which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide benefits for noncitizen members of the Armed Forces, and for other purposes.</official-title></form><legis-body style="OLC"><section id="H289674AFFF6F46F384C8F55F7DBFD428" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veteran Service Recognition Act of 2022</short-title></quote>.</text></section><section id="H6AABE8128D504173AEB12E91AF358CCE"><enum>2.</enum><header>Study and report on noncitizen veterans removed from the United States</header><subsection id="H5CC4CB73075B471C9683497E4116B0A9"><enum>(a)</enum><header>Study required</header><paragraph id="idD5E14B9390CB4641AA95432A5C576677"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Veterans Affairs shall jointly carry out a study on noncitizen veterans and noncitizen former members of the Armed Forces who were removed from the United States during the period beginning on January 1, 1990, and ending on the date of the enactment of this Act.</text></paragraph><paragraph id="id928342D96DFD44EB890ABD51C175D0D6"><enum>(2)</enum><header>Elements</header><text>The study carried out pursuant to paragraph (1) shall determine—</text><subparagraph id="H54C63F8E91614D00B727F4D9555971CF"><enum>(A)</enum><text>the number of noncitizens who—</text><clause id="id2642B21D6ECC4924A2F1C0D32592B01C"><enum>(i)</enum><text>served in the Armed Forces for an aggregate period of more than 180 days; and</text></clause><clause id="idEA1687A28D484EF9AB669E9E68236386"><enum>(ii)</enum><text>were removed by U.S. Immigration and Customs Enforcement or the Immigration and Naturalization Service during the period covered by the report;</text></clause></subparagraph><subparagraph id="HF933401354B34C2E8C006C835693D23D"><enum>(B)</enum><text>for each noncitizen described in subparagraph (A)—</text><clause id="H0526A4D3906A453787B35B2E66257853"><enum>(i)</enum><text>the country of nationality or last habitual residence of such noncitizen;</text></clause><clause id="HF6B9686F503F4269A05E5FEC36FAA084"><enum>(ii)</enum><text>the total time such noncitizen served as a member of the Armed Forces;</text></clause><clause id="H694CD51D713748D8899C4936DA38F9B6"><enum>(iii)</enum><text>each ground on which such noncitizen was ordered removed pursuant to section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) or section 237(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)</external-xref>), as applicable; and</text></clause><clause id="HACE8823D33FD4EE5BEC52EB0B55F47A6"><enum>(iv)</enum><text>whether such noncitizen appealed the removal order to the Board of Immigration Appeals;</text></clause></subparagraph><subparagraph id="H79266F58AF1144738CAAE8AA68B1BDB6"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idFCD7670FAAB04211AFCD6E31FC9BC8E3"><enum>(i)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who were discharged or released from service under honorable conditions;</text></clause><clause id="id410A01D336BC4CA8AFFB47893DD81604" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who were discharged or released from service under other than honorable conditions;</text></clause><clause indent="up1" id="idA5CB445701924629943713E3278FDF4B"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who were deployed overseas;</text></clause><clause indent="up1" id="id25EFAAA5EC28437296B7F5BE136023C6"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who served on active duty in the Armed Forces in an overseas contingency operation;</text></clause><clause indent="up1" id="idA224E0864A5846319AAF7B992B40CA85"><enum>(v)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who were awarded decorations or medals;</text></clause><clause indent="up1" id="id00B4D3A89E914F118489239186FB1DE3"><enum>(vi)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who applied for benefits under laws administered by the Secretary of Veterans Affairs; and</text></clause><clause indent="up1" id="idD3F07D1F287C4695B2EAF405F7ADCB78"><enum>(vii)</enum><text display-inline="yes-display-inline">the number of noncitizens described in subparagraph (A) who receive benefits described in clause (vi); and</text></clause></subparagraph><subparagraph id="H54117E9A27C84C1C82A3AEAE961D33C8"><enum>(D)</enum><text>the reasons preventing any of the noncitizens who applied for benefits described in subparagraph (C)(vi) from receiving such benefits.</text></subparagraph></paragraph></subsection><subsection id="H4E07F3AEC6BA4B41969149328A5E3D3D"><enum>(b)</enum><header>Report</header><text>Not later than 90 days after the date of the completion of the study required under subsection (a), the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Veterans Affairs shall jointly submit a report containing the results of such study to the appropriate congressional committees.</text></subsection></section><section id="H6E98D747466F40938393B40F1E4CFCCE"><enum>3.</enum><header>Information system on veterans subject to removal</header><subsection id="HEB41C5F86B8F402080EFDF8F2B3F46B5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall develop—</text><paragraph id="H527494D9E22C4B21A1F0EB2890A96106"><enum>(1)</enum><text display-inline="yes-display-inline">a protocol for identifying noncitizens who are or may be veterans; and</text></paragraph><paragraph id="H13284C02A4FC4565AD31DF35D0AC255C"><enum>(2)</enum><text>a system for maintaining information about noncitizen veterans identified pursuant to the protocol established under paragraph (1) and information provided by the Under Secretary of Defense for Personnel and Readiness under section 4(d). </text></paragraph></subsection><subsection id="H7C62904130864271970216C7A27F3A5D"><enum>(b)</enum><header>Information sharing</header><text display-inline="yes-display-inline">The system developed pursuant to subsection (a)(2) shall be shared across all components of the Department of Homeland Security, including Enforcement and Removal Operations, the Office of the Principal Legal Advisor, Homeland Security Investigations, and the Military Family Immigration Advisory Committee.</text></subsection><subsection id="H7D0EA0B5CF4745AE91DB16765A7087BE"><enum>(c)</enum><header>Consideration of veteran status</header><text>The Secretary of Homeland Security shall ensure that, in the case of any noncitizen veteran who is potentially removable, and in any removal proceeding against such a noncitizen veteran, information available under the system developed pursuant to subsection (a)(2) is taken into consideration, including for purposes of any adjudication on the immigration status of such veteran. </text></subsection><subsection id="HCDC7E7B00D854858955708472D278350"><enum>(d)</enum><header>Use of system required</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not initiate removal proceedings against an individual prior to using the system established pursuant to subsection (a)(2) to attempt to determine whether the individual is a veteran. If the Secretary of Homeland Security determines that such an individual is or may be a veteran, the Secretary shall notify the Military Family Immigration Advisory Committee concurrently upon initiating removal proceedings against such individual.</text></subsection><subsection id="H6895D2328AFF4E9C82FDD4FF01A4A4B1"><enum>(e)</enum><header>Training</header><text>Beginning in the first fiscal year that begins after the Secretary of Homeland Security completes the requirements under subsection (a), personnel of U.S. Immigration and Customs Enforcement shall participate in annual training on the protocol developed under this section.</text></subsection></section><section id="H63A25C680EF844E490B46600D8845F0D"><enum>4.</enum><header>Military Family Immigration Advisory Committee</header><subsection id="H00FA802221B343339C10DBB130D005B4"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall establish an advisory committee, which shall be known as the <quote>Military Family Immigration Advisory Committee</quote>, to provide recommendations to the Secretary of Homeland Security on the exercise of discretion in any case involving removal proceedings for—</text><paragraph id="H6D50A7B7ACAA44FB8BC5DAB6B6DDCE3C"><enum>(1)</enum><text>a member of the Armed Forces;</text></paragraph><paragraph id="HFF7DDD612FE94BA8A33434574C0CE2F5"><enum>(2)</enum><text>a veteran; or</text></paragraph><paragraph id="H14B393A2504D40419832D2421BEADBFC"><enum>(3)</enum><text>a covered family member.</text></paragraph></subsection><subsection id="HD2BCFC0B8E9B43D5A80CE3CBA99F1D3C"><enum>(b)</enum><header>Membership</header><text>The Advisory Committee shall be composed of 9 members, appointed by the Secretary of Homeland Security. </text></subsection><subsection id="H29DBD2CBADF14ADBA9374ECDE2202B95"><enum>(c)</enum><header>Case reviews</header><paragraph id="HC59A83E00197400AB868EA6BFB83085C"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the Advisory Committee identifies or is notified about the case of an individual described in subsection (a), the Advisory Committee shall meet to review the case and to provide a written recommendation to the Secretary of Homeland Security on whether—</text><subparagraph id="H881EF029B1774832B7104D61E20A4FD6"><enum>(A)</enum><text>an exercise of discretion is warranted, including—</text><clause id="H850C4ACD21C84B6DA03C82FE2D8F6E59"><enum>(i)</enum><text>termination of removal proceedings; </text></clause><clause id="H15594D929F1D48849C2028E4D093B677"><enum>(ii)</enum><text>parole;</text></clause><clause id="HF63E028DD49346B0ADE6BD0898224207"><enum>(iii)</enum><text>deferred action;</text></clause><clause id="H8F7E0AACB77246B3A47DE4FFDB21F6BA"><enum>(iv)</enum><text>a stay of removal;</text></clause><clause id="HFA3085284C4243D08E0ACB2A1FDEB836"><enum>(v)</enum><text>administrative closure; or </text></clause><clause id="H9673BC313F514937AF580363D4F03FB6"><enum>(vi)</enum><text>authorization to apply for any other form of relief; or</text></clause></subparagraph><subparagraph id="H1C0F21029FC84E41972A02706AB5EA5F"><enum>(B)</enum><text>to continue seeking the removal of such individual.</text></subparagraph></paragraph><paragraph id="HBE6D271067BE4E8EA18299B06A4CF195"><enum>(2)</enum><header>Submission of information</header><text>An individual who is the subject of a case review under paragraph (1) may submit information to the Advisory Committee, and the Advisory Committee shall consider such information.</text></paragraph><paragraph id="H2C174CD202D64C189BDBA31A1663006D"><enum>(3)</enum><header>Procedures</header><text display-inline="yes-display-inline">In conducting each case review under paragraph (1), the Advisory Committee shall consider, as factors weighing in favor of a recommendation under paragraph (1)(A)— </text><subparagraph id="H708D46D1070A4F79B7525356E6E4EB18"><enum>(A)</enum><text>with respect to a member of the Armed Forces, whether the individual—</text><clause id="H6DF3CD3C33AB4DA0909CD3A9F3EF7D8D" commented="no"><enum>(i)</enum><text>was an enlisted member or officer of the Armed Forces;</text></clause><clause id="HE58559BB26E94B7FBDC79F89D7053C15"><enum>(ii)</enum><text>received a medal or decoration, was deployed, or was otherwise evaluated for merit in service during his or her service in the Armed Forces;</text></clause><clause id="HF5AB3F2D6D4E47139419E89EB9D6366B"><enum>(iii)</enum><text>is a national of a country that prohibits repatriation of an individual after any service in the Armed Forces; or</text></clause><clause id="H05BEA66047664DC2968F9FFCC9CBA8D1"><enum>(iv)</enum><text>contributed to his or her local community during his or her service in the Armed Forces;</text></clause></subparagraph><subparagraph id="HBD03DAE757DD432D8E144085977CA2DF"><enum>(B)</enum><text>with respect to a veteran, whether the individual—</text><clause id="HF1192C8DFAC44B38A3A05F1C4E7CB635" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">was an enlisted member or officer of the Armed Forces;</text></clause><clause id="HF276C2063162418DBE4A20C626D9485C"><enum>(ii)</enum><text>completed a period of service in the Armed Forces and was discharged under conditions other than dishonorable;</text></clause><clause id="H28DCEC2C278F4EF0A55BC46D32E540EE"><enum>(iii)</enum><text display-inline="yes-display-inline">received a medal or decoration, was deployed, or was otherwise evaluated for merit in service during his or her service in the Armed Forces;</text></clause><clause id="H3647608A7D3D4D6D849B848C5709E5B9"><enum>(iv)</enum><text>is a national of a country that prohibits repatriation of an individual after any service in the Armed Forces of another country; or</text></clause><clause id="H6654B3FC8CEF44A6B60F051F61E6BFEC"><enum>(v)</enum><text>contributed to his or her local community during or after his or her service in the Armed Forces; and</text></clause></subparagraph><subparagraph id="HCEC79A833C174AA5B71A45DD89D85108"><enum>(C)</enum><text>with respect to a covered family member, whether the individual—</text><clause id="H9DBE8181CCA94513820A46983ECD95A8"><enum>(i)</enum><text>supported a member of the Armed Forces serving on active duty or a veteran, including through financial support, emotional support, or caregiving; or</text></clause><clause id="HC842CFB6683B40BEAE08380C72ADA365"><enum>(ii)</enum><text>contributed to his or her local community during or after the military service of the member or of the veteran.</text></clause></subparagraph></paragraph></subsection><subsection id="HD0A0450E34354F218B29926CB0A5E9BB"><enum>(d)</enum><header>Briefings on noncitizen veterans</header><text>The Under Secretary of Defense for Personnel and Readiness shall provide detailed briefings to the Advisory Committee regarding the service of a noncitizen veteran when that individual’s case is being considered by the Advisory Committee.</text></subsection><subsection id="H2A64FDFC2506459E8C7A8FC5B674EC89"><enum>(e)</enum><header>Briefings on actions in response to recommendations</header><text>Not less frequently than quarterly, the Secretary of Homeland Security shall provide detailed briefings to the Advisory Committee regarding actions taken in response to the recommendations of the Advisory Committee, including detailed explanations for any cases in which a recommendation of the Advisory Committee was not followed.</text></subsection><subsection id="H1E8C3DE9571843299977733A329ECF5E"><enum>(f)</enum><header>Transfer of case files</header><text display-inline="yes-display-inline">For any individual with respect to whom the Advisory Committee is conducting a case review under this section, the Secretary of Defense and the Secretary of Homeland Security shall provide to the Advisory Committee a copy of any available record pertaining to that individual, including such individual’s alien file, that is relevant to the case review.</text></subsection><subsection id="HB20C1237F37E426EB2AFB40C856739F0"><enum>(g)</enum><header>Limitation on removal</header><text>Notwithstanding any other provision of law, an individual described in subsection (a) may not be ordered removed until the Advisory Committee has provided a recommendation with respect to such individual to the Secretary of Homeland Security.</text></subsection></section><section id="HE683BD3299B94663878B7E2E0DF41861"><enum>5.</enum><header>Program of citizenship through military service</header><subsection id="HBBC28912346B459CBE123A2C68250B06"><enum>(a)</enum><header>In general</header><paragraph id="H995B83D5941547158C3A439F42EC356C"><enum>(1)</enum><header>Program established</header><text>The Secretary of Homeland Security, acting through the Director of U.S. Citizenship and Immigration Services, and in coordination with the Secretary of Defense, shall jointly implement a program to ensure that—</text><subparagraph id="H38536FA903C14F60B342FF63F096F46D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">each eligible noncitizen is afforded the opportunity to file an application for naturalization at any point on or after the first day of service on active duty or first day of service as a member of the Selected Reserve pursuant to section 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1440">8 U.S.C. 1440</external-xref>); and </text></subparagraph><subparagraph id="H68E99601382445B19DE28F62DFBC3CEF"><enum>(B)</enum><text display-inline="yes-display-inline">the duly authenticated certification (or any other successor form) required under section 329(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1140">8 U.S.C. 1140(b)(3)</external-xref>) is issued to each noncitizen not later than 30 days after the individual makes a request for such certification.</text></subparagraph></paragraph><paragraph id="H49E9B75D9EC2402CAFE105C787628855"><enum>(2)</enum><header>Eligible noncitizen</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible noncitizen</term> means a noncitizen who serves or has served in the Armed Forces during any period that the President by Executive order designates as a period during which the Armed Forces are or were engaged in military operations involving armed conflict with a hostile foreign force.</text></paragraph></subsection><subsection id="HCAAB7B1F992742F8B08C08F851D33EC1"><enum>(b)</enum><header>JAG training</header><text>The Secretary of Defense shall ensure that appropriate members of the Judge Advocate General Corps of each Armed Force receive training to function as liaisons with U.S. Citizenship and Immigration Services with respect to applications for citizenship of noncitizen members of the Armed Forces.</text></subsection><subsection id="H2F9B613C37D742E6A6E4B5C4C7E1002D"><enum>(c)</enum><header>Training for recruiters</header><text>The Secretary of Defense shall ensure that all recruiters in the Armed Forces receive training regarding—</text><paragraph id="H3B6ABAF2C16A4E9FA295C7F45267B5E5"><enum>(1)</enum><text>the steps required for a noncitizen member of the Armed Forces to receive citizenship;</text></paragraph><paragraph id="HD3D9295FFF8A4609B42E6821845B20B5"><enum>(2)</enum><text>limitations on the path to citizenship for family members of such individuals; and</text></paragraph><paragraph id="H60AFF69CFACB406C93088820C1881EB9"><enum>(3)</enum><text>points of contact at the Department of Homeland Security to resolve emergency immigration-related situations with respect to such individuals and their family members.</text></paragraph></subsection><subsection id="HF57468227DEB42CAA121A7A9B0B68AE9"><enum>(d)</enum><header>Annual reports</header><text display-inline="yes-display-inline">The Secretary of each military department shall annually submit a report to the appropriate congressional committees that identifies the number of all noncitizens who enlisted or were appointed in the military department concerned, all members of the Armed Forces in their department who naturalized, and all members of the Armed Forces in their department who were discharged or released without United States citizenship under the jurisdiction of such Secretary during the preceding year.</text></subsection><subsection id="H9B4D09153985428E9FFAD941DD91AEA8" commented="no"><enum>(e)</enum><header>Further facilitation naturalization for military personnel in contingency operations</header><text>Any person who has served honorably as a member of the Armed Forces of the United States in support of a contingency operation (as defined in section 101(a)(13) of title 10, United States Code), and who, if separated from the Armed Forces, was separated under honorable conditions, may be naturalized as provided in section 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1440">8 U.S.C. 1440</external-xref>) as though the person had served during a period designated by the President under such section.</text></subsection><subsection id="H5EE4416B1FA84C34BE2A6A517C2C73F5"><enum>(f)</enum><header>Naturalization through service in the Armed Forces of the United States</header><text>Section 328 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1439">8 U.S.C. 1439</external-xref>) is amended—</text><paragraph id="H19335D0493F14A239ED6126CAC515E04"><enum>(1)</enum><text>in subsection (a), by striking <quote>six months</quote> and inserting <quote>one year</quote>; and</text></paragraph><paragraph id="H5EB24DB27C7A4A3EB7EE462FDB488119"><enum>(2)</enum><text>in subsection (d), by striking <quote>six months</quote> and inserting <quote>one year</quote>.</text></paragraph></subsection></section><section id="HDE65A48B3F584251907F927A750F8814"><enum>6.</enum><header>Information for military recruits regarding naturalization through service in the Armed Forces</header><text display-inline="no-display-inline">The Secretary of Defense, in coordination with the Secretary of Homeland Security, shall ensure that there is stationed or employed at each Military Entrance Processing Station—</text><paragraph id="H0EDFDB88BBE045B98CF7B3A77C6D67B8"><enum>(1)</enum><text>an employee of U.S. Citizenship and Immigration Services; or</text></paragraph><paragraph id="HDF68E6933609402B9EB5B905C0ABCED9"><enum>(2)</enum><text>in the case that the Secretary determines that it is impracticable to station or employ a person described in paragraph (1) at a Military Entrance Processing Station, a member of the Armed Forces or an employee of the Department of Defense—</text><subparagraph id="H7C3A9643C6EC49CC982E0A762761E4F1"><enum>(A)</enum><text>whom the Secretary determines is trained in the immigration laws; and</text></subparagraph><subparagraph id="H4985FCE046534AC4A7EF2CEDD4B8296E"><enum>(B)</enum><text>who shall inform each military recruit who is not a citizen of the United States processed at such Military Entrance Processing Station regarding naturalization through service in the Armed Forces under sections 328 and 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1439">8 U.S.C. 1439–1440</external-xref>).</text></subparagraph></paragraph></section><section id="H364A8B6A2F0B431CB6816B975EE14992"><enum>7.</enum><header>Return of eligible veterans removed from the United States; adjustment of status</header><subsection id="H830ABBE59E0F4B7FB10DD63C0E915AB2"><enum>(a)</enum><header>Eligible veterans</header><text display-inline="yes-display-inline">Notwithstanding the issuance of a final order of removal against a noncitizen, the Secretary of Homeland Security may adjust such noncitizen’s status to that of an alien lawfully admitted for permanent residence, or admit such noncitizen for lawful permanent residence if the Secretary determines that such noncitizen—</text><paragraph id="id311CCDA52EDB433AA102BB999B0DC65E"><enum>(1)</enum><text display-inline="yes-display-inline">is a veteran; and</text></paragraph><paragraph id="idA3AAC828DE9B4A048BE33A0AE696D30F"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided in subsection (b), is not inadmissible. </text></paragraph></subsection><subsection id="HFD6EB7135621487C994D3E761854BBC0" display-inline="no-display-inline"><enum>(b)</enum><header>Waiver</header><paragraph id="H078E0961C6ED45918FAF28F1C857547D"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may waive any applicable ground of inadmissibility with respect to a noncitizen veteran described in subsection (a), under section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) (other than paragraph (3) of such section 212(a), or a finding of inadmissibility under paragraph (2)(A) based on a conviction of an aggravated felony described in subparagraph (A), (I), or (K) of section 101(a)(43) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(43)</external-xref>)) if the Secretary determines that such waiver is in the public interest. </text></paragraph><paragraph id="H77A862FC38CC4CE0A50BD417BDF9D08C"><enum>(2)</enum><header>Public interest considerations</header><text>In determining whether a waiver described in paragraph (1) is in the public interest, the Secretary of Homeland Security shall consider factors, such as—</text><subparagraph id="idAEB8C5EDCE3F47C09B175D6327433852"><enum>(A)</enum><text>the noncitizen’s service in the Armed Forces; and </text></subparagraph><subparagraph id="idF3AAD66212D24608A2E104CAFA6E4732"><enum>(B)</enum><text>the recency and severity of any offense or conduct that forms the basis of a finding of inadmissibility under section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HF9A6D25941604A569AE2E085E57F8B2B"><enum>(c)</enum><header>Procedures</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall promulgate regulations that establish procedures for carrying out this section. </text></subsection><subsection id="H9F7F3E87816C4F0FA3F198DB359AFEDC"><enum>(d)</enum><header>No numerical limitations</header><text>Individuals who are granted lawful permanent residence under this section shall not be subject to the numerical limitations under section 201, 202, or 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>, 1152, and 1153).</text></subsection><subsection id="H8492C95E54C842DDB297CFB561E945B4"><enum>(e)</enum><header>Clarification</header><text display-inline="yes-display-inline">If a noncitizen’s status is adjusted to that of an alien lawfully admitted for permanent residence, or if such noncitizen is lawfully admitted for permanent residence, such adjustment or admission shall create a presumption that the noncitizen has established good moral character under paragraphs (1) through (8) of section 101(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(f)</external-xref>).</text></subsection><subsection id="H701C26E523E64C808962F779F6C75537"><enum>(f)</enum><header>Limitation on removal</header><paragraph id="HB2ED23E0B8F447B9AC2B0143B002D8AA"><enum>(1)</enum><header>In general</header><text>A noncitizen who appears to be prima facie eligible for lawful permanent resident status under this section shall be given a reasonable opportunity to apply for such status. Such noncitizen may not be removed from the United States until a final administrative decision establishing ineligibility for such status is rendered. </text></paragraph><paragraph id="HA5EC1DDBD3B94B84B03FD0F3C651FCCE"><enum>(2)</enum><header>Effect of final order</header><subparagraph id="id994CBFB33D774E35BD936F95197DD194"><enum>(A)</enum><header>In general</header><text>A noncitizen present in the United States who has been ordered removed or has been permitted to depart voluntarily from the United States may, notwithstanding such order or permission to depart, apply for lawful permanent resident status under this section. Such noncitizen may not be required to file a separate motion to reopen, reconsider, or vacate the order of removal. </text></subparagraph><subparagraph id="idE0CB11A8A0DD4E808941C8AEFC3A5407"><enum>(B)</enum><header>Effect of approval</header><text>If the Secretary of Homeland Security approves an application filed pursuant to subparagraph (A)—</text><clause id="idDE1226C35EFD4107B1CD78772D97C79B"><enum>(i)</enum><text>the Secretary shall notify the Attorney General of such approval; and </text></clause><clause id="id0707C79FA7C34ED3B81D411ABDFC4C18"><enum>(ii)</enum><text>the Attorney General shall cancel the order of removal. </text></clause></subparagraph><subparagraph id="id1918F62A90E04B349C929BB808F8AB9B"><enum>(C)</enum><header>Effect of denial</header><text>If the Secretary of Homeland Security renders a final administrative decision to deny an application filed pursuant to subparagraph (A), the order of removal or permission to depart shall be effective and enforceable to the same extent as if the application had not been made, only after all available administrative and judicial remedies have been exhausted.</text></subparagraph></paragraph></subsection></section><section id="HE7513B69C5DC4F938281FA853FD47A9F" commented="no"><enum>8.</enum><header>Adjustment of status for certain immediate relatives of United States citizen service members or veterans</header><subsection id="HF0F6958938A64463B512EB7A29FF38E7" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of an application for adjustment of status pursuant to an approved petition for classification under section 204(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)</external-xref>), an alien described in subsection (b)—</text><paragraph id="HC25BA819E4894B0E8299AB8902BA649F" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">is be deemed to have been inspected and admitted into the United States; and</text></paragraph><paragraph id="HEFE67B2D5D7B442DAC4614C26699594B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be subject to paragraphs (6)(A), (6)(C), (7)(A), and (9) of section 212(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>).</text></paragraph></subsection><subsection id="H3B2B587AA8844F468B8401493A5A134A" commented="no"><enum>(b)</enum><header>Alien described</header><text display-inline="yes-display-inline">An alien described in this subsection is the beneficiary of an approved petition for classification under section 204(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)</external-xref>) as an immediate relative (as defined in section 201(b)(2)(A)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>)) of a citizen of the United States who—</text><paragraph id="H82AA80F9A17E4644BFAA8B7586D1B473" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">served, for a minimum of 2 years, on active duty in the Armed Forces or in a reserve component of the United States Armed Forces; and</text></paragraph><paragraph id="H6F484D30CA624961A3CC129A479219B5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">if discharged or released from service in the Armed Forces, was discharged or released under honorable conditions.</text></paragraph></subsection></section><section id="HE2AB59A110DD4B6DBA8822086FAC7F82"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H033B43B4066848CCBA0C33D1F8572070"><enum>(1)</enum><header>Advisory committee</header><text>The term <term>Advisory Committee</term> means the Military Family Immigration Advisory Committee established pursuant to section 4.</text></paragraph><paragraph id="H5049D508176C466B9337F3343F24F40C"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H71FC98EDE60D4DA6A7AEE9F5E213F254"><enum>(A)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></subparagraph><subparagraph id="H095B8EF7DF4246518F8CB820B8D2FF24"><enum>(B)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph id="H7C4A130EEC2147099F2DA89CF8DB09D2"><enum>(C)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph id="H271BEF818A954847AF8E22E64ACE2592"><enum>(D)</enum><text>the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph id="HB7EBD0369B234781961E1FF369851C79"><enum>(E)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="H33C4B2CBB6E24799B31A434DD810594D"><enum>(F)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="H4F5497158AC0441B94E6273D30964845"><enum>(G)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="H38BAD402E7A14611A30E844C56305A2A"><enum>(H)</enum><text>the <committee-name committee-id="">Committee on Veterans’ Affairs of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="H86AC55163E324C66973111528300A172"><enum>(3)</enum><header>Armed Forces</header><text>The term <term>Armed Forces</term> has the meaning given the term <term>armed forces</term> in section 101(4) of title 10, United States Code.</text></paragraph><paragraph id="HB63585B3764746A5AEEABF5B63796C03"><enum>(4)</enum><header>Covered family member</header><text>The term <term>covered family member</term> means the noncitizen spouse or noncitizen child of—</text><subparagraph id="H4D34EE64A8BF4657835102A81E9E02B1"><enum>(A)</enum><text>a member of the Armed Forces; or</text></subparagraph><subparagraph id="HED23D94BA7C94029A1C1906AB7C5844E"><enum>(B)</enum><text display-inline="yes-display-inline">a veteran.</text></subparagraph></paragraph><paragraph id="H4B73378294144044AC2354343BE184A2"><enum>(5)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given such term in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>).</text></paragraph><paragraph id="H6BC1E209B0B64DD18DEC1860973D7975"><enum>(6)</enum><header>Noncitizen</header><text>The term <term>noncitizen</term> means an individual who is not a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>)).</text></paragraph><paragraph id="H7EC14B49DC7141B3B5B3B51A66582C5C" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <term>veteran</term> has the meaning given such term in section 101(2) of title 38, United States Code. </text></paragraph></section></legis-body></bill>
