<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5076</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221114">November 14, 2022</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself, <cosponsor name-id="S380">Mr. Peters</cosponsor>, and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require training for employees of Federal agencies that award less than 3 percent of prime contracts to small business concerns owned and controlled by service-disabled veterans, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service-Disabled Veteran Opportunities in Small Business Act</short-title></quote>.</text></section><section id="id6DD8DB3BE8D946EFAA396E11D148FA9E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1F9A7A17DA774EAA957748C840E267D7"><enum>(1)</enum><header>Administration; Administrator</header><text>The terms <term>Administration</term> and <term>Administrator</term> mean the Small Business Administration and the Administrator thereof, respectively.</text></paragraph><paragraph id="id392A9C4F33594BA186D37CD0CCC09F8F"><enum>(2)</enum><header>Small business concern owned and controlled by service-disabled veterans</header><text>The term <term>small business concern owned and controlled by service-disabled veterans</term> has the meaning given the term in section 3(q) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(q)</external-xref>).</text></paragraph></section><section id="id1DE2E4875F834F59A328F038C1F09B66"><enum>3.</enum><header>Federal contracting opportunities for small business concerns owned and controlled by service-disabled veterans</header><subsection id="id44E75417436D42C990B3F2052527BEBA"><enum>(a)</enum><header>Required training</header><text>Notwithstanding the goals established under section 15(g)(1)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(1)(A)</external-xref>) for each Federal agency, the Administration, in consultation with the Office of Veterans Business Development of the Administration, shall provide training to employees with responsibility for procurement or acquisition at any Federal agency that awards less than 3 percent of prime contracts and subcontracts to small business concerns owned and controlled by service-disabled veterans in a fiscal year.</text></subsection><subsection id="id925F6A4349F64C2AB08D7BD8CD16D189"><enum>(b)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Office of Veterans Business Development of the Administration, shall issue publicly available guidance for each Federal agency that is required to meet the goal under section 15(g)(1)(A)(ii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(1)(A)(ii)</external-xref>).</text></subsection><subsection id="id79648193D5F34C40BE3F53DB77F12765"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administration shall submit to Congress a report detailing, for the fiscal year covered by the report—</text><paragraph id="id60460a849f094886afd4f78356b0d714"><enum>(1)</enum><text>a list of each Federal agency that awarded less than the 3 percent of the prime contracts and subcontracts required under section 15(g)(1)(A)(ii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(1)(A)(ii)</external-xref>);</text></paragraph><paragraph id="id8636c978334b4b709482bab4d7a3a89c"><enum>(2)</enum><text>the number of training sessions provided by each such Federal agency under subsection (a);</text></paragraph><paragraph id="idb2b89e5d416847f7b85763ba93f12b15"><enum>(3)</enum><text>an overview of the content included in those training sessions; and</text></paragraph><paragraph id="id386d45de934641029b17f5d6fbb2ed32"><enum>(4)</enum><text>whether additional contracting opportunities were provided to small business concerns owned and controlled by service-disabled veterans. </text></paragraph></subsection></section></legis-body></bill>
