which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a working group on electric vehicles.</official-title></form><legis-body><section id="id30EEC880F63C47EFA32678E5306A1771" section-type="section-one"><enum>1.</enum><header>Electric vehicle working group</header><subsection id="id22708584c9fd4a51b9f91a04490980c8"><enum>(a)</enum><header>Establishment of working group</header><paragraph id="id1AEA1E9F24E44722B4096A19355A4500"><enum>(1)</enum><header>In general</header><text>Not later than 240 days after the date of enactment of this Act, the Secretary of Transportation and the Secretary of Energy (referred to in this section as the <quote>Secretaries</quote>) shall jointly establish a working group (referred to in this section as the <quote>working group</quote>) to make recommendations on the development, adoption, and integration of light and heavy duty electric vehicles into the transportation and energy systems of the United States.</text></paragraph><paragraph id="id62f22abc65114373bd1d2d7f1d2b0c15"><enum>(2)</enum><header>Membership</header><subparagraph id="id4fc8fb0c88c54eaa856668c94efaa12a"><enum>(A)</enum><header>In general</header><text>The working group shall be composed of—</text><clause id="id5C6CE7BA001947288AAA78FC10A3941D"><enum>(i)</enum><text>the Secretaries (or designees), who shall be co-chairs of the working group; and</text></clause><clause id="idF9B8D528D4D74B698BCAB0AFC2774D80"><enum>(ii)</enum><text>not more than 25 members to be appointed by the Secretaries, of whom—</text><subclause id="id9A9B35FA2CDA447F88118EEE971AA6A8"><enum>(I)</enum><text>not more than 6 shall be Federal stakeholders as described in subparagraph (B); and</text></subclause><subclause id="id33F8A36664CB46F2A70CDAFFCB9E02A4"><enum>(II)</enum><text>not more than 19 shall be non-Federal stakeholders as described in subparagraph (C).</text></subclause></clause></subparagraph><subparagraph id="idD5F9186C317443CFA31399924504BB35"><enum>(B)</enum><header>Federal stakeholders</header><text>The working group—</text><clause id="id81C49F5E9173435D956A1CBBC9B313DB"><enum>(i)</enum><text>shall include not less than 1 representative of each of—</text><subclause id="id20cd09efb77c424fa0e00d46bc8bed9a"><enum>(I)</enum><text>the Department of Transportation;</text></subclause><subclause id="id2ecf8c9d29d148fc86d68001cf7efaa7"><enum>(II)</enum><text>the Department of Energy;</text></subclause><subclause id="id09a920e8ebe446f79e29680733281ae4"><enum>(III)</enum><text>the Environmental Protection Agency; </text></subclause><subclause id="id353949CC09814DAAAD61B461E4A67B7F"><enum>(IV)</enum><text>the Council on Environmental Quality; and</text></subclause><subclause id="idCC55B90560B1404FBBBE0BF9CBD34B5B"><enum>(V)</enum><text>the General Services Administration; and</text></subclause></clause><clause id="id0B87C0CADE28489DB976AA55886DA6E8"><enum>(ii)</enum><text>may include a representative of any other Federal agency the Secretaries consider to be appropriate.</text></clause></subparagraph><subparagraph id="id485b67cf874a492b8522d140f76f6ce8"><enum>(C)</enum><header>Non-Federal stakeholders</header><clause id="id6AFD2F910317402EBC5E645CEA47A993"><enum>(i)</enum><header>In general</header><text>The working group—</text><subclause id="id43B3B6FB05464A72ACDFF84DAED600D0"><enum>(I)</enum><text>shall include not less than 1 representative of each of—</text><item id="idfc6b8a8f79054010bf1fc544e5f47e2b"><enum>(aa)</enum><text>a manufacturer of electric vehicles or the relevant components of electric vehicles;</text></item><item id="iddf0e78e3a41b46aa84b0fac306d5dcc6"><enum>(bb)</enum><text>an owner, operator, or manufacturer of electric vehicle charging equipment;</text></item><item id="id125b8f0dc62a458f95617fce99619e9f"><enum>(cc)</enum><text>the public utility industry;</text></item><item id="idEE9A771C379F427C9D6FF617D116E32B"><enum>(dd)</enum><text>a public utility regulator or association of public utility regulators;</text></item><item id="id7756A188AE524D11933FA302C848A481"><enum>(ee)</enum><text>the transportation fueling distribution and retailer industry;</text></item><item id="id568B56EB45184366A9A2C008B579CB97"><enum>(ff)</enum><text>the energy provider industry;</text></item><item id="id4AE14840B1064648922EF5C8EF95F174"><enum>(gg)</enum><text>the automotive dealing industry;</text></item><item id="id8D8CFEA2C4644C88A15417810829DF78"><enum>(hh)</enum><text>the passenger transportation industry;</text></item><item id="idc5fda349356c4204908184171814a07f"><enum>(ii)</enum><text>an organization representing a unit of local government;</text></item><item id="idC2198F81588A491D8F209E02C157B9D7"><enum>(jj)</enum><text>a regional transportation or planning agency;</text></item><item id="id0EF20616EAB6423FB2D6256125489D07"><enum>(kk)</enum><text>an organization representing State departments of transportation;</text></item><item id="id52BB7EA2F23A49EC85D8275602DF3A86"><enum>(ll)</enum><text>an organization representing State departments of energy or State energy planners;</text></item><item id="idAAE3C89E98A44DE2951F1E8306511194"><enum>(mm)</enum><text>an expert in intelligent transportation systems and technologies;</text></item><item id="id1A548BF45341434DA279331068EA9CE8"><enum>(nn)</enum><text>organized labor;</text></item><item id="idD68AF3CCE24F462DA193BF11D4219B6A"><enum>(oo)</enum><text>the trucking industry;</text></item><item id="id5D68E18A1AF84473971EDD83B3675508"><enum>(pp)</enum><text>Tribal governments; and</text></item><item id="id3120941747824C0C916812C49C82A0A5"><enum>(qq)</enum><text>the property development industry; and</text></item></subclause><subclause id="id0BF64FABE3DC494A90CA5BFFB29D0698"><enum>(II)</enum><text>may include a representative of any other non-Federal stakeholder that the Secretaries consider to be appropriate.</text></subclause></clause><clause id="id007F835CCC364910BE9DDDE2C3A9B7B1"><enum>(ii)</enum><header>Requirement</header><text>The Secretaries shall ensure that the members of the working group selected under clause (i) shall include—</text><subclause id="id14102C8E635045A5A97AD636E8E7DF65"><enum>(I)</enum><text>individuals with a balance of backgrounds, experiences, and viewpoints; and</text></subclause><subclause id="idA25AA4F7E05842CFA5DD0941A40CF537"><enum>(II)</enum><text>individuals that represent geographically diverse regions of the United States, including from rural, urban, and suburban areas. </text></subclause></clause></subparagraph></paragraph><paragraph id="idD63E5A47AFF6449FA622BADD923605BF"><enum>(3)</enum><header>Meetings</header><subparagraph id="id97288E7BEDD945ABB49FE871342C06F2"><enum>(A)</enum><header>In general</header><text>The working group shall meet not less frequently than once every 120 days.</text></subparagraph><subparagraph id="idDCC190137FED409A8C9AE009195B31B1"><enum>(B)</enum><header>Remote participation</header><text>A member of the working group may participate in a meeting of the working group via teleconference or similar means.</text></subparagraph></paragraph><paragraph id="id806207B45B1D4CBDB99783AAB3FA1C14"><enum>(4)</enum><header>Coordination</header><text>In carrying out the duties of the working group, the working group shall coordinate and consult with any existing Federal interagency working groups on fleet conversion or other similar matters related to electric vehicles.</text></paragraph></subsection><subsection id="idc2ac10ad26b24346aa7f9b24d539588f"><enum>(b)</enum><header>Joint report and strategy on electric vehicle adoption, opportunities, and challenges</header><paragraph id="id86FFDC40C537459E956F3924DEEF8672"><enum>(1)</enum><header>In general</header><text>The Secretaries, in consultation with the working group, shall submit to Congress by each of the deadlines described in paragraph (2)—</text><subparagraph id="id862F9874339344E89BF3DDD8E42F94B3"><enum>(A)</enum><text>a report on the status of electric vehicle adoption and opportunities for and challenges to expanding adoption of electric vehicles, including—</text><clause id="id1a8f83b60ea74241b360f239a6f88dd2"><enum>(i)</enum><text>a description of the barriers and opportunities to scaling up electric vehicle adoption nationwide, with recommendations for issues relating to—</text><subclause id="id35F1F44F02464DDF8B5D99541CF09CFD"><enum>(I)</enum><text>consumer behavior;</text></subclause><subclause id="idE9B0C8C1B55D48EEB37265C38D170ABB"><enum>(II)</enum><text>charging infrastructure needs, including standardization and smart charging;</text></subclause><subclause id="id03032E96A7234A99A9EFD1E68A9902DA"><enum>(III)</enum><text>manufacturing and battery costs, including the raw material shortages for batteries and electric motor magnets;</text></subclause><subclause id="id209EBE99391147698AC2DF86A22AF627"><enum>(IV)</enum><text>the adoption of electric vehicles for low- and moderate-income individuals and underserved communities, including charging infrastructure access and vehicle purchase financing;</text></subclause><subclause id="id2631758773D647D7AB335A631E884B5B"><enum>(V)</enum><text>business models for charging electric vehicles outside the home, including wired and wireless charging;</text></subclause><subclause id="idb64963ecfd6b4736984ca7f50c56fd98"><enum>(VI)</enum><text>charging infrastructure permitting and regulatory issues;</text></subclause><subclause id="id53E298784A684A02B7F582DC42607E26"><enum>(VII)</enum><text>the connections between housing and transportation costs and emissions;</text></subclause><subclause id="id5D14382F8ECB4A70A25844FC491CD49B"><enum>(VIII)</enum><text>freight transportation, including local, port and drayage, regional, and long-haul trucking;</text></subclause><subclause id="id5EBE1461B56B4BCF84DB1BA264FB8B44"><enum>(IX)</enum><text>intercity passenger travel;</text></subclause><subclause id="idFF210C48A9C6417F943DFFF1B0D5C4F3"><enum>(X)</enum><text>the need or potential for model building codes for charging infrastructure;</text></subclause><subclause id="id9CEB86E5F5CA4EF4BF2C4D397713829B"><enum>(XI)</enum><text>the process by which governments collect a user fee for the contribution of electric vehicles to funding roadway improvements and potential investments in charging infrastructure;</text></subclause><subclause id="idE774FAF8055D41C89355639405D5EC5C"><enum>(XII)</enum><text>State and local level policies, incentives, and zoning efforts;</text></subclause><subclause id="id0E463819E7E9499C8FA63228D9DA34B9"><enum>(XIII)</enum><text>the installation of highway corridor signage;</text></subclause><subclause id="id3FB119BF9D1B4120878A7458E88E6D49"><enum>(XIV)</enum><text>cybersecurity of charging infrastructure;</text></subclause><subclause id="ida4efa22f86e9469a939df6823fa77ec7"><enum>(XV)</enum><text>secondary markets and recycling for batteries, including battery collection initiatives;</text></subclause><subclause id="id8D1464AA50D845919557CFC18E6722BA"><enum>(XVI)</enum><text>grid integration;</text></subclause><subclause id="idDD2B96235D864360BDD1548D5E0AB729"><enum>(XVII)</enum><text>energy storage; and</text></subclause><subclause id="id7AB2B89889A44E2896C1091825C7D54C"><enum>(XVIII)</enum><text>specific regional or local issues that—</text><item id="id421E00BC772F4F90B9CB46A7D6DA3FCA"><enum>(aa)</enum><text>are associated with—</text><subitem id="idF41FA2F1AFAE4D77840BF79BC98FF71A"><enum>(AA)</enum><text>the issues described in subclauses (I) through (XVII); or</text></subitem><subitem id="idDCF802EFDAF74B5884FDF54CBEED0F02"><enum>(BB)</enum><text>urban or rural environments; and</text></subitem></item><item id="idC2D6B6121D3648119CFFE3D8C2A02CC9"><enum>(bb)</enum><text>may not appear nationwide, but hamper a nationwide adoption or coordination of electric vehicles;</text></item></subclause></clause><clause id="idCC37BCB94414473AAB9044C91FF38186"><enum>(ii)</enum><text>examples of successful public and private models and demonstration projects that encourage electric vehicle adoption; and</text></clause><clause id="id4a4429d53335452ca34c99272ca5d702"><enum>(iii)</enum><text>an analysis of current efforts to overcome the barriers described in clause (i); and</text></clause></subparagraph><subparagraph id="id946efc960ac04bc48296b81fe7bc6b84"><enum>(B)</enum><text>a strategy that describes how the Federal Government, States, units of local government, and industry can—</text><clause id="idA2537EA0BE3644D6A807F016656D3EED"><enum>(i)</enum><text>set quantitative targets for transportation electrification;</text></clause><clause id="id4DB28CA12C5D4D1CA0807D57B4CBA7A3"><enum>(ii)</enum><text>overcome the barriers described in subparagraph (A)(i);</text></clause><clause id="id6734B57AD3504F8CA6BDB78F0D54B2C6"><enum>(iii)</enum><text>identify areas of opportunity in research and development to improve battery manufacturing, mineral mining, recycling costs and battery collection, material recovery, and battery performance for electric vehicles;</text></clause><clause id="id2C5E8067908545EF9E9CDCD9A3164618"><enum>(iv)</enum><text>enhance Federal interagency coordination to promote electric vehicle adoption;</text></clause><clause id="id78342B37423844E0A963BDB3A096C7A2"><enum>(v)</enum><text>promote electric vehicle knowledge and expertise within State and local governments;</text></clause><clause id="id408E7FB3B3874CF48B6C4EED96CCB9B9"><enum>(vi)</enum><text>prepare the workforce for the adoption of electric vehicles, including through collaboration with labor unions, colleges and other educational institutions, and relevant manufacturers;</text></clause><clause id="idE88E96E4B50046E8BCB1C10943AECC11"><enum>(vii)</enum><text>expand electric vehicle and charging infrastructure—</text><subclause id="idE6E1436F9718498AABA1F5221EA64732"><enum>(I)</enum><text>knowledge and use among Federal, State, and local governments, school districts, and private entities; and</text></subclause><subclause id="id4CBB9416C20C429AA96E8F014FA41A03"><enum>(II)</enum><text>adoption among the fleets of the entities described in subclause (I);</text></subclause></clause><clause id="idb17ade5d98284bd981042659d5c8c4f7"><enum>(viii)</enum><text>expand knowledge of the benefits of electric vehicles among the general public;</text></clause><clause id="idebeaeb8f0f044d77bd3732c41e5ff4b7"><enum>(ix)</enum><text>maintain the global competitiveness of the United States in the electric vehicle and charging infrastructure markets;</text></clause><clause id="id021be30fc8334e0e85beea85c54810e4"><enum>(x)</enum><text>provide clarity in regulations to improve national uniformity with respect to electric vehicles; and</text></clause><clause id="idCD0769FBA2AF40DDBC68F632754E2645"><enum>(xi)</enum><text>ensure the sustainable integration of electric vehicles into the national electric grid.</text></clause></subparagraph></paragraph><paragraph id="id2D536C7AD57E4838BB9F3A4C47A5318C"><enum>(2)</enum><header>Deadlines</header><text>A joint report and strategy under paragraph (1) shall be submitted by—</text><subparagraph id="id58947563C7C447EE90C197CEB4800E84"><enum>(A)</enum><text>for the first report, not later than 18 months after the date on which the working group is established under subsection (a)(1);</text></subparagraph><subparagraph id="idC800638BDC44474480C5FB6E0852CC4A"><enum>(B)</enum><text>for the second report, not later than 2 years after the date on which the first report is required to be submitted under subparagraph (A); and</text></subparagraph><subparagraph id="id38E78801B62C4A6DBDFD1A1E7F849E7E"><enum>(C)</enum><text>for the third report, not later than 2 years after the date on which the second report is required to be submitted under subparagraph (B).</text></subparagraph></paragraph><paragraph id="idECC4F0A3BAA043ADA9739FE1EA4570E2"><enum>(3)</enum><header>Information</header><subparagraph id="idD71155724E8049B28608122329B79184"><enum>(A)</enum><header>In general</header><text>The Secretaries may enter into an agreement with the Transportation Research Board of the National Academies of Sciences, Engineering, and Medicine to provide, track, or report data, information, or research to assist the Secretaries in carrying out paragraph (1). </text></subparagraph><subparagraph id="idB767C34BC29D4F958AB76534EDA49715"><enum>(B)</enum><header>Use of existing information</header><text>In developing the report and strategy under paragraph (1), the Secretaries and the working group shall consider existing Federal, State, local, private sector, and academic data and information relating to electric vehicles and, to the maximum extent practicable, coordinate with the entities that publish that information—</text><clause id="id37903ED0041C48F18AFE4AF544F36785"><enum>(i)</enum><text>to prevent duplication of efforts by the Federal Government; and</text></clause><clause id="idF283F8DA74D14ECCB8A9CACC2ACD9211"><enum>(ii)</enum><text>to leverage existing information and complementary efforts. </text></clause></subparagraph></paragraph></subsection><subsection id="iddbdf2fb10c0944f8af047fe42580af22"><enum>(c)</enum><header>Electric vehicle resource guide</header><paragraph id="id66c6a4ac4a0541bc91b9a64cba53cd50"><enum>(1)</enum><header>In general</header><text>The Secretaries shall electronically publish and update a resource guide to provide information to increase knowledge about electric vehicles and necessary charging infrastructure for consumers, State, local, and Tribal governments (including transit agencies or authorities, public tolling authorities, metropolitan planning organizations, public utility commissions, and public service companies), and businesses that sell motor vehicles.</text></paragraph><paragraph id="id33b050789811411fa6579f8032b68f09"><enum>(2)</enum><header>Inclusions</header><text>A resource guide under paragraph (1) shall include—</text><subparagraph id="ida86cca38188643e19ec2de281293de7e"><enum>(A)</enum><text>information on—</text><clause id="idC37C4DACA6D14FB2AD4E96F649B3EFDE"><enum>(i)</enum><text>the general characteristics of electric vehicles (including passenger vehicles, electric vehicles for public transportation, school buses, and electric vehicles for commercial use); and</text></clause><clause id="id9316B630BD2F49D5BA37FAAC2D7CA975"><enum>(ii)</enum><text>the types of charging solutions available to consumers, including, to the maximum extent practicable, a digitally accessible compilation of existing mapping of publicly available charging stations in the United States;</text></clause></subparagraph><subparagraph id="ide80f4131a42c40e78acbd9c18dd3607e"><enum>(B)</enum><text>information on electrifying business and government vehicle fleets;</text></subparagraph><subparagraph id="idb1036fb744c54722846cc0e037d45f34"><enum>(C)</enum><text>information on Federal grant programs available to State and local governments for the purchase of electric vehicles for public transportation;</text></subparagraph><subparagraph id="idA1E1350B91A44BD1BB21F794F6A63B78"><enum>(D)</enum><text>a description of current financial and nonfinancial incentives for electric vehicles; and</text></subparagraph><subparagraph id="idaf74d67f564d4630b5969c48ef83693d"><enum>(E)</enum><text>any other information that—</text><clause commented="no" id="id00DC47199FC24EAC9C30C67B9A1808B8"><enum>(i)</enum><text>a representative of industry or State or local government requests to be included; and</text></clause><clause commented="no" id="id1D89AF8AB8344CB68E648835B88C2D45"><enum>(ii)</enum><text>the working group recommends and determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id7b738025557c403ea21d3bfb4270f29e"><enum>(3)</enum><header>Use of existing guides</header><text>In publishing and maintaining the resource guide under paragraph (1), the Secretaries and the working group shall consider existing Federal, State, local, private sector, and academic guides relating to electric vehicles and, to the maximum extent practicable, coordinate with the entities publishing those guides—</text><subparagraph id="id3661c37129684073896a0d870f645a49"><enum>(A)</enum><text>to prevent duplication of efforts by the Federal Government; and</text></subparagraph><subparagraph id="id469e721ffb99462192410fc2af7a3e79"><enum>(B)</enum><text>to leverage existing information and complementary efforts.</text></subparagraph></paragraph><paragraph id="id9488bd468fd04282bbc3f0a158f82b59"><enum>(4)</enum><header>Resource guide outreach</header><text>The Secretaries, in consultation with the working group, shall conduct outreach to consumers, State, local, and Tribal governments (including transit agencies or authorities, public tolling authorities, metropolitan planning organizations, public utility commissions, and public service companies), and businesses that sell motor vehicles through the websites of the Department of Transportation and the Department of Energy, social media, and other methods—</text><subparagraph id="id715dc2a624024248bf73a3aac3be1998"><enum>(A)</enum><text>to provide the resource guide under paragraph (1) to interested stakeholders, including relevant consumer groups and transportation-related organizations;</text></subparagraph><subparagraph id="idd91463ccaef049128b2a803475b4df48"><enum>(B)</enum><text>to promote the use of electric vehicles in both government and industry fleets; and</text></subparagraph><subparagraph id="idcf4f2d68cb01459f83a24fe740599225"><enum>(C)</enum><text>to educate individuals involved in the sale of motor vehicles about the benefits of electric vehicles.</text></subparagraph></paragraph><paragraph id="idaf12be89065645689b9f4b472e8f3563"><enum>(5)</enum><header>Subsequent resource guides</header><text>Not less frequently than every 2 years for the duration of the working group, the working group shall publish an update to the resource guide under paragraph (1), as appropriate based on technological innovation and subsequent information.</text></paragraph><paragraph id="idBB137BAAEE92446B8C6E1B7D8B0D30BE"><enum>(6)</enum><header>Accessibility</header><text>The Secretaries shall each maintain the resource guide under paragraph (1) on a designated website, which may be an existing website, of each Secretary relating to electric vehicles.</text></paragraph></subsection><subsection id="id514B161BDAD24AAAA464E586183424CA"><enum>(d)</enum><header>Coordination</header><text>To the maximum extent practicable, the Secretaries and the working group shall carry out this section using all available existing resources, websites, and databases of Federal agencies, such as the Alternative Fuels Data Center, the Energy Efficient Mobility Systems program, and the Clean Cities Coalition Network.</text></subsection><subsection id="id5B4FEB6C309A49029077D462553E4B10"><enum>(e)</enum><header>Funding</header><text>The Secretaries shall carry out this section using existing funds made available to the Secretaries and not otherwise obligated, of which—</text><paragraph id="id474599F299294114A0D3D1E2231790AE"><enum>(1)</enum><text>50 percent shall be from funds made available to the Secretary of Transportation;
