1347A7A577445F973D8F035C9A7E65"><enum>2.</enum><header>Improving COPS grants for police hiring purposes</header><subsection id="idD7676D35D5DD47A496D7AF2854640C79"><enum>(a)</enum><header>Grant use expansion</header><text display-inline="yes-display-inline">Section 1701(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381(b)</external-xref>) is amended—</text><paragraph id="id7028F70107934F04B6DAC69A4A8D589E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5) through (23) as paragraphs (6) through (24), respectively; and </text></paragraph><paragraph id="id2499BB6565BD40BE974865FD44C479F3"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idA27FB14E9DC5416CACD3E20688C37813"><paragraph id="idd9576fd48172422e8f6d414e8b468e3b"><enum>(5)</enum><text>to support hiring activities by law enforcement agencies experiencing declines in officer recruitment applications by reducing application-related fees, such as fees for background checks, psychological evaluations, and testing.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4BAEC765D2A349A58C931B92C0234846"><enum>(b)</enum><header>Technical amendment</header><text>Section 1701(b)(23) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381(b)(23)</external-xref>) is amended by striking <quote>(21)</quote> and inserting <quote>(22)</quote>.</text></subsection></section><section id="idB56707670BB2445BBA3ED9FB3CAA873A"><enum>3.</enum><header>Administrative costs</header><text display-inline="no-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended—</text><paragraph id="id18DBB03924A744E58273147C457AF95B"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (i) through (m) as subsections (j) through (n), respectively; and</text></paragraph><paragraph id="idA524EDC902114C849D8EEF66E33378D4"><enum>(2)</enum><text>by inserting after subsection (h) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id79F746CFBE6D43D89B13F6B447978AA8"><subsection id="id78a4bf66a3004c5a934a8051d5c4f701" commented="no"><enum>(i)</enum><header>Administrative costs</header><text>Not more than 2 percent of a grant made for the hiring or rehiring of additional career law enforcement officers may be used for costs incurred to administer such grant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF2B7E6A822754BD7BE90EE92B42750F4"><enum>4.</enum><header>Pipeline Partnership Program</header><text display-inline="no-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by inserting after subsection (n) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6D1E2E0783624D9D87CB04A95B0CBC16"><subsection id="idcd0f0a9b5ea446c2814b56856dd14e6f"><enum>(o)</enum><header>COPS Pipeline Partnership Program</header><paragraph id="idC5189355DF444BFD925164212DE20A63"><enum>(1)</enum><header>Eligible entity defined</header><text>In this subsection, the term <term>eligible entity</term> means a law enforcement agency in partnership with not less than 1 educational institution, which may include 1 or any combination of the following:</text><subparagraph id="id82D3C6D84BC541A995F5CEE513DE74AF"><enum>(A)</enum><text>An elementary school.</text></subparagraph><subparagraph id="id175B8725A4824B7F8C851BC69EC526D2"><enum>(B)</enum><text>A post-secondary school.</text></subparagraph><subparagraph id="idBA6FF0B4DA0848DA884E68973205A99F"><enum>(C)</enum><text>An institution of higher education.</text></subparagraph><subparagraph id="id41E415B46EA243E08FA13ABD38A51B83"><enum>(D)</enum><text>A Hispanic-serving institution.</text></subparagraph><subparagraph id="id03A67FE01F3146ED9ECC69A742C7B4E4"><enum>(E)</enum><text>A historically Black college or university.</text></subparagraph><subparagraph id="idEA6484DE49C34B5F900AB684FE7491D7"><enum>(F)</enum><text>A Tribal college. </text></subparagraph></paragraph><paragraph id="id9A1492DBE0B943C186784CB6E27C5211"><enum>(2)</enum><header>Grants</header><text>The Attorney General shall award competitive grants to eligible entities for recruiting activities that—</text><subparagraph id="id6f3bab57576b473996cd81b2df28d186"><enum>(A)</enum><text>support substantial student engagement for the exploration of potential future career opportunities in law enforcement;</text></subparagraph><subparagraph id="id8069f97fa0fb45c4ac7eb67b9977fe65"><enum>(B)</enum><text>strengthen recruitment by law enforcement agencies experiencing a decline in recruits, or high rates of resignations or retirements;</text></subparagraph><subparagraph id="idcdd0cca9e211490eb9e976fbdf63be67"><enum>(C)</enum><text>enhance community interactions between local youth and law enforcement agencies that are designed to increase recruiting; and</text></subparagraph><subparagraph id="id4423DE06D7824D8FBFFD7B1CC88F0FA5"><enum>(D)</enum><text>otherwise improve the outcomes of local law enforcement recruitment through activities such as dedicated programming for students, work-based learning opportunities, project-based learning, mentoring, community liaisons, career or job fairs, work site visits, job shadowing, apprenticeships, or skills-based internships.</text></subparagraph></paragraph><paragraph id="id7E9AD89E39B845F79768503DA4D06ABF"><enum>(3)</enum><header>Funding</header><text>Of the amounts made available to carry out this part for a fiscal year, the Attorney General may use not more than $3,000,000 to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="idE588310897E84CEEB7265D6D0DC33CF4"><enum>5.</enum><header>COPS Grant guidance for agencies operating below budgeted strength</header><text display-inline="no-display-inline">Section 1704 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10384">34 U.S.C. 10384</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idFD2C28DE9EC045498A9DD7C1A70A939C" display-inline="no-display-inline" style="OLC"><subsection id="id1ad82975e31c4761b86aabcc7b816ec6"><enum>(d)</enum><header>Guidance for understaffed law enforcement agencies</header><paragraph id="idF00CC7246AAB48F99D5A96D9468A2D75"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idB01C471A0AE7441C888D411F0F8CD10D"><enum>(A)</enum><header>Covered applicant</header><text>The term <term>covered applicant</term> means an applicant for a hiring grant under this part seeking funding for a law enforcement agency operating below the budgeted strength of the law enforcement agency.</text></subparagraph><subparagraph id="idB9867B2513BA433E86200C16C17AE7BB"><enum>(B)</enum><header>Budgeted strength</header><text>The term <term>budgeted strength</term> means the employment of the maximum number of sworn law enforcement officers the budget of a law enforcement agency allows the agency to employ. </text></subparagraph></paragraph><paragraph id="id63BEEC481FD74D55AD008D06B08C4857"><enum>(2)</enum><header>Procedures</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall establish consistent procedures for covered applicants, including guidance that—</text><subparagraph id="id68BA48D140A643DEAE9496AA1005C92D"><enum>(A)</enum><text>clarifies that covered applicants remain eligible for funding under this part; and</text></subparagraph><subparagraph id="idB35A7398D1564495A783E9CD39BCC53A"><enum>(B)</enum><text>enables covered applicants to attest that the funding from a grant awarded under this part is not being used by the law enforcement agency to supplant State or local funds, as described in subsection (a).</text></subparagraph></paragraph><paragraph id="id8590EC1D5E8C4510993E521B12B24438" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Paperwork reduction</header><text>In developing the procedures and guidance under paragraph (2), the Attorney General shall take measures to reduce paperwork requirements for grants to covered applicants.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idDC741C077391422F92C67A2AC2692A58"><enum>6.</enum><header>Study on Police Recruitment</header><subsection id="id1C89F11873BC479FA65F4067895BFF0C"><enum>(a)</enum><header>Study</header><paragraph id="id825C5DCB71514FD1AFB2F3EF476334E5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study to consider the comprehensive effects of recruitment and attrition rates on Federal, State, Tribal, and local law enforcement agencies in the United States, to identify—</text><subparagraph id="idd403ba7d5a0645f28897e8eca9cab2de"><enum>(A)</enum><text>the primary reasons that law enforcement officers—</text><clause id="id8D2656468F8544A69A056F9D8F1A2107"><enum>(i)</enum><text>join law enforcement agencies; and</text></clause><clause id="idBCCF403E704A472BAF5138A8E0DF2EFE"><enum>(ii)</enum><text>resign or retire from law enforcement agencies;</text></clause></subparagraph><subparagraph id="id2B51C5B31F0D4CE48F7099493B915AC5"><enum>(B)</enum><text>how the reasons described in subparagraph (A) may have changed over time;</text></subparagraph><subparagraph id="id087DC9B51880407E950D7F5A6B8D28B5"><enum>(C)</enum><text>the effects of recruitment and attrition on public safety;</text></subparagraph><subparagraph id="idbc2d95d01f414c4991e64e5f7579004d"><enum>(D)</enum><text>the effects of electronic media on recruitment efforts; </text></subparagraph><subparagraph id="idD15B6C491A7640A08E37ABC902528CF7"><enum>(E)</enum><text>barriers to the recruitment and retention of Federal, State, and local law enforcement officers; and</text></subparagraph><subparagraph id="id55F23E3D5FBC4C628FCF0A78B4BAE73D"><enum>(F)</enum><text>recommendations for potential ways to address barriers to the recruitment and retention of law enforcement officers, including the barriers identified in subparagraph (E).</text></subparagraph></paragraph><paragraph id="id4B8BA68B399D467194FC518EB8B3BBE4"><enum>(2)</enum><header>Representative cross-section</header><subparagraph id="idB647AE75D3864DF1BFC38F3521C2E9E7"><enum>(A)</enum><header>In general</header><text>The Comptroller General of the United States shall endeavor to ensure accurate representation of law enforcement agencies in the study conducted pursuant to paragraph (1) by surveying a broad cross-section of law enforcement agencies—</text><clause id="id1234f1fab9f9407d87b8181593b9e90b"><enum>(i)</enum><text>from various regions of the United States;</text></clause><clause id="id491a521c88624667aba1a72cf82a3c6a"><enum>(ii)</enum><text>of different sizes; and</text></clause><clause id="id3847de655de84b36a12bfc15d7f343f2"><enum>(iii)</enum><text>from rural, suburban, and urban jurisdictions. </text></clause></subparagraph><subparagraph id="id086724ADCFEE4D63A0E2EDEF4E5D077D" commented="no"><enum>(B)</enum><header>Methods description</header><text>The study conducted pursuant to paragraph (1) shall include in the report under subsection (b) a description of the methods used to identify a representative sample of law enforcement agencies.</text></subparagraph></paragraph></subsection><subsection id="idAFF3A5EE280E410587715B109C99CDBD"><enum>(b)</enum><header>Report</header><text>Not later than 540 days after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="id164D23BCC4A642E7BE1DE56FDCD6DFC6"><enum>(1)</enum><text>submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report containing the study conducted under subsection (a); and</text></paragraph><paragraph id="id1944B489C38A46FEBA1199A9C48B4480"><enum>(2)</enum><text>make the report submitted under paragraph (1) publicly available online.</text></paragraph></subsection><subsection id="idA6D4E7B93D094607A614A3279AEEDD2B"><enum>(c)</enum><header>Confidentiality</header><text>The Comptroller General of the United States shall ensure that the study conducted under subsection (a) protects the privacy of participating law enforcement agencies.</text></subsection></section></legis-body></bill>
