which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase deployment of electric vehicle charging infrastructure in low-income communities and communities of color, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2DDE61A680244A41BD8C9D5AE025FE76"><section section-type="section-one" id="H1392F539BEB54BB689FE379C0BA64DD5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electric Vehicles for Underserved Communities Act of 2021</short-title></quote>.</text></section><section id="HB8DA8A58C3634D81A4D43E2A7A1D52CA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idd6466b8de6f94300ab663a89d2588ab5"><enum>(1)</enum><header>Electric vehicle</header><text>The term <term>electric vehicle</term> means—</text><subparagraph id="id53dbe4ae7a984b9bad623b2cfcbb8a52"><enum>(A)</enum><text>a Zero-Emission Vehicle (as defined in section 88.102–94 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act)); and</text></subparagraph><subparagraph id="id5213f3c53015420ab07fc77e0a12d7ab"><enum>(B)</enum><text>a vehicle that, under any possible operational mode or condition, produces zero exhaust emissions of—</text><clause id="ida3c0b3423d02436280a4437676f3ac22"><enum>(i)</enum><text>any criteria pollutant for which there are national ambient air quality standards under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>);</text></clause><clause id="idFBD28F652ED24CD283CAD43A615F4D7D"><enum>(ii)</enum><text>any precursor pollutant; or</text></clause><clause id="id97dc3c9fc536472bacc7d4ff30a0aa4c" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>any greenhouse gas. </text></clause></subparagraph></paragraph><paragraph id="H184A300C6FD441BB948D31393EB3DA8D"><enum>(2)</enum><header>Electric vehicle charging infrastructure</header><subparagraph id="idC186F946165D44B08AAAFD068057508C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>electric vehicle charging infrastructure</term> means any property (not including a building and its structural components) if that property is—</text><clause id="id2ba6ff578f6943c0b46321e966a32631"><enum>(i)</enum><text>made available for use by members of the general public; and</text></clause><clause id="id4483df46d1644c9085a76cbdb3d4ec5c"><enum>(ii)</enum><text>used to charge or fuel electric vehicles, but only if the property is located at the point where the vehicles are charged or fueled.</text></clause></subparagraph><subparagraph id="id87cd0af61e27476db6674fbb5b1deff8"><enum>(B)</enum><header>Inclusion of utility service connections</header><text>The term <term>electric vehicle charging infrastructure</term> includes any utility service connections, utility panel upgrades, or contributions in aid of construction (within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/26/118">section 118</external-xref> of the Internal Revenue Code of 1986) that are required for the charging or fueling of electric vehicles.</text></subparagraph></paragraph><paragraph id="id62496e8520ec484aa91b8c27cd6e4539"><enum>(3)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means any of the following:</text><subparagraph id="id7526ac691ed74c7dbe316b78bd4607b8"><enum>(A)</enum><text>Carbon dioxide.</text></subparagraph><subparagraph id="idf86cf196ddd448359b7f1031e1207e08"><enum>(B)</enum><text>Methane.</text></subparagraph><subparagraph id="ida2e6cdef7cbb4bc7ba6d2a29984513f6"><enum>(C)</enum><text>Nitrous oxide.</text></subparagraph><subparagraph id="id564d689b989c4359be5704c03d5a7e45"><enum>(D)</enum><text>Hydrofluorocarbons.</text></subparagraph><subparagraph id="idf3ad2c2413074807ac17b0ab102f1848"><enum>(E)</enum><text>Perfluorocarbons.</text></subparagraph><subparagraph id="ide9e5520329a54730baf41f23ca6e7bf9"><enum>(F)</enum><text>Sulfur hexafluoride.</text></subparagraph></paragraph><paragraph id="idfac40ff547cc417d989a5bd7e481b3d6"><enum>(4)</enum><header>Publicly accessible</header><subparagraph id="idE54A14E294A14423A957DB9294B6C77A"><enum>(A)</enum><header>In general</header><text>The term <term>publicly accessible</term> means—</text><clause id="id6681806DBD464C62921137316F31B5AE"><enum>(i)</enum><text>with respect to electric vehicle charging infrastructure, that the electric vehicle charging infrastructure is available, at zero or reasonable cost, to members of the public for the purpose of charging a privately owned or leased electric vehicle; and</text></clause><clause id="id4013BC990DCE4DDEB6491B617C68A2F6"><enum>(ii)</enum><text>with respect to an electric vehicle, that the electric vehicle is available for use by members of the general public as part of a ride service or vehicle sharing service or program.</text></clause></subparagraph><subparagraph id="id3FEF4A398C9D49A3A47EA5B991413689"><enum>(B)</enum><header>Inclusions</header><text>The term <term>publicly accessible</term> includes electric vehicle charging infrastructure and electric vehicles described in clauses (i) and (ii), respectively, of subparagraph (A) that are located within or around—</text><clause id="id650e71ba7e56440c883748bda68aadf8"><enum>(i)</enum><text>public sidewalks and streets;</text></clause><clause id="id53dbc4f6e0e345469d1895319336aabb"><enum>(ii)</enum><text>public parks;</text></clause><clause id="id1007b9bb56584705b64227d0b606c081"><enum>(iii)</enum><text>public buildings, including—</text><subclause id="id0d8ef119d8d24e139ece77ea6a09cefa"><enum>(I)</enum><text>libraries;</text></subclause><subclause id="ide6710bc31e5a4d1bb95b6910b78a828e"><enum>(II)</enum><text>schools; and</text></subclause><subclause id="iddfb2ab81e83d4949adc1dc612c755d5f"><enum>(III)</enum><text>government offices;</text></subclause></clause><clause id="id32b49359e3c04c92b0129175a0b3a3ee"><enum>(iv)</enum><text>public parking;</text></clause><clause id="id5ae52518ac6a4823bb8b2b88001dfcf5"><enum>(v)</enum><text>shopping centers; and</text></clause><clause id="idb4d2ea1712a046ed9bac2608492b17f8"><enum>(vi)</enum><text>commuter transit hubs.</text></clause></subparagraph></paragraph><paragraph id="ide8b7e027089a4d83a24762dcf0783528"><enum>(5)</enum><header>Relevant program</header><text>The term <term>relevant program</term> means a program of the Department of Energy, including—</text><subparagraph id="idb6adbea1b5d144ae9d40ff7f6bdf4c1e"><enum>(A)</enum><text>the State energy program established under part D of title III the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321</external-xref> et seq.);</text></subparagraph><subparagraph id="id2e9edcd2f4ec4c6f8a5e6c00b2564d31"><enum>(B)</enum><text>the Clean Cities program;</text></subparagraph><subparagraph id="id9592dce521844fe8a4a2475d6dc6e2c6"><enum>(C)</enum><text>the Energy Efficiency and Conservation Block Grant Program established under section 542(a) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17152">42 U.S.C. 17152(a)</external-xref>);</text></subparagraph><subparagraph id="idb893c77adfe247a2ba3e4ef204223e29"><enum>(D)</enum><text>a loan guarantee made under title XVII of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16511">42 U.S.C. 16511</external-xref> et seq.); and</text></subparagraph><subparagraph id="id8d0c12e5b8bf401889db767e58864e37"><enum>(E)</enum><text>any other program of the Department of Energy, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="ida0574ea8f5b84f64a049144815244530"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="ida3dbdbf4970c4fe7885de4b8c5fc2bf8"><enum>(7)</enum><header>Underserved or disadvantaged community</header><text>The term <term>underserved or disadvantaged community</term> means a community located within a ZIP Code or census tract that is identified as—</text><subparagraph id="idd35fb4ad94ea47fe892da888cd1e23da"><enum>(A)</enum><text>a low-income community;</text></subparagraph><subparagraph id="id0fcc2542893a4cd7902d03381d2ce306"><enum>(B)</enum><text>a community of color;</text></subparagraph><subparagraph id="ida234d70c75f147989d341f31a6a0705b"><enum>(C)</enum><text>a Tribal community;</text></subparagraph><subparagraph id="ida040058a209a4ac88244b16318a6c7eb"><enum>(D)</enum><text>having a disproportionately low number of electric vehicle charging stations per capita, compared to similar areas; or</text></subparagraph><subparagraph id="idbdc78bd45fa34736bfd1be69f482f9f2"><enum>(E)</enum><text>any other community that the Secretary determines is disproportionately vulnerable to, or bears a disproportionate burden of, any combination of economic, social, environmental, and climate stressors.</text></subparagraph></paragraph></section><section id="H5850E6622F1A49639C801F6945ADF72D"><enum>3.</enum><header>Expanding access to electric vehicles in underserved or disadvantaged communities</header><subsection id="H4ACA3E767A20428FB7A79E5ED219F9AB"><enum>(a)</enum><header>Assessment</header><paragraph id="idF67A0AE700944F71B28A37B044B6E71F"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct an assessment of the state of, challenges to, and opportunities for, deployment of electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural communities throughout the United States.</text></paragraph><paragraph id="id7FF61DE3FDF0468CAE5C0CBDF5ECDA23"><enum>(2)</enum><header>Requirement</header><text>In carrying out the assessment under paragraph (1), the Secretary, to the maximum extent practicable, shall work with each State to enumerate and identify, with detail at the level of ZIP Codes and census tracts, in urban, suburban, and rural areas within each State—</text><subparagraph id="idE58D15AC73BF449E8DEE3CC69C70206E"><enum>(A)</enum><text>the number of existing and planned publicly accessible level 2 charging stations and direct current fast charging stations for individually owned light-duty and medium-duty electric vehicles; </text></subparagraph><subparagraph id="idF97DECC4E776424DB52CE5817B7CF22C"><enum>(B)</enum><text>the number of existing and planned level 2 charging stations and direct current fast charging stations for public sector and commercial—</text><clause id="id51E95B8C284847458E64D584CD50756A"><enum>(i)</enum><text>fleet electric vehicles; and </text></clause><clause id="idDF5FB5373DC54A2EB54A0FE8ECAF05D4"><enum>(ii)</enum><text>medium- and heavy-duty electric vehicles; and </text></clause></subparagraph><subparagraph id="idE12BE4691D8B49B696EADBC396CA5080"><enum>(C)</enum><text>the number and type of electric vehicle charging stations installed in or around, or available to occupants of—</text><clause id="id9534249FE2434C3AB934E01788929DC5"><enum>(i)</enum><text>public housing; or </text></clause><clause id="idB1DD478A478D4CA082F898DBD7DC400B"><enum>(ii)</enum><text>affordable housing.</text></clause></subparagraph></paragraph></subsection><subsection id="H07E075C49FB94048B7F3161E3B38CCD2"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the results of the assessment conducted under subsection (a), which shall—</text><paragraph id="HF92C46674EBC44F4B38D94AC73F2635E"><enum>(1)</enum><text display-inline="yes-display-inline">describe the state of deployment of electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural areas in the United States, including—</text><subparagraph id="HD86A482ECA3848C58936EA402DCDDAC5"><enum>(A)</enum><text>the state of deployment of electric vehicle charging infrastructure that is—</text><clause id="id2737DD3BB8E84DB3B9618B9AE099ADBB"><enum>(i)</enum><text>publicly accessible;</text></clause><clause id="id7739A34DE5A04DD38B72A64F671FE4EA"><enum>(ii)</enum><text>installed in or around, or available to occupants of—</text><subclause id="id533ECF14070F4AEC89673EB69D67EA4D"><enum>(I)</enum><text>public housing; or</text></subclause><subclause id="idC9D26619A2574A35869C0899F9B663D9"><enum>(II)</enum><text>affordable housing;</text></subclause></clause><clause id="idF559373E522045CF8B70D53D107624BD"><enum>(iii)</enum><text>installed in or around, or available to occupants of, multi-unit dwellings;</text></clause><clause id="id50BA196999704BDFA2E3BF859BF59F70"><enum>(iv)</enum><text>available to public sector and commercial fleets; or</text></clause><clause id="id6AF6A48ABCEE416A88C2F1D0ABEBA1BD"><enum>(v)</enum><text>installed in, or available at, places of work;</text></clause></subparagraph><subparagraph id="H6A6D9EFA2CA74323940F0F6A1F4F9C9D"><enum>(B)</enum><text display-inline="yes-display-inline">the policies, plans, and programs that States, cities, utilities, and private entities are using to encourage greater deployment and use of electric vehicles and any associated electric vehicle charging infrastructure, including programs to encourage deployment of publicly accessible electric vehicle charging infrastructure that is available to residents of publicly or privately owned multi-unit dwellings;</text></subparagraph><subparagraph id="idbc031fd9e1af43c388a44366268cb144"><enum>(C)</enum><text>ownership models for level 2 charging stations and direct current fast charging stations located in or around—</text><clause id="idBC97A3541AE14DC5AADC0B093730BCA8"><enum>(i)</enum><text>residential multi-unit dwellings;</text></clause><clause id="id1318E1E33917455EA7C6BF47E808DBA6"><enum>(ii)</enum><text>commercial buildings; and </text></clause><clause id="idEF294DC991BB4238B4A2913CD05A7FDB"><enum>(iii)</enum><text>publicly accessible areas;</text></clause></subparagraph><subparagraph id="id18d79add40224f678a4c43dfcd0b486b"><enum>(D)</enum><text>mechanisms for financing electric vehicle charging infrastructure; and</text></subparagraph><subparagraph id="id9d922e5fa3384486a27103f61f9375fb"><enum>(E)</enum><text>the rates charged for the use of level 2 charging stations and direct current fast charging stations;</text></subparagraph></paragraph><paragraph id="H9BA9C7ABD8FD4B3A9DD25CAB877D6A7A"><enum>(2)</enum><text display-inline="yes-display-inline">identify current barriers to expanding the deployment of electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural areas, including barriers to expanding the deployment of publicly accessible electric vehicle charging infrastructure;</text></paragraph><paragraph id="HE4D24ABB88D445B8A652B2B5D94E2047"><enum>(3)</enum><text display-inline="yes-display-inline">identify the potential for, and barriers to, recruiting and entering into contracts with locally owned small and disadvantaged businesses, including women- and minority-owned businesses, to deploy electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural areas;</text></paragraph><paragraph id="ida2f0949cc15443a696ed5238c01dc6e4"><enum>(4)</enum><text>compile and provide an analysis of best practices and policies used by State and local governments, nonprofit organizations, and private entities to increase deployment of electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural areas, including best practices and policies relating to—</text><subparagraph id="HD0B11E0D85654121B46DB85064FEB442"><enum>(A)</enum><text>public outreach and engagement;</text></subparagraph><subparagraph id="HED1FAC26893B417C80036B82AB4A0D9B"><enum>(B)</enum><text>increasing deployment of publicly accessible electric vehicle charging infrastructure; and</text></subparagraph><subparagraph id="idB1B59CD7E7A842EF8F6A787F7EC80FE5"><enum>(C)</enum><text>increasing deployment of electric vehicle charging infrastructure in or around publicly or privately owned multi-unit dwellings;</text></subparagraph></paragraph><paragraph id="idF2B9589CADD440FBBEE2EBB8B433D71A"><enum>(5)</enum><text>to the maximum extent practicable, enumerate and identify, with detail at the level of ZIP Codes and census tracts, in urban, suburban, and rural areas within each State—</text><subparagraph id="id272434DB17FF48778BF84290EFDC7380"><enum>(A)</enum><text>the number of existing and planned publicly accessible level 2 charging stations and direct current fast charging stations for individually owned light-duty and medium-duty electric vehicles; </text></subparagraph><subparagraph id="id0E8B81DD15554121AA6EA82F76299470"><enum>(B)</enum><text>the number of existing and planned level 2 charging stations and direct current fast charging stations for public sector and commercial—</text><clause id="idC740D9331941450DBC1B5A88EE5DCC0B"><enum>(i)</enum><text>fleet electric vehicles; and </text></clause><clause id="id778CA0DCA18D463FB02BC8569E039E84"><enum>(ii)</enum><text>medium- and heavy-duty electric vehicles; and </text></clause></subparagraph><subparagraph id="id126AE5EB4EAF4A59AEAB6CF398715D90"><enum>(C)</enum><text>the number and type of electric vehicle charging stations installed in or around, or available to occupants of—</text><clause id="id64560FEA7C8E4EBFBFA6CB4EC8B31436"><enum>(i)</enum><text>public housing; or </text></clause><clause id="id0D2AD4E149684B3085669D5FC966892E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>affordable housing; and</text></clause></subparagraph></paragraph><paragraph id="H8CFF3A14DB1A45A88D35F829A9CEC06E"><enum>(6)</enum><text display-inline="yes-display-inline">describe the methodology used to obtain the information provided in the report.</text></paragraph></subsection><subsection id="HBAFD2E64F70148F8B027414257034A32"><enum>(c)</enum><header>Updated assessment</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Secretary shall—</text><paragraph id="H47A15AA8046E4C7F8A097B31EC8A0AEA"><enum>(1)</enum><text>update the assessment conducted under subsection (a); and</text></paragraph><paragraph id="HB9580E68258D4906B2EDC4E2C8AC180F"><enum>(2)</enum><text>submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives and make publicly available a report that—</text><subparagraph id="H398310467F6E4F8A8299CDF318528E79"><enum>(A)</enum><text>updates the information reported under subsection (b); and</text></subparagraph><subparagraph id="H3E63FB18F617458C911052D673943905"><enum>(B)</enum><text display-inline="yes-display-inline">includes a description of case studies and key lessons learned after the date on which the report under subsection (b) was submitted with respect to expanding the deployment of electric vehicle charging infrastructure in underserved or disadvantaged communities in urban, suburban, and rural areas.</text></subparagraph></paragraph></subsection></section><section id="idd841c7890bb14022aafca269255c7465"><enum>4.</enum><header>Electric vehicle charging equity program</header><subsection id="idf17e3340e10e44f6bd1650db2b7eb9b7"><enum>(a)</enum><header>Program</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program, to be known as the <quote>EV Charging Equity Program</quote>, to increase the deployment and accessibility of electric vehicle charging infrastructure in underserved or disadvantaged communities by—</text><paragraph id="idab8cd4dca11f4846977f2c0e6bf6e826"><enum>(1)</enum><text>providing technical assistance to eligible individuals and entities described in subsection (b); and</text></paragraph><paragraph id="iddb59ba71e34f4d739be0376a4cf9f6cf"><enum>(2)</enum><text>awarding grants, on a competitive basis, to eligible individuals and entities described in subsection (b) for projects that increase the deployment and accessibility of electric vehicle charging infrastructure, including electric vehicle charging infrastructure that is—</text><subparagraph id="idec143174bab04a4db6f38395ec96c4dc"><enum>(A)</enum><text>publicly accessible;</text></subparagraph><subparagraph id="iddf4499c23fdb4eb2a613ddfd9836de9b"><enum>(B)</enum><text>located within or around, or is easily accessible to residents of—</text><clause id="id0581425fc1fd411c854c3a0b1889a67d"><enum>(i)</enum><text>public or affordable housing;</text></clause><clause id="idfa3f3c59843b474c88597bb5a9fe6f09"><enum>(ii)</enum><text>multi-unit dwellings; or</text></clause><clause id="iddf1dfb2b4cda41abbebed53c0f55d8f3"><enum>(iii)</enum><text>single-family homes; or</text></clause></subparagraph><subparagraph id="id2007431d07d84b9aa1ca3ff9a7b3c1af"><enum>(C)</enum><text>located within or around, or is easily accessible to, places of work, subject to the condition that the electric vehicle charging infrastructure is publicly accessible not less than 5 days per week.</text></subparagraph></paragraph></subsection><subsection id="id03213f5e23b3426ebe10f8940e38b8ad"><enum>(b)</enum><header>Eligible individuals and entities</header><paragraph id="id23857950efd64880b59a461061d264af"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an eligible individual or entity referred to in subsection (a) is—</text><subparagraph id="id172499a845f24b54b738855ff08b27a8"><enum>(A)</enum><text>an individual or household that owns any property on which a project will be carried out;</text></subparagraph><subparagraph id="id9389cb22d1c540d5a52a81aa4f8b43f7"><enum>(B)</enum><text>a State, local, Tribal, or territorial government;</text></subparagraph><subparagraph id="idB9703F0738BB4EEE9850EB46707E70DC"><enum>(C)</enum><text>an agency or department of a State, local, Tribal, or territorial government;</text></subparagraph><subparagraph id="idd8b5399625244850b68750c517ef69d7"><enum>(D)</enum><text>an electric utility, including—</text><clause id="id0f0d1d2e393f4222a53a386e95376719"><enum>(i)</enum><text>a municipally owned electric utility;</text></clause><clause id="idad0a01c90eb4451dbf2aa624bc5fad9e"><enum>(ii)</enum><text>a publicly owned electric utility;</text></clause><clause id="idfddf4cda28e345a78ad45c00e3be8136"><enum>(iii)</enum><text>an investor-owned utility; and</text></clause><clause id="id47a7d21a91e1458f98d4a0334da84847"><enum>(iv)</enum><text>a rural electric cooperative;</text></clause></subparagraph><subparagraph id="id54c67eb5ba444ae1a75eae15b1dd62c5"><enum>(E)</enum><text>a nonprofit organization or institution;</text></subparagraph><subparagraph id="id5bcf8acf02a44b2a9ba5005cbe48cadf"><enum>(F)</enum><text>a public housing authority;</text></subparagraph><subparagraph id="id8d3d97cca1424eb8ba36734844adeaf4"><enum>(G)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>));</text></subparagraph><subparagraph id="ida969f397080144a09d41fefb007db409"><enum>(H)</enum><text>a local small or disadvantaged business; or</text></subparagraph><subparagraph id="ide6aebf4798464c3ab0387aa8ad42f573"><enum>(I)</enum><text>a partnership between 2 or more individuals or entities described in subparagraphs (A) through (H).</text></subparagraph></paragraph><paragraph id="idcd79e8c5261243f7ae0cb7c61a2e7fd8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Updates</header><text>In carrying out the EV Charging Equity Program, the Secretary may establish a list of eligible individuals and entities that includes individuals or entities not described in paragraph (1) or excludes individuals or entities described in that paragraph if the Secretary determines that including or excluding the individual or entity would be beneficial to increasing the deployment and accessibility of electric vehicle charging infrastructure in underserved or disadvantaged communities. </text></paragraph></subsection><subsection id="id241d0268f6d343009b82ab4e96990321"><enum>(c)</enum><header>Cost share</header><paragraph id="idbf8b5158a5a24c15bd5e06fcdb09014f"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amount of a grant awarded under this section for a project shall not exceed 80 percent of the costs of the project.</text></paragraph><paragraph id="id75dc829720a448f585109aab3e6ff34e"><enum>(2)</enum><header>Single-family homes</header><text>The amount of a grant awarded under this section for a project that involves, as a primary focus, single-family homes shall not exceed 60 percent of the costs of the project.</text></paragraph></subsection><subsection id="id66ba8134b2f84011a4146754d7f6b95f"><enum>(d)</enum><header>Limitation</header><text>Not more than 15 percent of the total amount of grants awarded under this section each fiscal year may be awarded for projects that involve, as a primary focus, single-family homes.</text></subsection><subsection id="id78c97403da7342129894bac6bfcbeb25"><enum>(e)</enum><header>Priority</header><text>In awarding grants and providing technical assistance under this section, the Secretary shall give priority to projects that—</text><paragraph id="idf0d89a85ef2f4d10b627852747e06f47"><enum>(1)</enum><text>provide the greatest benefit to the greatest number of people within an underserved or disadvantaged community;</text></paragraph><paragraph id="id047ef562d16246dea6e19fb8b85a246d"><enum>(2)</enum><text>incorporate renewable energy resources;</text></paragraph><paragraph id="id3ae5d4982c7b47bea28f1aaa1a6a82de"><enum>(3)</enum><text>maximize local job creation, particularly among low-income, women, and minority workers; or</text></paragraph><paragraph id="id8d239c10e34d4f13b6a687e4aa912368"><enum>(4)</enum><text>utilize or involve locally owned small and disadvantaged businesses, including women- and minority-owned businesses.</text></paragraph></subsection><subsection id="idcd7fd5af83774ff8888ae99791bc3cf7"><enum>(f)</enum><header>Public notice and request for applications</header><text>The Secretary shall publish in the Federal Register and such other publications as the Secretary considers to be appropriate a notice and request for applications to carry out projects under the EV Charging Equity Program.</text></subsection><subsection id="id9d12e6b425d0475eaecad3071d274be9"><enum>(g)</enum><header>Education and outreach</header><paragraph id="idd6b6654e2d8f4ef3933d95990a1c70d7"><enum>(1)</enum><header>In general</header><text>In carrying out the EV Charging Equity Program, the Secretary shall establish an education and outreach campaign to ensure that information regarding the program and the benefits of, and opportunities for, electric vehicle charging infrastructure is made available to individuals and relevant entities that live within or serve underserved or disadvantaged communities.</text></paragraph><paragraph id="idad9541defaf14026a758d3dbe6c4a8a5"><enum>(2)</enum><header>Requirements</header><text>At a minimum, the education and outreach campaign established under this subsection shall include—</text><subparagraph id="id33ce0faed9594f768697ab74ecc9d8ed"><enum>(A)</enum><text>the development and dissemination of an electric vehicle charging resource guide that is—</text><clause id="id1f80472dcb90430ebb9eb8b249265021"><enum>(i)</enum><text>maintained electronically on a website;</text></clause><clause id="ida0ab893a9a404d06a27acdc46ac56523"><enum>(ii)</enum><text>available to the public, free of charge; and</text></clause><clause id="id6028ded6f5c7434280c59fe1daeae888"><enum>(iii)</enum><text>directed specifically toward individuals and relevant entities that live within or serve underserved or disadvantaged communities;</text></clause></subparagraph><subparagraph id="id5fd5a32b6145429bbedbd0b5e408be3f"><enum>(B)</enum><text>targeted outreach toward, and coordinated public outreach with, relevant State, local, and Tribal entities, nonprofit organizations, and institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that are located within or serve underserved or disadvantaged communities; and</text></subparagraph><subparagraph id="idef4271212af246a6b6dbcb0cdb5e4e02"><enum>(C)</enum><text>any other forms of education or outreach that the Secretary determines to be appropriate to increase awareness of, and access to, the EV Charging Equity Program.</text></subparagraph></paragraph></subsection><subsection id="idfe9a15b906e1475185b2490691827864"><enum>(h)</enum><header>Reports to congress</header><text>Not later than 1 year after the date on which the EV Charging Equity Program is established under this section, and not less frequently than once every 2 years thereafter, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives and make publicly available a report on the status of the EV Charging Equity Program, including—</text><paragraph id="idF1D3FEADBA6C49FEAE4E5BB60901E4EB"><enum>(1)</enum><text>a list and description of projects for which a grant or technical assistance has been provided under this section; and</text></paragraph><paragraph id="id4A007D0FFA1140C8904B3EA3C7D71CF5"><enum>(2)</enum><text>a description of the amount of funding or assistance provided with respect to each of those projects.</text></paragraph></subsection><subsection id="id02848120613945d8bf5c50f9156b3d89"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $96,000,000 for each of fiscal years 2021 through 2030.</text></subsection></section><section id="H52FE9C1A1DC149C6A8DC7B6A75B52470"><enum>5.</enum><header>Ensuring program benefits for underserved and disadvantaged communities</header><text display-inline="no-display-inline">In administering a relevant program, the Secretary, to the maximum extent practicable, shall invest or direct available and relevant programmatic resources to ensure that each relevant program—</text><paragraph id="idE720E79E180E41938D74B1F4E80CE7A7"><enum>(1)</enum><text display-inline="yes-display-inline">promotes electric vehicle charging infrastructure; </text></paragraph><paragraph id="id3F00028D97D1420B9E4D97DF487232AB"><enum>(2)</enum><text display-inline="yes-display-inline">supports clean and multi-modal transportation;</text></paragraph><paragraph id="id3D3B61D8323642AA81B1733872E5D847"><enum>(3)</enum><text display-inline="yes-display-inline">provides improved air quality and emissions reductions; and</text></paragraph><paragraph id="id43B1521F3C3D4E07AC050D39B45228B9"><enum>(4)</enum><text display-inline="yes-display-inline">prioritizes the needs of underserved or disadvantaged communities.</text></paragraph></section></legis-body></bill>
