which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Northwestern New Mexico Rural Water Projects Act to make improvements to that Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Navajo-Gallup Water Supply Project Amendments Act of 2022</short-title></quote>.</text></section><section id="id272948B0EAA4406BB75515E22B5661D5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 10302 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>) is amended—</text><paragraph id="idCE6BEAEB06114026B9EC0DF59313DD54"><enum>(1)</enum><text>by redesignating paragraphs (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (27), (28), (29), and (30) as paragraphs (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (28), (29), (30), (31), (32), and (33), respectively;</text></paragraph><paragraph id="idCAF4419CEDDA4FC083AB5DF11978F9E7"><enum>(2)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFE7A08CDBB644106B2FA2EB50F850AA1"><paragraph id="idADE0B04EC33740088EBCCD7B321F587E"><enum>(12)</enum><header>Deferred Construction Fund</header><text>The term <term>Deferred Construction Fund</term> means the Navajo Nation's Navajo-Gallup Water Supply Project Deferred Construction Fund established by section 10602(i)(1)(A).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idA8284A61EF464E8DAAC084E1A82F4364"><enum>(3)</enum><text>in paragraph (14) (as so redesignated)—</text><subparagraph id="id2A438DADD0864FD4A8F0125C8B834A3C"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">Draft</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Final Environmental</header-in-text></quote>;</text></subparagraph><subparagraph id="id8535F7651D654005B769868DF2B2FA49"><enum>(B)</enum><text>by striking <quote>Draft Impact</quote> and inserting <quote>Final Environmental</quote>;</text></subparagraph><subparagraph id="idFDCDBCFC190F408EBE4C8AC1D4B0492B"><enum>(C)</enum><text>by striking <quote>draft environmental</quote> and inserting <quote>final environmental</quote>; and</text></subparagraph><subparagraph id="idD9AA7CC7BECA4784841C23ED10CD5458"><enum>(D)</enum><text>by striking <quote>March 2007</quote> and inserting <quote>July 6, 2009</quote>;</text></subparagraph></paragraph><paragraph id="idD3B192B5F5934465BC047C6C093C1FA7"><enum>(4)</enum><text>in paragraph (19) (as so redesignated), by striking <quote>Draft</quote> and inserting <quote>Final Environmental</quote>;</text></paragraph><paragraph id="idA2AE3FF70F3146EBB6DB7E0C9480186F"><enum>(5)</enum><text>by inserting after paragraph (25) (as so redesignated) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id8697108D0693423783B3E009EFFB0B2A"><paragraph id="id1A2E4415DE2A4F7B9997EC87070D1DE8"><enum>(26)</enum><header>Project Service Area</header><text>The term <term>Project Service Area</term> means the area that encompasses the 43 Nation chapters, the southwest portion of the Jicarilla Apache Reservation, and the City that is identified to be served by the Project, as illustrated in figure IV–5 (Drawing No. 1695–406–49) of the Final Environmental Impact Statement.</text></paragraph><paragraph id="id05B603B8CCC1489DADF255F5450E558F"><enum>(27)</enum><header>San Juan Generating Station</header><text>The term <term>San Juan Generating Station</term> means the coal-fired, 4-unit electric power plant and ancillary features located by the San Juan Mine near Waterflow, New Mexico.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id874739A65D054738A7A33EAD1D846D49"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE0F93FC25CCA498A873DC5C35D4F8322"><paragraph id="idEA5896BA63694B76BFCB0CAC775C94EE"><enum>(34)</enum><header>Working Cost Estimate</header><text>The term <term>Working Cost Estimate</term> means the Bureau of Reclamation document entitled <quote>NGWSP October 2020 WCE</quote> and dated May 20, 2021, that details the costs totaling $1,705,174,000, at the October 2020 price level, of the Project, as configured on that date.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id3CC0661DBE934E56A410EFB01D005BEA"><enum>3.</enum><header>Navajo-Gallup water supply project</header><subsection id="id10B0D7B480B840E6B9F9F1280BD4D4E6"><enum>(a)</enum><header>Authorization of Navajo-Gallup water supply project</header><text>Section 10602 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1379) is amended—</text><paragraph id="id451276D10AFC43EE892EB57F2DDDFC12"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id0E220DB965184B46AE5483FB75135EE0"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">In general</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Authorization</header-in-text></quote>;</text></subparagraph><subparagraph id="id20F55569B1FE41639833D2B4FAC16462"><enum>(B)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB61922F807894E9DB66D6C46A7AD371C"><paragraph id="idD41C1C6796864A5D86685577D51D114B"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idBDF57E7405644140AD7D8FE05CBA3FFA"><enum>(C)</enum><text>in paragraph (1) (as so designated), by striking <quote>Draft Impact Statement</quote> and inserting <quote>Final Environmental Impact Statement, as further refined in, and including the facilities identified in, the Working Cost Estimate and any subsequent supplemental documents prepared in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</quote>; and</text></subparagraph><subparagraph id="idA23C3A4E074E498B8BBE0A8026934A1E"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9D643C7D38784FDA9998A39775F3C542"><paragraph id="idECF278007FC94201BCF7D9720A6A0D28"><enum>(2)</enum><header>Additional service areas</header><subparagraph id="id027609C046E540ABBEF266E5C76A9538"><enum>(A)</enum><header>Findings</header><text>Congress finds that—</text><clause id="idD6D82FDCA2914A08B75A97A11A09DB14"><enum>(i)</enum><text>expanding the Project Service Area would create opportunities to increase service for additional Nation Tribal members and would not increase the cost of the Project beyond authorization levels described in section 10609(a); and</text></clause><clause id="id972BCC50370A41C385943C3128AF45BD"><enum>(ii)</enum><text>the unit operations and maintenance costs of the Project would be reduced by adding more customers to the Project.</text></clause></subparagraph><subparagraph id="id1C210AD6F83C48A8895DA38142844AD5"><enum>(B)</enum><header>Authorizations for additional Project Service Areas</header><clause id="id04BCF537CB124B8CA9C8DF358CBE61DA"><enum>(i)</enum><header>New Mexico</header><text>In addition to delivering water supply from the Project to the Nation communities in the San Juan River Basin, the Nation may expand the Project Service Area in order to deliver water supply from the Project to communities of the Nation within the Rio San Jose Basin, New Mexico.</text></clause><clause id="id14733828eadd44d38c652bf700d9102c"><enum>(ii)</enum><header>Arizona</header><text>In addition to delivering water supply from the Project to the Nation communities of Fort Defiance and Window Rock, Arizona, and subject to section 10603(c)(1), the Nation may expand the Project Service Area in order to deliver water supply from the Project to the Nation community of Lupton, Arizona, within the Little Colorado River Basin, Arizona.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA8F0526C8B7D453A825C5437F74383CF"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idE9A65B7EE4ED42DB8DE58BDFFC994148"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="id844B77920D30499E8518982643C0E2F3"><enum>(i)</enum><text>by inserting <quote>acquire,</quote> before <quote>construct,</quote>; and</text></clause><clause id="id58D816381D9A4874BAE10B6A3B0E8726"><enum>(ii)</enum><text>by striking <quote>Draft Impact Statement</quote> and inserting <quote>Final Environmental Impact Statement, as further refined in, and including the facilities identified in, the Working Cost Estimate and any subsequent supplemental documents prepared in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)</quote>;</text></clause></subparagraph><subparagraph id="idCD47D03A9271475D832E00BF39DF8EDA"><enum>(B)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99A31C23FBBC42AB99C3AC1047265178"><paragraph id="idA97446EBA1D94851AC12DC21C23509A4"><enum>(1)</enum><header>San Juan Generating Station</header><subparagraph id="id101CD622EA6E47FD98833CA33A0F3885"><enum>(A)</enum><header>In general</header><text>The water conveyance and storage facilities associated with the San Juan Generating Station, including the diversion dam, the intake structure, the river pumping plant, the pipeline from the river to the reservoir, the dam and associated reservoir, the power line between the river and reservoir, and any associated land, rights-of-way, easements, or ancillary features.</text></subparagraph><subparagraph id="id055C490C4BE34ED2B9E9799D46DE1EA2"><enum>(B)</enum><header>Waiver of appraisal</header><text>Notwithstanding any other provision of law, the Secretary may waive an appraisal relating to the acquisition of the water conveyance and storage facilities associated with the San Juan Generating Station described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id35C6AFB92EFD4BE1934E122AC53DCAF3"><enum>(C)</enum><text>in paragraph (2)(A)—</text><clause id="idFE2E49F884A94293B7514EBFB1D357E2"><enum>(i)</enum><text>by striking <quote>River near Kirtland, New Mexico,</quote> and inserting <quote>Generating Station Reservoir</quote>; and</text></clause><clause id="id890F810AC9D94508804C4F8798DD41CB"><enum>(ii)</enum><text>by inserting <quote>generally</quote> before <quote>follows United States Highway 491</quote>;</text></clause></subparagraph><subparagraph id="id15CC446F4EB442C4BAB899BD890B5982"><enum>(D)</enum><text>in paragraph (3)(A), by inserting <quote>generally</quote> before <quote>follows United States Highway 550</quote>; and</text></subparagraph><subparagraph id="idEC475B8E03424524B44BE038A1C6240F"><enum>(E)</enum><text>in paragraph (5), by inserting <quote>(including any reservoir facility)</quote> after <quote>treatment facility</quote>;</text></subparagraph></paragraph><paragraph id="id4C6A461D535E40809CF84E9057278EF7"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idCDFE2E4EDA774C0298F374B17B0D7D33"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text style="OLC" level="subsection">and Facilities</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">Land</header-in-text></quote>;</text></subparagraph><subparagraph id="id00F0AD030C4241F6AEFAB249E1A7D21A"><enum>(B)</enum><text>in paragraph (1), by striking <quote>any land or interest in land that is</quote> and inserting <quote>any land or facilities, or interest in land or facilities, that are</quote>; and</text></subparagraph><subparagraph id="idDA5DEDA633004192895AD2C2B7E57543"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id052D9FAB1F2A49B0BE3948F034A1EF12"><paragraph id="idDDB5B8F9C3A9495DB465CE569DF248D5"><enum>(4)</enum><header>Land to be taken into trust</header><subparagraph id="idADAB7F024EFE43D89B699783E4029217"><enum>(A)</enum><header>In general</header><text>On satisfaction of the conditions described in paragraph (7) of the Agreement and after the requirements of sections 10701(e) and 10703 are met, the Secretary shall take legal title to the following land and, subject to subparagraph (D), hold that land in trust for the benefit of the Nation:</text><clause id="id329e20a6a0ff4775b8aaa73d25909e3a"><enum>(i)</enum><text>Fee land of the Nation, including—</text><subclause id="id3C760D19318B476383C12A0DF92B2C55"><enum>(I)</enum><text>the parcels of land on which the Tohlakai Pumping Plant, Reach 12A and Reach 12B, are located, including, in McKinley County, New Mexico—</text><item id="id2D8F1DBD84A242EFA602C088945E19F0"><enum>(aa)</enum><text>sec. 5, T. 16 N., R. 18 W., New Mexico Prime Meridian; and </text></item><item id="idBFBE284BB9A14D689DEA2560EC3868BD"><enum>(bb)</enum><text>sec. 33, T. 17 N., R. 17 W., New Mexico Prime Meridian (except lot 9 and the NW<fraction>1/4</fraction> of lot 4);</text></item></subclause><subclause id="id26ff57a0d9b04f50a5a4a4952cd560f1"><enum>(II)</enum><text>the parcel of land on which Reach 12.1 is located, including—</text><item id="id92DD821A5B4548EA945879DB09E33590"><enum>(aa)</enum><text>NW<fraction>1/4</fraction> and SW<fraction>1/4</fraction> sec. 5, T. 16 N., R. 18 W.; </text></item><item id="idA4D81279AF0B49DC85084D0703EA062A"><enum>(bb)</enum><text>N<fraction>1/2</fraction> sec. 11, T. 16 N., R. 19 W.; and</text></item><item id="idE672DB15FEA645EE86650A3D238A7737"><enum>(cc)</enum><text>sec. 12, T. 16 N., R. 20 W.; and</text></item></subclause><subclause id="id4f49fd98e6c3454ebd0e05c01eca38b0"><enum>(III)</enum><text>the parcel of land on which Reach 12.2 is located, including NW<fraction>1/4</fraction>. sec. 2, T. 16 N., R. 21 W.</text></subclause></clause><clause id="id28850111f9104cb9b7661734dd79f229"><enum>(ii)</enum><text>Public domain land managed by the Bureau of Land Management, including—</text><subclause id="id8a43607a40914df9b21982cbad008a74"><enum>(I)</enum><text>the parcel of land on which the Cutter Lateral Water Treatment Plant is located, including S<fraction>1/2</fraction> sec. 9, T. 25 N., R. 9 W., New Mexico Prime Meridian; and</text></subclause><subclause id="ide7f0377f65fe48f888cdf823d6bd87dd"><enum>(II)</enum><text>the parcel of land on which the Navajo Agricultural Products Industry turnout is located, including NW<fraction>1/4</fraction> and NE<fraction>1/4</fraction> sec. 34, T. 26 N., R. 9 W., New Mexico Prime Meridian.</text></subclause></clause><clause id="id36f75fe1c1d147cbb2b2a53f79da563e"><enum>(iii)</enum><text>Public domain land managed by the Bureau of Reclamation, including the land underlying the San Juan Generating Station facilities acquired by the United States.</text></clause></subparagraph><subparagraph id="id77cf5c6f78e9496f8eeb5694625a1e6b"><enum>(B)</enum><header>Part of Navajo Nation</header><text>The land taken into trust under subparagraph (A) shall be part of the Navajo Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for the benefit of an Indian Tribe.</text></subparagraph><subparagraph id="idd2359df34ea143f0b7387539a27cb2ac"><enum>(C)</enum><header>Limitations</header><text>The land taken into trust under subparagraph (A) shall be subject to valid existing rights, contracts, and management agreements, including easements and rights-of-way.</text></subparagraph><subparagraph id="id1B3C0891DE0B4B1F8F35317B2F77BB91"><enum>(D)</enum><header>Savings clause</header><text>Nothing in this paragraph affects any—</text><clause id="id3FE3A37910BC4D6C8DE56EB896D2AAED"><enum>(i)</enum><text>water right of the Nation in existence on the day before the date of enactment of the <short-title>Navajo-Gallup Water Supply Project Amendments Act of 2022</short-title>; and</text></clause><clause id="id32506E48530E4AF1A4E9C95C72764788"><enum>(ii)</enum><text>right or claim of the Nation to any land or interest in land in existence on the day before the date of enactment of the <short-title>Navajo-Gallup Water Supply Project Amendments Act of 2022</short-title>.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id81986764944A4FA6B930CF5771AF46B6"><enum>(4)</enum><text>in subsection (d)(1)(D), by striking <quote>Draft</quote> and inserting <quote>Final Environmental</quote>;</text></paragraph><paragraph id="id60B92BE6C8E94D1AAF173F9FDE96C4E9"><enum>(5)</enum><text>in subsection (e)—</text><subparagraph id="idF9BC418D515C4E70B2F0F8C945AAF07B"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE3B589951D564A60A5415D73CCC635C9"><paragraph id="id32D03D2DEB01472B833F60D7EB015497"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idF1009AAF30D446F8BF3A0C371EE90040"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39CF05380AC7477689725D25BDA52FC6"><paragraph id="id3B39551812BB48BB880B71B7C09BFD14"><enum>(2)</enum><header>Renewable energy and hydroelectric power</header><subparagraph id="id938A966D7A5444D5AB55C4054EB77E45"><enum>(A)</enum><header>Renewable energy</header><text>For any portion of the Project that does not have access to Colorado River Storage Project power, the Secretary may use not more than $6,250,000 of the amounts made available under section 10609(a)(1) to develop renewable energy.</text></subparagraph><subparagraph id="id66796B0B72D24092AF0FC21D044DEAE5"><enum>(B)</enum><header>Hydroelectric power</header><text>Notwithstanding whether a Project facility has access to Colorado River Storage Project power, the Secretary may use not more than $1,250,000 of the $6,250,000 authorized to be used to develop renewable energy under subparagraph (A) to develop hydroelectric power for any Project facility that can use hydraulic head to produce electricity.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id40450A68A8044A3E963C6FA9D723C9BA"><enum>(6)</enum><text>in subsection (h)(1), in the matter preceding subparagraph (A), by inserting <quote>, store,</quote> after <quote>treat</quote>; and</text></paragraph><paragraph id="idD26A2BE80FB34D608905806AE1788D49"><enum>(7)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAD8BDA94A4D8495AB10F8665C2862A61"><subsection id="id52864EC9F4784EAF91C652B9EDA4F7CB"><enum>(i)</enum><header>Deferred construction of Project facilities</header><paragraph id="id90DAB159673F4931BF942891474E47D5"><enum>(1)</enum><header>Deferred construction of Project facilities</header><text>On mutual agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, construction of selected Project facilities may be deferred to save operation and maintenance expenses associated with that construction.</text></paragraph><paragraph id="id7EC588F17A644A5999D2A8EB7E81B689"><enum>(2)</enum><header>Deferred Construction Fund</header><subparagraph id="id348FD36D869D4EF5B722C698FBC777CB"><enum>(A)</enum><header>Establishment</header><text>There is established in the Treasury a fund, to be known as the <quote>Navajo Nation’s Navajo-Gallup Water Supply Project Deferred Construction Fund</quote>, to consist of—</text><clause id="idC2EE98815B6944EDB7D0522688AAA457"><enum>(i)</enum><text>amounts that correspond to portions of the Project that have been deferred under paragraph (1); and</text></clause><clause id="id897CAB1829D8445D87878E65AC0DED95"><enum>(ii)</enum><text>any interest or other gains on amounts referred to in clause (i).</text></clause></subparagraph><subparagraph id="idCDD4A2E8C995486BA8DC91D5707773E8"><enum>(B)</enum><header>Use of the Deferred Construction Fund</header><text>The Nation may use amounts in the Deferred Construction Fund—</text><clause id="idC7D0529DA34243E881F25DF953B859E4"><enum>(i)</enum><text>to construct Project facilities that have been deferred under paragraph (1); or</text></clause><clause id="idFAB20AC9F2C949B99B409D219DDF413F"><enum>(ii)</enum><text>to construct alternate facilities agreed on under subparagraph (C).</text></clause></subparagraph><subparagraph id="id257E96AE44C5419B8C9A8932E7712239"><enum>(C)</enum><header>Alternate facilities consistent with the purpose of the Project</header><text>On agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, and in compliance with all applicable environmental and cultural resource protection laws, facilities other than those previously agreed to be deferred under paragraph (1) may be constructed if those alternate facilities are consistent with the purposes of the Project described in section 10601.</text></subparagraph></paragraph><paragraph id="id945CDE83ED5244379C6BD02A609727D5"><enum>(3)</enum><header>Amounts to be deposited</header><text>Funds allocated from the amounts made available under section 10609(a)(1) to build facilities referred to in paragraph (1) shall be deposited into the Deferred Construction Fund.</text></paragraph><paragraph id="id126F74D4808243BBA8E8069A70D42703"><enum>(4)</enum><header>Adjustments</header><text>On deposit of amounts into the Deferred Construction Fund under paragraph (3), the adjustments to authorized appropriations under section 10609(a)(2) shall no longer apply to those amounts. </text></paragraph><paragraph id="idABF148761DF9468A87AEF09C60BDAB23"><enum>(5)</enum><header>Deadline to construct Project facilities</header><text>On deposit of all amounts into the Deferred Construction Fund for construction of Project facilities agreed on under paragraph (1), the Secretary shall be deemed to have met the obligation under section 10701(e)(1)(A)(ix).</text></paragraph><paragraph id="id13164096732641CA9F911F56D29EEE62"><enum>(6)</enum><header>Future construction of Project facilities</header><text>On agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, the Nation shall use amounts deposited into the Deferred Construction Fund to construct—</text><subparagraph id="id2FC329237C8A4B85B7DFF4135AF56369"><enum>(A)</enum><text>Project facilities deferred under paragraph (1); or</text></subparagraph><subparagraph id="id33EC166BE4D449E294E195CA7233FFAB"><enum>(B)</enum><text>alternate Project facilities described in paragraph (2)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id648D2EC30C084BA5A106D72BF3A4DD36"><enum>(b)</enum><header>Delivery and use of Navajo-Gallup water supply project water</header><text>Section 10603(a)(3)(B) of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1383) is amended—</text><paragraph id="idC1F43900650C4E2DBCF44E1E72723EC5"><enum>(1)</enum><text>in clause (i), by inserting <quote>or, if generated on City-owned facilities, by the City</quote> after <quote>the Nation</quote>; and</text></paragraph><paragraph id="id94082E0651E94B57BCD57FD517A8E7EB"><enum>(2)</enum><text>in clause (ii), by inserting <quote>, except that the City shall retain all revenue from the sale of hydroelectric power that is generated on City-owned facilities</quote> after <quote>hydroelectric power</quote>.</text></paragraph></subsection><subsection id="id656CC8400438468894D4913CEC7E60F1"><enum>(c)</enum><header>Project contracts</header><text>Section 10604 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; and </text></clause><clause id="id9E4883CEA38543E099DB145839D692C3"><enum>(ii)</enum><text>the date on which the waiver granted by the Secretary under that subparagraph has been in place for 15 years.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idCD1936450E214ADCADD3F05D95C5B65C"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15455BAE55F14524A8FEA1315141906F"><paragraph id="idd4608e9da9514bacafc989139da58aaf"><enum>(2)</enum><header>Jicarilla Apache Nation</header><subparagraph id="ide2001e90b1da4c658f889269166906cd"><enum>(A)</enum><header>In general</header><text>On the date on which the Secretary declares a section of the Project to be substantially complete and delivery of water generated by and through that section of the Project can be made to the Jicarilla Apache Nation, the Secretary shall waive, for a period of 10 years, the operation, maintenance, and replacement costs allocable to the Jicarilla Apache Nation. </text></subparagraph><subparagraph id="id652e3ff587e042f19fa8259d3e0060cf"><enum>(B)</enum><header>Subsequent payment by jicarilla apache nation</header><text>After a waiver under subparagraph (A) expires, the Jicarilla Apache Nation shall pay all operation, maintenance, and replacement costs of that section of the Project that are allocated to the Jicarilla Apache Nation.</text></subparagraph><subparagraph id="id7a707f83f742402097a2f5a7c9811246"><enum>(C)</enum><header>Payment by united states</header><text>Any operation, maintenance, or replacement costs waived by the Secretary under subparagraph (A) shall be paid by the United States and shall be nonreimbursable.</text></subparagraph><subparagraph id="idBD68B82413C24144905AB7D4A9914BFA"><enum>(D)</enum><header>Antideficiency</header><text>The Secretary shall not be liable for any failure to carry out any obligation or activity authorized by this subsection if adequate appropriations are not provided expressly by an Act of Congress to carry out the purposes of this subsection.</text></subparagraph></paragraph><paragraph id="idd5bdc70f0cdc4d8e80b2638272fbf027"><enum>(3)</enum><header>City of Gallup</header><subparagraph id="id58e7496932f64268bf7f0b28b79e9d9e"><enum>(A)</enum><header>In general</header><text>On the date on which the Secretary declares a section of the Project to be substantially complete and delivery of water generated by and through that section of the Project can be made to the City, the Secretary shall waive, for a period of 10 years, the operation, maintenance, and replacement costs allocable to the City.</text></subparagraph><subparagraph id="id496671949fc04da99bff2943bdb62316"><enum>(B)</enum><header>Subsequent payment by City of Gallup</header><text>After a waiver under subparagraph (A) expires, the City shall pay all operation, maintenance, and replacement costs of that section of the Project that are allocated to the City.</text></subparagraph><subparagraph id="idc0190db36ed342daa6db504c8775307a"><enum>(C)</enum><header>Payment by united states</header><text>Any operation, maintenance, or replacement costs waived by the Secretary under subparagraph (A) shall be paid by the United States and shall be nonreimbursable.</text></subparagraph><subparagraph id="id9747E816D6C84CFC853F3C48CA526A49"><enum>(D)</enum><header>Antideficiency</header><text>The Secretary shall not be liable for any failure to carry out any obligation or activity authorized by this subsection if adequate appropriations are not provided expressly by an Act of Congress to carry out the purposes of this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id9249ECB2412140E28165E7C5BF9AD049"><enum>(d)</enum><header>Authorization of conjunctive use wells</header><text>Section 10606 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1392) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8BF599E9BC034AE0B8370B47DE98FCB7"><subsection id="id1e8a318e955c4c1395f9d69d28b4f563"><enum>(i)</enum><header>Wells serving the City of Gallup regional water system</header><paragraph id="id0583B217585D4EE592ED7781867CBB2A"><enum>(1)</enum><header>In general</header><text>The Secretary shall enter into a financial assistance agreement with the City to provide funding, using amounts made available under section 10609(b)(3), for the construction or rehabilitation of wells and related pipeline facilities to provide capacity for the diversion and distribution by the City of not more than 1,500 acre feet of groundwater per year. </text></paragraph><paragraph id="id30791DF740284E42BCC6A8417030B352"><enum>(2)</enum><header>Water rights</header><text>The water rights associated with any wells constructed or rehabilitated under paragraph (1)—</text><subparagraph id="id7A7D13D299CD46658DBD0115D7AB0571"><enum>(A)</enum><text>shall not be considered to be part of the Agreement; and</text></subparagraph><subparagraph id="id141DFE0C61444D85A652D29FE2C6866D"><enum>(B)</enum><text>shall be considered to be already existing water rights permitted by the New Mexico State Engineer to the City for municipal and domestic uses.</text></subparagraph></paragraph><paragraph id="id20113EACAF774B92ADF7714EC597FB31"><enum>(3)</enum><header>Title to wells</header><text>Title to the wells and related pipeline facilities constructed or rehabilitated in accordance with paragraph (1) shall remain with the City at all times. </text></paragraph><paragraph id="id7A2EFE769A974CEAA7E620ACB9D8B871"><enum>(4)</enum><header>Associated costs</header><text>All operation, maintenance, and replacement costs associated with wells and related pipeline facilities constructed or rehabilitated in accordance with paragraph (1) shall be the responsibility of the City.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idDA0D853BE2184D0D83E83D89907FF30C"><enum>(e)</enum><header>Authorization of appropriations</header><text>Section 10609 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1395) is amended—</text><paragraph id="idD6C850BFCC22435EB50419FAB8F812EF"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idA9B3276EF27E46C8B1FE14E57FC7C4E6"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$870,000,000 for the period of fiscal years 2009 through 2024</quote> and inserting <quote>$1,923,200,000 for the period of fiscal years 2009 through 2029</quote>;</text></subparagraph><subparagraph id="id5615DB7C310C4ECEA9AC021AB8D54B1C"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7E5464F535F848BBBB2A2972C66E696C"><paragraph id="id0ADC80BA970D44289D0993DCAC1E9CA6"><enum>(2)</enum><header>Adjustments</header><subparagraph id="idF5D53BA28C0842C1BF07BF92DCE495EB"><enum>(A)</enum><header>In general</header><text>The amount under paragraph (1) shall be adjusted by such amounts as may be required—</text><clause id="id62EC9546B38F4150B6E59EC1D2DE31F6"><enum>(i)</enum><text>by reason of changes since October 2020 in construction cost changes in applicable regulatory standards, as indicated by engineering cost indices applicable to the types of construction involved; and</text></clause><clause id="idC58026EA4B6A44F986F2F4D1F65EAD5A"><enum>(ii)</enum><text>to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices described in clause (i), as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></clause></subparagraph><subparagraph id="id6450724099EA42AEB07736A875165848"><enum>(B)</enum><header>Deferred Construction Fund</header><text>Amounts deposited in the Deferred Construction Fund shall not be adjusted pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>; 123 Stat. 1379) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBBE1401885BB478CBDA022C428FECD07"><section id="idFA2DB908C0B149C48FC2C51F3F22D45E"><enum>10610.</enum><header>Taxation of construction, operation, and maintenance of Project facilities</header><subsection id="id261569890f3c44e088a5654ed35b6677"><enum>(a)</enum><header>Nation land</header><text>Any activity constituting the construction, operation, or maintenance of Project facilities—</text><paragraph id="id067AB334FCE34B08830762E61CED0305"><enum>(1)</enum><text>shall, if the activity takes place on land that is held in trust by the United States for the benefit of the Nation, be subject to taxation by the Nation; and </text></paragraph><paragraph id="idF26021862B964DACAA16FA1439FB013E"><enum>(2)</enum><text>shall not be subject to any fee, tax, assessment, levy, or other charge imposed by any State or political subdivision of a State.</text></paragraph></subsection><subsection id="idd1b8b6eabab147db90439d1e552cdfe4"><enum>(b)</enum><header>Other land</header><text>Any activity constituting the construction, operation, or maintenance of Project facilities—</text><paragraph id="idDAEAF47A47784045A2B85B3E1B747DE2"><enum>(1)</enum><text>shall, if the activity takes place on land other than the land described in subsection (a)(1), be subject to taxation by the State in which the land is located, or by a political subdivision of that State to the extent authorized by the laws of that State; and </text></paragraph><paragraph id="idE2B8810D729E43FF9297DCE2E4C1CC09"><enum>(2)</enum><text>shall not be subject to any fee, tax, assessment, levy, or other charge imposed by the Nation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id7E34028DF38E4E238A4ADC4B04A4A339"><enum>4.</enum><header>Navajo Nation water rights</header><subsection id="id95B7A0771B324A959C75F28661BCB38D"><enum>(a)</enum><header>Agreement</header><text>Section 10701(e)(1)(A) of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1400) is amended—</text><paragraph id="idBC38B8B9A6824EFD83C336C895E33431"><enum>(1)</enum><text>in clause (ix), by striking <quote>2024</quote> and inserting <quote>2029</quote>; and</text></paragraph><paragraph id="id3CEDF0A27F984E6AA46CE47E29968DC8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF07071352A7748439D3B94856D35DBBF"><clause id="id396288F8E7F545969116E2FA94F26CA3"><enum>(x)</enum><header>Deferred Construction Fund</header><subclause id="id25F9ACC669034F9DA9851D26AA62FF0B"><enum>(I)</enum><header>In general</header><text>Not later than December 31, 2029, the United States shall make all deposits into the Deferred Construction Fund in accordance with section 10602(i)(3). </text></subclause><subclause id="idDB5B305C0C0D464D984E49A2B3B0A702"><enum>(II)</enum><header>Project deadline</header><text>On deposit of the amounts into the Deferred Construction Fund under subclause (I), even if certain Project facilities have not yet been constructed, the Secretary shall be deemed to have met the deadline described in clause (ix).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEBDE9E1101BC46AD82B7A8FD62C2E066"><enum>(b)</enum><header>Waivers and releases</header><text>Section 10703 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1403) is amended—</text><paragraph id="idDE7331CFD79E4E66B5BE60E09C3EC819"><enum>(1)</enum><text>in subsection (d)(1)(A), by striking <quote>2025</quote> and inserting <quote>2030</quote>; and</text></paragraph><paragraph id="id5816A3213A5C44E1A594D81DE6476E42"><enum>(2)</enum><text>in subsection (e)(2), in the matter preceding subparagraph (A), by striking <quote>2025</quote> and inserting <quote>2030</quote>.</text></paragraph></subsection></section></legis-body></bill>
