which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Abuse Prevention and Treatment Act to require mandatory reporting of incidents of child abuse or neglect, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H83C1005A3BC14978BEE4026740CE80BC"><section section-type="section-one" id="H664D6F9222AE488797E2CF46A682EAD2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Speak Up to Protect Every Abused Kid Act</short-title></quote>.</text></section><section id="H56C172D20F554E7A8E6485036059FC0D"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H6D88BA5D97824AAC8F60E2AB38B39B71"><enum>(1)</enum><text display-inline="yes-display-inline">children are dependent on the adults in their lives, including parents, extended family, teachers, health care providers, and others in their community, to ensure their safety and well-being;</text></paragraph><paragraph id="H55167D3FB7F6478992904B48D85F9C8F"><enum>(2)</enum><text display-inline="yes-display-inline">data from the Administration on Children and Families for 2016 indicate that 671,622 children in the United States were reported as being victims of child abuse or neglect, and 1,447 of those children died as a result of such abuse or neglect;</text></paragraph><paragraph id="H99BFC2992BEC41148F382EE4C4C15D80"><enum>(3)</enum><text display-inline="yes-display-inline">regardless of whether an adult is legally required to report child abuse and neglect, every adult who suspects or knows about child abuse or neglect has a moral duty to report such concerns to the appropriate authorities; and</text></paragraph><paragraph id="H51FFF67E954D45D6A1C7DE38DC3E838F"><enum>(4)</enum><text display-inline="yes-display-inline">establishing a Federal standard for the classes of individuals that State law establishes as mandated reporters will protect children and ensure greater consistency among the laws of States, while allowing States the flexibility to establish additional classes of individuals as mandated reporters.</text></paragraph></section><section id="H0B7D630F7E634E5EBFCA4E76ED55D8F9"><enum>3.</enum><header>Educational campaigns and training</header><text display-inline="no-display-inline">The Child Abuse Prevention and Treatment Act is amended by inserting after section 103 (<external-xref legal-doc="usc" parsable-cite="usc/42/5104">42 U.S.C. 5104</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H24435A0CAD374934ADEC5E85439A6D2D"><section id="HB1C65FBD0A9C4948AD7C605E388771E5"><enum>103A.</enum><header>Educational campaigns and training</header><subsection id="H82E803538F0F4ABB840FC17A2BAA2626"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make grants to eligible entities to carry out educational campaigns and provide evidence-based or evidence-informed training regarding State laws for mandatory reporting of incidents of child abuse or neglect.</text></subsection><subsection id="HDF94C6510E3E462EB59561B548E523B9"><enum>(b)</enum><header>Guidance and information on best practices</header><text display-inline="yes-display-inline">The Secretary shall develop and disseminate guidance and information on best practices for—</text><paragraph id="H2362DEBE20ED429CBF79CD76BD2AAE5F"><enum>(1)</enum><text display-inline="yes-display-inline">educational campaigns to educate members of the public about—</text><subparagraph id="HE1DA1E24DD2541B1803B8C3E7AD81618"><enum>(A)</enum><text display-inline="yes-display-inline">the acts and omissions that constitute child abuse or neglect under State law;</text></subparagraph><subparagraph id="HB4F79032E3404D729D5AAB173BCBABC7"><enum>(B)</enum><text>the responsibilities of adults to report suspected and known incidents of child abuse or neglect under State law; and</text></subparagraph><subparagraph id="HAB288F7D627E4A43A8ED3FDC7041EA21"><enum>(C)</enum><text>the resources available to struggling families to help prevent child abuse and neglect; and</text></subparagraph></paragraph><paragraph id="H1C9DEB8EC2D240B19F983F870661F250"><enum>(2)</enum><text>evidence-based or evidence-informed training programs to improve reporting by adults of suspected and known incidents of child abuse or neglect, consistent with State law, with a focus on adults who work with children in a professional or volunteer capacity.</text></paragraph></subsection><subsection id="HCC1A45AE3480466BB642332835C611B3"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under this section, an entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. In determining whether to make a grant under this section, the Secretary shall determine whether the educational campaign or training proposed by the entity uses practices described in the guidance and information developed under subsection (b).</text></subsection><subsection id="HA8C0D824FCB34B11B103F3C3FFDFD95C"><enum>(d)</enum><header>Use of funds</header><text>An entity that receives a grant under this section shall use the funds made available through the grant to carry out an educational campaign, or provide training, described in subsection (b).</text></subsection><subsection commented="no" id="H88318523E55C4568BE182181095D9C97"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for fiscal year 2020 and $10,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF9C6F70953E7458D81EE01553B16FA37"><enum>4.</enum><header>Grants to States for child abuse or neglect prevention and treatment programs</header><text display-inline="no-display-inline">Section 106(b) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a(b)</external-xref>) is amended—</text><paragraph id="H375D2D1C31CA47A487D2B6B219DD590F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="H5440792655C04EEC9047CE7B8B6D29EA"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>(B) an assurance</quote> and all that follows through the end of clause (i), and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDC1E499336CE4E409855527C9DECA2EC"><subparagraph commented="no" id="HED8D33BD3F1841328111D0F9BF9AA4F9"><enum>(B)</enum><text>an assurance in the form of a certification by the Governor of the State that the State has in effect and is enforcing a State law, or has in effect and is operating a statewide program, relating to child abuse and neglect that includes—</text><clause commented="no" id="H9B0DE8914A9C4C03A71D38A668974E10"><enum>(i)</enum><text>provisions or procedures for an individual described in paragraph (5) to report suspected or known incidents of child abuse or neglect to a State child protective service agency or to a law enforcement agency, which shall include a State law for mandatory reporting of such incidents, to either type of agency, by any individual described in paragraph (5), in accordance with paragraph (6);</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="H1B9554F831084C358F8DCA4AD3B9B4CB"><enum>(B)</enum><text>in subparagraph (F), by striking <quote>; and</quote> and inserting <quote>;</quote>;</text></subparagraph><subparagraph id="H3CBF340032A246B49EC2C724A30897AC"><enum>(C)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>;</quote>; and</text></subparagraph><subparagraph id="HDDA55A3129B4485C9F35A72A1F7CB1E5"><enum>(D)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5038527BC2234B97B1A5B3A694DFD143"><subparagraph commented="no" id="HFFF22AC12B61418F861C1E509D7422CE"><enum>(H)</enum><text>an assurance that the State, in developing the State plan described in paragraph (1), has established procedures to ensure coordination between the State law or statewide program described in subparagraph (B) and relevant law enforcement and State or community-based victims’ services agencies to ensure that children who are the victims of acts by a perpetrator other than a parent or caretaker that would be considered child abuse or neglect under section 3(2) if the perpetrator of such act were a parent or caretaker, are referred for appropriate follow-up services, even if such children do not qualify for the protections under such State law or statewide program;</text></subparagraph><subparagraph commented="no" id="H10F89D54AB314B45916BB90AA5604C8F"><enum>(I)</enum><text>an assurance that the State will—</text><clause commented="no" id="H70307A0A79DE4866AA65DE67BE330E2C"><enum>(i)</enum><text>take primary responsibility to accept and investigate reports of known and suspected child abuse or neglect pertaining to an incident that occurred in that State, even if the child or the alleged perpetrator resides in a different State;</text></clause><clause commented="no" id="H3849FE21E241406C85278479ECC0F679"><enum>(ii)</enum><text>in the case of a State that takes primary responsibility to investigate a report as described in clause (i), share the results of the investigation with the State where the child resides and with the State where the alleged perpetrator resides; and</text></clause><clause commented="no" id="H612D740D35E94BF0ABECCDDD8177651E"><enum>(iii)</enum><text>in the case of a State in which the child or alleged perpetrator resides, but where the alleged incident did not occur, establish a plan to assist the State with primary responsibility for the investigation; and</text></clause></subparagraph><subparagraph commented="no" id="H0BEC998986014A68BA2C314D5A1E6C18"><enum>(J)</enum><text>an assurance that the State has established procedures to screen for domestic violence in the course of investigating child abuse and that such procedures—</text><clause commented="no" id="H16F2F65360064A148FFFB8A5D5A765F2"><enum>(i)</enum><text>were developed in consultation with the State Domestic Violence Coalition (as defined in section 302 of the Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10402">42 U.S.C. 10402</external-xref>)) or other entity eligible for funds under section 311 of the Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10411">42 U.S.C. 10411</external-xref>); and</text></clause><clause commented="no" id="H1272FAF3003D49DB892401EDEBB23A98"><enum>(ii)</enum><text>include training and practice requirements for investigators of child abuse where domestic violence is also present.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD565CCB9D4074587BD9AECCD1D6E0422"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7DA74C9B80E641CABEE5EEDF86273531"><paragraph id="H95A51E2118DF4AD78D351927F2A3A342"><enum>(5)</enum><header>Individuals required to report suspected or known child abuse or neglect</header><text>To satisfy the requirements of paragraph (2)(B)(i), a State law for mandatory reporting described in such paragraph shall require all of the following individuals to report suspected or known incidents of child abuse or neglect:</text><subparagraph id="H578FFB233BDA429F921C10FB5CB8A554"><enum>(A)</enum><text>Individuals licensed or certified to practice in any health-related field licensed by the State, employees of health care facilities or providers licensed by the State, who are engaged in the admission, examination, care or treatment of individuals, including mental health and emergency medical services providers.</text></subparagraph><subparagraph id="H5EB852D138EB4F57B59B329F3D8A0857"><enum>(B)</enum><text>Individuals employed by a school who have direct contact with children, including teachers, administrators, and independent contractors.</text></subparagraph><subparagraph id="H30856C41FE5E4DACB697D7C37FD6A512"><enum>(C)</enum><text>Peace officers and law enforcement personnel.</text></subparagraph><subparagraph id="H5F7C6DA101B84E00B23F29ECAC0BB428"><enum>(D)</enum><text>Clergy, including Christian Science practitioners, except where prohibited on account of clergy-penitent privilege.</text></subparagraph><subparagraph id="H88757338B93845278E199452F9F4B520"><enum>(E)</enum><text>Day care and child care operators and employees.</text></subparagraph><subparagraph id="H0C47D930816044F995900AA9710DFE0E"><enum>(F)</enum><text>Employees of social services agencies who have direct contact with children in the course of employment.</text></subparagraph><subparagraph id="H157B78DEE0D540A8A28FF6EF2856AB01"><enum>(G)</enum><text>Foster parents.</text></subparagraph><subparagraph id="H1713DD64FFF14E12B2841E105B2DDCD1"><enum>(H)</enum><text>Court appointed special advocates (employees and volunteers).</text></subparagraph><subparagraph id="HDFE040E2A3E04679A1EE04DF143BF50D"><enum>(I)</enum><text>Camp and after-school employees.</text></subparagraph><subparagraph id="HDD890FBEACB64C328959B367F402A7F9"><enum>(J)</enum><text>An individual, paid or unpaid, who, on the basis of the individual's role as an integral part of a regularly scheduled program, activity, or service, accepts responsibility for a child.</text></subparagraph><subparagraph id="HC23DE0B2F23B4E72A4BF51803AB7D18F"><enum>(K)</enum><text>Other individuals, as the applicable State law or statewide program may require.</text></subparagraph></paragraph><paragraph id="H1B6E6689FB774B6895EB5192D15CA7E0"><enum>(6)</enum><header>Reporting requirement</header><text>To satisfy the requirements of paragraph (2)(B)(i), a State law for mandatory reporting described in such paragraph shall require such individuals to report suspected or known incidents of child abuse or neglect directly to the appropriate law enforcement or child welfare agency (as applicable under State law) and, if applicable, to the individual's supervisor or employer.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="H100B56DB5EC842D8B4610C7489B9D560"><enum>5.</enum><header>Approaches and techniques to improve reporting</header><subsection id="HE3CB56F2800C46E5A202C752A7DDF724"><enum>(a)</enum><header>Eligibility</header><text>Section 107(b) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106c">42 U.S.C. 5106c(b)</external-xref>) is amended—</text><paragraph id="H1A7DDBF39D40482A89FBACC2F0DEE718"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="H07D5E039609D450887268FD34450CD36"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H8057DE6E3BB643D9879575AFBF685D1F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H413936BDA80B4FE6ACF5C98038B29AA1"><subparagraph id="H6526D9907D2B4122B7377F917196D7D4"><enum>(C)</enum><text>support training for adults who work with children in a professional or volunteer capacity, to report suspected and known incidents of child abuse or neglect under State law; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD98D15E3561143D8B7D9636086868094"><enum>(2)</enum><text>in paragraph (5), by inserting before the period <quote>and the training described in paragraph (4)(C)</quote>.</text></paragraph></subsection><subsection id="HC2F691B4215343F89B173A63A84F0590"><enum>(b)</enum><header>State task force study</header><text>Section 107(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106c">42 U.S.C. 5106c(d)</external-xref>) is amended—</text><paragraph id="H0FD67EC117194B85B62EDB9837D1C9E2"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H8533B9298C6B4BDBA17D271654A1113D"><enum>(2)</enum><text>in paragraph (2), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HB554EDD3E2BD4F90882030E2BC843AAB"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H90050CE08A0D4FB986AE57F88892C92C"><paragraph id="HB75E95B62BF84EDE9084D0C5F26A9EA2"><enum>(3)</enum><text>evaluate the State's efforts to train adults who work with children in a professional or volunteer capacity, to report suspected and known incidents of child abuse or neglect under State law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1D79A546965A424887CC833081B9DB43"><enum>(c)</enum><header>Adoption of recommendations</header><text display-inline="yes-display-inline">Section 107(e)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106c">42 U.S.C. 5106c(e)(1)</external-xref>) is amended—</text><paragraph id="H338643154DA14327A318731930A415CD"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H9AEFC6B6B48543CF90C9597E9BE83D9F"><enum>(2)</enum><text>in subparagraph (C), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HBA5CBD35BFC143F4823C039E56B93B18"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0B048C368E4A401F9EA0E4008A543A65"><subparagraph id="H4C0962EC85F140CFB7238888A9F729BB"><enum>(D)</enum><text>experimental, model, and demonstration programs for testing innovative approaches and techniques that may improve reporting of and response to suspected and known incidents of child abuse or neglect by adults to the State child protective service agencies or to law enforcement agencies.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H6FDFC87AF5634B01AE1B2076A32D05DB"><enum>6.</enum><header>General program grants</header><text display-inline="no-display-inline">Section 108 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106d">42 U.S.C. 5106d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4BDF768367C549A59B5732F94C1FB8E9"><subsection id="H73CD4D7B67A64028B8C83E6E3FE8FE2E"><enum>(f)</enum><header>Mandatory reporting</header><text>To be eligible to receive any form of financial assistance under this title, a State shall include in the corresponding plan or application an assurance that the State has in effect a State law for mandatory reporting described in section 106(b)(2)(B)(i).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB250E973B9CE4A27BAA8331BF07E3C00"><enum>7.</enum><header>Reports</header><text display-inline="no-display-inline">Section 110 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106f">42 U.S.C. 5106f</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDA2765C765D747F29248A99F7D60914B"><subsection id="HA397DE58539F43C2A6F7154960E278CF"><enum>(e)</enum><header>Study and report on State mandatory reporting laws</header><paragraph id="H2F41B2B38D8E47889DFB7432A29AAF63"><enum>(1)</enum><header>Study</header><text>Not later than 4 years after the date of enactment of the <short-title>Speak Up to Protect Every Abused Kid Act</short-title>, the Secretary shall collect information on and otherwise study the efforts of States relating to State laws for mandatory reporting of incidents of child abuse or neglect, in order to assess the implementation of the amendments made by that Act.</text></paragraph><paragraph id="H2C9A66AA7BB9434D8B96E81644C49468"><enum>(2)</enum><header>Report</header><subparagraph id="H2A9E38296EC547ABB3A8B859BB9D3EBD"><enum>(A)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of the <short-title>Speak Up to Protect Every Abused Kid Act</short-title>, the Secretary shall submit to the appropriate committees of Congress a report containing the findings of the study under paragraph (1).</text></subparagraph><subparagraph id="HD17916CB847348F99E3F1ACF8363121E"><enum>(B)</enum><header>Contents</header><text>The report submitted under subparagraph (A) shall—</text><clause id="H45FF814D81C441538DD3320FEB5B92D4"><enum>(i)</enum><text>provide an update on—</text><subclause id="HA68FE3C2CDFE4E25ADB745ED4D1BD4D7"><enum>(I)</enum><text>implementation of State laws for mandatory reporting described in section 106(b)(2)(B)(i); and</text></subclause><subclause id="H39FDDB8CC27249889FF3EDD0F5D37CB5"><enum>(II)</enum><text>State efforts to improve reporting on, and responding to reports of, child abuse or neglect; and</text></subclause></clause><clause id="H600311AA898B4444850E418E108A947E"><enum>(ii)</enum><text>include data regarding any changes in the rate of substantiated child abuse reports and changes in the rate of child abuse fatalities since the date of enactment of the <short-title>Speak Up to Protect Every Abused Kid Act</short-title>.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1C057E9F10954AAD97713EF587B4764B"><enum>8.</enum><header>Community-based grants</header><text display-inline="no-display-inline">Section 204 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5116d">42 U.S.C. 5116d</external-xref>) is amended—</text><paragraph id="H3C34FEED5A99481CBCC11E869038B656"><enum>(1)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HCFEC8A380BF24F08BBF91698B57F86CC"><enum>(2)</enum><text>in paragraph (12), by striking the period and inserting <quote>;
