which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title IV of the Social Security Act to expand foster parent training and authorize new appropriations to support the obtainment of a driver’s license.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF42DB7EBCA4C40019984E1A72CBF1488"><section section-type="section-one" id="H193896E871EB41628720CC3C57671D69"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foster Youth and Driving Act</short-title></quote>.</text></section><section id="HE368FD3CFC97424FB9CA780E25107859"><enum>2.</enum><header>Foster parent training related to preparing a child to drive</header><text display-inline="no-display-inline">Section 471(a)(24) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(24)</external-xref>) is amended—</text><paragraph id="H3DAD392B2BBF4A2EA61EF65D51F86A9E"><enum>(1)</enum><text>by striking <quote>and knowledge and skills</quote> and inserting <quote>knowledge and skills</quote>; and</text></paragraph><paragraph id="HE53EE25EBCA0422799A7EE0297A2CA7A"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>and, when appropriate to the age or other circumstance of the child, knowledge and skills related to preparing the child to drive, including assuring opportunity for practice driving hours and assistance in obtaining a driver’s license and automotive insurance and in applying as needed for driving and transportation assistance as described in section 477(k)</quote>.</text></paragraph></section><section id="HF177BBA163814AFB861C5D24921F353F"><enum>3.</enum><header>Requirement to include a plan for driving preparation in case plan</header><text display-inline="no-display-inline">Section 475(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)</external-xref>) is amended—</text><paragraph id="HB3664C1442314F1892FE3C96194DCFEF"><enum>(1)</enum><text>in subparagraph (G)(ii), by moving the margin for subclause (II) 2 ems to the right; and</text></paragraph><paragraph id="H008AB033CDDF4A9CA67C279A63832654"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H366A5B9E676D4887B67288CA48AF1037"><subparagraph id="HF6C44FBF881849F09DAE3B0A5FE8AA8E"><enum>(H)</enum><text display-inline="yes-display-inline">A plan for assuring that the child, when appropriate to the age or other circumstance of the child, receives assistance, knowledge, and skills related to preparing to drive, including opportunity for practice driving hours and assistance in obtaining a driver’s license and automotive insurance and in applying as needed for driving and transportation assistance as described in section 477(k).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H180A2E9AB1754BEEBBAAB87FE6B597C6"><enum>4.</enum><header>Driving and transportation assistance program</header><subsection id="H69FE7A0B6F7A4602BA5E56CCF4FA2BF5"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">Section 477(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(a)</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" id="HFA3C290B185045F9BF1B895B33F7A961"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HBF9DA0363A87410E8F377B0DD5532E72"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H477111D15E244747B0B3C0E44C4F5003"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H264258C48E0F43649A7113A6A9A0A8FD"><paragraph id="H0F69D26DA07A4C1D8377A47EA0DFD533"><enum>(8)</enum><text display-inline="yes-display-inline">to provide driving and transportation assistance to children in foster care and certain former foster care recipients who have attained the appropriate age and circumstances to begin receiving such assistance.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H837CEF54E796461FAE00EFACC00CCCC2"><enum>(b)</enum><header>Driving and transportation assistance</header><text display-inline="yes-display-inline">Section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H686AF34592B042FEBC0E1F365D27C80C"><subsection id="HAA832AE496CA4CCE8C859326D9557BBC"><enum>(k)</enum><header>Funds for driving and transportation assistance</header><paragraph id="H50EF563564734EAEB65ED039C778DC02"><enum>(1)</enum><header>In general</header><text>The following conditions shall apply to a State driving and transportation assistance program under this section:</text><subparagraph id="H408E867D947446BBB6475750156886A2"><enum>(A)</enum><text display-inline="yes-display-inline">Assistance under the program shall be available to youth who have experienced foster care at age 14 or older, as described in subsection (a)(1).</text></subparagraph><subparagraph id="H656E51D4CDE8433485A75B6E1EF2DC52"><enum>(B)</enum><text>The State may allow youths participating in the assistance program on the date they attain 21 years of age to remain eligible until they attain 26 years of age, as long as the State is satisfied that they are working or enrolled in a postsecondary education or other employment training program and are making satisfactory progress toward completion of that program.</text></subparagraph><subparagraph id="H95ECD20AD5654669A6974A4AB9E6C3D9"><enum>(C)</enum><text>The assistance provided for an individual under this section—</text><clause id="HDC54E721AC174DFC97940FE383156C50"><enum>(i)</enum><text display-inline="yes-display-inline">may include vehicle insurance costs, driver’s education class and testing fees, practice lessons, practice hours, license fees, roadside assistance, deductible assistance, assistance in purchasing an automobile, and any other costs related to obtaining a driver’s license and driving legally in the State; and</text></clause><clause id="H1FCFA3F4EA8F40DA9DE61C3756663759"><enum>(ii)</enum><text>shall not exceed the lesser of $4,000 per year or the total cost of the items described in clause (i), excluding the cost of a vehicle purchased as part of the program.</text></clause></subparagraph><subparagraph id="HB5352DFDCB9B491082A003A64C00DEDD"><enum>(D)</enum><text display-inline="yes-display-inline">The State shall ensure that, in the case of a youth in foster care under the age of 18 participating in the assistance program, the youth’s foster parent (if any) may authorize another adult to provide any authorization required by the State to be provided by a parent or guardian in order for such a youth to obtain a driver’s license or permit or take driving lessons.</text></subparagraph><subparagraph id="H4B310542F94349CC85F12D65DCEF598A"><enum>(E)</enum><text>The State shall work to remove barriers to obtaining a driver’s license and appropriate insurance for youth under the age of 18, such as addressing liability and insurance laws to allow minor youth to more easily obtain a license.</text></subparagraph><subparagraph id="HFEA8B22D0E9D416CBE671C2DDDEAA4C7"><enum>(F)</enum><text>The amount of assistance under this section—</text><clause id="H2F0931B94B234BF89EE85CE077CF99D8"><enum>(i)</enum><text>shall not, for purposes of the Internal Revenue Code of 1986, be includible in the gross income of the individual with respect to whom such assistance is provided, and</text></clause><clause id="HE4CF694D7D38487198F8EA0F70057F29"><enum>(ii)</enum><text>shall be disregarded for purposes of determining such individual’s eligibility for, or the amount of, any other Federal or federally supported assistance, except that the State agency shall take appropriate steps to prevent duplication of benefits under this and other Federal or federally supported programs.</text></clause></subparagraph><subparagraph id="H98AAB44D9F234083A6FEC6C00B9EC41B"><enum>(G)</enum><text display-inline="yes-display-inline">The State shall coordinate the program with other appropriate programs, including those described under subsection (b)(3)(F), to support current and former youth in their transition to adulthood.</text></subparagraph><subparagraph id="HFBE02FD9CE374A4296D054C0E43C6BA3"><enum>(H)</enum><text display-inline="yes-display-inline">The State shall work to streamline processes for communicating program eligibility and shall conduct public awareness efforts to ensure that foster youth are aware of the assistance available under the program.</text></subparagraph><subparagraph id="H3525443B5CE0414881D78CE2D34465D3"><enum>(I)</enum><text display-inline="yes-display-inline">The State agrees to submit such annual data to the Secretary as the Secretary may require, including data specifying the number of individuals, of those in foster care or formerly in foster care who have attained from 15 to 26 years of age, who (as appropriate to the age and other circumstances of the individual)—</text><clause commented="no" display-inline="no-display-inline" id="H66AAD9720CB040A09891B9D5F751100F"><enum>(i)</enum><text>are eligible for a driver’s license;</text></clause><clause commented="no" id="H768AEF620D6642FBAB0C6410686E091F"><enum>(ii)</enum><text>have completed a driver’s education course;</text></clause><clause commented="no" id="HB9F0AA27854A49878A17DDFF8A3AC5EB"><enum>(iii)</enum><text>have completed driver’s training hours;</text></clause><clause commented="no" id="H5FBF6D38D4B44DA8A9F4544BE0370FCE"><enum>(iv)</enum><text>have obtained a learner’s permit;</text></clause><clause commented="no" id="HD228B7CAC8E74CE38C3BF8E781AD0E75"><enum>(v)</enum><text display-inline="yes-display-inline">have obtained a driver’s license;</text></clause><clause commented="no" id="H204D959C82C14C4EAC3095F166BBA70D"><enum>(vi)</enum><text>own a vehicle or otherwise have access to a vehicle to drive; and</text></clause><clause commented="no" id="H2A8611BE23144A3CAC1587D83DD27059"><enum>(vii)</enum><text>have automotive liability insurance.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HB40A4AF2291C48F0AA2C49E51208251C"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary shall annually submit a report to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate on the State driving and transportation assistance program under this subsection, and shall make such report publicly available. Such report shall include a compilation of the State data submitted to the Secretary under paragraph (1)(I).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBD55DE5A84E2469FA6255740F85A8622"><enum>(c)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 477(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(b)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD2E3715908464AB9824FDAA7B1AAF4CC"><subparagraph id="H3940F7D4590749BDBBAB63180B03D56F"><enum>(L)</enum><text display-inline="yes-display-inline">A certification by the chief executive officer of the State that the State driving and transportation assistance program under this section is in compliance with the conditions specified in subsection (k)(1), including a statement describing methods the State will use—</text><clause id="HB20946E9FF044AA3B3E72DE8F0FCF462"><enum>(i)</enum><text display-inline="yes-display-inline">to ensure that the total amount of driving and transportation assistance to a youth under this section and under other Federal and federally supported programs does not exceed the limitation specified in subsection (k)(1)(C)(ii); and</text></clause><clause id="H953DE70C7B184F6686D89D72899BD593"><enum>(ii)</enum><text>to avoid duplication of benefits under this and any other Federal or federally assisted benefit program.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H750755AF99124FE583502A23496C7C04"><enum>(d)</enum><header>Increased authorization of appropriations</header><text display-inline="yes-display-inline">Section 477(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(h)</external-xref>) is amended—</text><paragraph id="H8C6DF986DFB34FE8AB87BDFD3BBCB7E0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H8CA19C48773945BF9DE1CEA53C709638"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HBBEE0A7115064847A0CEBC688C9D4FFD"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC146937D2B274100B465C6A0B1EBDE47"><paragraph id="H76F2F3B77CCC4E9B9B24C20C4B34278C"><enum>(3)</enum><text display-inline="yes-display-inline">an additional $36,000,000, which are authorized to be available for payments to States for driving and transportation assistance in accordance with subsection (k)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF9EF33C52AD94B778E3AC2070C7F14C7"><enum>(e)</enum><header>Allotments to States</header><text display-inline="yes-display-inline">Section 477(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(c)</external-xref>) is amended—</text><paragraph id="H9BC80AA06D7A44D1AB31C7B20DD6DF9B"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="H90A4FC23C50949CDB241D59D26BDC120"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF3C9F3794807437AAD9769AC8B96C108"><paragraph id="HD83E964560F44DE4B7EA3F9EC9247671"><enum>(4)</enum><header>Driving and transportation assistance allotment</header><subparagraph id="HBBB77A258E8240A0A082053502150C53"><enum>(A)</enum><header>In general</header><text>From the amount, if any, appropriated pursuant to subsection (h)(3) for a fiscal year and remaining after the reservation described in subparagraph (B), the Secretary may allot to each State with an application approved under subsection (b) for the fiscal year an amount equal to the State foster care ratio multiplied by the amount so specified.</text></subparagraph><subparagraph commented="no" id="H625E3635BD1B450AAFCC780722411E6A"><enum>(B)</enum><header>Reservations for Indian tribes and tribal organizations</header><text display-inline="yes-display-inline">The Secretary shall reserve up to 3 percent of the amount appropriated each year pursuant to subsection (h)(3) for payments to Indian tribes and tribal organizations to be used in accordance with subsection (k).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFA33E350897847B3B93513F15FBDECDC"><enum>(f)</enum><header>Discretionary grants</header><text display-inline="yes-display-inline">Section 474 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674</external-xref>) is amended—</text><paragraph id="HA9486BF281CB43858D994E733E04658C"><enum>(1)</enum><text>in subsection (e)(1), by striking <quote>section 477(a)(6)</quote> and inserting <quote>section 477(a)(5)</quote>; </text></paragraph><paragraph id="HD8BBF28A1E7148B097EC433CC031BE46"><enum>(2)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph><paragraph id="H21D9E2E216044931B5B8212D690F3871"><enum>(3)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H18FF2D8B5A5A4E31A918C31075897A32"><subsection id="H04C35A5EE3B3452BA7530389FDDCBFE8"><enum>(f)</enum><header>Discretionary grants for driving and transportation assistance</header><text display-inline="yes-display-inline">From amounts appropriated pursuant to section 477(h)(3), the Secretary may make a grant to a State with a plan approved under this part, for a calendar quarter, in an amount equal to the lesser of—</text><paragraph id="HF153D1F8954646F3B5218243D75C5F49"><enum>(1)</enum><text>80 percent of the amounts expended by the State during the quarter to carry out programs for the purposes described in section 477(a)(8); or</text></paragraph><paragraph id="HD9ACFB9D0D0549D3B7F35AA82C9124FC"><enum>(2)</enum><text display-inline="yes-display-inline">the amount, if any, allotted to the State under section 477(c)(4)(A) for the fiscal year in which the quarter occurs, reduced by the total of the amounts payable to the State under this subsection for such purposes for all prior quarters in the fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA55AAFFBAC6B4E23AAA160208E7DEB84"><enum>(g)</enum><header>Payments to Indian tribal organizations</header><text display-inline="yes-display-inline">Section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>), as amended by subsection (b), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H165432CF85904FE08B6B12BCD78FC763"><subsection id="H2A1CF3F540724D82BB06116353A39B63"><enum>(l)</enum><header>Payments to Indian tribes and tribal organizations for driving and transportation assistance programs</header><paragraph id="H0B040D9557744378B577B3092827B825"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An Indian tribe or tribal organization (as such terms are defined for purposes of section 428(c)) which has a plan for child welfare services approved under subpart 1 of part B of this title and which operates a foster care program may apply for an allotment out of any amounts reserved for a fiscal year under subsection (c)(4)(B) to carry out programs for the purposes described in subsection (a)(8).</text></paragraph><paragraph commented="no" id="H7295C94DE75E49EB864B9581C22BB15A"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">An Indian tribe or tribal organization desiring an allotment under paragraph (1) of this subsection shall submit an application to the Secretary to directly receive such allotment that includes a plan which—</text><subparagraph commented="no" id="H06D56D4AC7BA4B319EB4E4D82320E259"><enum>(A)</enum><text display-inline="yes-display-inline">satisfies such requirements of subsections (b)(3) and (k) as the Secretary determines are appropriate in consultation with the tribe or tribal organization;</text></subparagraph><subparagraph commented="no" id="H7DB4EA9CC97E47BB828EDDC4C5919D11"><enum>(B)</enum><text display-inline="yes-display-inline">contains a description of the Indian tribe or tribal organization's consultation process regarding the programs to be carried out under the plan with each State in which the Indian tribe or tribal organization is located; and</text></subparagraph><subparagraph commented="no" id="H8A4C9152E3654903A350B5F720DAE8CB"><enum>(C)</enum><text>contains an explanation of the results of such consultation, particularly with respect to—</text><clause commented="no" id="HBECC8225D9C04C41BC73BE82E632F99D"><enum>(i)</enum><text display-inline="yes-display-inline">determining the eligibility for driving and transportation assistance benefits and services of Indian children to be served under the programs to be carried out under the plan; and</text></clause><clause commented="no" id="HE372410C960F481BA072F66E200404A1"><enum>(ii)</enum><text>the process for consulting with the State in order to ensure the continuity of such benefits and services for such children who will transition from receiving such benefits and services under programs carried out under a State plan under subsection (b)(2) to receiving such benefits and services under programs carried out under a plan under this subsection.</text></clause></subparagraph></paragraph><paragraph id="H09AF039DB97D4DDDBB9F5486938B2BD4"><enum>(3)</enum><header>Payments</header><text display-inline="yes-display-inline">The Secretary shall pay an Indian tribe or tribal organization with an application approved under this subsection from the allotment determined for the Indian tribe or tribal organization under paragraph (4) in the same manner as is provided in section 474(f) with respect to a State, or in such other manner as is determined appropriate by the Secretary, except that in no case shall an Indian tribe or tribal organization receive a lesser proportion of such funds than a State is authorized to receive under such section.</text></paragraph><paragraph id="H5B52F530FF4345B1806298E6E28678A0"><enum>(4)</enum><header>Allotment</header><text display-inline="yes-display-inline">From the total amount reserved for a fiscal year under subsection (c)(4)(B), the Secretary shall allot to the Indian tribes or tribal organizations with an application approved under this subsection for that fiscal year an amount based on each Indian tribe or tribal organization’s share of the total tribal child population among all such tribes and tribal organizations with an application so approved.</text></paragraph><paragraph id="HF91EB3C0780E41B8A0FCBEA6B60BA439"><enum>(5)</enum><header>Data and evaluation</header><text display-inline="yes-display-inline">The Secretary shall consult with tribes and tribal organizations to determine the tribally relevant data needed to understand how the driving and transportation assistance program helps tribal youth and if any policies would improve tribal youth access to drivers’ licenses and, to the extent practicable, the number and demographic data of tribal youth served. </text></paragraph><paragraph id="HE863398CDED54B7D8DF39A265BFC76B0"><enum>(6)</enum><header>Matching requirement</header><text display-inline="yes-display-inline">In determining the amounts expended by an Indian tribe or tribal organization for purposes of section 474(f)(1), the Secretary may take into account in-kind expenditures of the Indian tribe or tribal organization.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H53D38371DFB34C469F76D797D9845122"><enum>(h)</enum><header>Technical assistance</header><text>Section 477(g)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(g)(2)</external-xref>) is amended—</text><paragraph id="HCA2C19B5354E4439B9B90A49A1B5BDF9"><enum>(1)</enum><text>by striking <quote>the amount specified in subsection (h)</quote> and inserting <quote>each of the amounts specified in paragraphs (1) and (2) of subsection (h), and up to 5 percent of the amount specified in paragraph (3) of such subsection,</quote>; and</text></paragraph><paragraph id="H083DA989CC1746E69B7CA4076029CCC6"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="H48BB1848E9DA4A5C9AE07DC184754073"><text>With respect to such reservations of amounts specified in paragraph (3) of subsection (h), the Secretary—</text><subparagraph id="H4C47D181B7E14E2E8307735ED277F3F7"><enum>(A)</enum><text display-inline="yes-display-inline">shall consider a higher reservation of funds for initial fiscal years to the extent necessary to support States in establishing a new program in each State; and</text></subparagraph><subparagraph id="HE3ADE2D88A724E64A80E2002463CF57C"><enum>(B)</enum><text display-inline="yes-display-inline">shall not consider an entity an appropriate entity unless the entity has demonstrated the capacity to successfully administer a State-mandated program to provide driver’s licenses to youth under the age of 18 who are in State foster care and to increase the number of such foster youth who obtain a driver’s license.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
