<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5092</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221115">November 15, 2022</action-date><action-desc><sponsor name-id="S338">Mr. Manchin</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 40, United States Code, to relocate the headquarters of the Appalachian Regional Commission, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idc03ce311f8624d73b8e2bac45aed77b6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ARC Relocation Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id1C630331E8384DC6AEF770EDDB145557"><enum>2.</enum><header>Headquarters of the Appalachian Regional Commission</header><subsection id="id0ec1796a5ba749f8bdd1cd2eb71fd04a"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id789A8E2E8EFE4C108893F7006B9C1A08"><enum>(1)</enum><text>Senate Report 115–258, accompanying S. 2975 (115th Congress), contained bipartisan language expressing a belief that <quote>if the Appalachian Regional Commission is going to move, it should move to the State of West Virginia</quote>;</text></paragraph><paragraph id="idA1BD16277C99481389BF8B94E1A8000D"><enum>(2)</enum><text>the greater Washington, DC, metropolitan area accounts for 22 percent of the Federal workforce, yet only accounts for less than 2 percent of the population of the United States;</text></paragraph><paragraph id="id7E3BFAD4173F4323A384F0DE8F601117"><enum>(3)</enum><text>the headquarters of the Delta Regional Authority, the Denali Commission, and the Northern Border Regional Commission are already headquartered in their respective regions;</text></paragraph><paragraph id="id21FDCB98F62F432B9258AA459273626D"><enum>(4)</enum><text>headquartering a regional commission within the jurisdiction of the commission can reduce administrative overhead, increase accountability to the people the commission was designed to serve, and enhance confidence in the work of that commission;</text></paragraph><paragraph id="idCEE5B6F1019E44D0A3710EABEB892759"><enum>(5)</enum><text>the Appalachian Regional Commission is an economic development agency focused on the Appalachian region and representing a partnership of Federal, State, and local governments across 13 States;</text></paragraph><paragraph id="id4037EF7551E34C8B9BF19673671C5D3F"><enum>(6)</enum><text>despite the reach of the Appalachian Regional Commission across 13 States, West Virginia remains the only State fully within the jurisdiction of the Appalachian Regional Commission;</text></paragraph><paragraph id="id8891DB3A7DEB4258BEC564D6AF541B19"><enum>(7)</enum><text>West Virginia is located at the midpoint of the Appalachian region;</text></paragraph><paragraph id="idD7B2641770474F00B152A783CC15C61D"><enum>(8)</enum><text>West Virginia is central to the creation of the Appalachian Regional Commission;</text></paragraph><paragraph id="id961C87224EBA4C89A6E670C53E900AF6"><enum>(9)</enum><text>following the visit of President John F. Kennedy to West Virginia during his presidential campaign in 1960, he was moved by the poverty he observed there and he worked to create the Appalachian Regional Commission through an Act of Congress in 1965;</text></paragraph><paragraph id="idCD5DB258267C4A25AF201C6D17328C43"><enum>(10)</enum><text>the Appalachian Regional Commission is critical to assisting communities impacted by the decline of the coal industry as well as the opioid crisis, and no State has seen a greater impact from those issues than West Virginia;</text></paragraph><paragraph id="id1B36C2C243894AE89CCA63D6ABF2BCEA"><enum>(11)</enum><text>one of the top goals of the Appalachian Regional Commission is to spur economic opportunities in the Appalachian region by investing in strategies that strengthen the economy of the region; and</text></paragraph><paragraph id="idAFA711B3DBCD49A2913F05374AB742CF"><enum>(12)</enum><text>an effective way to achieve the goal referred to in paragraph (11) is to directly invest in the region by relocating the workforce of the Appalachian Regional Commission to the region itself.</text></paragraph></subsection><subsection id="id5D6DA048C4DA4A358192DC9ED0849C3F"><enum>(b)</enum><header>Headquarters</header><text>Section 14301 of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5651ea442f744d869454e2206578a5a5"><subsection id="id01c30eadc12d4844bcf1fc9d9903ca1d"><enum>(g)</enum><header>Headquarters</header><text>The headquarters of the Commission shall be located in the State of West Virginia.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idc7ca71fb8b79461fab8ea39f561cce6d"><enum>(c)</enum><header>Implementation</header><text>The Federal Cochairman of the Appalachian Regional Commission shall take such actions as may be necessary to carry out the amendment made by subsection (b).</text></subsection></section></legis-body></bill>
