<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5062</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220929">September 29, 2022</action-date><action-desc><sponsor name-id="S375">Mr. Daines</sponsor> (for himself and <cosponsor name-id="S284">Ms. Stabenow</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to increase access to mental health programs for physicians.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Physicians Act</short-title></quote>.</text></section><section id="id9B54983834C94961B6CB932D95C48462"><enum>2.</enum><header>Access to mental health programs for physicians</header><text display-inline="no-display-inline">Section 1877(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(e)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="id4098A8C2A701421E95D12E0B7C1F8D70" display-inline="no-display-inline" style="OLC"><paragraph id="id9e14f79051f548208985349aed1f3ddd"><enum>(9)</enum><header>Mental health program for physicians</header><text>The provision by an entity of an evidence-based or evidence-informed program for physicians for the primary purpose of preventing suicide and improving mental health and resiliency and for training such physicians in appropriate strategies to promote their mental health, if such program—</text><subparagraph id="id6767554fa0a04c39b42f0cc60ae8f404"><enum>(A)</enum><text>is in a policy set out in writing and approved in advance of the operation of the program by the governing body of the entity;</text></subparagraph><subparagraph id="id3a7cc9d233cc4b379b92de07625371cd"><enum>(B)</enum><text>is offered to all physicians on the bona fide medical staff of the entity or in the local community or service area of the entity;</text></subparagraph><subparagraph id="id2176835ca5454dc182c9dfe6f012c0d1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>is offered to all such physicians on the same terms and conditions regardless of the volume or value of referrals or other business generated by the physician for the entity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5A154ABD738845B28A0B684AEB3889CC"><enum>(D)</enum><text>meets any other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
