which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose sanctions with respect to General Secretary Xi Jinping and other senior officials of the Chinese Communist Party complicit in the perpetration of genocide and other crimes against humanity against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sanction Xi Jinping for Xinjiang Atrocities Act</short-title></quote>.</text></section><section id="ide391bd01a15b4e558628c377bf0b2d00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id0482b5a5a7db4459a50e2d3366b4de65"><enum>(1)</enum><text>On August 31, 2022, the Office of the United Nations High Commissioner for Human Rights released an assessment that found that—</text><subparagraph id="idb09c3281ea9c4a00aae9eb7cf9503580"><enum>(A)</enum><text><quote>serious human rights violations have been committed</quote> by authorities of the People’s Republic of China against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="id5b87bf76a04c47a2a411a8261b17e65f"><enum>(B)</enum><text>such violations may <quote>constitute international crimes, in particular crimes against humanity</quote>.</text></subparagraph></paragraph><paragraph id="id5485ac50889741378cdcb0fa968eef9c"><enum>(2)</enum><text>The Secretary of State has found that treatment by authorities of the People’s Republic of China of Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region constitutes genocide and other crimes against humanity. </text></paragraph><paragraph id="id6d52c4100c7642fbbc86df5a16798d9b"><enum>(3)</enum><text>The Xinjiang Police Files published in May 2022 offered unprecedented insight into the human rights violations perpetrated by authorities of the People's Republic of China against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region, including—</text><subparagraph id="id81973b09d239456894ed8f65f99fc137"><enum>(A)</enum><text>imprisonment of the elderly, young mothers, and other adults considered to be a threat by the Chinese Communist Party, including individuals alleged to have engaged in forbidden religious activities;</text></subparagraph><subparagraph id="id5441fd03f8c74bbeb2c9e49f1e5317d4"><enum>(B)</enum><text>imprisonment of children as young as 14, some of whom were apparently instructed to smile for detention photos;</text></subparagraph><subparagraph id="id80e8df5fc1df45a7bc89d5d0a5967f24"><enum>(C)</enum><text>use of armed strike groups and other personnel armed with clubs, batons, bayonets, machine guns, assault rifles, sniper rifles, and other military-grade weapons to intimidate and control detainees;</text></subparagraph><subparagraph id="id193b1f09f87644caa47f422ed3f028ae" commented="no"><enum>(D)</enum><text>directives for police forces to <quote>shoot dead</quote> detainees who fail to heed orders, including to prevent individuals from escaping alive; and</text></subparagraph><subparagraph id="id69a98895925942f8a3b9e17b6688cb90"><enum>(E)</enum><text>restrictions on medical care afforded to detainees.</text></subparagraph></paragraph><paragraph id="id2fea225427b642a99c547c9f5bb7c130"><enum>(4)</enum><text>The Xinjiang Police Files provide further evidence, including speeches by Minister of Public Security Zhao Kezhi and then-Xinjiang Party Secretary Chen Quanguo, that General Secretary Xi Jinping directed and oversaw persecution of Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region, including by—</text><subparagraph id="id02d46efabdaa4a16abaf1456df2e3ad6"><enum>(A)</enum><text>directing Chen to travel to Xinjiang and <quote>make a stable Xinjiang arise</quote>;</text></subparagraph><subparagraph id="id60f9c7de6f4548929760695dab3d8174"><enum>(B)</enum><text>issuing <quote>important instructions on governing Xinjiang according to the law, unifying and stabilizing Xinjiang, and building Xinjiang over the long term</quote>; and</text></subparagraph><subparagraph id="id2245afb12112445a8532355e4a67f8f4"><enum>(C)</enum><text>ordering Xinjiang authorities to—</text><clause id="idaee1f695b0fd43f8ae8397bf745e8110"><enum>(i)</enum><text><quote>conduct de-extremification work</quote>, including <quote>transformation through education</quote>; and</text></clause><clause id="id308323129dea4dbd9a3d5798608761f2"><enum>(ii)</enum><text><quote>implement practical measures such as expanding the number of employed [staff in detention facilities], enlarging the capacity [of those facilities], and increasing investment [in those facilities] within the set time frame</quote>.</text></clause></subparagraph></paragraph></section><section id="id0b3162f84b304a01b6c3883b4daca438"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id3dd9378ffe58474ab73554e6873ece9e"><enum>(1)</enum><text>General Secretary Xi Jinping is complicit in the genocide and other crimes against humanity perpetrated against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region; and</text></paragraph><paragraph id="id37ee830c74da417382498abdab650459"><enum>(2)</enum><text>General Secretary Xi Jinping and other senior Chinese Communist Party officials should be held accountable for such genocide and crimes against humanity, including through the imposition of sanctions.</text></paragraph></section><section id="ida9ed5481cdb34896bb92718e7e132e11"><enum>4.</enum><header>Imposition of sanctions with respect to senior Chinese Communist Party officials complicit in Xinjiang human rights violations</header><subsection id="idafdbb9749dc244299ad79d7f32996350"><enum>(a)</enum><header>Identification of senior Chinese Communist Party officials complicit in Xinjiang human rights violations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State, in consultation with the Director of National Intelligence, shall submit to the appropriate congressional committees a report that includes the following:</text><paragraph id="idfe638a49ff0c4531bb3f8f4b30879072"><enum>(1)</enum><text>A list of senior Chinese Communist Party officials who directed, oversaw, monitored, or were otherwise complicit in the perpetration of genocide and other crimes against humanity against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="idb4e04076132749769ff21b28848ae139" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>A description of actions taken by senior Chinese Communist Party officials listed under paragraph (1) that resulted in their inclusion on such list.</text></paragraph></subsection><subsection id="id1b2492d460e44cb18a51910177088bf3"><enum>(b)</enum><header>Sanctions</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the President shall impose the sanctions described in section 1263(b) of the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10102">22 U.S.C. 10102(b)</external-xref>) with respect to individuals identified under subsection (a).</text></subsection><subsection id="ided4c0a2cf3b24252bc98c9f51b232eb3"><enum>(c)</enum><header>Report on implementation</header><text>Not later than 90 days after first imposing sanctions under subsection (b), the President shall submit to the appropriate congressional committees a report regarding measures taken by the President to implement this section.</text></subsection><subsection id="id097ad150639647bd8ee56928e7fdc515"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id78e6f3ced96c417b9abbb7f5a74c0b79"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id4fa430c601e043c9a1b01f3b3a694f1d"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="iddc1a715ec12648048591067e7c12508c"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id75a4e63360f54c24a8249f18d8e6ab06"><enum>(2)</enum><header>Senior Chinese Communist Party officials</header><text>The term <term>senior Chinese Communist Party officials</term> means—</text><subparagraph id="idb0fe57cd346d4c35b5970f137fdcf1ef"><enum>(A)</enum><text>the General Secretary of the Party Central Committee;</text></subparagraph><subparagraph id="id17490d0adff44c30a52b176cc548648a"><enum>(B)</enum><text>members of the Political Bureau Standing Committee;</text></subparagraph><subparagraph id="ida2c4d322fb8646409d951016fdcc4179"><enum>(C)</enum><text>members of the Political Bureau;</text></subparagraph><subparagraph id="id1c8235cde64c4ec79369025b958211ab"><enum>(D)</enum><text>members of the Central Military Commission;</text></subparagraph><subparagraph id="idabf5da43fdde433b9e8d9ddb4bfea5f7"><enum>(E)</enum><text>members of the Central Committee;</text></subparagraph><subparagraph id="id46e29a31da674342b676784dd1aba361"><enum>(F)</enum><text>members of the Central Commission for Discipline Inspection; and</text></subparagraph><subparagraph id="idb6655d1e3f994dabb64881fe766ff13d"><enum>(G)</enum><text>members of the Secretariat. </text></subparagraph></paragraph></subsection></section><section id="id5f5f04600eaf4a128a938899ec8c4c6c"><enum>5.</enum><header>Termination</header><text display-inline="no-display-inline">This Act shall terminate on January 1, 2033. </text></section></legis-body></bill>
