which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Clean School Bus Grant Program, and for other purposes.</official-title></form><legis-body><section id="id7E35C6A051714FBDB7695A87940F55B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean School Bus Act of 2021</short-title></quote>.</text></section><section id="id495195ED6CD3488399FB9A584F065280"><enum>2.</enum><header>Clean School Bus Grant Program</header><subsection id="IDA2CF2EE675EF4CB89C4FFC1BDBE83620"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida4401139fe9744fb875ee2d73ea0ff2e"><enum>(1)</enum><header>Electric school bus</header><text>The term <term>electric school bus</term> means a school bus that is propelled—</text><subparagraph id="ide8aab01503de4b85a15f190a178f729a"><enum>(A)</enum><text>to a significant extent by an electric motor that—</text><clause id="id217a4388df7f47c2836a77744aae8d72"><enum>(i)</enum><text>draws electricity from a battery; and</text></clause><clause id="idef7e4f83f0d64a8594935f31b6e79d00"><enum>(ii)</enum><text>is capable of being recharged from an external source of electricity;</text></clause></subparagraph><subparagraph id="idCADDE057B0BB4223B3C64D648299DB14"><enum>(B)</enum><text>by any necessary components or equipment required to facilitate electric school bus operations; or</text></subparagraph><subparagraph id="id691bd55810ad46eea644c8407bc11ae3"><enum>(C)</enum><text>by 1 or more hydrogen fuel cells.</text></subparagraph></paragraph><paragraph id="ID9D671145FCE942A592F700495710D55A"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="IDC3D1B40A86514287AACD3AAF20D2875A"><enum>(A)</enum><text>1 or more local, regional, or State governmental entities, including a local educational agency, responsible for—</text><clause id="IDE07CB324922642BC929FDD870DA52BCB"><enum>(i)</enum><text>providing school bus service to 1 or more local educational agencies; or</text></clause><clause id="ID9B2B7C7C9908453DBBDBD98F94E8C843"><enum>(ii)</enum><text>purchasing school buses for use by 1 or more local educational agencies;</text></clause></subparagraph><subparagraph id="ID55671CF83BC241839405C0536964BBD7"><enum>(B)</enum><text>1 or more contracting entities that provide school bus service to 1 or more local educational agencies;</text></subparagraph><subparagraph id="ID7B13B51EBF9B48EBA287518FFB86C130"><enum>(C)</enum><text>a nonprofit school transportation association that provides school bus service to 1 or more local educational agencies; or</text></subparagraph><subparagraph id="idF7BEB6D6A92D4E9CBC34CEEC4945FCC8"><enum>(D)</enum><text>a tribally controlled school (as defined in section 5212 of the Tribally Controlled Schools Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/25/2511">25 U.S.C. 2511</external-xref>)).</text></subparagraph></paragraph><paragraph id="idFF5EBBF6C0BD4943AE1AEF84EC7F3189"><enum>(3)</enum><header>Fuel cell</header><text>The term <term>fuel cell</term> has the meaning given the term in section 803 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16152">42 U.S.C. 16152</external-xref>).</text></paragraph><paragraph id="id18363E1E154949B79D9D9D2200135F62"><enum>(4)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="id7850300D91BD4157A05ECACD1313994F"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the Clean School Bus Grant Program established under subsection (b)(1).</text></paragraph><paragraph id="id027CF3D423E946CCA6E347BC403FDD13"><enum>(6)</enum><header>School bus</header><text>The term <term>school bus</term> has the meaning given the term <quote>schoolbus</quote> in section 30125(a) of title 49, United States Code.</text></paragraph><paragraph id="idA9C6C04FDC794878873C2FDD34F5BD48"><enum>(7)</enum><header>Scrap</header><subparagraph id="id5F2B051FB88D4F6499650CA7EDDFDFC2"><enum>(A)</enum><header>In general</header><text>The term <term>scrap</term> means, with respect to a school bus engine replaced using funds awarded under the program, to recycle, crush, shred, or otherwise disable the engine within such period and in such manner as determined by the Secretary.</text></subparagraph><subparagraph id="id052354fdbdcd4850ab384a5ca820605f"><enum>(B)</enum><header>Exclusion</header><text>The term <term>scrap</term> does not include selling, leasing, exchanging, or otherwise disposing of an engine described in subparagraph (A) for use in another motor vehicle in any location.</text></subparagraph></paragraph><paragraph id="idA9266562DC8C43CF8F147CF30D2FD1CB"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="idC32DCB16357E4C2592F4DB03DCF92BF7"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="idD5A2559057CD4B139E32539201F60E42"><enum>(A)</enum><text>each of the several States of the United States;</text></subparagraph><subparagraph id="id53FABBAA97074D149C90BB07D6AA80A8"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="idFB838D49290D4AAFB2ED9299C7EC6B7E"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph></subsection><subsection id="ID8A6AEB9C69E240618716935F593E794B"><enum>(b)</enum><header>Clean School Bus Grant Program</header><paragraph id="ID23F7E4A9DADD42E0AE3EE2E7F0A16B16"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish in the Office of Energy Efficiency and Renewable Energy of the Department of Energy a program, to be known as the <quote>Clean School Bus Grant Program</quote>, for awarding grants on a competitive basis to eligible entities for the replacement of certain existing school buses.</text></paragraph><paragraph commented="no" id="idFA1C556961C849598463F985B08F826A"><enum>(2)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall require, including—</text><subparagraph commented="no" id="idF21C086D93484B60849CE6B5874EAF65"><enum>(A)</enum><text>a certification that no public work or service normally performed by a public employee will be privatized or subcontracted in carrying out a project under the grant; and</text></subparagraph><subparagraph commented="no" id="id5C8485CD5864468CAE958160EA0DFE50"><enum>(B)</enum><text>to ensure a fair assessment of total workforce impact, a detailed accounting of the workforce of the eligible entity at the time of application, including—</text><clause commented="no" id="id2E88ED377D9A4E1D9FC2DB2137C90FD5"><enum>(i)</enum><text>the number of employees, organized by salary;</text></clause><clause commented="no" id="id24E270A2989749439A942F071F610A10"><enum>(ii)</enum><text>the bargaining unit status of each employee;</text></clause><clause commented="no" id="id401EFA6AB35746F39431AEB0007E923C"><enum>(iii)</enum><text>the full- or part-time status of each employee; and</text></clause><clause commented="no" id="idE1C3122AB0514D20B4AE14CB7E87B2DE"><enum>(iv)</enum><text>the job title of each employee.</text></clause></subparagraph></paragraph><paragraph id="IDF5441DBF123E4FDFAD3FB61C0227B23C"><enum>(3)</enum><header>Priority of grant applications</header><subparagraph id="id563E5123EB2C43F8ACD25BD1230517E7"><enum>(A)</enum><header>In general</header><text>The Secretary shall give priority to eligible entities—</text><clause id="id4E287684A9F34526B55F52902587D5E9"><enum>(i)</enum><text>that have significant aging, inefficient, or high emission bus fleets that need improvement;</text></clause><clause id="id9d5b57850d78420eb3468eaf019346ac"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idD2F790A13C254030AC267543DAC9D50A"><enum>(I)</enum><text>that serve a high percentage of students from low-income families, as determined by the Secretary using data from the Small Area Income and Poverty Estimates Program of the Bureau of the Census; and</text></subclause><subclause id="H002D99359D9F4CB2B42197E3190BF7D7" indent="up1"><enum>(II)</enum><text>with a participating local educational agency designated with a school district locale code of 41, 42, or 43, as determined by the National Center for Education Statistics in consultation with the Bureau of the Census; or</text></subclause></clause><clause id="idBA49154DCEBD4490B56D8EE0A6A41FCC" commented="no"><enum>(iii)</enum><text>that propose projects that will most reduce emissions, as described in subparagraph (B).</text></clause></subparagraph><subparagraph id="id8FEC153785C44110BCE5183B7891A0D4"><enum>(B)</enum><header>Most emissions-reducing projects described</header><text>The projects that will most reduce emissions referred to in subparagraph (A)(iii) are projects that—</text><clause id="idD76A66C31D5545D6939DB20ED68E4329"><enum>(i)</enum><text>will replace the most polluting diesel school buses with the cleanest running electric school buses, as indicated by—</text><subclause id="id342c7b2787384094a68179937b41035f"><enum>(I)</enum><text>the age of the school buses to be replaced;</text></subclause><subclause id="ida43dabab3d234135bed39b845a21f6be"><enum>(II)</enum><text>the emissions control technologies on the school buses to be replaced;</text></subclause><subclause id="id37757250961d46d6b05f3da3fdc44e3a"><enum>(III)</enum><text>the annual vehicle miles traveled by the school buses to be replaced;</text></subclause><subclause id="id76B60CA6865E4733A71C4CA3C91EA064"><enum>(IV)</enum><text>the source of electricity or hydrogen used to power the electric school buses; and</text></subclause><subclause id="id0f2fd153ebe248afbf041567e8e70825"><enum>(V)</enum><text>any other factors the Secretary determines to be relevant; or</text></subclause></clause><clause id="id90f0223bdbf5409083f003c7e525d120"><enum>(ii)</enum><text>will complement the use of grant funds through other activities that—</text><subclause id="idc549d97fb6ab41b68c5cc97bcffe5c75"><enum>(I)</enum><text>will enable broader deployment of electric vehicles, such as securing additional sources of funding through public-private partnerships with utilities, grants from other entities, or issuance of school bonds; or</text></subclause><subclause id="idB5E174F251884CB0BE91DAEB7369CDF0"><enum>(II)</enum><text>will achieve further reductions in emissions, such as installing solar panels as part of recharging infrastructure to power electric school buses purchased with grant funds.</text></subclause></clause></subparagraph><subparagraph id="id5B6FF65067B2419E8004FF6E03581AC9"><enum>(C)</enum><header>Additional criteria for consideration</header><text>With respect to eligible entities seeking a grant to purchase electric school buses under the program, the Secretary may consider, in addition to the information included in the application submitted under paragraph (2)—</text><clause id="id73ccc5018dd5429eb293b054d16ba2ad"><enum>(i)</enum><text>whether the grant will benefit students in a region that is in nonattainment of a national ambient air quality standard under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>);</text></clause><clause id="id3aeb4c39485242e7a9e7c3386e127d34"><enum>(ii)</enum><text>whether the eligible entity, or whether the local educational agency that would be served by the eligible entity, has taken other action to reduce emissions during the transportation of students, such as instituting a no-idling policy; and</text></clause><clause id="id0592E600ABB34FAE8DF91BF20C6F3064"><enum>(iii)</enum><text>whether the eligible entity serves geographic locations with potential barriers to the use of an electric school bus, including—</text><subclause id="id30C75B70553B44BE82B7F538E90D664A"><enum>(I)</enum><text>significant weather events; and </text></subclause><subclause id="id4BF0490A381D4155A1BD2102753037DE" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>distance challenges and limitations.</text></subclause></clause></subparagraph></paragraph><paragraph id="IDE75CA44ADE174F8798D756A0652C2CDB"><enum>(4)</enum><header>Use of school bus fleet</header><text>Each electric school bus acquired or leased with funds provided under the program—</text><subparagraph id="id65F8DB9D26694DD3B8B63D8423B02FD0"><enum>(A)</enum><text>shall be operated as part of the school bus fleet for which the grant was made for not less than 5 years;</text></subparagraph><subparagraph id="id9FB3050FAE44481E910703C0285D1D32"><enum>(B)</enum><text>shall be maintained, operated, and charged according to manufacturer recommendations or State requirements; and</text></subparagraph><subparagraph id="idC861E3A1AC0346F7A88728A08D551ADA"><enum>(C)</enum><text>may not be manufactured or retrofitted with, or otherwise have installed, a power unit or other technology that creates air pollution within the school bus, such as an unvented diesel passenger heater.</text></subparagraph></paragraph><paragraph id="id2aa9d8ee222842ea8d87f20f351e2d3c"><enum>(5)</enum><header>Grant awards</header><subparagraph id="idf8b773b0cdda4d8290b689342797242d"><enum>(A)</enum><header>In general</header><text>The Secretary may use funds made available to carry out the program—</text><clause id="id22013840f9bc4d728167c7e46fff37e6"><enum>(i)</enum><text>to award grants for—</text><subclause id="idb517eaa758c74333a8de2bf85680ba00"><enum>(I)</enum><text>the replacement of existing diesel school bus fleets with electric school buses;</text></subclause><subclause id="id462aea9cd0b940cbb3de85deb956d254"><enum>(II)</enum><text>the implementation of recharging infrastructure or other infrastructure, including renewable energy generation infrastructure, needed to charge or maintain electric school buses;</text></subclause><subclause id="id880bead422ba4ac7adf7a2994297b864"><enum>(III)</enum><text>workforce development and training, to support the maintenance, charging, and operations of electric school buses; and</text></subclause><subclause id="id41E97E7B96B84F4F81B28A2D32619DB8"><enum>(IV)</enum><text>planning and technical activities to support the adoption and implementation of electric school buses; and</text></subclause></clause><clause id="id1136437ba78241c7a33d3168ebb69af1"><enum>(ii)</enum><text>to develop resources to inform, encourage, and support eligible entities in applying for and fulfilling the requirements of grants awarded under the program, including materials to support the workforce development and training described in clause (i)(III) and the planning and technical activities described in clause (i)(IV).</text></clause></subparagraph><subparagraph id="id1aad2d685ae04cd0bc2f259406980fa1"><enum>(B)</enum><header>Requirements</header><text>In order to receive a grant under the program, the Secretary shall—</text><clause id="idcb506d5604864354bf0ecfc7e38fa8b2"><enum>(i)</enum><text>require that grant recipients—</text><subclause id="id920d015e1b7e43f795dc841cb34bb7aa"><enum>(I)</enum><text>replace diesel school buses with electric school buses;</text></subclause><subclause id="id82903ec6dbd3457fb7e9a7b6bd246ef5"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idF11736A3CF6544249F72CA662D7A732B"><enum>(aa)</enum><text>not later than 1 year after receiving the electric school bus purchased using a grant under the program, scrap the diesel engine of the school bus being replaced; or</text></item><item id="id586C3C541AD642D39A0E9555FB5E8777" indent="up1"><enum>(bb)</enum><text>receive a waiver under paragraph (6);</text></item></subclause><subclause id="idB568C9F1D9F743B2A6CF9CC3CEB758C8"><enum>(III)</enum><text>do not, as a result of receiving the grant—</text><item id="id0371A8F4247D4D5589650A6577567806"><enum>(aa)</enum><text>lay off, transfer, or demote any current employee; or</text></item><item id="id8928381D7F5745D4864BFBA11E1BF447"><enum>(bb)</enum><text>reduce the salary or benefits of any current employee or worsen the conditions of work of any current employee; and</text></item></subclause><subclause id="id0F730E13CF124D4DAB76243C63003E79"><enum>(IV)</enum><text>provide current employees with training to effectively operate, maintain, or otherwise adapt to new technologies relating to electric school buses; and</text></subclause></clause><clause id="idb7bba60f082749ecbcf95927ee38b88a"><enum>(ii)</enum><text>permit grant recipients to receive and retain any funds or benefits received from—</text><subclause id="idfbab809c81ed449299bae6f01dc381c5"><enum>(I)</enum><text>scrapping a diesel engine;</text></subclause><subclause id="id8F4845070D064AB8AAA56570ACD914B3"><enum>(II)</enum><text>transferring or repurposing a diesel school bus as authorized under a waiver under paragraph (6); and</text></subclause><subclause id="idaf41cf297aaa440cb323934901c7f145"><enum>(III)</enum><text>the resale or reuse of other parts of a school bus replaced using grant funds.</text></subclause></clause></subparagraph><subparagraph id="id275199b672854f2594f374f97f5c92fc"><enum>(C)</enum><header>Grant amounts</header><clause commented="no" display-inline="no-display-inline" id="id8599186DC95B44DC9ABF981F0253F3A6"><enum>(i)</enum><header display-inline="yes-display-inline">Maximum amount</header><text display-inline="yes-display-inline">For each eligible entity that submits an application under paragraph (2), the maximum amount of a grant under the program is $2,000,000.</text></clause><clause id="idc1ddc582c2424022938a095300a80843"><enum>(ii)</enum><header>Amounts for purchase of electric school buses</header><subclause id="id137737142C494DC684A907FFEC05463C"><enum>(I)</enum><header>In general</header><text>For any grant under the program, the amount of funds awarded for the purchase of an electric school bus shall not exceed 110 percent of the amount equal to the difference between—</text><item id="idbc4c0bc6ee664f12ac85e6f764eaebd6"><enum>(aa)</enum><text>the cost of an electric school bus; and</text></item><item id="id1667933c67b5483d8fed5af860090b8e"><enum>(bb)</enum><text>the cost of a diesel school bus.</text></item></subclause><subclause id="id876a1ac6d4cf40c68ad27efb3ee8fae6"><enum>(II)</enum><header>Determination of cost of school buses</header><text>In determining the amount of funds under subclause (I), the Secretary may determine the cost of a school bus for the purpose of calculating the marginal cost under that subclause through—</text><item id="idbddbef6e333b476aa4c5c84f8ffbd9dc"><enum>(aa)</enum><text>a competitive solicitation process for the manufacture of the school bus;</text></item><item id="id59AE1D49E6FF4E3A84E000C453D4E82F"><enum>(bb)</enum><text>a cooperative purchase agreement permitted by the laws of the State in which the grant recipient is located; or</text></item><item id="idaa67c216bd9c4f729a5724a408b606a0"><enum>(cc)</enum><text>another method that the Secretary determines to be appropriate.</text></item></subclause></clause><clause id="id96a2e5a510f5427a9b8c834e8c558edd"><enum>(iii)</enum><header>Amounts for supporting activities</header><text>For any grant under the program, the amount of funds awarded for the purposes described in subclauses (II) through (IV) of subparagraph (A)(i), or other purposes related to those subclauses, as determined by the Secretary, shall not exceed $600,000.</text></clause></subparagraph><subparagraph id="id3f33b2dc7e8f4149a50b8df2006649e4"><enum>(D)</enum><header>Buy america</header><clause id="id7de8f80125b144b2b7631c67699fb609"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), any electric school bus purchased using funds awarded under the program shall comply with the requirements described in section 5323(j) of title 49, United States Code.</text></clause><clause id="iddfa183899d564fa4a695c9073d9ee545"><enum>(ii)</enum><header>Exceptions</header><subclause id="idbabb0ff7ef924b568d020d898c43cbaf"><enum>(I)</enum><header>Waiver</header><text>The Secretary may provide any waiver to the requirements described in clause (i) in the same manner and to the same extent as the Secretary of Transportation may provide a waiver under section 5323(j)(2) of title 49, United States Code.</text></subclause><subclause id="id915d482a093742ffbd9c952578d3441f"><enum>(II)</enum><header>Percentage of components and subcomponents</header><text>The Secretary may grant a waiver in accordance with section 5323(j)(2)(C) of title 49, United States Code, when a grant recipient procures an electric school bus using funds awarded under the program for which the cost of components and subcomponents produced in the United States, for fiscal year 2022 and each fiscal year thereafter, is more than 70 percent of the cost of all components of the school bus.</text></subclause></clause></subparagraph></paragraph><paragraph id="idFD262B2840DE4915A522C4603C5582C8"><enum>(6)</enum><header>Waiver</header><text>On request of a grant recipient, the Secretary may grant a waiver under paragraph (5)(B)(i)(II)(bb) to authorize a grant recipient—</text><subparagraph id="id560CB4E79BBA4223ADED9B1C037FEC99"><enum>(A)</enum><text>to transfer a diesel school bus replaced using grant funds under the program under an agreement—</text><clause id="id37C004D958324B95A97663DBAF00F077"><enum>(i)</enum><text>between—</text><subclause id="id1A31DB292D3C43988CB8C5AD749E2F93"><enum>(I)</enum><text>the grant recipient; and</text></subclause><subclause id="idA79513F675C2464B9F63947BE072701F"><enum>(II)</enum><text>an entity described in subsection (a)(2) that serves an area that is in attainment of national ambient air quality standards under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.);</text></subclause></clause><clause id="idE24CE39B8A9C435ABC383E7F16292C2A"><enum>(ii)</enum><text>that provides that—</text><subclause id="id1ECA7E510C9B40B2832B28A8F68F8282"><enum>(I)</enum><text>not later than 1 year after the transfer subject to the agreement, the entity receiving a school bus from the grant recipient will scrap a number of diesel engines of school buses that is equal to the number of school buses being received; and</text></subclause><subclause id="id8EC406543A81426EBF391709EDB2C526"><enum>(II)</enum><text>any diesel engines described in subclause (I) are older and more polluting than the diesel engines in the school buses being received; and</text></subclause></clause><clause id="idB1D69721837C4AC2A8845656FF9A1137"><enum>(iii)</enum><text>provided to the Secretary; or</text></clause></subparagraph><subparagraph id="idA87109A6AD154EBD928FEC810B66660B"><enum>(B)</enum><text>to delay the requirement under paragraph (5)(B)(i)(II)(aa) for not more than 3 years after receiving the school bus purchased using a grant under the program for the purpose of using the school bus being replaced for a use determined by the Secretary to be appropriate.</text></subparagraph></paragraph><paragraph id="ID71A9C0FCB67D40798A5CC766277449ED"><enum>(7)</enum><header>Deployment and distribution</header><text>In carrying out the program, the Secretary shall, to the maximum extent practicable—</text><subparagraph id="ID404F3735752C43119DE7908407BB144F"><enum>(A)</enum><text>achieve nationwide deployment of electric school buses through the program; and</text></subparagraph><subparagraph id="ID2D289859B65348A7ACF73FAEE6C2AF02"><enum>(B)</enum><text>ensure a broad geographic distribution of grant awards, with no State receiving more than 15 percent of the grant funding made available to carry out the program for each fiscal year.</text></subparagraph></paragraph><paragraph id="ID47ED8801AEAB4AB980F2336C164D9B76"><enum>(8)</enum><header>Annual reporting</header><subparagraph id="idE643BB32887B4B8BA4AAAD0A37371E67"><enum>(A)</enum><header>Data release</header><text>The Secretary shall make available to the public on the website of the Department of Energy a downloadable electronic database of information with respect to each grant made under the program, including—</text><clause id="id17B0D0CD6B104E47952F7D94BBD44B10"><enum>(i)</enum><text>the name and location of the grant recipient;</text></clause><clause id="id4CC12911FC84440A841FF80B7C9A5C6F"><enum>(ii)</enum><text>the school district served by the grant recipient, if the grant recipient is not a school district;</text></clause><clause id="id4014C7AA7D0348A48D9DE4B91A36FEC2"><enum>(iii)</enum><text>the criteria that the grant recipient met under subparagraphs (B) and (C) of paragraph (3), if any;</text></clause><clause id="id611ABC4335444CB2992637E29A8BFB58"><enum>(iv)</enum><text>the grant amount, including a description of the amounts of the grant used for—</text><subclause id="id1B13D0E172804BDA80A1727B1BE92935"><enum>(I)</enum><text>the purchase of electric school buses;</text></subclause><subclause id="id2819724A9FD342F4A3C636BB3696C56D"><enum>(II)</enum><text>the purchase of infrastructure;</text></subclause><subclause id="idAD81776DE4D840D9AB94C84276DF823E"><enum>(III)</enum><text>workforce development;</text></subclause><subclause id="id74327E31F792493C9A461F2219D17F56"><enum>(IV)</enum><text>the purchase of hydrogen or electricity; and</text></subclause><subclause id="id7549304853F94CAA96907DCF1C91D621"><enum>(V)</enum><text>any other purpose;</text></subclause></clause><clause id="id393019E0C9AE4682A1E7FBF9D70184E5"><enum>(v)</enum><text>with respect to an electric school bus purchased using a grant under the program, the number, make and model, year of make, cost, estimated annual vehicle miles to be traveled, and estimated number of students to be transported per day, as provided by the eligible entity awarded the grant;</text></clause><clause id="id0A8B3B5BDA3244B39FFD9B75AE3D9894"><enum>(vi)</enum><text>with respect to a school bus replaced using a grant under the program, the number, make and model, year of make, fuel type, annual vehicle miles traveled, and the average number of students transported per day, as provided by the eligible entity awarded the grant;</text></clause><clause id="id414F7900DA0644F295D3648906539927"><enum>(vii)</enum><text>whether the grant recipient received a waiver under paragraph (6) and, if the grant recipient received such a waiver, with respect to a school bus scrapped by the receiving entity described in paragraph (6)(A), the number, make and model, year of make, fuel type, type of school bus, annual vehicle miles traveled, and the average number of students transported per day, as provided by the eligible entity awarded the grant;</text></clause><clause id="id79650134F2FE41B288FF330FB367993F"><enum>(viii)</enum><text>an estimate of the local air pollution emissions and global greenhouse gas emissions avoided as a result of the grant; and</text></clause><clause id="id754ED01D0176491BAD798E8E0BC74AB1"><enum>(ix)</enum><text>any other data determined by the Secretary to enable an analysis of the use and impact of grants under the program.</text></clause></subparagraph><subparagraph id="id91D82576C44048E18C72A77F582A2FE6"><enum>(B)</enum><header>Report to Congress</header><text>Not later than January 31 of each year, the Secretary shall submit to Congress and make available on the website of the Department of Energy a report that describes—</text><clause id="id4B38DEBB66A449599A2A7610143B60FF"><enum>(i)</enum><text>the grant applications received under the program, including a summary of the grant applications meeting the criteria described in subparagraphs (B) and (C) of paragraph (3), if any;</text></clause><clause id="id87DD75BF15FB4D84865BF3301733D203"><enum>(ii)</enum><text>the grants awarded under the program, including a summary of the data described in subparagraph (A);</text></clause><clause id="id36C7FF9406544688A7E1CE5368F76E9C"><enum>(iii)</enum><text>the effect of the receipt of the grant on students, schools, local communities, industry, and the workforce;</text></clause><clause id="id5C0375963E964E339B80D6A1E90F7614"><enum>(iv)</enum><text>the impact of the awarded grants on local air pollution and greenhouse gas emissions; and</text></clause><clause id="id7D932522569B4A9A9A2450E487979C4F"><enum>(v)</enum><text>any other information determined by the Secretary to enable Congress to understand the implementation, outcomes, and effectiveness of the program.</text></clause></subparagraph><subparagraph id="id39adb4294c6d4e998c28d33c545ca638"><enum>(C)</enum><header>Report on Buy America waivers</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit a report describing any waiver granted under paragraph (5)(D)(ii)(I) during the preceding year to—</text><clause id="idee2da304039d43ff8332178d2fc0c814"><enum>(i)</enum><text>the Committee on Environment and Public Works of the Senate;</text></clause><clause id="id0D1B58C33DA64911BF818F9B0A1BBD13"><enum>(ii)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause><clause id="id32D92098188043A599F3B7CCE006E608"><enum>(iii)</enum><text>the Committee on Appropriations of the Senate;</text></clause><clause id="id80d33a8dff864e948ae7cd634c1e2ffa"><enum>(iv)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives;</text></clause><clause id="id2BE834BBE5864F70A7CC3F0DBF35E7DE"><enum>(v)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></clause><clause id="id595BFEC620B84ADDB0DA1DEC43FDA2A2"><enum>(vi)</enum><text>the Committee on Appropriations of the House of Representatives.</text></clause></subparagraph></paragraph></subsection><subsection id="ID582892F79EF14E21B7712252D7CBDB17"><enum>(c)</enum><header>Education</header><paragraph id="IDB108984267A643C79461D7C2C24C1781"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after funds are appropriated to carry out the Program, the Secretary shall develop an education outreach campaign to promote and explain the program.</text></paragraph><paragraph id="IDA60D0946EEA549DE9E8852D72BDBC4BF"><enum>(2)</enum><header>Coordination with stakeholders</header><text>The outreach campaign under this subsection shall be designed and conducted in conjunction with national school bus transportation associations, educators, local educational agencies, school bus drivers, school bus leasing or contracting operators, the school bus manufacturing and supply industries, and other stakeholders.</text></paragraph><paragraph id="IDB9EA8A6B309642FBBDDA64DA49FFA85D"><enum>(3)</enum><header>Components</header><text>The outreach campaign under this subsection shall—</text><subparagraph id="ID065C5C14E5984C80A4F2D5738635F2E0"><enum>(A)</enum><text>inform eligible entities of the process of applying for grants;</text></subparagraph><subparagraph id="ID02EAB0007F214C00B769A0605705A7AC"><enum>(B)</enum><text>describe the available technologies and the benefits of the technologies;</text></subparagraph><subparagraph id="IDAAA870962FD042BB81C5BBEA5A00298E"><enum>(C)</enum><text>explain the benefits of participating in the program;</text></subparagraph><subparagraph id="idBCDBC67FD4344EAC9BFCA690554B6952"><enum>(D)</enum><text>facilitate the sharing of best practices and lessons learned among grant recipients and between grant recipients and eligible entities; and</text></subparagraph><subparagraph id="ID12D4CA61811A4FF4965C820F2688AED1"><enum>(E)</enum><text>include, as appropriate, information from the annual reports required under subsection (b)(8).</text></subparagraph></paragraph></subsection><subsection id="id5EA1176479B64DA480BE85267597C6D4"><enum>(d)</enum><header>Cost sharing</header><text>The Secretary shall not require cost sharing for any project carried out using a grant awarded under the program.</text></subsection><subsection id="ID626FC84416E6493A980F4777A5328A11"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program $200,000,000 for each of fiscal years 2022 through 2027, to remain available until expended.</text></subsection></section></legis-body></bill>
